The white house has been reviewing it. And its quite likely that the president will transmit the letter back to the house chairman select committee and its chairman either late today or tomorrow morning. Im hearing tomorrow morning is probably the most likely scenario. Then its up to the Intelligence Committee what they want to do with it. The white house is under taking a rigorous review. The Principle Deputy press secretary outlined some of that process earlier today on fox. Lets listen. The president s been taking and the white house has taken input from a variety of stake holders, Law Enforcement and intelligence agencies. I dont want to get too deep into the process, but some of those have been conveyed privately and the feed back has been conveyed privately. Some have been conveyed publicly. We hear them. We understand them. Ultimately, this is the president s decision. He has a Constitutional Authority to declassify information, and hes gonna take that very seriously. Take the input in, but then ultimately make his own decision. Reporter you heard him talking about stake holders. Some of the stake holders are the fbi. Tuesday afternoon, before the president left for the state of the union address, five career officials from the fbi, including officials from Counter Intelligence, came to the white house to read the version of the memo that was transmitted by congressman devin nunes to the president. This is a little different than the memo that those same people and the fbi director Christopher Wray had read up on capitol hill. Mare chan nunes made some minor technical changes to that document. Im told nothing substantive changed. Im told there were a couple words that were deleted at the request of the fbi. As to adam schiffs complaint that nunes made material changes to that document before transmitting it to the white house, im told again those were minor technical changes and that the Committee Chairman has it in its authority to make minor technical changes to a document without the committee revoting on it. So, it would appear that what nunes did did not contradict any orders or rules in the house there, dana. Dana john, has the fbi changed its opinion about the release of the memo . Yesterday the agency said it had grave concerns. Has that changed . Reporter not that we have heard. Although, i was told that the fbi official, the five of them who came over to the white house, took a look at the minor technical changes that were made in the memo and, according to white house sources, didnt have any particular problem with it. But then the very next morning the fbi released a statement that said, quote, as expressed during our initial review this would have been the one up on capitol hill we have grave concerns about material omission of fact that fundamentally impact the memos accuracy. I spoke with an intelligence source who said, we dont understand why theyre complaining about omissions of fact when they are the ones who asked for these technical changes. So people here are a little puzzled, dana, as to what the fbis game is. Dana maybe we will all find out when it all comes out. Thank you, john roberts. Many lawmakers have already seen this memo. My next guest is only one of a handful of memos of congress who have also seen the first document and fisa application. Joining me now is texas congressman John Radcliffe. You understand all of these issues because you used to work in prosecuting these types of cases. One of the things we have heard calls for is not just the release of the nunes memo, but the democrats have a memo and then theres a question about the originating document. Having worked at the white house, i have never seen anything like this, where we would release all of the stuff in the open, but would you be up for releasing it all and letting the public decide . Absolutely not, dana. There are two different memos, the republican memo, a democratic memo. I can tell you i think if Christopher Wray was asked if one of them had to be released, it would be the republican memo. I have viewed both of them, as well as the source document. Classified information, we have to be very careful with it. Some of the comments john roberts was making, i share the directors concerns. We have to be very careful with this. He is concerned, as am i, that at the end of the day we dont destroy important vital Critical National security Law Enforcement and Counter Intelligence tools in the process of examining and identifying potential abuses. Dana earlier this week speaker ryan was on the floor explaining his position on this, and there have been reports that the white house has tried to push back on, but reports that the president believes the memo will help him in the public perception. That maybe there is bias against him when it comes to the Mueller Investigation. Speaker paul ryan is trying to make it clear that these two things are separate. Listen. There are legitimate questions about whether an American Civil Liberties were violated by the fisa process. We are the legislative branch of government. It is our job to conduct oversight on behalf of the American People of the executive branch. This is a completely separate matter from bob muellers investigation. His investigation should be allowed to take its course. Dana so your job is not the messaging, but i want you to help me understand. How are people to separate these two issues when its obviously being inflated in every story that you read. It is being inflated. Thats one of the concerns the director of the fbi has moving forward. People lumping all