In need of drastic repair. The president will say that the state of our union is strong. The truth is, the state of the trump economy is failing americas middle class. The state of the Trump Health Care system is failing American Families t state of the Trump Administration is embroiled in chaos and incompetence. Shepard the speech will come in a battle over Border Security that led to the longest government shut down in america history. Nancy pelosi put the state of the union off and on hold in the stalemate. Eventually the president signed a temporary spending bill with mo money for a border wall. That bill runs out february 15. The president says he will declare a National Emergency if lawmakers dont come up with a deal for the wall. Tonight, Speaker Pelosi will be sitting behind President Trump. Some of the president s potential 2020 rivals will be sitting in front of him, including senators Elizabeth Warren, kamala harris, cory booker around kirsten gillibrand. Democrats have chosen Stacey Abrams to give the rebuttal speech to President Trump. We have team fox coverage. Mike emanuel reporting live from capitol hill. First, john roberts reporting live from the white house. Hi, john. Good afternoon. A big difference 2019 compared to 2018 compared to President Trump. Last year he had paul ryan and Mitch Mcconnell standing up and applauding. About everything the president said. Tonight he will have Mitch Mcconnell doing that but also the speaker of the house, nancy pelosi, who will likely sit on her hands most of the night. The president getting criticism from Chuck Schumer. The president tweeting back his response saying i see schumer is already criticizing my state of the union speech even though hes not seen it yet. Hes upset he didnt win the senate like he thought he would. The president will take an opportunity tonight to make a case for his Border Security and a border wall. The Conference Committee is city trying to hash out a deal. The border wall was one of the big tickets in last years state of the union and even offering up a path to citizenship for 1. 8 million dreamers. Now hes offering up three years of protection for 700,000 individuals. While schumer and nancy pelosi are adamantly opposed to any kind of a border barrier, some democrats are warming to the idea of some sort of barrier along the southern border if it is strategically placed in areas where the Border Patrol says its needed. Long to katie hill, Congress Woman from california with bill hemmer. I think we can come to an agreement that keeps the government open and addresses the major issues along the border. Im sure it will get me in trouble with some folks. We know its not that 2,000 mile concrete barrier, so im as long as its not that, im good. As long as its no a 2,000 mile concrete barrier, im good with that, which would indicate that shes a democrat that might support that and we understand from the white house there are other democrats that could support such a proposal. Were not sure at this point if theyre willing to go against nancy pelosi and Chuck Schumer. In addition to immigration, some of the other priorities that the president will be talking about tonight infrastructure, he also talked about that last year. Never got his money. Healthcare and drug pricing, still working on both of those. Trade, hes accomplished some things in the last year on trade. Still more to go. Deregulation, he will talk about as well. The president believes hes got a good story to tell about the economy. He can talk about 304,000 new jobs in january. Data that he would not have had the the state of the union went off as scheduled tuesday. Stock market is still high. Heres what Kellyanne Conway said earlier today. The president will get up and talk about the accomplishments as president. You cant deny them when you have an audience oneonone with the american people. Hes remade the judiciary. Were the number 1 exporter of oil and gas now. Hes helped unemployment get lower. Now, by their nature, these are bipartisan events. Both houses of congress, democrats and republicans in the same room. But they always turn out to be partisan as one side applauds and the other sits on their hands. Shepard thats been the course for quite a while. What to we know about the president s invited guests . As far as we know, theres 13. We dont know if they will add any to the list. 13 people will be sitting in the first ladys box. A lot are there as a result of some theme. We remember the north korean dissident last year and we had progress with north korea but they have not taken any steps towards denuclearization. Tonight, a sixth grader from wilmington dell way named joshua trump. Hes been bullied at his school because of his last night. So the president will be highlighting that tonight. Also, the daughter, granddaughter and great granddaughter of a couple murdered by an illegal immigrant last month. Matthew charles, the first person released from prison under the step act will be there. Timothy matson was a member of the Pittsburgh Police department swat team that nearly lost his life responding to the tree of light synagogue shooting along with a number of other people. Sounds like a good group that the first lady has in her box this year, shep. Shepard john, thank you. Lets go to capitol hill now. Mike emanuel is there. Hi, mike. Shep, good