From colorado heres bret baier. There was a famous saying in the 1800s, go west, young man. Millions took that advice hoping to find opportunity in the vast openness the west represented. A place they could build their lives in a way they saw fit and live the arican dream which is why we came out to colorado where many of those travelers ended up. Were here at the Capitol Building in denver. For a while the American Dream may be something that each citizen must discover in the 21st century. What the government does can have quite an effect on how easy or how hard it is to reach that dream. And with a close as can be senate race between democratic incumbent mark udal and challenger corey many are focused on an election that could strongly affect their future. American dream to me is have the opportunity and promise if you things, you succeed and go. As a child robert gray, now 58, had the classic wish that millions of American Kids had before him. It was my dream to be a cowboy. And thats exactly what he became. Of course it helped that he was raised on his familys ranch. Today, hes the Owner Operator of bray ranches, 60,000 acres in r redvale, colorado. Ranch life is hard work, but he gets plenty of help from wife melissa and their four kids, darren, zandon, lance and shadon. He worries about whether hell be able to pass on the life he loves to his kids and to their kids. Its everything to pass it on to the next generation. Thats why were still doing what were doing. One thing robert never dreamed of when he wanted to be a cowboy, how much time hed spend wrangling with Government Agencies on the phone. I spend all my time in the office dealing with the bureau of nonmanagement, the National Forest service, the state land board. Reporter bray says his biggest obstacle is environmental regulation. He used to raise sheep along with his cattle but lost his sheep permits due, he says, to government policies. I havent touched on the wilderness designation issues. Thats huge for us. Thats one of the reasons were out of the sheep business. And bray worries that his senator, democrat mark udahl is more attuned to the concerns of environmentalists than those of ranchers. He has sponsored significant environmental legislation. And among his top donors are environmental activist groups. He comes from boulder, colorado. Its an environmental community. Those are his constituents. And he kind of follows that line. And now the epa wants to add more rules to regulate ditches and streams making it even more costly to run a ranch. So the brays sent son zandon and his wife, sarah, to washington, d. C. , in the hope of getting udal to see their side. Its not the first time theyve had to go. Our goal here is just to get our story out to the senators. And just have a chance to talk with them. Yeah. Reporter the next morning they met with senator udals agricultural team. How did those meetings go . It was very helpful for us to get to actually speak to his staff and kind of give them an insight that they may not have had. They heard you. Historically thats not always been the case. In senator udals office its been a little iffy for us as far as agriculture and the shiesh us we believe in. Back in colorado i talked to the candidates about the brays concerns. Agriculture a big deal in this state. Youre right. Agriculture is a big part of our economy here. And its really tied to our way of life and how we see ourselves. Some of the farmers and ranchers we talk to say they like what you say. They like how you talk about it. Yes. But theyre worried about harry reid and the Democratic Senate pushing that epa agenda from the administration. Senator reid is from the west. He understands the importance of the ag sector. Im going to be making the case we need to back off, we need to work with the ag sector. Congressman corey gardner, udalls republican opponent wants to exploit udalls ties. Weve watched as the governments gotten more involved, epas gotten more involved, threats to regulate dusts off dirt roads and regulating every mole molecule of water a farmer will have to address. When mark udall says im going to attack those issues too. Hes supported president obama 99 of the time. When it comes to protecting agriculture in this state, hes going to once again miss the mark. Back at the ranch the bray family is trying to deal with the effects of those regulations and worrying about their future. Well, i kind of wanted to call everybody together. Its a changing of the season. Its the fall is beginning. Weve got hunters showing up this week, we got cattle to move. Roberts referring to the annual cattle sale, a once a year shot at making ends meet. One bad day could mean disaster for the ranch. Things have to go right. And we only get paid once or twice a year. This is a payday for us. We work year round for this day. We had really, really good years and really, really poor years. Its feast or famine. A nail biting moment for the brays. Well find out what happens later in the hour. But when we return, we go from the grassy terrain to another type of grass thats turning colorados economy greener. E. The getaway vehicle for all the confidence you need. Td ameritrade. You got this. In 2012 the citizens of colorado passed amendment 64, which legalized the possession of marijuana for recreational use. 55 of the public saw it as a good idea. 45 saw it as a bad idea. And a handful of citizens saw it as a chance to make money. As soon as you get a taste of it, youre back on your path again. Including the hackett sisters, robin and sher ri. In january they opened up a shop near denver. So we rolled joints and we preweighed out cannabis and we said to each other, we dont know if were planning the Biggest Party ever or if nobodys going to