Significant, because the entire uproar over omarosa is predicated on the existence of a tape where the president uses the nword. No one has produced such a tape or any hard evidence that a tape exist. Omarosa did provide this little bit of a teaser. Listen up. There are things that i read about, and things that i am going to save to share when the time is right. She did not go into any detail about that. Todays release on conversations that she had with President Trumps daughter in law lara trump, in the conversations that were recorded in december 2017, offering her a new job, moving her out of the white house to a job with the Trump Campaign offering her the opportunity to stay either in d. C. Or new york. And at a salary that is similar to what she makes at the white house. Omarosa claims that the significance of these conversations is that it proves her honesty. Everything that is in this book, everything that you see in quotations can be verified. Has been cooperated and is documented. And these clips are specifically the outline of the scene that i have unhinged. There is an alternative explanation for these conversations with layer trump, as you know in Corporate America it is very, very common for a company to promote somebody to promote them up and out as a way to remove the problem to allow both parties to save face. That is an alternative explanation. Dana has a president wrapped up his Cabinet Meeting mr. Mark anything about john brennan security clearance . None whatsoever that it was mentioned at all, only in the context of how it has removed any discussion in the Mainstream Media about the single greatest achievement of the Trump Administration to date, and larry kudlow elucidated that, here he is at the meeting this morning. The single biggest story this year is an economic boom that is durable and lasting and that most people thought was impossible. Brennan did respond to the revocation of a security clearance in a New York Times oped, he wrote mr. Trump has clearly become more desperate to protect himself and those close to them, thats why he may be politically motivated to revoke my security clearance in an attempt to scare into silence others who might dare to challenge him. The president remains that he was a key player in the construction of the collusion narrative. Back to you. Dana thank you for that, for more on this, joining me now is andy mccarthy, former u. S. Attorney deanne fox news contributor. Let me ask you about omarosa. I think that her book couldve entitled how to lose friends and alienate people. Is there a possibility that she could be charged because of the situation room at the white house . The main role is if she had a security clearance, that would be end. What if she violated a federal law, probably depends on whether National Security information somehow got out, which i doubt. There could be not in d. C. , but local law consequences of it. Theres all kinds of stuff about when one Party Consents whether the conversation is tortious or criminal, that can be an exemption from s feeling that leads me to the other question, they are staffers at the white house that are concerned that any conversation they may have had with omarosa was taped. Would any of them have standing to bring a civil suit against her . If you are the person that got taped, sure. Dana is there a statute of limitations . Yes, statue of limitations on anything. It was cybill stuff it is usually a shorter statute, so if there is a statute that they can sue on and they have standing to do it, sooner the better. Dana if you can stick around for a moment, we have a fox news alert, jury deliberations underway in the Paul Manafort trial, the chair when facing 18 counts were larded to tax and bank fraud. In the rush of meddling in the 2015 election. Peter doocy has been closely watching the trial for us, he is outside the courthouse. The jury is not deliberating in the jury room, why not . Because they thought that it was too tight in there. So they asked the judge if they could go and deliberate to the 18 counts in the break room paid he said okay. Thats where they are right now on the ninth floor. Something else that the judge really stressed was that they need to ignore two weeks of comments that were critical to the mueller team, that they complain twice said the judge might be misleading the jury, the judge once the jury focused on the evidence only. That is actually consistent with the mueller prosecutors reminder that rick gates, the star witness might not be so believable. But they ladies and judgment, the star witness is the documents. But they argue that the documents are not an airtight case, so they think the way the roles are weighed out, the jury has to vote to acquit. One of the defense attorney said this, it is not enough to think that somebody is possibly guilty, it does not overcome reasonable doubt, it not enough to think that somebody is probably guilty or likely guilty. In fact, it is not enough that they are highly guilty, highly unlikely to be guilty. They must be guilty beyond a reasonable doubt. We do not know how long the jury plans to deliberate, but they could go past the business that has been about 5 30 p. M. Local if they want to end as soon as they reach a verdict on these 18 counts, unanimous verdict, the verdict that we understand will be read in open court about ten or 15 minutes later. Dana we have not heard about a lot of emotion from Paul Manafort during this trial, but something made him laugh in court today. What was that . Once the jury left today, the judge from the bench started to kind of move on towards the next matter that he was going to be hearing today, and so he asked the court room that was packed with a lot of trial watchers, is mr. Trump here . And people gasped and craned their neck to look around to see who was mr. Trump, as it turns out, mr. Trump is a prosecutor who is here for something totally different. Dana i can imagine that that would break the tension a little bit. Thank you, peter. Lets bring back