afternoon to you. Senate democratic leader Chuck Schumer said President Trump will be the warmup act for Stacey Abrams that is delivering the democratic response. Well see about that. Schumer says its abundantly clear, the Trump Administration has been failing the middle class. The state of our union is in need of drastic repair. For the last two years, the white house previewed addresses to congress. Each team they emphasized unity, bipartisanship, reaching across the aisle. The next morning, President Trump forgot all of that. A Key Senate Democrat says hes hoping the president will talk about a matter that could get broad bipartisan support. My hope is the president will talk about infrastructure, rebuilding our roads and bridges, aiding our veterans. Making sure that we have education that serves everyone. Others like massachusetts senator Elizabeth Warren says they would like to hear the president say hes going to keep the government open facing a deadline. Shep . Shepard mike emanuel live on capitol hill. Thank you. Jerry side is here with us and wrote a column about both parties taking a hard line on immigration. Fox news and the journal share common ownership. You make a market that the democrats have moved to the left on immigration. They have. Look at the democratic possession in the 90s and the clinton era. They were tough on Border Security. They talked about illegal immigration. The 1996 democratic part platform talked about steps that the Clinton Administration had taken after years of neglect to stop Movement Across the border. Said before that happened, immigrants were moving back and forth, crimes were being committed. It was trumplike language now. Now thats what you hear from the Republican Party. Ironically in the 90s there were a lot of republicans including jack kemp and bill benedict at the time that were making the opposite argument that immigration was good for the Republican Party and the immigration should not be harsh. Bad politics and have times changed. Shepard both parties say theyre for legal immigration. Both parties say theyre against illegal immigration. And a quote from president clinton, we cannot tolerate illegal immigration and we must stop it. The border of mexico has been underpatroled and drugs flowed freely and illegal immigration is rampant. 90 of the drugs come through ports of call where democrats want to spend more money. Illegal immigration has been outstepped. Theres significant differences between now and then. In a way, the entire immigration debate is about 20 years out of date. Were arguing about events that were the norm in the 1990s. Not really what is happening today. You said some of them. Most of till legal immigrants now that are new Illegal Immigrants came, got visas and overstayed them. Nobody is talking about that. If everybody talked about what is needed here is comprehensive immigration reform. Were arguing about a border wall which is a small part of the problem. The comprehensive fix is out there to be had. The two sides cant seem to get together and Start Talking in those terms. Most rationale people realize this is about the need to update the entire immigration system. Shepard that seems clear. The people realize theres a need up to grade the immigration situation and has been for years and years. Thats not what anybody in washington is talking about. The president says i want a wall. The democrats say you wont give him a wall. The republicans wouldnt give it to him and he wont get it now. We focus on things that are not even pertinent to the conversation. We have concerns about immigration, big picture immigration. What to do about dreamers, what to do about kids locked up and all they want to talk about is a wall that as long as theres democrats in charge wont happen. This is all futile. It is. Its worse than what you just described. The two parties are basically moving away from positions that they were willing to accept a few months ago. President trump now will not take the level of funding for the wall or Border Security that he seemed willing to take last fall and democrats now having won back control of the house and won a government shut down are going to offer the same amount of money that they seemed to offer up a few months ago. What you have both sides driving the other away from the middle. Theres a polarization that is happening as the republicans move in one direction and President Trump on the wall and democrats move in equal and opposite form in the opposite direction. The middle is left pretty vacant. Shepard i want a wall. You cant have one. Where is the middle . Before you go, the decision by the democrats to have as their counter tonight, Stacey Abrams of georgia. Your thoughts. This is a statement about where the Democratic Party is. This is a party more cognizant of racial diversity, more cognizant of the role of women and more interested in making inroads in the south. In 2018, they got close in georgia and texas. Places they never used to win. Stacey abrams stands for those things. Thats why she almost the perfect voice to be responding. Shepard thanks, jerry. Ruth Bader Ginsberg made her first public appearance since her cancer surgery. She went to a concert that her daughterinlaw held for her last night. Justice beginser is had surgery for lung cancer and been recovering at home in washington. Shes