these things together. Put it in perspective, dana, last week, or the week before, i voted to review section 702 of fisa. Knowing what i know now, having the concerns that i have and have expressed, id vote for it again. Id vote to renew fisa as a law generally and will continue to do that because it is important. People are conflating these issues. It is going to be important that we understand what were talking about, in the event that the president does declassify the memo in the morning, that folks talking about this are careful that theyre talking about something that they really understand. Dana youre here to help us understand it. So what you all voted on last week was the reauthorization of the program that allows the government to seek a warrant if theres a suspected terrorist overseas talking to somebody here in the United States. The concern, as i understand it, as laid out in the nunes memo, doesnt have to do with that title of the fisa law. It has to do with title i of the fisa law. What is the key difference there . Well, under fisa, there is warrantless surveillance of foreign adversaries overseas. Theres also a process to acquire a warrant here in the United States for surveillance. Thats a process that includes going before an fisa court, just as you would any other court and making representations to a judge about the ability and the verification for having a warrant. Dana and thats where i understand this memo gets released, maybe thats when people will be able to understand. I do want to ask you one more thing. That is congressman trey gowdy is a good friend of yours. He has decided to retire from congress. I am sure you are sad to see him go. I am sad to see him go. Im happy for him. Look, i should probably apologize to all my colleagues out there. I have spent a good bit of time trying to talk him out of that decision. But in my defense, not many people win arguments against trey gowdy. Dana thats true. He will be retiring at the end of this year. Although that seat probably will remain in republican hands. I mean, since the civil war, this is just incredible to believe, in Midterm Election since the civil war, only three president s have gained seats at one point. Fdr, bill clinton and george w. Bush. In almost literally, every other midterm, you lose seats. Sometimes you lose big. Popularity has no relationship. President tru president eisenhower lost control of the house. Richard nixon, one of the most loathed president s by the Washington Press corps only lost about five seats. Why . Because he was presiding over a Strong Economy in 1970. Dana so does that mean if this current economy continues to go well for President Trump, that he could turn conventional wisdom on its head . Well, they got to hold the house by not losing more than 24 seats. I think if they hold a number below that, obviously they do. One more example. 1998, bill clinton, a wash in scandal, awash in scandal, he gained five seats in the house. Why . Because we were in the middle of an economic boom in the middle of the 1990s. Unemployment was down to 4. 5 . So pretty clearly, President Trump and the republicans coming off the first of the tax cut, had something to build on. Dana the battle is joined between pelosi and President Trump. Take a look at what happened today. Last night the president delivered a speech of unwarranted selfcongratulatory comments. Beautiful to acknowledge the courage, sacrifice of the people in the audience, as if he had something to do with the successes that they had achieved. We were waiting for february. Then we got hit with these corporations giving tremendous bonuses to everybody that nancy pelosi called crumbs. That was a bad that could be like deplorable. Does that make sense . Deplorable and crumbs . Those two words seem to have a resemblance. I hope it has the same meaning. She called it crumbs when people are getting 2,000 and 3,000 and 1,000. Thats not crumbs. Thats a lot of money. Dana dan, do the democrats need to have a plan b . Plan a was to try to convince americans and voters that President Trump had not fulfilled his promise of making America Great again and that they would be better able to do what those voters wanted. But now, with these economic headlines, what are they to do . Come up with a plan b. Nancy pelos isnt providing it. During the tax cut, they said it would be tax cuts for the wealthy. Even now theyre saying the tax bill is benefitting the wealthy. Obviously, it isnt. President trump is right about that. And nancy pelosi has been under pressure from inside her own caucus. There are democrats from working class districts in places like ohio. Tim ryan. Who want to come up with a message thats more related to the concerns of those people. And those are the kinds of people who are benefitting from these bonuses that are being handed out, from cuts in their payroll taxes. Dana investments in their 401k or perhaps the education fund. But if you talk to democrats about their top recruits, it is not people from the far left. They are looking for the centrist, moderate democratic voters that they used to be able to count on. Thats not the message youre getting at the National Level from nancy pelosi or chuck shumer. Theyre still in bed with the progressives. I think the republicans have a chance here, but they cannot rest on merely the tax cut. I think they have to go on offense now. Find a way to pass the twoyear budget resolution. Try to pass the immigration bill. Even if it means bringing some democrats over to help them. But go into some offensive momentum heading into