show up. So on opening day we kept them warm and we had a coffee vendor. We probably served about 750 people. I dont know how to explain that chaos. It was just person after person after person after person. And we did a sell every nine seconds. And for the next, i think it was 21 days we served 600 people a day. They called their dispensaries botanacare. Sell lots of pot. Yeah. I usually do. Its a familyrun business. Sherris 25yearold daughter pitches in as needed. I maintain all their marketing. I maintain all of the online menus, all of our presence as far as social media. But i also do retail sales. When it gets really busy at the end of the day, of course we roll joints, everyone has to do everything out here. But for all their success theyve got some problems. The biggest obstacle right now. The state may have okayed it, but currently under federal law marijuana businesses are subjected to special scrutiny. And most banks avoid doing business with them. So theyre forced to operate on a cashonly basis. You ought to try to run a business without being able to bank. I mean, paying your employees is impossible. Paying rent. Because my money comes from marijuana. And all that cash can be dangerous. My staff is in danger. Im in danger. The people that walk in with cash, i mean, if youre shopping for a month, youre going to come and spend 200 or 300 in cash. And so the Senior Citizen in my parking lot is either leaving with a lot of product or walking in with a lot of cash. So of course its a danger for them. The fda has classified marijuana as a schedule 1 drug, a dangerous substance that has no recognized medical use and has a high potential for abuse. Well go to things and theyre like, oh, this program that were offering. And were like, yes, wed like to participate. And theyre like, oh, you cant because youre marijuana. This is a federally funded program. Theres obstacles at every turn. Even paying taxes is not easy. Our sales volume is we pay 80,000 a month in sales tax. And so we have to take it in cash. It takes, you know, four hours to count our money. You pay them very carefully. At first it was okay, just bring the money down. At one point they offered to send armored trucks to pick up the money. If the hassle of paying in cash wasnt bad enough, colorado soon added insult to injury. Now we have to pay a penalty for using cash. Its very upsetting to think that i have to pay my tax and then pay a penalty because i paid it in cash. Doesnt seem fair. While the state may see marijuana sales as a legitimate business, the federal government still sees it as an illegal enterprise. The entire industry could go to pot if the feds decide to override amendment 64. Truth is though these sisters already knew that the marijuana business, no matter how legitimate, can be problematic. They knew it from hard experience. Robin and sherri following in the familys tradition, were once iron workers but robin was seriously injured in a twostory fall and lived in pain for years no matter what the doctors prescribed. A friend insisted she try a marijuana cookie. Two hours later i experienced pain relief i had not felt in 15 years. I called him up and said whats in this cookie. And he said its just marijuana, robin. That cookie made her a believer. So after colorado passed a law allowing marijuanas medicinal use, she went into the therapeutic cannabis business, a small step toward the retail boom in Recreational Marijuana that was coming soon. Though Medicinal Marijuana had been legalized, it seemed to the sisters the government was always looking for an angle to stop it. One day there was a knock on the door. The police came to my house and said, well, we hear youre a major underground grower. I said, well, i have 30 plants. Im not really a major underground grower. A few hours later local Drug Enforcement came in to inspect the plants. They came in the house and they looked at my plants and took a picture and took a leaf off of each plant and put it in a bag. And came upstairs and said, well, we dont know if youre breaking the law because it just changed five days ago. Robin was arrested and charged with a felony. They brought her into the prosecutors office. She looked at me and said all i have to do is prove that you knowingly grew marijuana. And i said, well yeah, but i did it under this law. And she said take a plea bargain. But this will label me as a drug addict the rest of my life and im not a drug addict. So i said, no, im not going to take that plea bargain. Robin says she was offered three more plea deals but refused them all. I was looking at 8 to 16 years in prison for growing cannabis. So then the day came where there would be no more plea bargain. And i said, think about it, robin, youre in an 8 by 10 room, you sleep on a steel bed, the sink is in the back of the toilet, can you do this . Can you spend ten years of your life over this cause and what you believe in . I was scared to death, but i didnt break the law. And im not going to be bullied. So she held fast and practically on the courtroom steps the other side caved in. The charges were dropped and it was game on again. Here we go. Which led the sisters to the Marijuana Dispensary business theyre in today. But if the threat of prison didnt stop them, it may end up that banking regulations squeezed them out of the game. The politicians need to realize this is something that we wanted. We voted it in. They need to work on banking. And they need to take what we want and represent the people. So robin and sherri are looking for help from both senator udall and representative gardner. Well tell you the headway theyve made when we come back to this story. Reproductive freedom is a big deal to millions of coloradans. If he hadnt tried to limit