President s own words about a payment to Stormy Daniels. Chief White House Correspondent john roberts is following at all from the white house pretty good evening. Good evening to you, one of those we are not in kansas anymore, after months of denial that President Trump had anything to do with the payoff to Stormy Daniels came more today that yes, he did. And then there was word that the personal achievement Attorney Michael Cohen was under surveillance. It was the latest in a day of bombshells, report that in the week leading up to the radon trump personal personal at Attorney Michael Cohen, he was a part of a wiretap that came froe white house pray to im not sure when the last conversation took place, i would say to go to the outside counsel about any concerns. Neither the attorneys or the representative for Michael Cohen could confirm the wiretap, but Rudy Giuliani went off on the doj. Sing if true, anybody who says that i am exaggerating when i say that this is an outofcontrol investigation and they are acting like stormtroopers, give me a break, baby. They prove it every day. He blasted the possibility of a wiretap as a blatant transgression of attorneyclient privilege saying that i am waiting for the attorney general to step in. In his role as defender of justice to put these people under investigation. Last night giuliani threw a hand grenade into the investigation telling sean hannity that the president paid cohen back for that 130,000 payment to Stormy Daniels. So they funneled it through a law firm . Funneled it through the law firm and the president repaid it. It appeared to contradict previous statements from Michael Cohen in february who said neither the Trump Organization nor the Trump Campaign reimbursed me for the payment either directly or indirectly. And another, april 5th from the president aboard air force one. Do you know about the 30,000 payment . But giuliani insist that President Trump did not know that he was paying cohen back for a paying story. It was for expenses that he did not itemize. And while giuliani insisted that the payment to daniels did not benefit the campaign, he also seemed to say that it did. Imagine if that came out on october 15th 2016 in the middle of a last debate with hillary clinton. So to make it go away, they made the cohen thing. He made it go away. He did his job. Stormy daniels lawyer Michael Avenatti was stoned about the admitting of the payoff. Are a got better and 24 hours. I have been saying this all along, it is about the coverup. It is about lies to the American People. It is about people trying to pull the wool over peoples eyes, the citizens of this country. The new revelation with the chaos what was meant to be a day of faith at the white house. The president hosting religious leaders to celebrate the national day of prayer. We are proud of our he has, and as president and president i will always protect religious liberty. He signed an executive order to start the faith in the white house initiative. It will focus on protecting religious freedom. The Faith Initiative will help design new policies that recognize the vital role of faith in our families, communities, and our great country. At the same time President Trump was urging quiet reflection, his newly reconstituted legal team adopted a far more aggressive posture. After Rudy Giuliani referred to fbi agents who conducted the search on Michael Cohen as stormtroopers, james comey tweeted i know the new york fbi. There were no stormtroopers just a group of people devoted to the rule of law and the truth. Our country would be better off if our leaders tried to be like then rather than comparing them to nazis. Giulianis response to james comey, he is a sensitive little baby. Telling jake gibson that while Michael Cohen was under surveillances phones were not tapped and his calls were not recorded. The device was a pan register recording the numbers of the calls that cohen was making from his phone, log and the duration of the calls, but the phone calls themselves, shannon, were never listen to. All right, john roberts live at the white house, thank you. For more on what this could mean for the president legally, we turn to the judicial analyst judge napolitano, maybe we put you in the category of those who do not totally believe the story on the pen register. I do not believe the story on the pen register, on a day in which the president s chief lawyer threw a bomb shell into many of the president s defenses, do you really think that the Justice Department is going to admit that they listen to phone calls from the president . They may not have recorded it, but i assure you that they were listening. If they were listening they cannot use anything they hear as a basis for an affidavit. A probable cause or in a prosecution. They can send them seeking other means to attain evidence to support that. Shannon parallel reconstruction coming up on something they were not supposed to have access to so you find a different way to get access to it. A different and lawful way so that you can presented to a court. When Michael Cohen asks the document ceased by the fbi be returned, the government said there is no privilege here because of the crime fraud exception. That means that they had enough information from those phone calls to suggest that Michael Cohen or his client were participating in a crime or a fraud and masking the phone calls as attorneyclient privilege, and they werent. Shannon lets talk through the potential legal ramifications of what Rudy Giuliani revealed last night. He says he discussed it with the president. Heres what he tweeted out