missed all of last months court arguments. Shepard the government of the state of virginia is dysfunctional and the state of its leadership is uncertain. The democratic governor refusing to resign after a racist photo from his medical School Year Book appears. And the Lieutenant Governor is facing charges of his own. The accuser has not made a Public Statement on the matter and editors at fox news have decided we will not be identifying her. As for governor northam, we have neither heard or seen him since saturday. He initially apologized for the photo admitting that he was indeed one of the men in the two in the photograph, either the one in the black face or the one in the klan robes and hood. He was not specific. But then the governor changed his story saying hes not one of the people in that photo while at the same time admitting to appearing in black face in the same year and indicating he had done so prior. Most democrats in virginia and across the nation are demanding the governor resign. The governor is asking for more time, clinging to power with limited support. Garrett tenney reporting live from richmond. Shep, as you mentioned, we have not heard publicly from the governor since saturday. Behind the scenes, hes opinion pleading his case to his fellow democrats asking for time and for a chance to clear his name and to stay on as governor. Its notable that his entire cabinet remains intact and nobody has abandoned him there. Today its also interesting that it was a republican who became one of the few people to come out publicly in support of governor northam. State senator Richard Stewart said in a statement, no matter the voracity of the photo, a man that devoted his life to the service of others should have an opportunity to clear his name. To be clear, theres a mountain of pressure urging the governor to step aside and allow someone else to help the state heal. Shep . Shepard on the other side, the Lieutenant Governor, the accuser of the Lieutenant Governor has legal representation. Yeah, shep. Its not just any legal representation. She has hired the same law firm that represented dr. Blase ford. Theyre very familiar with these high stakes politicses and accusations. Theyre discussing what steps to take next as they go forward. Youll remember the Lieutenant Governor said that he plans to take legal action against those that are pedalling these allegations in his wards. Hes strongly denied the accusations. He does say he did have a relationship with this woman 15 years ago but it was a consensual relationship and there was never any assault and that the timing of these allegations coming forward now is no coincidence. Theres a lot of attention on it a and the possibility of my being el investigated from the Lieutenant Governorship to governor. Theres people that will come out and smear you and attempt to attack your character. I am totally comfortable in my own skin. Im told that the accusers legal team does plan to release an update later today on what their plans are Going Forward and possibly more details of the accusations against the Lieutenant Governor. Again, this happened in august a chav chavez ravine. Were hearing about it now. Trace . This is the first year that all 30 teams had protective netting. That is after a toddler got hit by a foul ball in 2017. An usher came running down to ask if she was okay. When she said no, emts rushed her to the hospital where she died three days later. At the time the family released a statement saying while the end came suddenly by a foul ball at Dodger Stadium, she had a long, beautiful and blessed life. The Dodgers Organization did not say anything until now releasing this. But neither the dodgers nor the family will explain how the matter was resolved. Linda goldbloom was at the game with her husband to celebrate her recent 79th birthday and their 59th wedding anniversary. General in the middle east testified on capitol hill that the fight against isis not over and warned lawmakers the terror group could make a comeback if the United States fails to keep up the pressure. National security correspondent Jennifer Griffin live at the pentagon. You reported in december that. Trump caught the commander off guard when he announced he was pulling troops out of syria. Thats right, shep. Tonight general votel admitted that he was caught off guard by the president. General, were you aware of the president s intention to order withdrawal of our troops before it was publicly announced . I was not aware of the specific announcement. Certainly were aware that he had expressed a desire and intent to depart iraq syria. So you werent consulted before that decision was announced . I was not. General votel warned lawmakers the fight against isis is not over. We should expect them to attack us and continue to regenerate themselves and we will continue to put pressure on them to prevent that. They have the capability of coming back together if we dont. He agreed with a new pentagon i. G. Report which warns absence sustained pressure, isis could likely resurge in syria in 6 to 12 months and regain limited territory. General votel was asked about the president s reaction to his intelligence chief contradicting him saying iran is in compliance with the nuclear deal. Are you aware of a single u. S. Intelligence official of any position that has told President