Mishandling of classified information. Purely draft said there is evidence to support a conclusion that secretary clinton and others use the private email server in a manner that was grossly negligent with respect to the handling of classified information. Fox news has confirmed fbi agent peter strzok made the edit removing grossly negligent and in july 2016 that was the language used by then fbi director james comey. Although we did not find clear evidence secretary clinton or her colleagues intended to violate laws governing classified information, there is evidence were extremely careless in their handling of very sensitive highly classified information. In another section, edits made to downplay that clintons server used for government business was hacked. The early draft read given the combination of factors we assess its reasonably likely that hostile actors gained access to secretary clintons personal email account. Reasonably likely was changed to possible. A letter from ron johnson to fbi director Christopher Wray included the comey draft. There is a very good reason to suspect people that were early involved in the investigation and deeply involved in it had biases against the president and its very unfair to the American People to have an agency with a reputation of the fbi that they would have political interference. Senate investigators are suspicious that agent strzok is the one who made all or majority of the edits and theyve asked the fbi as much. Bret critics have said yes this has to be looked at. There could be bias and it should be investigated. The fbis job is to get convictions and let the courts decide about fairness. So what do lawmakers on the hill say where this is going. When you look at the changes made, everything will change really works in the favor of Hillary Clinton. It decreases rather than increases for legal jeopardy. I think the next step. As people on the hill want to know who exactly made the edits because there is a footnote in the letter that refers to the fbi office of general counsel. That got my attention because the other person whos been at the heart of the texting controversy this week is the fbi lawyer, lisa page. Bret thank you. What could be President Trumps biggest compliment could also be his biggest disappointment next week. Thats how close things are. Votes are expected then on tax reform. Republicans still cannot guarantee tonight that whatever they come up with will make it past their own members. If failure would obviously lead to a monumental crash and burn for the president s agenda just in time for the holidays. Success is definitely on the table. Chief Congressional Correspondent mike emanuel tells us where we are right now. Im so excited that we are on the cusp of this accomplishment. Senator marco rubio said today not so fast on the issue of the Child Tax Credit. If they can figure out a way to add to the figure. Mike lee said he is undecided about tax reform, pushing for more with rubio. A Senate Democrat saluted the effort. Its good that some of the debate is about enhancing the Child Tax Credit. Our side will go a lot higher than senator rubio but its good hes making the effort. Despite rubio and lis some of the key points according to correctional sources, 37 is the top individual rate to help people in high tax states. Corporate tax rate dropped from 35 to 21 in 2018. State and local Tax Deduction known as salt capped at 10,000. Repeal obamacare individual mandate, maintain deduction for high outofpocket medical expenses. Ryan was asked by the tax plan isnt more popular. If you look at the polling that was done in Ronald Reagans 1986 tax reform, a month before he passed, 18 of the people polled thought they were going to benefit. This is the nature of the debat debate. The Associated Press reports this package would most benefit big corporations and upper income americans. Democrats have jumped on the analysis. The g. O. P. Tax plan becomes more cowardly, outrageous, dishonest, brazen thrift for middleclass families. The battle comes as there are reports ryan has told us close to and he intends to retire after the 2018 Midterm Election elections. There is buzz on the hill ryan could leave sooner. He brushed off a question today. Tax reform would be a dream come true for speaker ryan and face with more tough fiscal votes, its not likely to get better than that moment. Bret more on this with senator hatch any moment. Candidate trump promised to get rid of 2 federal regulations for everyone added. Today President Trump claimed his deregulation efforts are ahead of schedule. He says the ratio is 22 one. John roberts has the story. During the campaign President Trump promised to free american businesses of what he called burdensome, duplicative, and ineffective regulations. Today he used a pretty dramatic example to show how bad the situation has become. This is what we have now. This is where we were in 1960. President trump brought props to the roosevelt room to illustrate how federal regulations have exploded since 1960. One, two, three. It was an opportunity to brag on his efforts to cut red tape, dialing that government regulation saying his administration has eliminated or delayed 1500 plant regulations. Adding that his plans to eliminate two regulations for everyone implemented has been successful beyond his wildest imagination. For every one new regulation, we have eliminated 22, 22. Big difference. We aimed for twoforone and we hit 22 for 1. Part of a suite of measures the president is promoting. Tax reform started leaking oil today after florida senator marco rubio threatened to vote no and thus the Child Tax Credit is sweetened. The demand comes at