In the oval Office Yesterday with the dutch Prime Minister the president said the Selection Process is moving ahead quickly. He has got to get it done quickly because he has that announcement coming up on monday. And that he is going to meet with three or four more candidates before making a decision. Listen to what the president said. They are outstanding people. They are really incredible people in some different ways, academically and every other way. And he have a very interesting morning. Other judges we are told are on the short list and could meet with the president here at the white house joan larsen again from the circuit circuit of appeals seems to be a very popular circuit for Picking Supreme Court nominees and Thomas Hardiman from the Third Circuit of appeals. At least the court of appeals and their record is quote lighter. Kavanaugh has the heavier record because he has been on the d. C. Court for quite a while. Some conservative groups give him marks because of obama ruling he made recent years. He would seem to be, dana, the strongest horse. Im told if you are looking for a justice in the model of neil gorsuch, kavanaugh would be your judge. Dana thats interesting there was another decision that could be coming out of the white house any moment now maybe as we speak about reversing the obama era rule regarding college admissions. Do you have anything on that . Correct. This is part of a broader revision of obamacareera guidance documents that the department of justice has been undertaking. And they will rescinding a number of them this afternoon. This particular guidance encouraged the consideration of race in college admissions. The Obama Administration issuing the guidance to promote diversity on college campuses. But the rescission comes as the department of justice is investigating a complaint Harvard University from a group of Asian American students who say they were being held to a more rigorous admissions process than were some other students. Devin omalley a spokesman with the doj and statement to fox news saying quote the executive branch cannot circumvent congress or the courts by creating guidance that goes beyond the law and in some instances stays on the books for decades, the Justice Department remains committed to enforcing the law and protecting all americans from all forms of illegal raced based discrimination. Roe v. Wade decided 45 years ago is a well established precedent. The opposition has loaded up everything on the idea that roe would be overturned it doesnt matter to them whether its Brett Kavanaugh or raymon colette kethledge. David souter said they would overturn roe v. Wade. Those were the coauthors of planned parenthood v. Casey which affirmed roe v. Wade. Dana that was in 1992. The quinnipiac poll that came out yesterday asked do you agree or disagree with roe v. Wade . The public in this poll 63 agree with it and would not want to see it overturned. Do you think because its been in place for 45 years that maybe the justices would not want to overturn it . I doubt that there sal Juvenile Court on this court to lirttlely overturn roe v. Wade. Talking about the core right to abortion. That doesnt mean the public is in favor of unlimited abortion as some democrats and liberals want. Nor would they be opposed to some states refining that right within those states the core right established by roe in 175, i think, is intact and safe. Because Justice Roberts really reveers starry decaiaphas the strength of precedence. This is a strength this precedence has lived with for a long time. That main thing there the court right of roe i dont think is in danger the liberals are going to oppose any of those nominees based on that idea. Dana they said they would vote to overturn it as well. Maybe there will be changes especially in the states as you are saying as there have been. Judges finding goals that they want to achieve and then finding reasoning behind it gorsuch is very much apposed to this sort of thing. This new nominee, no matter who it is going to end the liberals ability to File Lawsuits and get judicial results in the courts. Super important and can make a big difference to businesses, individuals, freedom, liberty, all across the board. They are not in the legislative branch. They are not in the Judicial Branch but they do the jobs of all three. I will give you an example. The food and Drug Administration will write its own rules. It will enforce its own rules and interpret its own rules. When it does that, and the person against whom those rules have been written and forced and interpreted challenges it, what should judges do . Should they look at the two as an equal in the food and Drug Administration and the company that wants to register a Prescription Drug or should they defer to the food and Drug Administration because it has expertise in the matter . Dana thats right. That deference is known as chevron deference. Famous cases voluming chevron. Dana chevron the company. When it defers it gives them a leg up allows them to do the job that judges are supposed to do which is interpret the law. Judge neil gorsuch is a champion against the deference. I suggest nearly everyone on the list of 25 is also against it why should the average person care about it . Because some day the average person might be caught up on this. Dana thats right. Are they in a equal situation or a leg up. Dana justice general paul stevens says judges are not experts in the field and not a part of the branch of either government thats why he defers. I will tell you the progressives, the people who should we should be governed by experts not by congress, not by people like the rest of us are, they love chevron deference. They love getting this extra level of protection to administrative agencies. Those that believe your private property is yours or when you go into court your adversary has the same stopping as you they are against chevron deference. It will devolve to the states. If you abolish roe v. Wade, abortion is not unlawful. There will be 50 different abortion laws because we have 50 different states. Dana i imagine the proabortion rights groups. Prochoice