the rest of the year and toward that november election. Dana the other thing they can try to do is make the tax cuts permanent. That would be another thing to say. Dont change. That Corporate Tax cut is permanent. You were in a background briefing today by the administration. What did you learn . Thank you, dana. Two Senior Administration officials were describing the way assad has continued to use chemical weapons in the after math of that american air strike last april. What these officials describe to us was a situation in which the assad regime has moved away from barrel bombs or clumsy weapons dropped from helicopters and towards using chemical weapons on shells and with mortars. Really interesting part though, they were talking about what they describe as a shift from sarin gas towards chlorine. That suggests the assad regime isnt just using hidden stock piles. They may be reconstituting a production program. Dana i assume they didnt indicate any action we might be taking. Well, they talked a lot about what they describe as a full court diplomatic press to get the International Community and especially russia to crack down on the assad regime. Convince the regime to make a political decision not to use chemical weapons. They did, as every administration does, reserve the right to use military force, if needed. They said this is a full court press by the administration because the International Community, to convince assad to stop doing this. Reporter based on the questions that every other republican has been getting, yes, it does seem like when they hold this press conference, thats set to start any minute here in West Virginia, that there will be a lot of questions about that. But its going to be interesting to see them together. They are not often together answering questions. And the reason is because this next big piece of legislation, immigration, there are major differences between what republicans in the senate want and republicans in the house want. It is entirely possible that the senate could work with democrats on a bill, it could get 70 votes there and then they kick to it the house and it doesnt pass. Dana youre right. Its good to stick around for this press conference. Youre right, you dont see themming to very often. Getting them on the same page would be very good. Here now we are going to hear from Senate Majority leader Mitch Mcconnell and speaker of the house paul ryan. Lets listen. Good afternoon, everybody. How you doing . First, i want to again express that our hearts and prayers are with the victims of yesterdays tragic accident. You know, for those of us who were there, we just were very grateful for the first responder. Especially our doctors, our doctor caucus and husbands and wives of our members who ran out and took care of the injured. It was very impressive to see people drop what they were doing to go tend to those in need. Over the last 24 hours right here in West Virginia, weve had very productive discussions about our agenda in 2018. Everything from infrastructure to National Security. We finished the year strong with tax reform. In just weeks, it has become a Great Success across the country. U. P. S. Just announced a big investment in our economy. Lowes Just Announced bonuses for its employees. To date, more than 4. 1 million workers received bonuses totalling more than 2. 5 billion. And today, being the first day of february, when workers are going to start seeing more money in their pay checks based on these new with holding tables. Take home pay is going up, wages are going up, benefits are going up. Businesses are expanding. Consumer confidence is at a 17year high while unemployment is at a 17year low. Tax reform is working. One of the reasons we are here in West Virginia is because we want to build on this success in 2017 and 2018. We want to make sure that secretary mattis, who we heard from this morning, has the tools and resources he needs to rebuild the military. We need to close the skills gap in this country and help people move from welfare to work so they can tap their true potential. Weve made great progress, but theres more to do. That is why we are excited about having the president here today to work on this shared agenda. I want to thank him, the Vice President and all the members of their administration, who have joined us here in West Virginia to talk about this agenda. I think speakers done an excellent job of outlining all the good things that are coming about as a result of the comprehensive tax reform bill that we passed in december. Having been here awhile, im in a good position to compare 2017 with other years. And if you prefer a right of center america, as virtually every republican does, it was never a better year than 2017 in the time i have been here, which would cover three decades. Starting with the supreme court, now 13 circuit judges, but the 12 we did last year were the most in the first year of any Administration Since the circuit courts were established in 1891. We used the Congressional Review Act 15 times to try to deal with the regulatory rampage that occurred during the obama years. It had only been used once in history. And finally, as the speaker outlined, the incredible success of this tax reform legislation. You mentioned u. P. S. , which happens to be the single biggest employer in kentucky. The employees all across the country are benefitting from what we did last fall. It is the reason for optimism, for growth, opportunity to get our country growing again. Think of it this way. Taking your foot off the brake and putting it on