a moment of maximum political pressure for the president after the senate lawson alabama. If tax reform doesnt pass next week, it may never happen. President trump remains optimistic. I think we will been there. Hes been a great guy, very supportive. I think senator rubio will be there. We are doing very well on the tax front. We have tremendous support. Press secretary Sarah Huckabee sanders suggested rubio might get something a little extra in his christmas stocking this year. Weve made Great Strides and pretty Historic Movement in terms of the Child Tax Credit. We are proud of it. Were going to keep working until we get the job done. We expected to happen before the end of the year. The white house was bombarded today with questions about the termination of omarosa manigault. She will be here later this afternoon. She has resigned from her position but theres nothing to add. Sources say omarosa was asked to hand in her resignation by chief of staff john kelly and was escorted from the white house grounds. President trump sought to quell a firestorm surrounding it, tweeting his thanks. Today he has words of praise. I like omarosa. Omarosa is a good person. On good morning america, omarosa suggested she may have more to say. There were a lot of things i observed during the last year that i was very unhappy with, that i was uncomfortable with, things i observed. I cant expand upon it because i have to still go back and work with these individuals but when i have a chance to tell my story, quite a story to tell. There were some breathless reports yesterday that after she spoke with the chief of staff john kelly, omarosa tried to appeal her termination to ivanka trump and then tried to go to the residents to talk to the president. White house sources today to fox news though story simply are not true. But they do admit that when john kelly told her she wouldnt be staying with the warehouse, there was some degree of yelling. In the situation room. Bret her interview was a bit of a deep tease of whats to come. John roberts, thanks. Bret as we told you earlier, republican lawmakers from the house and senate are still working through final version on tax reform, votes are expected next week. We want to talk about within that plan, the Politics Around it, and another key issue with Senate FinanceCommittee Chairman and senator pro tem orrin hatch. Thanks for being here. Nice to be with you. Bret first on tax reform, today it seemed like there was a bit of a hiccup in that senator rubio from florida said this. Take a listen. If they can figure out a way to add to the figure, i want to support tax reform. Its important. Bret Child Tax Credit, bump that up. Senators rubio, corker, lee, flake. All saying something and you dont have a lot of numbers. Whats your take . We have to work out those problems. That always happens toward the end of these very, very difficult appropriation battles. There is always somebody trying to get something more. Those are important issues, child credits. Bret do you think thats going to get worked out . Youre in the conference. They have come up with something and now this is the 11th hour. I think it will get worked out one way or the other but its going to take good faith on both sides to be able to do it. Like anything else, weve got to get a result in order to get the bill passed. Bret you have a couple senators out for health reasons. Senator mccain, senator cochran. Are they, do you believe, going to be back to vote . I dont know. They have come back on crucial votes with a mere so they me back. I dont know if they have to but lets hope they can get feeling better. Bret what weve seen out of the conference plan, the details, is that where you think this is, the 37 top rate, 21 corporate rate . Is it going to stick . How much does it flex in the final days . I think they are going to fight it sticks pretty well. Wanted 2020, rather than 21. Its going to be a sea change compared to what weve had and its going to be a major reduction in taxes. We want to hold on to that and i think even the democrats are starting to feel that way. Bret is it your sense it will be effective january 1, 2018 . I hope so. I hope so. That remains to be decided. Bret a lot in these final days. Yeah, these kinds of things are difficult. I have to say mcconnell, our leader, is a master at this. He has lots of help from some of the rest of us too. Bret i want to talk about another important issue youve been fighting for, this young man from utah, josh holt, 25 years old, pleading for his life. Hes been in jail in venezuela on a weapons charge for now nearly 18 months. It was a phony charge to begin with. This guy is a mormon missionary who fell in love with a woman down there in venezuela, went down to pick her up and they threw him in jail. They framed him by saying he had illegal weapons in his possession. Hes a fine young man and his parents, i know them well. They are anguished over this like you cant believe. For their purposes, they have really given him a rough time. Bret his mom talked to us last night. I dont know else how to get help, go to the public and put pressure on our government to do something. Do something more than what youve done so far. Because its not working. Bret talk about your relationship with them, how often you talk to them, how its established. We talk on a regular basis. They are a wonderful couple. Its a shame they have to go through this. He is the type of person, totally honest. Its inexcusable for them to do what they are doing. It involves politics with the united states, and our state department has a rough time with people in venezuela. We are not in sync with the leadership of venezuela