today. We will walk through this, mr. Cohen, retaining a monthly retainer nothing to do with the campaign from which he entered into through reimbursement of private contract between two parties, known as a nondisclosure, these agreements are very common against celebrities and people as well in this case it is in full force and effect and will be used in arbitration for damages against discovered. The agreement was to stop the false comments made by her about an affair having already signed a detailed letter admitting there was no affair. Prior to the violation by miss clifford and her attorney this was a private agreement. If played no role in this transaction. So now we get to the question of how this money was repaid to Michael Cohen, is there potential for a fraud charge . There is potential here, because one of the reasons that President Trump was able to say that he knew nothing about the agreement is his name does not appear in there. And he did not sign it. Michael cohen and ms. Daniels then employer, not her current lawyer used a pseudonym, David Dennison in place of donald trump, so the question is it even a valued agreement, because it binds the president did not actually sign it. The president is correct when he says a nondisclosure agreement is common, with respect to celebrities. A lot of celebrities can tell everybody that works from them to sign a nondisclosure agreement, because they may see something that they do not want disclosed. But it would be a violation of legal ethics as Michael Cohen paid a settlement in a case out of the retainer that was intended for his own fees and his own expenses. It is also to me inconceivable that donald trump who was notoriously aware of where every dollar he has is going was not aware that 130,000 were going to Stormy Daniels. Shannon whatever Rudy Giuliani said, busy people do not always know what is being fixed or taken care of on their behalf, they authorize someone to do it. They just do it and dont have to get involved with the details pay that may very well be the case, there couldve been a method to Rudy Giuliani is mentioning this last night. Knowing his mind as i think i do, ive known them for 25 years, he likes to focus on discreetly legal issues coming wanted to take the Stormy Daniels Michael Cohen issue off the table. I dont know if he succeeded by what he said last night, i do not know if the white house and the president , and certainly mr. Cohen were prepared for this, he is not Michael Cohens lawyer, he seems stunned by what he heard last night, but this is off the plate it appears in the Mueller Investigation or the Southern District investigation with respect to the president. Shannon quickly, Stormy Daniels current lawyer who does not miss a chance to weigh in on the case says that he believes that cohen will be indicted on several serious charges, he is continuing to predict that the president does not make it through his first term because of legal issues. I dont know about that, it depends on what bob mueller comes up with, i happen to think that the Mueller Investigation is a very serious one and they have accumulated a lot of evidence that Rudy Giuliani and the president do not want to confront. I dont know where Michael Cohen or Michael Avenatti got this from, except for the Los Angeles District Court judge before the Stormy Daniels versus donald trump case is assigned stated the case for 90 days until Michael Cohen is indicted. I dont know if you know something that the rest of us do not know, or if this is a mutual judicial mind saying that there is going to be an indictment. Shannon with that discussion taking effect as well. Judge, always great to see you. Thank you very much. A woman picked to lead the cia can find yourself confirming one of the closest votes yet. As questions are raised about her involvement in interrogation, some critics call torture. To the intelligence correspondent Catherine Herridge with a closer look at an household. They will be happy with gina who is here today. The public endorsement from President Trump appears to be a part of the push by the white house in advance of the Senate Confirmation hearing where she may be the first woman to lead the agency. More than 54 intelligence officials support the nominee including 47 year veteran carly allen. She has 33 years of experience in the client destined world, she has seven overseas tours. She is a gifted linguist and she understands that we have mounting dangerous. But critics say her role in the cia enhancement interrogation the boats appear to be 50 in favor and 49 against. With wild card senator john filling arizona for cancer treatment. I am hopeful that the people look at the merits of her candidacy, but i still would expect that at the end of the day it will be a close vote. To get gina haspel through, the cia declassified the controversial detainee program, which is due to the 9 11 mastermind. The 27 memo said that gina haspel acted appropriately and did not order those videos. Firsthand knowledge working side by side with george tenet. I was at the table, george tenet was at the table, gina haspel was down at headquarters, but she had no authority to do that. She did not make any of those decisions. The senate has never confirmed somebody with an operational use of torture. This would be a new low. Chris sanders along with Senior Senate democrats say that the cia should be classified more records so that the public can independently assessed gina haspels character before the confirmation vote. What she involved in the kidnapping program . Was she a part of the decision to kill and execute an