andy mccarthy, former u. S. Attorney. To that point, you wrote a piece about this. What is more important . The gates witness testimony or the documents in court . Objectively i think that the documents are more important. What people forget is that mueller indicted this case before he had dates as a witness. In fact, he was a codefendant of Paul Manafort, so it was a documents that drove him to plead guilty. Its not like he arrived and suddenly there was a case on Paul Manafort. The problem that i think that mueller has. It is perfectly strategically natural to say that the whole case revolves around gates, because he is a difficult witness but he has a lot of deception in his background. But the problem that they have on mueller side, they paid too much to get this plea. They really gave him kind of a slap on the wrist plea, so you have one day where they indict him for felonies that are over 100 years of exposure and then the next day they pleaded him out to two minor counts that capped the exposure at ten years and create a real possibility that he walks out the door. Hard for those prosecutors to look the jury in the eye and say, you do not need gates, the whole case is the documents when they paid a very dear price to get him. Dana let me ask you another question on another topic, that was separate from the investigation when it comes to President Trump and the question of campaign collusion. Listen to Rudy Giuliani talking about the possibility of a subpoena. Do we have that . We do not have it. Do you want me to read it for you . Even if a respondent in ten days to a subpoena, it would have to be decided by District Court judge, and then you argue it be for the supreme court. I thought that that was sound from him. But you know this question of whether a president can be subpoenaed. Not actually settled law. But there is a lot of legal opinions on it, what is yours . There is a preliminary question, this is no longer can star under the independent stature, these are special counsel regulations. Under them, Robert Mueller is in the Justice Department chain of command, a superior officer, if the chief executive decides that he does not want to be subpoenaed, i do not know how the inferior executive officer justifies issuing a subpoena. But even if he can get past that hurdle, i think that the problem that he has is to get a sit down with the president , you should have to show that there is a serious crime that he is implicated in. If you cannot get the information that you need to make your case from any other source. And i think at this point he needs to show that. Particularly if he wants to issue it. Dana a legal scholar, professor of law at the university of berkeley, he said that he does believe the president as a chief law enforcer should sit down and that he is not above the law, do you agree . Showed is different then has to. Ira prefer to see the president go in and give mueller what he wants and have the investigation over. At the same time, you know, he has potential criminal liability, unless they spelled out what it is, it is unfair to expect to be on the president has the right to refuse. Yes, of course played dana andy mccarthy, thank you for being a part of the show. New york governor takes a shot at President Trump saying that america was never that great. Aretha franklin passing away at 76, from pancreatic cancer. For decades of hits like respect think chain of fools. Performing at three president ial inaugurations and was awarded the medal of freedom by george w. Bush in 2005, she will be very missed. This is not normal times, so these decisions are being made for whatever reason. I just think that it will be sad if it goes down to politics. Dana President Trumps decision to revoke the security clearance of john brennan, sparking reaction on both sides of the aisle, karl rove, former chief of staff for george w. Bush. Let me read to you from John Brennans office today in the New York Times and have you react. He said that mr. Trump has become more desperate to protect himself and those close to them which is why he made the politically decision to revoke my security clearance and to silence other those who might dare to challenge him. I wonder if there was any National Security violation that was lending to this. But using his position of knowledge from the Previous Administration of his time to do a wink and a nod at the things that he might know that other people dont and that he was profiting off of. I think the answer to the first question is no, and the second question, maybe. That i think that more than trading on the sense that he had inside knowledge as to what was going on, he was trading on his position of authority having served for a long time in the Intelligence Community both under president obama and previous president s. And some of the comments were over the top. Remember after the helsinki summit or the helsinki meeting, he declared that President Trump behavior was treasonous, over the top. And to look, you and i both kno know, security clearances of top members of the Intelligence Community allowed to keep them for a certain period of time. They can renew them if they request. But they are allowed to keep them initially so that their successors can call upon them for advice and counsel and know that they still have their clearance to receive that kind of information. Obviously nobody in the Trump Administration was calling on mr. Brennan, but having said that, im not sure that this is a good use of the president s time. You saw at the beginning of your program that larry kudlow talking about the biggest story of this year which was the economic recovery and 82 days after the election we are talking about how the president affectionately revokes the security clearance of john brennan for saying ugly things and he replies with an oped in the New York Times, not a constructive day for advancing the agenda. Dana it was interesting, you might think he said he does not need to say anything more about it, he had a Cabinet Meeting