and then you have the people of venezuela arent particularly in sync with the current leader. A lot of problems down there, and this is in the middle of them. Its really been very, very problematic for the family. Bret how have you used your influence, your rank, senate pro tem, highest leader serving in the senate. However you used it to change the dynamic . We have brought the state department in, ambassadorial types. Weve done a lot of things to bring him home. He has not done anything wrong. They should let him go. We have used every possible thing we can do to get this taken care of but its gotten into politics at this particular point. People in venezuela are trying to take advantage of our country. They are mad at us, and so they will take it out on this poor young man and his new bride. Its just really pathetic. Bret hopefully the dynamic changes. Senator, are you definitively running again . Well, i said i intend to run again. I am chairman of the finance committee. Thats important stuff. Its an important committee. I think most people would say i know what i am doing there. Yeah, i would like to do that. We will wait and see. I will probably announce sometime after the first of the year, exactly what im going to do. Bret do you think mitt romney has a political future . I sure do. If i didnt run, i would like to see them run in my place and he has indicated we might appear we are really close friends. Theres no problem there. Mitt would be good wherever he serves. He is a straight shooter and a wonderful fellow. Smart as can be. Bret senator, last thing. Are we going to avoid a Government Shutdown at the end of next week . We are going to avoid it but its not going to be easy. There are a lot of games being played, i have to say, by democrats. We will have to work our way through those raindrops and hopefully we can get through without getting too wet and get it done. Weve got to get it done. Its crazy to go through these type of holdups. It happens almost every time we get to the end of the year. Bret senator hatch, thanks for being here. A lot of people are concerned about new rules on the internet, how they affect consumers like you. We will explain all of that, Net Neutrality and what happened today when we come back. T i was. You know what, im not buying this. You gotta come a little harder dawg. You gotta figure it out. Eh, i dont know. Shaky on the walk, carriage was off. Randy jackson judging a dog show. I dont know dawg. Surprising. Whats not surprising . How much money lisa saved by switching to geico. Wow performance of the night. Fifteen minutes could save you fifteen percent or more. It feels good to be back. Bret there could be major changes coming to your Internet Service. Or not. It depends on what you read. No one really sure what will happen now that the government has changed the rules governing the world wide web. Chief washington correspondent james rosen is here to sort things out for us. The item is adopted. Along party lines the federal Communications Commission voted to overturn the obama era regulation supporters called Net Neutrality rules. Now broadband providers like verizon, comcast, at t can slow down the interface for apps by rival firms, block them altogether, or charge them for faster online performance. Fcc chairman rg palla, and obama appointee argued the move restores the internet to the rules under which it flourished prior to 2015 and will spur Infrastructure Investment by smaller firms. Companies in oklahoma, ohio, minnesota, montana and other places these are the companies of clubs in the record that these rules seen in a way of them building out their network networks. Ahead of the sec action, protesters descended on 700 verizon stores, large tech firms, and smaller ones. They oppose the move, arguing a broadband oligarchy will effectively censor online content an end stifle startup ingenuity. I dissent from the corrupt process that has brought us to this point and i dissent from the contempt this agency has shown our citizens in pursuing this path today. The fcc voted to transfer oversight of Internet Service providers to the federal trade commission. One architect of the early internet era voiced concern about the new rules of the superhighway. We need to make sure the internet remains open for innovation and err on the side things are tilted in favor of the entrepreneurs trying to launch new things. New yorks democratic attorney general has announced a multistate lawsuit to rollback the rollback, democratic senator ed markey of massachusetts is introducing legislation toward the end and liberal groups say this will be an issue in 2018. Bret thank you. The dow lost 77 to snap a fiveday winning streak today. S p 500 down 11. Nasdaq off 19. You have probably heard by now there are some major changes coming to the media landscape and to the fox organization. You may be wondering how this all affects fox news. Fox news media analyst and host of foxs media buzz howard kurtz has some answers tonight. The blockbuster deal between 20 for century fox and disney that shook up the news and entertainment world today involves two very different corporate cultures. Disney would buy most of foxes entertainment assets for 52 billion, with foxs edger offerings combined with disney. The Murdoch Family would hold on to a more tightly focused news and sports company, top rated fox news, fox business, the Fox Broadcast Network the local television stations and fox sports. Disney, whose film history ranges from snow white to frozen would acquire the 20th century fox movie studio. Which produced the original star wars as well as national geographic, fx, 22 Regional Sports channels, and