Trump that iran is a kindergarten . No, senator. Im not aware of that. Trump as said as much in his interview with face the nation before the super bowl. Shep . Shepard what did the general have to say about withdrawing troops from afghanistan . He characterized talk of pulling out of afghanistan and talk of a frame work for a peace deal with the taliban as being in its early stages. General votel said the u. S. Would need to pay 4 billion a year to support afghan forces. Certainly would need to be continued support to the afghan forces. The amounts certainly we would have to look at. Yes, that is accurate, senator. Added that without u. S. Troops on the ground in afghanistan, overseeing that u. S. Taxpayer investment, theres concerns that money would be syphoned off, shep. Shepard Jennifer Griffin live at the pentagon. Federal prosecutors issuing subpoenas to President Trumps inaugural committee which raised a recordbreaking 107 million. Last year the u. S. Attorneys office in manhattan opened a criminal investigation into how the committee raised and spent that money. Now hour corporate cousins at the wall street journal are reporting that prosecutors are asking for documents related to donors and benefits that they got and whether foreigners donated. Contributions by foreigners are illegal unless they use american citizens as agents. Catherine herridge reporting live in washington. Shep a spokesperson for the president ial inaugural committee issued a brief state to reporters about new york prosecutors seeking a request for records. They said we just received a subpoena for documents. It states while were restill reviewing the subpoena, its our intention to cooperate. The wall street journal first reported on the subpoena and prosecutors are seeking documents related to the committee donors and vendors and any benefits that may have been received after making their contributions. Another key investigative threat is whether donors were made through nationals or a proxy. The committee raised 107 million for events. And based on the research, theres two main issues here. The significant increased in money raised contrasted with other inaugurals and the size of that event. We could not find a recent formal investigation into a inaugural committee with a similar scope though its worth noting in the late 90s with the prospect of a congressional investigation, that inaugural committee released a list of their donors, shep. Shepard how does this fit into the big picture . Based on our reporting, this was investigation sparked out of the Michael Cohen case. It shows the depth and breath of congressional probes that have grown out of the russian interference allegations. The president s former attorney plead guilty about a trump tower real estate project and what is significant there, those charges were brought by the special counsel and by the new york prosecutor for violating election laws. Jurors are deliberating in the trial of the worlds most notorious drug lord. Prosecutors say that el chapo as we know him is responsible for smuggling tons of cocaine in the United States and slaughtering rival cartel members. Defense attorneys said hes been framed. Former prosecutor bob bianchi is joining us here. Wildly exaggerated. Yes, shep. I put together what i used to do when i tried to prove a drug conspiracy or leader of organized narcotics. You look for witnesses, wiretaps, pictures, videos, accounting records, bribes, payoffs and drugs themselves. And flight when a person is trying to avoid law enforcement. All of that came in in this case. The u. S. Attorneys did a tremendous job by putting cooperating witnesses on and the defense says its exaggerated and theyre just trying to help themselves get out of their own trouble. Not when you have actual audio tapes from the defendants making massive drug deals and all the other evidence put together saying you can believe these guys because we have other evidence that is independent that corroborates their testimony. A strong case for the government. Shepard you think theyre about to convict him . Theres a lot of charges here. Yes, they are. But will they have wobbliness with regards to one or two charges, this is multiple pages of questions that they have to go through, multiple counts. Maybe he avoids or escapes one or two of them. I cant see with the overwhelming evidence that you can escape all of it. Theyve had a couple jury questions that have come back. Some of it is the requirement of reading the testimony of major government witnesses that worked with el chapo in his organization and they want all of the testimony read back. Thats not unusual to happen, but it says there may be one or two jurors that are little hesitant at this point in time and lets listen to this. After you listen to them, you tell me hes innocent. I they thats whats going on right now. Shepard what was the level of concern that el chapo and his hundreds of millions might be an to influence this panel . A great question, shep. In my mind, that would be the number one thing that id be concern with as a prosecutor and have been concerned with a prosecutor with a high profile person and was involved in a case where a juror was gotten to. That is two questions that i have. Will a juror be afraid to convict because of the danger associated with it or has somebody gotten to a juror .