and a chance to talk to the press. He did not say anything about it. He might be moving on already. I didnt want to bring up this, andrew said that america was never that great. Trying to backtrack. He is a 2020 hopeful. His republican opponent Mike Molinaro said this. As a kid who grew up on food stamps with a single hardworking mom, dont tell me america is not a great country. That kid with patches and his wranglers was the youngest mayor in america, and republican governor of the state of new york today. That did not happen because i was special, im not, it was because my mom taught me to believe in myself and in america. I wanted to get your take on 20 20 hopefuls who are going out and trying to rile up a basic test test and see, but apologizing backtrack when their story becomes national. Look, a lot of them and the stories become national, and they are not watching it back. That was the point in my column today in the wall street journal. Ive been watching this for a number of weeks, a number of months. It struck me in the past few weeks how overthetop some of these 2020 democratic hopefuls are and how they do not feel the need to walk it back. Elizabeth warren, our criminal Justice System is racist from back to front. Cory booker, justice has become normal, Camilla Harris of california, the economy only works to the people at the top, not for the people at the bottom. Well, what is interesting to me is that this was an open combination of the criminal justice which was provided over for eight years by eric holder and loretta lynch. So how the democrats and they are falling back on the pattern that they were in the 1980s when Jeanne Kirkpatrick excoriated them as the blame America First crowd. She was talking about Foreign Affairs then. But it is wholly possible to say that the democrats are turning into a blame America First crowd when it comes to the domestic policies of our country. Dana let me ask you one other thing, could it be that the left wing of the party, the progressive part of the party is basically saying that the establishment democrats that have been there for a long time, that they did not do the job and that they need to be cleared out, that we need to have a leftwing proposal for america if we hope to win and whatever they want to do with the country, supposedly they want to make the country great. That is the logical conclusion, because look, are all the difficulties that are in the country and that we face today the responsibility of the guy who has been in office for 18, 19 months . Or are they may be things that were not attended to during Barack Obamas administration . The interesting thing to me is not only are the democrats being so negative and so down and finding so much to blame america, but they are they cannot find a way to set these as aspirational, we can do better. We work for the day when all americans will do x and y. And instead they have to spend most of their time, if not all of the time just excoriating our country and its current situation. Dana we will see if anybody is listening on the left ear advice. Karl rove, thank you. I hope they dont between now and november. After that i hope they do. Dana the u. S. Dana officials in new haven, connecticut, saying that 76 people have overdosed in 24 hours from a suspected bad batch of synthetic marijuana, trying to determine what sicken the victims. People began falling ill wednesday morning, on the New Haven Green at city park near yale university. No deaths have been reported, police have arrested a man who they say may have passed out free samples of synthetic marijuana. The Trump Administration is pushing closer to a new trade deal with mexico as they renegotiate nafta. The top u. S. Trade official saying that he sees a breakthrough in days. Ants reporting for the Fox Business Network and washington. Edwards. Well, dana, yes, starting the renegotiation one year ago today. Am right now we are very close to a deal with the mexican allegation. The canadians, we are not talking to them at the moment. This is the assessment that the u. S. Trade representative gave the president at the Cabinet Meeting. In terms of nafta, right now literally as we sit here, and i am hopeful that in the next several days we will have a breakthrough. Still some difficult issues to work out as there always are at the end. And the economy administrator says that we will see about a deal by the end of the week adding that there are a few hurdles to overcome. Everybody has shortcomings, and the rights. For the second time this week, jared kushner, white house advisor showed up for these talks. How are they going . They are doing well. My sources are saying that the white house wants to finish this deal with the mexican delegation first and then presented to the canadians to see if they would like to sign on or not. And the group economists, ortiz, saying that he believes that this deal needs to be redone. He was involved in the negotiations on the first of nafta and the 90s, but he says that the new one needs to not have a sunset clause. The sunset clause says that you do not know after five years nafta will be enforced. If you are an investor in the Department Sector or infrastructure, then you have a lot of capital and longterm return. If you cannot plan for more than five years, chances are you will not make that investment. Now the sunset clause is the sticking point. The rules of origin also, the u. S. Would like to see 75 of the car in north america till fall under nafta, the mexican saying that if they can reach that goal, after five years. We are very close. Today now. Dana all right, edward, thank you. Dana fox news alert, secretary of state mike pompeo at the state department right now as he announces the creation of what is being called the iran action group, following the administration reimposing sanctions after withdrawing from the nuclear deal. Live from the state department. Good afternoon, dana, Officials Say that this is a way for the state department to coordinate its efforts to