foxs stake in hulu and sky news. Ruth Rupert Murdoch face the prospect of competing against hollywood and major giants like netflix and amazon. Thats why disney chairman bob iger wanted the fox properties. The watch television differently. We are seeing with the emergence of new companies. Silicon valley spending tens and tens of billions on entertainment programming. Ruppert has managed to assemble a Stellar Group of assets. We are getting high quality content, global reach. Murdoch says he insisted that iger stay on. Quashing media speculation that murdochs son might be headed to disney. The Justice Department must approve the deal on antitrust grounds. Murdochs son says its about returning to our roots. Rupert murdoch, who began a newspapers, has always been a news junkie above all. Bret thank you. Up next, whats behind the unprecedented housing crisis in california . Its more than just wildfires. So i just got off the phone with our allstate agent, and i know that we have accident forgiveness. So the incredibly minor accident that i had tonight four weeks without the car. Okay, yup. Good night. With accident forgiveness your rates wont go up just because of an accident. Switching to allstate is worth it. Bret containment numbers are increasing on whats the fourth largest wildfire in california history. At least 700 homes have been destroyed so far. This comes as the state faces an unprecedented housing crisis. National correspondent william la jeunesse explains in southern california. California and san diego as well has housing crisis. We cant provide housing to our citizens. For all its claims of being an economic paradise, california is a failure when it comes to affordable housing. The biggest tragedy of california is that we have stopped building housing for the middle income folks. After the cities of houston and dallas built more homes than the entire golden state, according to the National Homebuilders association. Right now californias building less than half the number of units necessary to meet demand. As a result, 70 of the state cannot afford to buy the house. These numbers help expand why. Median priced home here 458,000. More than twice the national price. In orange county, that number is 690,000. San francisco 1. 5 million. To buy a home in los angeles, a buyer needs 120,000 in income, twice as much as the average household actually has. Supply and demand works. People want to be here. We are not accommodating them with new housing. To the cost of housing goes up. Current residents dont want more traffic and environmentalists oppose growth. We started in 2010 on planning. Seven years later, trying to build new homes near san diego. A similar project nla battle environmental lawsuits were 20 years. These lawsuits are not won but it extends the time to do development. Time is money. With holmes hitting 600,000 for a starter, opponents face a backlash. It stands for yes in my backyard. This mom started a group to counter those who say not in my backyard. Our longterm growth and prosperity is fundamentally dependent upon having housing folks can afford. Economists predict another year of rising prices, interest rates, and taxes. In los angeles, william la jeunesse. Fox news. On a new york judge has sentenced two nephews of venezuelas first lady to 18 years in prison for their conviction on drug conspiracy charges. The men were convicted of conspiring to import more than 1700 pounds of cocaine. Prosecutor says the crime was egregious because the men wanted to raise money to keep their family and power. Next up, the panel on the original james comey memo concerning the Hillary Clinton email scandal. The russian leader weighs in on all things u. S. And the u. S. Talks tough on iran next. This is going to be an unusual statement. Im going to include more detail about our process and i ordinarily would because i think the American People deserve those details in a case of intense public interest. Second ive not coordinated this statement or review date in any way with the department of justice or any other part of the government. They do not know what im about to say. Although we did not find clear evidence that secretary clinton or her colleagues intended to violate laws governing classified information, theres evidence they were extremely careless in their a very sensitive, highly classified information. Bret we have seen that many times. James comey, then fbi director, laying out the case that he did not bring against Hillary ClintonHillary Clinton and why in a very unique way. Today in a letter from senator ron johnson to the fbi director chris ray, we see this. On may 6, Deputy DirectorAndrew Mccabe quoted the draft statement other senior fbi employees, including peter strzok. The original draft of director comeys remarks included a statement that could be read as a finding of criminality in secretary clintons handling of classified material. The edited statement deleted the reference to gross negligence, legal threshold for mishandling classified material. The original draft of director comey statement included a conclusion that it was reasonably likely that hostile actors had penetrated secretary clintons private server. Instead, the edited statements and it was possible those events occurred. Other things in that letter coming out late today. Lets bring the panel. Fox news senior judicial analyst judge andrew napolitano. Molly henley, Senior Editor at the federalist, tim farley, host and managing editor of morning briefing potus on sirius xm radio. I dont think it matters who edited it. James comey owns it. I dont get matters the ideological predilections of the editor. The person who signed it, the person