In fact the whole idea for cooperation was hatched by the president s attorney at the time. Initially, mcgann had been very reluctant to cooperate with mueller. His job as he thought was to protect the presidency and cooperating with mueller may set president for a future white houses. But doubt in cobbs thought that access to white house personnel including mcgann would avoid subpoenas from mueller and bring us books which are conclusion to the special counsel investigation. Listen to what Rudy Giuliani said about that yesterday. They allowed 32 witnesses to testify and turned over 1. 4 million documents. And in fact, i would think john dowd would tell you with an agreement with bob mueller that it would be concluded quickly. If i had known the outcome, that mueller had not concluded quickly and it was amended attempt in good faith to try to work at the resolution, i might have chosen a different strategy and im pretty sure he would have. The other big issue with the white house, the revocation of security clearances. President trump this morning fairly daring the former cia director john brennan to sue him to try to get his security clearance back. Brennan had suggested yesterday that he might do that, the president tweeting, i hope john brennan, there were cia director in the countrys history brings a lawsuit. It will then be very easy to get all of his records, texts, documents and emails to show not only the poor job he did but how he was involved with the mueller rigged witch hunt. He wont sue. The judge that again today that the names of the jurors are going to remain under seal and you want to remind of the court that on friday, he rolled against a bunch of news outlets including the ap and the New York Times and cnn who filed a motion to intervene, seeking the names of the jurors and transcripts from bench conferences be released before a verdict comes down. Ellis said not only with that subject jurors to threats like hes received during the trial but he said jurors would be scared and afraid to serve on juries in highprofile cases like this if they knew going in at their i. Its not clear how much of this the jury is aware of though as a judge makes these rulings relating to their safety before or after they enter and that jury is not supposed to do any research or reading on the case outside of court. Are they reading into it . They are reading far too much into it. It was a complex case and there was plenty of evidence and a number of charges but most people in the jury are not tax encounters or lawyers and they are going through the indictment and trying to match of the evidence they heard. I think looking at facial expressions or frustration, its never fun to have just sit in there and you are locked in a room, but this is really not at all an inordinate amount of time for people to deliberate. Dana i want to ask you about that because the defense is encouraged that deliberations have gone on this long, that every day or hour that it goes on, its better for their client, Paul Manafort. Is that generally the case . My general experience is if you have a very quick verdict, that can be bad for the defendant. Im not sure the long delay is good for a defendant. There is a lot of evidence in this case, there is overwhelming proof that men manafort was moving money around. If he was sitting in his ostrich jacket bemoaning his finances, i think thats not common sense. You may have some jurors and their wrestling with the decision or with the particular accounts about what the proof was on a particular account and they may debate those now, but if you think about the fact that theyve been there about 18 hours, thats about an hour per account. You do that and you still have to have bathroom breaks and lunch and that type of thing. Its really not that long, i think his team may be putting a little too much emphasis on it. Sometimes lawyers do that. Dana ive heard that lawyers do that. Let me take another topic. Don began, the president S White House counsel had given, with the president s full permission, an opportunity to be interviewed by a mueller for about 30 hours total. Telling him things like, being able to describe the president s fury toward the russian investigation, and mcgann apparently said that trump attempted to fire mueller but he also cautioned that he never saw trump go beyond his legal authorities, which are murky. The wall street Journal Editorial Board wrote this. The bottom line is that readers should remain skeptical about what is reported about mr. Muellers probe and wait to see the evidence actually produces. But when you talked about don mcgann going in and the president did not try to assert any executive privilege, what did you think . You know the white House Counsel as counsel for the office of the president , and i wasnt surprised to see there would be some cooperation, nor was i surprised to see that mcgann would want to talk to them. He would want to be the one ring out to dry so he wanted to make sure the record was clear in that regard. Also, and i read it about the same time i did some information where the president had referred to john dean as a rat. I said before, rats jump off of a sinking ship, and that is you may have some people who were close to the president who are feeling the need to make sure they are not ultimately settled with some of the decisions and actions that have come from the administration. So that being the case, i think its normal for muellers Interview Team to go back a number of times and talk to a witness. I also thought it was interesting that the executive privilege itself was not waived. We seen that asserted at various points both in congressional hearings, but i thought it was interesting at that point the executive privilege was not waived. Almost hinting they may want to rethink that. Now Rudy Giuliani basically inherits the original teams approach to the case. Rudy giuliani has tried to make it look like it seamless and they are all on board and everything is fine, do you think that will hold . I think at this point, there was a little bit of it in a statement that giuliani made, i might have done something different. But if hes in a situation where things go south, he will blame the former lawyers. If things go well he will say, it went well because i continue down this path and it was my perseverance as his great lawye lawyer. I dont know that his legal strategy moving forward has been as effective as may be his p. R. Strategy has been as he has tried to sort of shift the discussion and the debate on whats going on. Dana it one last question, the president has been very vocal calling the Mueller Investigation a rigged witch hunt. Aside from a few of the stories that pop up, we dont actually hear from mueller, he hasnt spoken to the public in a year and a half. Theres all this public p. R. , doesnt have any effect on what mueller is doing . Absolutely not. Remember mueller is a soldier by profession, and he actually was asked to go to vietnam and try to wait out an injury. Hes following his policy. Prosecutors dont come out and are instructed under doj headlines to come out and talk about the investigation, and hes doing exactly what he ought to do. I think he feels absolutely no pressure from the noise thats being made, from the trump team. But by same token dana well maybe not on twitter. The danger for the trump team coming out talking about this stuff, about it being a witch hunt and Paul Manafort and all the stuff, it can impact jurors or it could be messages sent to other witnesses. I think thats the danger, we dont let the process take its natural course. It seems like its been a very long time but in reality if you judge it against other investigations, this has not been a long investigation at all and has actually returned some significant charges and confirm some of the initial thoughts about Intelligence Community is. What do you make of that, is this an issue where you think you have a chance of blocking the president s nominee . I think its possible, its hard to see how the conservatives are outspending the left by like 71 on this. So if it comes down to who can spend more, democrats are going to lose.