the accelerator and giving american the opportunity to reach its potential. Does anyone have any questions . Thank you, speaker. What do you think about the fbi memo and it posing grave danger. Let me tell you what this memo is and what this memo is not. What this memo is, is congress doing its job in conducting legitimate oversight over a very unique law, fisa. And if mistakes were made and if individuals did something wrong, then it is our job, as the legislative branch of government torque conduct oversight over the executive branch if abuses were made. Remember, fisa is a unique situation which involves American Civil Liberties. And if american civil libb eeri were abused then that needs to come to light so that doesnt happen again. What this is not is an indictment on our justice system. This is not an indictment of fbi, of the department of justice. It does not impugn the Mueller Investigation or the Deputy Attorney general. What it is is the congress legitimate function of oversight to make sure that the fisa process is being used correctly and that if it wasnt being used correctly, that needs to come to light and people need to be held accountable so we do not have problems again. Because this does affect our Civil Liberties. Schumer as well as nancy pelosi have called on you to remove chairman nunes. Whats your response . I think theyre playing politics and looking for a political distraction. Look, the tax cuts are working. Tax reform is working. Weve got isis on the run. Things are going well. Economic confidence, as i said, is at a 17year high. They would love nothing more than to play politics and change the subject. Devin nunes helped with the Foreign Surveillance law. Hes focusing on keeping our country safe, focused on National Security. What theyre trying to do is just side track us for some political gain. Okay. [ inaudible question ] weve been talking about the cr. First of all, the reason were having these crs in the first place is because democrats have been holding the cap agreement hostage, the military funding hostage for an unrelated issue. If we would have had our cap agreement in place by now, we would not be having to do these crs. Having said that, i think were making progress on a cap agreement. Even if we get everything figured out by, say, tuesday, we still will have to have a cr, if only for the fact that we had to give the appropriators time to write an appropriations bill. There will have to be a cr just to get the appropriators Committee Time to get the bill. We are still debating on that. Do you want to jump in there . I might just add one tool that has clearly been eliminated, i dont think well see a Government Shutdown again over this subject. One of my favorite old kentucky country sayings is, theres no education in the second kick of a mule. And so i think there will be a new level of seriousness here in trying to resolve these issues the speaker outlined as we go forward. Youre planning on creating an immigration bill soon. Can you tell us when that will be . No. What i said, what i said friday, last friday, friday a week ago tomorrow was if the immigration issue is not resolved inside the global discussions that the speakers been talking about, that we have going on, which the democrats have been trying to shoe horn the immigration issue into that collection of discussions. If those are not resolved, i am perfectly happy, provided the government is still open on february 8th, to go to the subject and to hand to treat it in a fair way, not try to tilt the Playing Field in anybodys direction and well see who can get to 60 votes. There were reports about the memo. It was before it was voted on. The question was the memo. Its important that we scrub these memos for any sources and methods that could reveal National Security or compromise National Security. That scrubbing has taken place. In consultation with the fbi, they made a change to register those concerns and then they voted on releasing the memo to the white house. So the process is exactly what it should have been. Scrubbed to make sure that there are no sources and methods being revealed. When a matter was brought to the attention of the committee, they addressed that matter and then they went through the committee process. Republicans are traditionally the party of law and order. We have an fbi director saying please dont release this memo. It was incomplete. Doesnt that give you pause . No. What concerns me is we are violating American Civil Liberties. This fisa is a very unique law. The fisa law. Theres been confusion about different titles of this law. This law allows the government to go to a secret court to get a wire tap on a citizen. So this is incredible power that the people of this country, through congress, has given our executive branch of government. We have to make sure this power is being exercised properly and judiciously. And if there are instances or individuals who have abused that power, it is our job in congress to shed light on that bring transparency an accountability to the process. Let me just say, the vast, vast, vast majority of the men and women of the fbi are doing a great job. These institutions, the department of justice, the fbi, very important institutions for the rule of law. But its also very important that we guard peoples Civil Liberties as we exercise these institutions. Like i said to you on tuesday, the men and women in the milwaukee office, at the field office at the fbi, they are ones helping keep opioids out of our schools. Theyre doing a fantastic job. But we sraul to make