american citizen by use of drones . Tonight, a fox news first as one of the men who inspired the brothers who carried out one of frances most dramatic terrorist attacks tells a story of his own dissent into extremism and gives a clear and chilling insight into the cold blooded killers who gunned down two Police Officers and ten journalists in 2015. Senior Foreign Affairs correspondent amy kellogg has that story. It was out of repentance that one of frances most notorious jihadist recruiters joined forces with one of the radicalization specialist. He was a preacher who sent the killers on their path to. It was more than friendship, it was complicity. They found radical islam and soon developed a substantial following and clear encouraging jihadist to fight in iraq. Especially close to the younger of the two terrorist brothers. In 32yearold was arrested before he made it to iraq and ultimately turned his hatred on france. I encouraged him at a time to go to iraq when he had doubts he came to see me and i would dispel those doubts. Both men round up up and prt while diffuse hard and they are, the company then actually helped him deal radicalized. The simple act of building relations with other people open my mind. The other thing that really helped me was the assistance of my jewish neighbors when i got out of jail, they knew that i had been imprisoned and why i had been in prison, but they open their door to me. Once released from prison in 2009, he failed to deal radicalized his brother, now even more extreme, he went to yemen to get weapons training and started to follow american born clerics. The radicalization experts says that even though he was not able to stop the brothers those like him who have been down the extremist path can be powerful examples for those under the influence of jihadist groups. So isis has lost its territory, she says that the recruiters have not let up targeting young people who know very little about islam and the way that they targeting people. Isis looks into the profile of each young person and adapt the jihadist area genealogy to the psychological profile of each. It touches everyone. They take responsibility for the frances major terror attack of the millennium. It is i who instilled the ideology. I participated in some way. There are some estimates that 19,000 people in france have radicalized, 2,000 art considered extremely dangerous. So it really is a race against time, shannon. Shannon amy kellogg, thank you so much. Shannon the city of seattle has a plan to combat homelessness, but critics say it could come at a cost to actual jobs. And one of the citys largest private employers is fighting back. Dan springer reports from washington on whether a text to clean up the city could actually clean out job growth. The city of seattle with its booming Tech Industry has opposed to lower the boom on the job creators, the council is considering 0. 26 for every workmen on the city that grows 20 million a year. Some businesses will die or leave seattle because of this. The tax will raise 75 million from around 600 companies. Among them home street bank which has 700 employees in seattle just across the city line. When you start creating a scenario where it is much more attractive to house employees outside the city. And that is bad for the city. It is bad for jobs it is bad for the city economy. The tax revenue will be used to build homeless shelters, tiny house villages and affordable apartments. Despite spending on homelessness that has ballooned to 200 million a year. The number on the streets has grown 20 in two years to nearly 4,000. Housing and homelessness is a regional crisis, but we have to act with urgency right here in seattle to get folks inside. This is almost around 2,000 deeply affordable homes. By far the biggest impact will be felt by amazon, looking on an annual tax of 540 on each of its 40,000 employees. The online retailer will pay 21. 6 million more a year. Even though it is spending 10 million to build a homeless shelter in one of its many new office towers. And at the same time amazon is looking for a second headquarters. What amazon is doing is keeping their options open. They are saying that they are going to set up a headquarters in another city and then they can transfer work from seattle to other places as needed and it is just a basic business decision. After months of being silenced, amazon has declared a warning shot that it has put on hold plans to build a office tower and is considering subleasing a different building that it owns if the city goes ahead and taxes the head tax, that would be 7,000 jobs not created. Suggesting that republicans have done so much damage to each other the rightleaning state is now a tossup. Whoever the nominee is should beat donnelly, thats what i was troubling for the two of them when in the public poll, they were way off. All that is certain is that the white house use indiana as a place where republicans can sing doing and can gain some ground in the senate. This was information that the president did not know at the time but eventually learn. The president has denied and continues to deny the underlying claim. We give the very best information that we have at the time. Mr. President , you and your advisors and your lawyers need to bring it. Bring it. Because you continue to lie to the American People and we are not going to tolerate it. Not today, not tonight and any other day. Shannon all right, lets bring in the panel, lots to talk about, tom rogan, commentary writer for the Washington Examiner nader, of the washington post, and opinion editor for the washington