Unlawfully using illegal substances. This is the same gun case for which prosecutors elected not to charge hunter biden as part of a now defunct plea deal several weeks ago. Special counsel david weiss gave the green light to go ahead on charges and ultimately a grand jury approved charges against the son of the sitting president of the United States. Tonight, hunter biden facing two false statement counts, which are felonies, also a third count of possessing and owning a gun, another felony. According to the special counsels office, back in 2018, hunter biden lied on a federal form to purchase a gun in delaware when he said that he was not addicted to any Stimulant Narcotic Drug and any other controlled substance when, in fact, he knew that statement was false. The second charge is a false statement made for the person who worked for the gunshot in delaware. The third is owning the gun when he used unlawful substances. The charges, bret, could put him behind bars for 25 years if you total them all up. Swift reaction on capitol hill from House Oversight chairman james comer who says the Justice Department has plenty of other larger crimes to pin on hunter biden. List goes on and o you have never heard me say anything about gun charges. Again, thats the one crime that you committed that you cannot tie to joe biden. Democrats say todays indictment is nothing to celebrate. We shouldnt take delight in other peoples misfortunes but we have to have a rule of law. When people commit crimes, then the consequences follow. Both hunter biden and the doj hope to avoid this day when they met in court in delaware in july. The plea deal fell apart in a very public way, bret, when the government would not guarantee that hunter would be immune from any future prosecution. Hunters attorney abbe lowell took aim at the special counsel in a statement this afternoon to fox news he said in part hunter biden possessing an unloaded gun for 11 days was not a threat to Public Safety but a prosecutor with all the power imaginable, bending to political pressure presents a gray threat to our system of justice, end quote. This may not be the only indictment for Hunter Bidens Special Counsel Weiss indicated in an august court filing that those tax charges that were part of that failed Plea Deal Indictment where hunter lives in washington where he once lived. They have never connected anything to joe biden. So its not surprising that the Justice Department charges have nothing to do with the president. I think that shows that we still have an independent rule of law and nothing they have said has amounted to anything. Bret a lot of reaction today. Shannon, obviously, the hunter biden lawyers, abbe lowell in particular saying hey, wait a second, this is part of the deal we agreed to. Think that that fs still binding here. Yeah. And that has been the position that they are sticking to. They say this is something the parties were fully informed about. They had consent. They decided what they were going to do and they were going to move forward. Remember, back in july. The judge started asking questions about that and many other parts of what they had put together and never gave a blessing or signed off on this. So i would expect and philip can talk to this better than i can that as a Defense Attorney you are not going to allow anything to slip through your fingers that may be of possible help to your client. That seems to be their argument they are going to stick with now. There are some more things now looming with this indictment actually in place. And how far they want to go with that and what success they will have remains to be seen. Bret right. Philip, what about that to shannons point . She is exactly right. A good Defense Lawyer is going to try to do Everything Possible to get the very best possible result for their client. In this case the very first way to defend it, because you cannot defend it on the facts. The facts are clear. You are going to have to try to establish if you can that that Diversion Agreement was a binding contract; in other words, was it a quid pro quo, was it a meeting of the mind . Was it something that is enforceable just as a regular contract would be . And thats going to be a question, first off, for the federal judge who is going to be assigned this case. But, at the same time, guys, they are going to be trying to have a dialogue with weiss and his team. They are going to try to see if there is a plea bargain that can still bed had. Im a bit skeptical because we were told over the last couple of months the parties did try to revise some kind of a plea deal before we got to this point and they just came to logger heads. So it appears that we are either going to be headed to a trial or potentially a whole series of pretrial motions about the enforceability of that agreement. Bret philip, let me just follow on this, and that is people call for other things fara charges, other investigations, just dealing on these charges, its still very serious what he is facing, right . Oh, yeah. Is he looking at potentially up to 25 years, i think this is the lowest of the low hanging fruit. What remains to be seen is whether or not weiss is going to go for something a little bigger. Is he going to look into some alleged financial crimes. Things that might involve other people, perhaps even the president of the United States. But, this one is serious enough because it goes back to almost five years ago. A gun was found in a dumpster near a school. And if that doesnt create a dangerous situation i dont know what does it. Could have been a potential tragedy if the gun had gotten in the wrong hands near that school. We need to know why it took so long. Why did it take almost five years, right at the statute of the limitations to bring this case . Bret and the politics of this shannon are obviously all over the place. There are false statement purchase of a firearm. Thats 10 years if convicted. False statement information required by federal Firearms Dealer five years. Possession of a firearm by unlawful user because of drug use its 10 years. The hunter biden attorney, abbe lowell says this as expected prosecutors filed charges they deemed not warranted just six weeks ago following a five year investigation into this case