>> they just started playing the audio tape of conrad murray with lawyers present and the prosecution put him in for an interview and that is where the story unravels and we her the tape during a lunch break but that is the case that the jury will go home fresh in their mind after hearing the tape. >>shepard: our panel will weigh in open the new evidence and what dr. murray told the investigators in the days after michael jackson died in "studio b" in a you few minutes. new job numbers and they ease some fears of a possible down dip recession. for today. they were not go enough to make a dent in the unemployment rate with employers adding more than 100,000 new jobs in september, almost twice the amount some predicted. the government a month ago reported zero new jobs when there was a gain of 57,000, not enough to drive down the unemployment rate overall which is at 9.1 percent. so, there are still, there still is a great deal of pressure on the president and congress to create more jobs. now, wendell, the white house is using the latest numbers to push the jobs bill. >>reporter: the chief of the economics council said this could be an insurance policy against the impact of europe's economic crisis having on the united states. republicans, hour, have embraced some of the tax cuts in the jobs at but not the spending portions of the bill that the white house says would create jobs faster. >> what we have not seen yet from the republicans is our jobs proposals that are proposals that have an immediate impact on economic growth and jobs. the idea that deregulation is the answer to our economic woes is unfounded. >>reporter: he said it is not the private sector that has been shedded jobs but the public sector: teachers, police officers, firefighters, being laid off as state and local budgets are pinched. this is money to help in the american jobs act but the republicans say propping up-state and local government with federal aid is not the right way to deal with that. >>shepard: what dot republicans say? >> no. i first mentioned in 2006, a patient friend who was a security guard with him asked that i see him as a request. he wanted to see a doctor. >>shepard: he said that he first treated michael jackson for a "flu illness" and the prosecution claimed anything meg was given a lethal dose of propofol while the doctor was working on the many women in his life and he said that anything meg killed himself by taking the drug without medical help. to hear from the observers it sounds like the expression having a pretty good day of things? >>arthur: that tape of the doctor is crucial. they will weigh the credibility that you can assume that the doctor will not take the stand and as close as they will get to hearing him testify. the other thing going on in the courtroom, they have expert after expert after expert talk about drugs and how they interact, and on and on and on. boring. when you read the blogs, they say it is painstaking cross-examination and the jury on friday afternoon ... what matters is what he said and the pictures of the drugs, and how he behaved. >> the defense does not have to take apart the prosecution's evidence. what the 20 these do is point out where the evidence is lacking. because one thing that they does she for sure is that doctor murray was negligent. in order to prove he was criminally negative egypt, in order to prove involuntary manslaughter they have to show that he was not properly monitoring the situation but he caused the situation to occur and the only way the prosecution can do that is to demonstrate the drugs which the doctor administered to michael jackson were the drugs that, in fact, killed michael jackson. the prosecution, up to this point, has not been able to show that because of the fact that jackson himself may have administered the deadly dose. >>arthur: is it enough if the doctor provided the drugs? okay, so --. >>shepard: i don't think it is. art at i'm not sure the a fine line. steve is giving the accurate standard of the law. but, therefore, without the drugs, jackson could not have accessst he only --. >>shepard: the doctor prescribed the bottle of xanax and i take them all i will drop dead but that does not mean this is anything wrong with the drugs or the doctor and i did it myself. >>arthur: with xanax i agree but propofol stuff? that is not xanax. you have a needle and a thing and --. >>shepard: that is stupid. can you do better. >> what about personal responsibility? you cannot blame a doctor --. >>shepard: he is paying the doctor $150,000 a month. >> to stop him from taking drugs? >>guest: obviously we are not headed for victory, but we are headed, i think, as suggesting, for a stronger army that can take the fight from us the well not win this war, and our watch will decline in the next three years and 2014 is the year of transition. but, we are, i think, curtailing and containing the insurgency and train the afghanistan army. the model is colombia in south america, a country that obviously has had a lost violence and still has an insurgency but the government has gradually able to whittle away at it, over the years, with only limited outside help. and i think that is the model we can aspire to for afghanistan in two or three more years from now. >>shepard: they more literate, only 5 percent of the people can read and write in afghanistan, and as corrupt as colombia may have been, it cannot hold a candle to the corruption in afghanistan from everything i read and understand. >>guest: those are great points but let me town the tide the other say. you walked about civilian violence and fatalities. afghanistan is safer than colombia today. colombia had the 30,000 murder as year, 30,000 civilian deaths a year from violence. afghanistan has in the last year, under 3,000 civilian deaths from violence by estimates. it is worse and you are right, the trends have been in the wrong direction, but, over all, this is not a place that has been ransacked and torn apart by violence the way colombia was or the way iraq was, for that matter. so, there are things to hold on to, but, you are right there is in guarantee it can reach the legal of colombia. >>shepard: they raped their own land to the point where they could not grow the corners that used to sustain the economy on some level, from everything i understand, from the military and reading, is that 95 percent of all the poppies that supplies heroin to the world comes from there and that is their only cash crop. so, that is a problem, isn't it? >>guest: yes, another reason why colombia nature for is appropriate because of the drug problem. one thing that richard holbrook was effective in accomplishing to get us to have the right strategy on counter narcotics. originally the government and nato, we wanted to eradicate with spraying but you drive people into the hands of the insurgency because they have no other way to make a living so you need to get the roads working, get them safer, help people with crops and fertilizer and in the narrow river valleys in afghanistan, you can grow a lot of wheat, you can grow different kinds of orchards and there are alternates but you cannot do that until you have reliable access to markets so you protect the roads and the communities and then you do the crop substitution. we have godden that under better control the last one or two years. >>shepard: is it your sense that originally, we had a lot of high hopes and a lot of targets and now it is just to hand it over from our army to their army. is there a sense their army has the leadership and the cohesiveness or cohesion to continue this once we are out? if we get out? >>guest: you are asking the right questions. and i wish it was a simple "yes," but mostly yes. time tell. they have good leaders. a challenge, though, is a lot of the leaders are primarily from the northeast of the country, and they are a minority. they are not from the part of the country where the insurgency is strongest and there are ethnic tensions. as president karzai is supposed to step down in three years from the presidency that happens in 2014 the question is, what kind of tribal animosities will arise? or over simplifying. >>chris: i would lake to say it is unfair but the counter argument would be that the president tried to compromise with republicans. it did not go anywhere on the debt deem. raising the debt ceiling in august. so, he decided to take a very hard stand and further to the left. maybe it is a negotiating position. you know, in a better position to try to work out a compromise but maybe it is, as the people you talked to and that with be the majority opinion in washington and in the policemen class, that the president said i cannot make a deal with these guys and i will start my campaign and i will put the heat on them and say they want to protect rich folks and i am looking out for the middle class. >>shepard: every opinion poll, whether republicans, independents, they all say the people are for raising taxes especially the millionaire people, they are for it and the president seems to be saying if you do not do something you will lose in the ballot box because you are not doing what the people want. >>chris: well, that is right. look, if you have a choice we have a debt problem, solve it by taxing someone else and not me. that is what most people will say, sure, i like that idea. the problem is, he is at an all time low not approval ratings and he got his clock cleaned and so did democrats in the november 2010 elections so there is little reason to think that political dynamic has changed. he can try, he tried that argument in the fall of 2010 and it did not work well. the president is going to get blamed fairly or not for the economy and the economy sinks. >>shepard: every time. the massachusetts senate race is heating up, one for the seat ted kennedy held before he died. the democrat elizabeth warren taking a dig at republican rival scott brown over his 1982 photo spread where he was spend telling a question about how she paid for college when she said "i kept my clothes on." what?