times. One of the members of the legal team, out there talking. A lot, charlie. Yes, he is out there talking, and i do think that it is important, a lot of people are speculating about he went too far or got over and i think last night was sean hannity, but at the end of the day i think that he wanted to accomplish two things and he did accomplish the two things paid one is that he wanted to go ahead and set the marker that infect Donald Trump Trump himself did pay the money. That went to the nda agreement. In the second thing was he wanted to put out there that the president did it for personal reasons. Not for the Campaign Period he kind of stepped on that a little bit this morning on fox friends where it seemed to sort of walk it back a little bit, but he wanted to accomplish those two things pretty dated and because he did that, i think that the president is in a lot better, a stronger situation. Because of that. Now then he was when there were questions about who paid for it. Shannon chuck, was this a cleanup issue dealing with the fec, if the president handles it this way, if Rudy Giuliani says that it did happen this way, doesnt work out that way . I dont think so, i think it started a bunch of new fires, this is antics going around what is actually pretty serious issue a couple of weeks ago, i think it was about a month ago on air force one, the president flatly denied knowing anything about this payment. Which created a situation where there were two alternatives. One, he was lying or some other benefactor using the thrall of some benefactor who is playing hush money to his alleged former mistress, well now we know that he was lying. So if that is the bestcase scenario for him, that is not a good case. The Campaign Finance thing is only the beginning of the trouble. Because it is going to be a whole inquiry now by the Southern District of new york, the u. S. Attorney into this chain of payment that was funneled through his then lawyer Michael Cohen if there was any fraud but the banks and so forth, i dont think anything is cleaned up. Shannon tom, a lot goes back to the timeline of what the president know when he did get involved with payments, they have been very careful in their language. It is possible that theyve been telling the truth but pursing the words very carefully to this point. What did the American People feel like it is wrong or did they feel like they have been lied to by the president , that is a different question of whether he did something legally wrong. Right, but i think that notion of the American People is what we are going out. Or at least what the Trump Administration is trying to do through giuliani. They sense mueller closing and in some way whether that is through cohen, collusion, whatever, and so to them the best thing to do is to fight it in the political domain rather than the legal domain, they know as much as a law is supposed to be fine, ultimately with the president of the United States the special counsel, if he can get out ahead of this and push it into the public atmosphere, i think that they think Robert Mueller will be more amenable to negotiating or backing up, im not sure if that is a good gamble, but i think thats where they are trying to do. Shannon to the p. R. Point, a lot of backandforth between Rudy Giuliani and james comey, of course fired by the president about whether people are acting like stormtroopers or not, james comey says, you know, that has to stop using the words, and giuliani says stop acting like it. Where do we go, chuck . I try to be a political analyst, and yet this is almost like, ive used the words and text, it is freakish that is going on between the formerly very substantial people in our political system like the former mayor of new york and the former director of the fbi. I would not say that Rudy Giuliani chose the most wisest adequate term when he called a bunch of fbi agents stormtroopers. And furthermore, they were there without a search warrant. They did not barge in like the gestapo or Something Like that, that is just something shannon what do make of the fact that not only cohen, but paul manafort, very heavyhanded and how it was carried out. Stronger case with paul manafort, the handcuffs and all of that stuff, whatever the tactics, the known operate. They dotted all of the eyes and crossed all of the tees in respect to paul manafort, you can go into the lawyers office, but as so far following procedure, so Rudy Giuliani is working the rest as tom said. Shannon necessary in sporting events, but the fact that cohen was wiretapped, reporting has been that there was a ten register where they logged phone calls when they go in, when they go out, how long they are. Judge napolitano at the beginning of the show saying that he does not think that they did not listen. He does not think that they could have resisted the temptation and that they probably did listen to phone calls. Whether they did or not these are huge constitutional issues, who authorize such a thing. Were talking about the president of the United States and his personal attorney. And i do think that maybe the president has not been fully forthcoming about the Stormy Daniels thing every step of the way. But not being fully forthcoming to people, to the American People is not a crime. Theres no violation. And when you look at the charges that the president colluded with russia to jolt an american election, those are the charges that mueller is going after. And then to come around to this nonsense that the Stormy Daniels mba payment where it went, and who, it is almost like going after al capone for his income