sure if there are individuals who did the wrong thing, who either brought bias or cut corners or did something wrong that implicates an American Civil Liberties, it is our job to bring people to account so this doesnt happen again. This is for senator mcconnell. Have you seen the memo . And secondly, do you agree with senator thume that the senate Intelligence Committee should see the memo before it is released publicly . No, i havent. I dont have any suggestions to make to the speaker. I think hes handling this just right. Do you believe this memo has something that will have no impact on [ inaudible ] people should not draw lines. People should not implicate they are. Im suggesting people should not be drawing lines or implicating independent issues. This does not implicate the Mueller Investigation. This is about us holding the system accountable and reviewing whether or not fisa abuses occurred. The government has been given extraordinary power over citizens Civil Liberties. It is our job to make sure the process is followed properly. And if its not followed properly, then we need accountability. I say haul it out, so long as were not involving sources. So long as were not involving source and methods that protect our National Security, the more transparency the better. So the people of this country can see that their Civil Liberties are being protected. Thats why we think sunshine, transparency and accountability is the correct anecdote for this. But hasnt it been the republicans for the last two weeks who have been hash tagging release the memo and that they have hyped to it the point of being side tracked . Yeah, thats true. So in the Opening Statement you heard from mcconnell and ryan, lots of talk about the tax bill and with good cause. Its working very well. And the economy. Not a single question about those issues. Maybe one question on immigration. Everything else on the memo. It is tough for republicans to play victim here because theyve been pounding the drum on release the memo and now it looks like the memos going to be released. I think at this point you have to release it. Theres probably some information in there that is concerning, based on what weve heard. But to speaker ryans point, he said the most transparency possible is the best course of action. Thats why i think the republican memo and the democratic memo and as much of the under lying intelligence as possible should be released altogether. Well see if we get that. I think one way or the other we probably will. Either its done through official clan tphels or some of it is going to leak. Dana congressman John Radcliffe was on earlier, leslie. Hes an expert in fisa. He spent the majority of the day looking at all of these documents in a secure facility. He said that he was not for releasing the under lying document, so there must be something of concern there. But i do think speaker ryan would not have authorized this to go forward if he was concerned. One thing i think is impossible for me to try to understand is, this has gone on, while at the same time the Mueller Investigation is heating up and yet the republicans continue to try to say that the nunes memo has nothing to do with the Mueller Investigation. Have they been successful in trying to separate those two . Absolutely not. When they say the democrats want to distraction or that this is political, that they themselves are doing this. I mean, look. The president said to advisers that he wants it released. He would gain by this perhaps. It could help discredit the investigation. Could also help him to get rid of senior officials within the doj or fbi without question. Traditionally weve seen over the last 24 hours that adam schiff said there were changes made by nunes himself. The fbi said, please, do not release this because there have been omission and changes that they do not agree with. If youre going to have this information released, which i believe it should, it has to be released in its entirely. It cannot be edited. There cannot be omissions or changes. Dana i imagine that will be out there. The fbi Agent Association has just released a statement saying that it is supportive of the fbi director, but while that press conference was going on, a report that there are concerns at the white house that fbi director wray may be considering resigning over all of this. What do you think would happen if that were the case . That would look bad. That would add to more chaos. I would point out that this accusation from adam schiff about the alteration of the memo, what nunes and the republicans are saying, those alterations were made at the behest of the Justice Department and fbi and of schiff and the democrats themselves. Look, i am not somebody who doesnt believe that the republicans have a political motive here. Of course they have a motive, an agenda. We shouldnt pretend that the democrats dont either. Adam schiff and his crew have been leaking like an sieve. Theyre also playing politics. Dana democrats have often pointed to the fbi as overreaching. If there is a problem that theyve uncovered in that title i part of fisa, and if somebody was unfairly targeted and there is a concern there, do you think the democrats would be willing to say, thats not good . Oh, absolutely. I think they should. But you cant if you dont have all the information or if you have information changed. And i have to say, for a guy thats not supposed to have anything to do with any kind of link to a russian investigation, depending how you connect the dots that could be here, nunes himself is questionable.