try to respond to iran, tried to pressure iran, leading the group will be brian hook. He is the director of policy planning here. And he is the one who is negotiating with the european allies to try to keep the United States in the Iran Nuclear Deal. That effort failed, and then he took over this new effort to try to convince countries and companies against doing business with iran. They have called at the roadshow. And Officials Say that they have met with about 20 Different Countries to try to convince them to cut off their business ties. The u. S. Started reimposing sanctions against them earlier this month on august 6. That effort will increase in november with Banking Sector sanctions, but there is a major problem with the u. S. Policy, that european allies are telling their businesses not to listen to these american sanctions. Telling their country to continue doing business, and trying to hold the Iran Nuclear Deal together paid a lot of challenges here in this new u. S. Effort to essentially take those sanctions that were lifted as part of the Iran Nuclear Deal and apply them again and pressure iran since u. S. Allies are not pledging to do that. Spin on the situation in turkey is deteriorating, can you give us an update . It is with the administration with the United States, the secretary or telegraphing a warning turkey that it needs to release andrew bronson, who turkey has detained for the past couple of years and if not, there will be more consequences. We put sanctions on several of the cabinet members, working with you. And we have more that we are planning to do if they do not release him quickly. The Trump Administration earlier this month distinction two top turkish officials because of his detention. The administration has also announced that it is going to double tariffs on aluminum and steel of imports in the United States. Turkey has responded with tariffs on american goods, the president of turkey has told his people not to buy American Electronics like iphones, so this continues to go back and forth. We have asked the state department whether there are any discussions planned with top officials. They say, no. And also the discussions that the u. S. Was having with turkey earlier this week, Officials Say that there was no Real Progress there. Dana if their citizens are not able to actually bring any money home because of their deteriorating economic situation, they will not be able to buy iphones anyway. Thank you. Lets bring in general jack keane, retired fourstar general, at the institute of war and a fox news senior strategic analyst. This is unusual tension between nato allies, what do you make of it . Probably the serious grievances we have had in sometime between two allies, and what is really happening, certainly it is said to nato and the United States has some real concerns about what he has been doing. Moving closer to the orbit of russia, aligning himself with russia and iran in terms of activities in syria. That is number one. The second thing is he is going to buy the 400, the most advanced Missile System in the world, but not compatible with other activities, that has never, ever happened before. He is also able to let the russians build four Nuclear Power plants. Another frustration that nato has is despite his protestations is that he kept the border clos close. And the truth is that he kept the border open, the isis group largely foreign fighters, all coming through syria. And provided aid and money. A strategic event that blew up in his face, thought that isis and al qaeda, would help take down the regime. They moved east, not west. And what they have with nato, when the two occurred in 2016, dana, not a single nato nation including the United States came out and provided any moral support for him. Dana do you think that we should have done that . No, absolutely not. The authoritarian, he got the most authoritative regime in nato, moving away from the western values, keeping the International Border together. But nobody is even thinking about giving turkey the boot good turkey sits in the most strategic piece of property that exists. They are at the confluence of europe and the middle east, not too far away. They are significantly strategically placed. And we want to work these issues out with him diplomatically as best we can. We have to look beyond the leader in terms of how valuable turkey years. They also have the second Largest Military beyond the United States. And that is also very significant. Dana we will have you back to talk to us more about that, to see if he wants to take the off ramp as an option to him so that he can get back to some normalcy with the relations between our countries. Can i ask you about one other thing . President trump is reportedly going to soften some rules on the deployment of cyber weapons. Requiring an inner Agency Response on any decision launching a cyber attack. That according to the wall street journal. The change was a step forward to the military operations and to prevent a foreign election interference paid a lot of complaints about the obama era guidelines was that they were too weak or that it would and strength the americans from being able to move fast if we need to. In cyber warfare, do you think this is a good move . It absolutely is, the 2012 director that president obama initiated actually began, it was wellintentioned, but it became overly cautious, very bureaucratic. And here is what the issue is. We have somebody hacking us, and Cyber Command picks set up, they are part of the National Security agency, and they monitor it, there are shooters. And they have the authorities, the president grants them certain authorities to take out those who are shooting at us who are undermining our elections. In other words, hackers using Computer Systems to do that. They can take those guys down. And do it at a network speed, obviously. What is complicated about it and why they are so overly cautious is this, what happens if one about other intel agencies is already in the Computer System