the evidence in this matter has not changed in the last six weeks but lawsuit has and so has ultra maga republicans improper and partisan interference in this process and obviously republicans have a lot to say about all of that today. Lets bring in our panel, jason riley, Wall Street Journal columnist Senior Fellow at the manhattan institute. The fives cohost, Jessica Tarlov and tyler pager of the Washington Post. You look at this, jason, and what do you see in these charges . A lot of republicans say hey, listen, wheres the other part of this . Is it going to continue . Well, what i see is what we should have seen months ago when the biden team of lawyers is trying to strike a plea deal, which would have essentially made him immune to future prosecutions of his overseas dealings. And thats what we really want to know with respect to 2024 and joe bidens role in all of this. If in fact he has had a role. So he is sort of getting a Sweetheart Deal before. He is not any longer. Or so it seems. But an indictment is not a conviction, bret. We have to see how this plays out. Heres the problem Going Forward for the white house. You know, they want donald trump to be of the nominee. They want to run against him and claim that he is unfit for office because he is corrupt. Hunter biden keeps complicating that narrative for democrats and thats the real problem Going Forward with this indictment. Bret yeah, tyler, your thoughts on this and what it portends, maybe, for the inquiry now happening on capitol hill . Yeah, look, the white house was wellprepared for this indictment to come. Special counsel david weiss filed court papers earlier this Month Signaling that this was coming. But, obviously, the day that it lands is a different day at the white house. The president found out, was briefed by senior aides just before leaving the white house to give an economic speech in maryland and as you said House Republicans are hoping that this is just the tip of the iceberg, that this, you know, gives more momentum to their investigation into hunter biden as we heard from members of congress this particular has no link to joe biden. Republicans are trying, they have not provided evidence that joe biden benefited at all from Hunter Bidens business dealings, but i think this is part of a larger effort by republicans to really tie the president to his son and to some of his sons struggles with addiction and the like whether or not they are successful in doing so i think remains to be seen and Impeachment Inquiry as we know is just getting started. Bret yeah. And obviously comer and jordan have a long list of things that they tie directly to then vice President Biden and we will see where the money trail goes. Jessica, the New York Times opinion has 2024 field of nightmares. And Running Biden for reelection, democrats are making a fateful bet that the successful management can simply continue through two sets of risks. The high stakes of next election in which a Health Crisis just more slippage might be the thing that puts trump back in the white house. And the different, but also substantial stakes of another fouryear term. You add this to the other writeups. You add this to the the Washington Post and david ignatius. You add this to the new fox polls out tonight that shows President Biden losing not only to former President Trump but other candidates in the republican field who are trailing the former president by some 50 points, actually. But there you see the matchups if you are voting for president right now. How do you see that, jessica . Jessica well, its going to be close. As all elections are recent elections have been. That he was the exception and thats how democrats are running this election and cant take any vote for granted, especially when you look at the margins in 2020 and considering who it was that democrats were able to pick off from the republican side to win. Namely white suburban voters. Increase the gen z turnout and then also big increase in asianamerican voters. Its going to be tight. All the polls are within the margin of error which is where the exception is. Obviously some memo went out that there should be a lot of podesta and a lot of reporting this week about concerns over joe bidens age and i will point point out, nancy pelosi was interviewed yesterday about it. Hillary clinton was interviewed this morning about it. Jamie raskin was interviewed about it this afternoon. Hillary clinton was the only one who gave a full throttled defense of the entirety of the bidenharris ticket that is something that certainly is a sending a bit of a smoke signal up, at least to me as an analyst saying what is going on . Jamie raskin and nancy pelosi do know how to answer a straightforward question why did they not defend Vice President harris in the way that you would expect . Bret that was striking. I agree with you. Former House Speaker pelosi was asked, i think, three times about Kamala Harris as Vice President. It was weak. Jessica it was a dodge. Bret yeah are, saying its the president s choice. Jason, if you look at the g. O. P. Field. And i mentioned it here about the polls, our latest poll has the former president well up in the polls. If he is not in the race, Governor Desantis leads there you see the 60 . Over 13 ron desantis has gone down in this poll, if the former president is not had the race but is he in the race, desantis is at 33, Vivek Ramaswamy at 31 . Here is another one. Favorable opinion since the debate, donald trump has gone from 78 to 82 . He wasnt in the debate, jason. But his favorability has gone up and desantis has gone down. What do you make of this g. O. P. Race . Yeah. This is exactly what donald trump wanted. He wanted a crowded field. And that is what he has right now. You have people who have been in the race for months. Still polling in the mid to low Single Digits wont get out and let Republican Voters consolidate around a trump alternative. And so donald trump is benefiting from this as we would expect him to. And we will see if the people still running in the republican nomination have second thoughts about what they should do. But, right now, the crowded field is benefiting donald trump and that is what we saw in 2016, thats what we are seeing again. Bret all right.