those freedoms, wed probably be having some other conversations. Reproductive rights i think is an important issue for me. Im just going to say it, who has the right to be able to decide over what a woman does . Annette and victoria are the kind of voters udall is betting his senate seat on. The two sisters are businesswomen who cofounded the denverbased istonish inc. Were roughly about 10 million in sales and we employ about 80 people in colorado, wyoming, minnesota areas. I think having a business is having your own destiny and being able to create a dream. Its fantastic. So how about i give you a call later on it . Yet socalled womens issues are only a small part of what concerns them this election. For instance, as business owners, health care is very much on their minds. One of the things that we offer is a real wide health care package. Weve been told one of the competitive compelling things about joining our company. The sisters hope obamacare will work out, but they do worry that it might change things in ways they cant control. Weve been managing it, but whats coming in 2015 is really the question. And even the experts were talking with were saying are we in compliance, are we doing the right things to be set up and the dates kind of change and move. Are you going to try to repeal obamacare . Its already cost 340,000 coloradans their health care plan, its increasing costs dramatically. Mark udall casts a deciding vote on obamacare and said hed do it again. And youd do it again . I would support it again because we had a broken system. Of course there would be some reforms that hindsights 20 20 if i could name a couple of them, we want to make sure we keep it affordable. Then theres Immigration Reform. I see that the immigration issue having a big impact on the Technology Labor pool after 9 11 significantly scaled back. There just arent as many workers. I dont want to be voting for a candidate whose positions on immigration are to do nothing. What are you hearing from constituents when it comes to Immigration Reform . And how important is that in the state of colorado . This is an area where congressman gardner and i disagree. Congressman gardner says he wants to do it in steps but he hasnt taken one step. It will be a key part of his campaign. I believe we do need Immigration Reform that actually works. We ought to start with a secure border, but thats more than just a personnel or equipment. That means we have a Guest Worker Program in place, that we address entry exit system, address the stem visa issues. Have a steady hand for these. We visited another Family Business thats concerned about Immigration Reform. We all got here from spain equally. Hes the tall one in the family. All of the other people that are trying to make a better life for themselves coming from other countries are entitled to an American Dream. The aguilars are trying to expand their business, so they want a candidate who will work to make that possible. The hard part is you can be successful at one store, but can you replicate it at another store . And as you do that, can you keep the rain back and still be able to control everything . And thats kind of some of the things that happen with government. It gets bigger and bigger and bigger and harder to keep in check. With his background i understand why theres a need to regulate, because theres a safety and a risk aspect. But i also know that in some areas it stifles growth. Senator udall recently came through town and the aguilars met him. Whats your business . Barber and beauty. I have one question if you dont mind, with the government shut down and kind of the taxpayers at the state perspective, the fires that happened during that time actually stopped us from expanding because they shut down the whole area. How do we prevent that from happening again . We are individuals ive worked really hard to keep fires from happening by reducing fuel loads. And then weve got to have the assets like airplanes and the infantry to fight fires so they can get on the ground as quickly as possible. Great talking with you. Thank you. I probably am going to vote for udall again. Hes a peoples person. And back in denver, who are the sisters voting for come november . Victorias answer as of this summer may surprise you. I dont even know whos running if you want to know the truth. Whoa yeah, i dont. I will, eventually. But i dont right now. When we come back, an issue that goes deep, fracking. And later, well return to the bray ranch to see how their make or break cattle sale went. There are as many paths to the American Dream as there are americans. But under normal circumstances theres only one path to the u. S. Senate. And that is by winning an election. Weve come out here to colorado to look at one of those elections. Weve talked to all types, ranchers, hairdressers, cannabis retailers and many others, to try to find what theyre looking for in a politician and how they see their two main senatorial candidates. Udall and gardner are currently neckandneck. And with each citizen we talk to we discover another issue that could make or break this race. Fracking, ten years ago the word sounded like an insult. Today, it sounds to some like the salvation of the american economy. And to others like the destruction of the environment. Whatever it is, fracking or hydraulic fracturing, a High Pressure method of getting oil and gas out of the ground, is a contentious issue in colorado. People jokingly have referred to us as the wharton brothers, which i take that as a compliment with my age. Reporter jc warden and his son have been running an Energy Consulting firm since 200. We keep about seven of us in the office full time. But we can range anywhere from 15 to 40 contractors at any time. Working