and they are monitoring it because they are an intel agency and trying to figure out who they are working for. What are the strings to the government as an example . That is a complication to be sure. We can resolve that through coordination and make the coordination quickly and still be able to take advantage of our offense of capability. The United States, dana, has the best offense of cyber capability in the world. We do not use it nearly as much as we should. Dana can i ask you one other one, i did want to ask you about afghanistan. There was a lot of hope in june when there was the ceasefire and looks like there was a possibility that we might be able to get something done. It would help everybody and maybe even our troops resolve all of the issues and be able to come home. But these recent attacks have killed scores of local police, local officers in afghanistan, did we just take a couple of steps backward . Well, the taliban has really initiative, freedom of movement. They can attack at will, they took down a military base in northern afghanistan on monday. They have been attacking a District Capital in ghazni about five days ago. And it has taken four days to rethink that. They just blew up an Intelligent Center in the city of kabul and killed 48 people. They are demonstrating how they can conduct complex attacks at will throughout afghanistan. What does this mean for us . What we are trying to do, the president made a good decision. That decision was no arbitrary withdrawal, we are going to stay the course. And then also putting some Additional Resources in there to help the National Security forces do better than what they were doing. What is really behind that strategy and my judgment is, that strategy will not defeat the taliban. But what the strategy, i think what we are trying to convince is that they cannot win. And being that they cannot win. Lets go to the negotiation table and work some political settlement out. I think that that is what is at play. What the taliban are doing is absolutely if they are going to go to the negotiating table, they want a very strong hand. They are demonstrating that strong hand this last week. Dana general jack keane, thank you for being here. Good talking to you, dana. Verdict watch, i am Shepard Smith on the fox news deck, a life look at alexandria, virginia, where jurors are in their fifth hour of deliberating in the trial of President Trumps former Campaign Chairman Paul Manafort, facing hundreds of years behind. We will talk to an attorney about the outcome could mean for the special counsels russia investigation. Verdict watch continues. I am Shepard Smith reporting. Dana fallout continues over a pennsylvania injury, reports that said naming 300 catholic priests abusing children or helping cover it up. The heat on donald wuerl who is the archbishop of washington and who headed the pittsburgh diocese. Many for falling on him to step down paid my next guest tweeting that he presided over my mass today, gave a statement at the beginning about the story we have heard. It was hand waving and diversionary, shameful. Im joined now by tim kearney, the commentary editor at the washington examiner, somebody everybody should follow on twitter as well. He went to mass yesterday, tell us what happened. I actually did not think that he would be presiding. It normally would be the archbishop, yesterday was a holy day of obligation for the assumption of mary. And the new mass in the past when ive gone to those, it has been the archbishop, but i thought that the day after his name appeared in this grand jury report that he was sort of take the day off, and instead he gave this little statement before hand. What was absent from the statement was any expression of apology. Any expression that what he has done after cardinal mccarrick, his predecessor has come out to be involved with roping seminarians, basically in activity, and that his name for either neglecting or at worst covering up for abusers in the pittsburgh archdiocese, you would think that he would do something to act as if he was somehow trying to keep his flock safe, but he did not look like that sort of person. He just basically said, well, we need to pray for the victims. Of course we need to pray for the victims, but you are not allowed to say that. You are diverting away from the fact of what you did, or what you did not do. Dana mark rossi, state representative in pennsylvania, he was abused as a child. He is now an elected official. He said that for people who say that we should have reported this sooner, we did not know what the law was as a child to read how did you expect us to know what the law was as we were being raped or abused, he is asking for the end of statue of limitations. Do you have any thoughts on that . One of my main problems with the way that the church has handled this is that men who committed crimes were treated as if they were simply men with some possible psychological issues. And so they did not end up going to jail. There were bishops who knew what the priest had done and maybe reach out to the victims, certainly reached out to the priests, and then got psychological evaluations of the men, put them back out into other parishes. So yes, there should be criminal punishment for men who did this, especially, heres the thing, especially there are predators, abusers in all walks of life. Why do we talk about the church so much . Because it is worse. Because the trust that we put in these people in these priests is so profound that theyre abusive it is worse. So certainly these are the last men who should be protected by some statute of limitations. Dana let me read you what was said a National View yesterday, i thought that it was quite impactful. He said, if we treated the Catholic Church the same way as the British Public treated the grooming gangs, we would ask questions about the abuse on the scale. We would ask questions about what twisted form of Political Correctness from identifying until now. I think thats what youre talking about.