delivered is responsible for it. If you ask a firstyear law student to define gross negligence, extreme carelessness. Attempting to pull the wool over the eyes of the wreck in public and for a while he succeeded. Many of us have argued for 18 months, since that came out, james comey was wrong on the facts, wrong on the law and profoundly wrong to make that decision and make it public as if it were made with finality. The job of the fbis doctor decide whom to prosecute but to present the evidence to professional prosecutors and the doj and let them make the decision. He took that away from them. Bret mollie, you know what critics say. This is all chum in the water, thrown out there to try to muddy the water of this russia investigation. There is so much to the story, so many details. Ultimately we are talking about whether you can trust the fbi to do a good job investigating people in politically sensitive constructs. Thats an issue not just with Hillary Clinton investigation but with the ongoing donald trump investigation. The statement, james comey, you showed him stating he had never coordinated what he was about to say. We also know from the letters that there was a great deal of coordination going on. That coordination and these edits, they all went in the same direction, the direction of making it so that Hillary Clinton was in less legal jeopardy than she wouldve been. Not just what weve already talked about with the language from gross negligence to extreme carelessness but downplaying the likelihood of foreign actors hacking into the system. This gets to the trust issue. If we can trust the fbi to do a good job, faithfully going after the laws we agree to hold two and we are seeing these problems with the russia investigation. Getting to the issue of, was the reason to believe there was treasonous collusion with russia or was it an entire Information Operation where the fbi was weaponizing operations and research to go after an incoming administration. Bret i think critics would say painting with too broad a brush about the fbi where there are a lot of good people fighting good battles is dangerous. This investigation showing that that there is some nugget that opens up another piece of the investigation. At the very least when james comey was saying was of misrepresentation the truth. Obviously people had consulted on editing. Im not sure who was, differing with the judge in one sense, its important to know who is editing because i would like to know the process. As catherine reported, we dont know who was responsible for the edits. Peter strzok was one but there may have been more. I wonder how much james comey knew about the exhibit a versus exhibit b. The deletions, whatever was taken out or how the language was change. I will say one of the things that struck me letter was the edits to downgrade the likelihood that hostile actors had penetrated secretary clintons private server. That to me is sort of like the idea of whether or not the investigation about russia and whether they responsible for the election, that right there is diverting attention away from a possible effect on the election. Also the removal of the word intelligence agencies. That leads one to realize there was a large operation going on or at least a concern. That downplayed it. I dont know if it was for security reasons but im concerned seen that and hearing the conversation that takes place now about what we thought happened in 2016. Bret today, Vladimir Putin came out and was asked about this investigation and donald trump. Everything is made up. Made up by people who oppose President Trump to deal delegitimize his work. It is done without understanding this damages politics. They suppress the resources of the elected president. It means they dont respect the voters who voted for him. Bret you talk to people privately here. They say no matter what is said publicly in support, that russia is very dangerous place for the u. S. That man is the most dangerous killer on the planet right now. Dangerous to the united states, eastern europe, western europe. This is the last person donald trump wants defending him. I dont know what the story was with a four hour press conference. Amy kellogg was in the front row and trying to ask a question and he wouldnt call on her. Sounds like he has something to hide. That is the genius of this. Either this is his coverup for having been part of the collusion or he saying something thats true, even though its coming from Vladimir Putin who is a very dangerous individual. There are issues about this entire narrative of collusion. Weve been added for over a year and we still dont have evidence of the trump donald trump working with russia to steal an election. Bret we dont know what we dont know. We dont know whats going to come of it. We havent seen leaks, havent seen evidence, havent seen anyone come to the microphone and tell us something other speculation and circumstantial talking, like adam schiff talks about. We have journalism going into this. Congressional inquiries, special prosecutor, everyones communications and we dont have evidence of the central theme which is a treasonous collusion with russia. At some point its worth asking whether the actual story is the narrative put out there to begin with and that there were leaks designed to support the narrative coming from highly placed obama intelligence officials. Thats also significant. We do have evidence of those things and those are things we need to Pay Attention to. The fbi and department of justice need to be more transparent about what they were doing. I remember when christmas time, the only russian we talked about was the nutcracker suite.