taxes. This is not, this has nothing to do with a serious crime, the serious charges that were leveled against the president. And it is like, well, now, the prosecutor needs some scalp on a small, so we are going to come up with some cocked up diversion of nonsense. And i have a real problem with that. Shannon we have seen officially thus far, no evidence of collusion as we know a way to the Mueller Investigation. Call now take control of your retirement today we are seeing widespread support across the political spectrum and within the intelligence community. The past association with socalled extraordinary interrogation techniques make her stalwart two resisted in the future. Among the peers, it is absolutely universal. Over the last 15 months, mike served the nation as the director of the Central Intelligence agency where i can tell you that they have such respect for him. They may be the only people that are not very happy right now. But they will be happy. They will be happy with gina. Shannon we are back with the panel to talk about the upcoming nomination, confirmation votes on potential cia director gina haspel. Tom, you wrote a piece on her and why she is so wellrespected here and abroad as well. Yes, she is. She has served two tours in london, a big lizzy liaison thing, but actually stuff around europe as well, very popular with the british, as it explains that to not early on in her career, but operatively he is back and she is popular abroad. Very creative and counter russia activities which could she will say a lot of that to the democrats. If you want somebody who is tough on russia, i am your gal, but in terms of the ultimate factor, the white house has not been pushing as much for her as they were for mike pompeo. Perhaps they use that up with rand paul already. That is the key, so it is going to be a very close call. Shannon speaking of rand paul, heres his take as they await the vote. The joyful glee at someone who is being tortured, i find it just amazing that anyone would consider having this woman at the head of the cia. Rand paul does not always make the right decisions, right away, but we hope that he gets there. Shannon talking to the president , he has said so many recent votes, we can count on him, i know that he comes through for me in the end. But he has not even met with her yet unless it has changed today. It is kind of a core issue for someone like rand paul who is so much of a libertarian. And so committed to the Fourth Amendment and that whole doctrine and who opposed many of these wars, so if he does come around, it will be be because he has been persuaded to look the other way and away on his principles but however it does suggest bringing attention back to the importance of this hearing, because he is on the republican side, but a lot of democrats want to hear from gina haspel herself, what did you do . Why did you do it . How do you think about that special Interrogation Program in hindsight . How committed can you be to us never to do anything like that again . By the way, it has been banned by statute at this point in a way. So i think inside the agency and the intelligence community, obviously a lot of respect for her and in some way she is ideal because of the director of operations would have a veteran there in charge. But they do not get to make this decision, this is for the peoples representatives. And i think that the last point i would make its lead i think that this would be less of a close call if there were not such partisanship over all nominations now. And democrats, she would probably be getting more democratic support upfront then she has played shannon marc shorts had this to say about the upcoming vote. We hope that there are enough democrats that are courageous enough to look at some of these qualifications and what they think is in their best interest of the nation and put that as a priority for casting a vote. Shannon charlie, do you think that they will get enough numbers together . I do not know, it is surprisingly acrimonious, but as chuck said, largely because the partisanship about everything today, but it is amazing, this is the first person nominated to head the cia in decades who is not a political person. First woman, of course that is the problem with her, because of her experience as working in the cia, but to have somebody like James Clapper talking about how there is no supporter of the Trump Administration saying that she would be a very good, she would be the best at resisting those sorts of techniques going forward, but i think that it is going to wind up being a big political game where the white house tries to point out that the president is dealing with things like north korea, iran, russia, china. And we are having their squabble over here. And i think that they are hoping that they can win the big picture political fight. One little wrinkle in this john mccain is very ill, he may or may not be able to even vote on this. But that reduces the number of potential republican votes and even if he could, because of his strong or even if he does votes because of his strong views on torture, he is by no means an automatic for the administration. Shannon earlier this week, Condoleezza Rice defending her saying it is tough for people who were not in our shoes after 9 11 to make these kind of calls. It is coming in one of the things that you hear a lot of cia is a woman factor, and a lot of cia people i talked to say that it is so important to them that she has ups potential. Shannon we will see who gets on board and whether she gets that meeting with rand paul before they get to a vote.