out of a small office, theyve got a lot of big clients and deal in big ideas. One of those ideas is that fracking will not only make money but could also make America Energy independent, an important goal for jc and a legacy for his children and grandchildren. Lets go outside. I have reached the point in my life where im sensitive of time. And i just feel very pressured to accomplish a lot more in a shorter period of time. I just feel a real sense of responsibility to leave it a better place than i found it. But they recognize theres a large group ready to wage war on fracking in colorado. And the battle has moved into the political arena. Various initiatives were put forth to deal with fracking. Recently the political initiatives have been initiatives 88, 89 and 121 on the colorado ballot. We could be literally shut down tomorrow by an election over an issue of how far away from a city limit we have to drill. Luckily due to bipartisan efforts the three were pulled off the ballot. The prospect of having oil and gas initiatives on the ballot in energyrich colorado made democrats uneasy. Governor John Hickenlooper brokered a deal that removed the measures from the ballot and created a commission to make recommendations to the Legislature Next year. But the battle is not just instate, its a national issue, something a senator might deal with. Which is why i asked the incumbent senator and his challenger about it. You made it clear that youre profracking. American Energy Independence means jobs, a brighter future. Over 100,000 people in colorado are at work because of our industry. Fracking. Yes. If hydraulic fracking was banned statewide, it would cost colorado an estimate of 68,000 jobs and 8 billion in Economic Activity over five years. Do you think that this issue, fracking, is important . Fracking is safe. Its led to growth here in our economy. At the same time we want to do it in a safe and responsible way. We want to protect the Public Health of the communities where fracking takes place. We also want to protect the job creation. We have a Blue Ribbon Commission in place to find that sweet spot where we protect this really special way of life we have, but we also protect our jobs. Voters like the whortons for whom fracking is a key issue, might not get much of a clue with answers like that. But theres another issue the whortons worry about, the keystone xl pipeline. On this issue senator udall and congressman gardner openly disagree. While gardner supports it, senator udall has voted more than once to stop it from going forward. Why hold back on keystone xl pipeline . Look, my point of views been that the science ought to be completed. A lot of people wanted to fast track the pipeline. We dont even have a route for the pipeline. Those are just sitting out there the whortons professional life requires them to confront Major Political issues. Their personal life does as well. You know, a recent divorce from my wife, being a single father is definitely a hiccup in the American Dream. Hes got a 2yearold daughter, autumn grace, born deaf in one ear and now losing hearing in the other. The personal issues and family issues are tough to deal with, but i still have two wonderful children i get to spend a lot of time with and make it part of the american dpreem. I would really like for her to have a full complete life and be able to hear music and other childrens laughter. And so the health cares really important right now. John whorton is selfemployed, so he has to take care of his own health care costs. We have not the providing of benefits. Were still in the process of setting it out. But at a personal level the rise of insurance premiums and things as a selfemployed individual and watching my children and is insurance skyrocket has been pretty tough to handle. But they wonder if obamacare is the answer. Im not sure that socialistic system that Great Britain and that canada and other countries has is great. I dont really think what we have is the answer either. And thats some place we need a lot of work on because everyone has the right to be healthy and see their children be treated when theyre sick. Its hard to be critical when i cant propose a solution that this is some place weve got to go and weve got to be the best. Health care is another issue where the candidates are on opposite ends of the spectrum. As weve seen, cory gardner would repeal obamacare, senator udall would keep it but try to fix its flaws. Considering all the factors the whortons have a pretty good idea who will get their votes. I do think its time that maybe we do have some new leadership in the senate from the state of colorado that will be more representative of the people here. But banking regulations forced them to operate as a cashonly business, which is why Sherri Hackett recently went to Cory Gardners office. Hi. Im Sherri Hackett. Im a cannabis business owner. And i had been in a few times and spoke with you about what Cory Gardners position is on marijuana and especially the banking side of it. Sherri may have missed congressman gardner that day, but we caught up with both senatorial candidates and talked to them about marijuana. Its a laboratory state, colorado. Now you have this experiment on marijuana. And it brings in 32 million in taxes so far over six months. And youve got 12 million more to 40 million in Law Enforcement savings from arrest, prosecution, sentencing, et cetera. Are you happy about those numbers . Look, when it comes to the issue of marijuana, i think the founders of this country always intended the states to be laboratories of democracy. And colorado finds itself deep in the heart of the laboratory. Do you plan to move forward, to move the Industry Forward . There are certainly problems that