groups say thats not good enough. Women who live in a state like mississippi might restrict would not be the same as everywhere. That is their argument. Counter advocacy groups get those women where they can have abortions. Im not going to advertise this because im prolife. Come to new jersey, abortion is lawful up to the moment of birth and the state will pay for it if you cant afford it even if they dont live. Dana pay for a person to come. Yes, yes. Have you wacky progressive laws out there that will allay the anxieties of those who think that judge, fill in the blank, whoever the president is going to nominate is going to invalidate abortion. Of the democrats and 60 , im surprised at this number, 60 to 67 , depending on which poll you look at of the american voting public believes abortion should be lawful in some form. The other thing i would point out is if there is not a big gender gap of women who approve of some abortions and men. Its actually pretty much the same. The offices include the one here in el paso. Detroit, los angeles, newark, and philadelphia. Now, that judges ruling has said that the federal government violating its own rules when this comes to the treatment of people seeking asylum. And ordered ice to stop what the suit called arbitrary detention of legitimate asylum seekers. Yeah. I think people are definitely aware of what is going on and its one of those things, actually tharks think is rare that is actually uniting people instead of dividing people. Most people that i talk to, no matter what their Party Affiliation they want a strong and secure country. But they understand that strength and compassion is not mutually exclusive terms. That we have a humanitarian crisis on our hands. That we have a reputation to protect and moral high ground on the world stage. Its definitely something that i think is going to be a complex issue that we need to work on. Dana now that your profile has been raised to a national level. Democrats throughout a few suggesting abolishing ice would be a good next step. Is that something you would agree with . Um, i dont agree that abolishing an agency is the answer when that agency is, you know, trying to implement policies and procedures that were handed down lastminute without resources and without guidance. I liken it to the problems that we have in the v. A. I dont want to see the v. A. Abolished but there is definitely a lot of things inside the system that are broken that are crippling the good men and women working in the v. A. That deliver the services that our veterans deserve. I feel the same way about ice. I think we need to be talking more about policies and it doesnt matter which department is handling those policies, you know, we need to make sure that were enabling the good people who are working in these organizations to act in a way that they can sleep at night. Dana you are a veteran yourself. Curious, did the Democratic Party come to you wanting you to run, thinking that you had potential or did you raise your hand and say its time for me to try this out . I had a mutual friend who is not a party operative or anybody who said that they were made aware of my bioand they asked me a few questions about what i thought about the direction of the country and suggested that i run and honestly i didnt even really consider it until i was holding my i have a young kid i have two young kids and the youngest was crying and i was telling him in the middle of the night i was going to protect him and take care of him. I mean, i think they are doing that not just because of the strength of my candidacy because of the vulnerability of the incumbent. He hasnt held a town hall in five years. Definitely when you talk to the people in my district theyre not talking about the one liner talking points. They are talking about issues of putting food on the table and goedel education and healthcare. Absent representation. One the reasons that the video resonated with people across the country and in my district is because that is something a lot of people can relate to that absent representation. Their voice is not being heard because they are not a donor. Dana i know when you are out there, of course, the economy in most places is very, very good. I know there might be pockets that are not. Overall the democrats are running against a party that can boast that it has helped the economy get to where it is today. What are you hearing out there . What is your message about why your representation would be better from an economic standpoint . Yeah, one of those pockets that things are not going as well is my district. We definitely have higher unemployment than the National Average and the texas average. And its definitely not something that i think people understand that Economic Issues are complex and that they a lot of things that policies put in place take sometimes years to have an impact. And i think that they understand that there are problems with trade wars. There is problems with, you know, how we treat our allies on an international, you know, stage and there is problems with making agreements and then backing out of them. I think that people in my district just want a representative who will hear them and will ho will look out for their interests instead of their own resumes. Dana im running out of time but a quick question. Are you surprised at the response to that ad . I was surprised at how many people in my district recognized me. I can be out, you know, standing in line buying breakfast tacos for my team or Something Like that, im having to be cognizant of not going out in my pajamas and having to make sure that im on a little bit more. They survived Drinking Water that was dripping off the sides of the cave. But they had no food. Rescue workers brought them liquid food. How are they going to get them out . The next step is trying to get them out. Its a very tricky procedure. The latest word we are getting is being considered is to put a special breathing gear on them. Special diving gear and to bring them out in sort of a diveout process. So its got to happen in the next couple days. The alternatives are quite lengthy and arduous.
