One thing for certain, tonights address by the president nor the joint democratic response is going to solve the problem of the Government Shutdown or what to do about Border Security, it will be an exercise in staking out competing positions. That actually happened on sunday when sarah sanders, the press secretary appeared with Chris Wallace on fox news sunday, stating that custom protection and government authorities apprehended 4,000 terrorists or people with ties to terrorism, i believe it was fiscal year 2017 was the time frame. That number, the 3,755, that number were told by dhs is real. What is not correct is that they were all apprehended or prevented, i should say, at the southern border. Its a number of different ports of entry. As you know customs and Border Patrol is at the airports. Apparently airports, ports, the border other ports of entry. That is the clarification. Heres what dhs said in a Statement Released late yesterday. Overall we stop on average 10 individuals on the terror watch list every day from traveling to or entering the United States. And more than 3,700 in fiscal year 2017. Heres a key point. Most of these individuals are trying to enter the u. S. By air, not the southern border, but we must also be focused on stopping those who try to get in by land. As recently as 2015, secretary clinton boasted, quote, i voted numerous times to spend money to build a barrier to try to prevent Illegal Immigrants from coming in, Hillary Clinton. Well, mr. President , obviously that was then and today the new speaker of the house is trying to argue that a physical barrier is, quote, immoral. Immoral . Today my friend the Democratic Leaders proposing to add a Senate Shutdown to the partial federal Government Shutdown and block even more of the peoples business, all, all to avoid more of what he already voted for. Maybe the Democratic Party was for secure borders before they were against them. Or maybe theyre just making it up as they go along. Maybe they are dead set on opposing this particular president on any issue for any reason, just for the sake of opposing him. Now, look, walls and barriers are not immoral. How silly. Enforcing our laws wasnt immoral back in 2006 when thennor clinton and thensenator obamand the democratic leader were proud, proud to vote for physical barriers. The only things that have changed between then and now are the political winds and of course the occupant of the white house. So this is no newfound, principled objection. Its just political spite. A partisan tantrum being prioritized over the public interest. So for more than two weeks they have indulged in that partisan tantrum rather than good faith border funding, hardly something that should be a partisan subject in the first place. They put that partisan tantrum ahead of keeping a quarter of the government open. And now theyre saying their par day san tantrum is more urgent than pressing legislation that concerns our lives with israel and the syrian civil war. Look, mr. President , i hope that isnt the case. I hope that or democratic colleagues dont pile on even more pointless obstruction. I hope they dont block the senate from turning to the important legislation, legislation by the way that they support. Well find out later today. You have got also senators from states that have huge federal employee populations, who are having their workers furloughed, all fired up, saying theres no need for. This House Democrats are going to put a variety of funding bills on the floor that has no to do with Border Security, hoping republican members will say, well, i have to vote for, this im in favor of funding the irs during tax season and other nonrelated Border Security ish oos. In order for republicans to continue and have really leverage in negotiations they need a broader section of the population. And so he is trying to bring in sort of those moderate republicans, those independents, and you said congress is not movable, i believe democrats are not movable. The white house does run the risk of losing moderate republicans in congress on this. Part of this speech is also to rally up republican support and say this is the right thing. Shepard does that risk come from a constituency from those individuals, when they stop getting paychecks or feeling the effects of the Government Shutdown, might put pressure on the representatives who might feel pressure to break with the president . Absolutely. Government employees are not just democrats, right . Some of these senators, represent states where theyre government employees, constituents, for house members, are government employees. Like you pointed out earlier, paychecks for some of these people will not come on friday. Thats a really big deal. Republicans in the white house are trying to basically move people away from the stories about people not getting their paychecks, not being able to pay for necessities. Shepard have republicans identified any leverage that the president might have in this argument . Not so much so far. I mean they are hammering down the point mcconnell made that, democrats have voted for this before. We have seen the president move away from that concrete wall he campaigned on to the steel slats, which is closer to the fencing, some of the democrats voted for over a decade ago. But right now, theyre kind of just waiting to see what the president does. Thats according to a new court filing for manaforts lawyers. It appears they just forgot, apparently, to redact some of the information. They also say hes suffering from anxiety and depression behind bars. The filing is a response to Robert Muellers accusation that manafort lied to investigators. Good afternoon much the lawyers for Paul Manafort filed a response to allegation he is lied to special counsel investigators therefore violating his plea