have been created, the banking issues, the Financial Services issues that are going to have to be worked out. While gardner is guarded, udall seems to see legalizing marijuana as an overall positive for the state. Voters showed the country that we have a libertarian streak here, we think the prohibition for marijuana for private use didnt make sense. It increased crime rates and perhaps even gave momentum to drug cartels. And so we as a state decided to undergo an experiment, which is what the founders wanted the states to do. Do you think its working . I think so far its working. But weve called on congress to remove marijuana from the schedule 1 status because thats what creates the tension with the state and the federal government. And most importantly we need to provide access to the cannabis industry to the banking system. Right now its a cashonly business. And while that may sound like it has some upside, it actually becomes a Public Safety risk and creates a lot of inefficiencies. That sounds more like what the hacketts want. Will it affect their votes . Not necessarily. When we last checked they were both leaning toward the straight laced conservative republican cory gardner. I am a conservative person, i would say. And so i tend to vote republican because they tend to have the same conservative views that i do have. The last few weeks weeks hav busy. We rode ten days straight, ten hours per day. And theyre down a man. His oldest son is 350 miles away in denver hearing from government officials about changing regulations. Its hard to do. Then we have heavy handed government threatening you with another regulation, that is really hard. If the sale doesnt go well, the future of the gray ranch is in jeopardy. The ranch is the most important to me. Very a daughter. Boy love to see her be a part of the ranch with her life. We started 40 years ago. Our lives was ten times more complicateed and expensive now. I figured if i can get 250 to 300 a calf i might be able to stay in business one more year. Now were going to sell these for five times that. And were not sure if we can survive that. Later that morning the cattle are driven to a scale to be weighed. Then, a tense moment. Robert and the buyer crunch numbers my number comes out to 377 in the end the take was enough for another year. There are times i come home. Very a pit in my stom wrik that just doesnt go away. We need to do this. I dont have that feeling today. The sale went well. But theyve got to deal with the Bigger Picture a growing list of regulation thats could affect their future profits. And not just environmental regulations. Something that threatens to break up many of the Family Businesses. The state tax is a huge issue. My grandparents died. One in 2005, the other, 2006. My dad and very been dealing with estate tax issue almost ten years now. Weve had to sell properties, weve had to do thing thats have diminished my kids future. And were still paying. Were almost 60 years old. We have to pay this stupid in r inheritance tax. My grand dad and mom and dad worked their lives to build what we have today the potential for us to lose that because of an estate tax of close to half of what our ranch is worth, that is devastating. Its another reason the family is focusing on who will represent them in the u. S. Senate. Senator udoff voted for the largest estate tax increase. Voted to lift tax rates on billionaires and millionaires, increasing tax rates on middle class and working people. Gardener has been behind several bills that have been agriculturely supportive. We have seen the office take a stand back from some of the things its disappointing after speaking with him for a while in washington, d. C. I strongly feel cory fits our culture better. Its what our dreams better. We feel more so than some elections we feel more strongly about this one. Than a lot of them. Its such a close race. That i wont be surprised if we look at numbers and it just comes out to are you going to go up and vote . Which brings us to one final twist in our story. Recently there have been major changes in how coloradans vote. With easier residency requirements, later registration. Above all, near universal voting. But the state is keeping track of who is voting. Not who they voted for. Ballots . Can be mailed in up to election day. Supporters claim this will make voting available to everyone. Opponents fear it will make voter fraud more likely. How this will play out on election day . No one knows what we do know is that the citizens of colorado from ranchers to oil men, to marijuana merchants are divided not only as to which candidate they support, but in what they see is the best direction for their country, for their estate and themselves. My American Dream is to have my life style and my kids. The American Dream to me is being able to do what you really want to do, your passion. To pursue it. And the great thing about america is where else can you go to have this opportunity . I think the American Dream is that you can be anything you want to be. And you get to do that. Nobody sells you that. America was founded on a remarkable promise. Life, liberty, pursuit of happiness. Think of it. The pursuit of happiness. What other country guarantees that as a birth right . Its not happiness guaranteed only pursuit but the point is that everyone is free to seek it their own way. In colorado, as weve seen, there are many different paths in a world where the government is bigger than Thomas Jefferson imagined sometimes that brushes up against the governments plans. That is why this Election Year is so impo may not only decide be your senator but also, depending on how you see things whether government will help or hinder the right to seek the American Dream.
