Even that explanation didnt slow the drumbeat of obstruction of justice that began echoing through the halls of congress. The president knew he had lied to the fbi which means that when he talked to the fbi director and asked him effectively to drop the case, he knew that flynn had committed a federal crime. To me, its more serious coming from the attorney than it wouldve been coming directly from the president. The president took aim at the fbi after the revelation special Counsel Robert Mueller removed one of his principal investigators, peter strzok, for sending antitrump, prohibit a click and Text Messages. Strzok is a top counterintelligence investigator and helped lead the clinton email investigation. President trump tweeting report antitrump fbi agent led clinton email probe now it all starts to make sense the president lashed out at former fbi director james comey for good measure, tweeting after years of comey, with the phony and dishonest clinton investigation and more, running the fbi, its reputation is in tatters. Worst in history call me wasnt about that tweeting i want the American People to know this truth. The fbi is honest, strong and is and always will be independent. Clinton, the same month strzok is one of a dozen fbi officials who receive the dossier, the salacious and largely unverified allegations about mr. Trump and his associates that was bankrolled by the Clinton Campaign and the dnc and which the fbi may have used to launch a counterintelligence probe that encompassed fisa surveillance. July of this year, mueller learned strzok had sent a colleague Text Messages said to be critical of mr. Trump and removed him from the special counsel team. Prosecutors say manafort has been working on an oped essay with a colleague that prosecutors assessed to have ties to russian intelligence services. There was a lot of stonewalling. Do you think the chairman is going to be proceeding with contempt of congress . We want the documents about the drama. When you go to a floor fight on contempt of congress, its inherently political. We just want the information and access to the witnesses. With the department of justice or the bureau has a legitimate reason for withholding that information and the only legitimate reason i can think of is that its part of an ongoing probe, if thats what it is, they need to make it very clear. Otherwise they need to produce information, and if they dont, i dont want to go contempt. I want the information. Ill dont want the drama of a floor fight. If we have a floor fight, it will be because the department picked one. Bret there is an office of Inspector General investigation. Michael horowitz is the Inspector General. I talked to him over the weekend. Hes exactly what we want to think the fbis. Hes a referee, straight to her, ive known them for four years. Hes the one who uncovered these texts and i have full confidence that hes going to get to the bottom of it. Bret if strzok changed the language, as is being reported, in the clinton situation for director comey from grossly negligent troops from the careless, is that perhaps alone grounds to reopen the case . I dont think they need any grounds to reopen it. The fbi was picked by trump. That doj had was picked by trump. Rod rosenstein was picked by trump. The old actors are gone. They dont need a reason. There is no statute of limitations. They dont need permission to reopen something. I find it interesting the fbi change the words grossly negative and to extremely carel. Another reason we need to get this agent in an comey into understand Decision Making back in 2015. Bret take a listen, senator mark warner and dianne feinstein. This president has been obsessed with this investigation. Always saying theres nothing there, but each week, another shoe drops. Its an interesting legal argument. Bret Alan Dershowitz says you cant make the argument against the president. Other people point to nixon and clinton and the political cases made of impeachment. Where are you . To go i think the chief executive can obstruct justice. I disagree with professor dershowitz there. Its hard when you have plenary pardon power and you that chief executive and you can direct what is and not investigated. This is the same president who said he liked bill and Hillary Clinton and didnt want to see anything bad happen to them. Is that obstruction of justice . Are the democrats complaining he waited and tried to influence a decision with respect to them . I wish he would stay off twitter. I really do. I wish she would quit commenting on ongoing probes. The obstruction of justice, that started being discussed when comey had these memos he made. I have read them. They would be defense exhibit a in and obstruction of justice case, not prosecution exhibits. Defense. If comey felt obstructed, he did in a masterful job keeping it out of his memos. Bret how does the fbi go from assessing that flynn made a mistake to deliberately lying to the fbi. Something Michael Flynn agrees to, a plea agreement. Either they were wrong. He knows whether he was lying. It may be they thought he wasnt but he raised his hand and said i was. Or it may have been they said we are not going to investigate this other stuff but we need you to make a plea and you need to plea to making a false statement. When all you have is a false statement, you aint got much but thats usually the very bottom of the barrel of what you make people plead to. No prison Time Associated and you have made that witness incredible on credible. Either he knew he was lying in the bureau didnt or they have worked something out in lieu of other charges. Bret is this going to last a long time . I think the democrats wanted to last until the next election cycle. Its our job to do a thorough job and not let it be prolonged. I think Robert Mueller is our best hope for finding out what really happened. Congressional investigations dont have a reputation of being very good. Ive got friends on the other side, but the folks running the department of justice now arent the ones who ran it under president obama. These are trump people. So special counsel just means we either dont think you can do your job and the women and men we pay millions of dollars to to run the energy run the dojs are working to find someone not part of the doj and give them fbi agents and all, by the way the fbi has issues. I think its hard to build up there might be a case to be made but its worth considering the fbi was saying they didnt think it was a big deal. Bret thats the big question over the weekend. Here is Alan Dershowitz and his thoughts. There has never been a case in history where president has been charged with obstruction of justice for merely exercising his constitutional authority. That would cause a constitutional crisis in the United States. Im afraid i have to disagree with my friend on that. I think a president can be charged with obstruction. In fairness to alan and mr. Dowd, its a good faith question. Professors use this as a parlor game, whether a sitting president can be indicted, the meaning of emoluments. Hopefully he wont answer those questions but theyve become much more relevant. I think a president can be charged with obstruction but it really doesnt matter because of obstruction can be the basis of an abusive power charge. Bret thats a political process going through the house and adjudicated in the senate. We saw it with clinton and nixon. The thing is, its too early for that. Its painful to watch this, another generation of tweets go awry. Its like going to the doctor and saying it hurts when i do this and the doctor says stop doing that. Someone has to tell this white house stop doing that. Its causing a great deal of harm. And it is. They really did take care of this by saying this wasnt trumps words. Bret how big of an issue is this investigation into the antitrump texts and how much the Deputy Director for counterintelligence was tied into key moments like the interviewing of Hillary Clinton, interviewing Michael Flynn, changing of the words about the clinton email investigation. There is a strong case to be made that Law Enforcement and intelligence agencies have not inspired confidence. They were playing around with the dossier they had no business playing around with. Then they leaked it to legitimize an insane Conspiracy Theory. You james comey, Conspiracy Theory about collusion with russia. We have no reason to believe after a year of investigation. James comey privately saying donald trump wasnt investigation but publicly intimating he was. Its comparing it to the clinton email investigation where you had immunity handed out like candy.