agreement. We have obtained a redacted version of the filing. Manaforts lawyers reporting that their client is suffering from depression, anxiety, and using a wheelchair at times. His lawyers say prison conditions have weighed heavily on his state of mind and memory and their client did not intentionally make false statements. This is the second body to turn up there in less i should say in the last year and a half. Deputies responded to the West Hollywood apartment of ed buck after getting a report somebody had stopped breathing. Last year, a different man died of a drug overdoze there. Officials havent arrested become or accused him of any crime. A lawyer for the wealthy fundraiser claims this man who died this week had been partying and taking substances before coming to this apartment and was acting very strangely. And investigators will carefully examine all of the evidence. We are just about 24 hours, now, since the body of the as yet unnamed man was removed from the apartment in West Hollywood. Shepard what more do we know about the previous death in 2017 . Well, that involved a 26yearold man, his name was jamel moore. Now, he died of a meth overdose, he was found naked on a mattress in bucks living room. He was a selfcon fus fessed drug addict, he wrote a journal. In one of the last entries, he said, quote, if it didnt hurt so bad id kill myself. But ill let ed buck do it for now. Community activists protested outside his home, linking the death of moore with this new death and calling buck a danger to the community. Listen here. This man is a danger to our community. Critics say theres no emergency and that its only a ploy to get around congress. Just this morning he was asked point blank do you expect President Trump to declare a National Emergency during his prime time address tonight. Heres how he answered. Well, i expect the president will do tonight, is explain to the American People that we have a who man tearian and security crisis humanitarian and security crisis at our southern border. He didnt rule it out. But democrats are already vowing to fight this in court and in congress if President Trump does decide to declare a National Emergency tonight, or at any other point in an effort to try to end the shutdown. Shepard Kristin Fisher live, thank you. Lets get the legalese of this, bob bianci, is an attorney, former prosecutors. Emergency . National emergency . Humanitarian crisis . Democrats say theres no evidence. But if he declares an emergency the courts will decide, is this how it works . Eventually itll get filed with the courtship. The congress has given so much power to the president to act in terms of a National Security crisis, under the law. Thats really not defined. There are about 100 laws that allow him to take funds not dedicated in various areas and use them for protection of the border, protection against drug smugglers, allows the army and secretary of defense and secretary the army to build projects that were supposed to be dedicated for here. But if its a National Emergency they can use the money for over here. Thats what the trump team is going to do. I found it very curious, all of a sudden we started getting away from the idea of concrete walls and started calling them slats and fences. Thats parroting language in some of the laws that give the President Authority to be able to move that money around. Drug smugglers and gangs and Human Trafficking and terrorists theyre creating the reason why he can say its a National Emergency. Of course those on the other side are going to say wait a minute, this is purely a political thing, youre trying to fulfill a Campaign Promise, those things are not enough. Shepard the Campaign Promise was the mexicans would pay for it. Fair enough. But theyre going to be arguing that you could not use these lawsnd these powers, youre using them as a mask, a smoke screen to get through the backdoor what you cant do through the front door. Thats where the Court Challenge will be. Shepard in court you have to have standing to challenge, who would have standing . When you talk about shifting money for projects that have already been dedicated, perhaps, to contractors or money thats not going to the police where it was place where it was originally designed, moved over to building a wall, those people could have standing. People whose property would be affected could have standing. It will be a real issue, whether the congress has standing. Typically speaking they dont have standing in these scenarios. But i am certain, i am assured they will find somebody that has the standing to file the suit to get it before the court. Shepard the government is shut down, portions of the government are shut down in the interim. This a process that could move along quickly, something that might be drawn out . I think its going to move quickly. What this act shepard predicated on we dont know if he will do this. We know he has said he may. Were talking about the possibilities if he does. The National Emergency means we have an emergency, a crisis. I need to act with dispatch. Of course, the other side is going to say you had two years to do that with an all Republican Congress and you didnt do it, thats just the smoke screen, a false use of that act. But thats what hes going to do, move quickly. I think the courts are going to hear it quickly. To me politically, it makes perfect sense. I expect to hear a date certain, if you dont do it, im going to invoke my president as National Emergency act and under a sub act that allow meese to move funds around to build the border wall to protect our country, its a National Security interest. Then if i get that, if do i that, hes going to release the shutdown. Now he looks like a hero to his base, hes taking aggressive action. He opens up government. Now the courts can decide.
