And north korea is joining the pileon. The governmentrun media is comparing the cias interrogation tactics to the killings of unarmed black men by police in ferguson, missouri, and here in new york city, and no, you no wrongdoing was found on the part of the officers as grand jury did not a indict them. Of course in north korea, police kill citizens on a whim. Millions of people are starving and thousands work in forced labor camps. The report from the Senate Democrats outlines the cias enhanced Interrogation Program in the years following the 9 11 attacks, describing waterboarding and sleep deprivation, detainees slam against walls and stuffed inside boxes the size of coffins. Katherine herridge has the news in washington. The new Global Response and what is the response inside d. C. The cia directors a seesment that interrogation led to intelligence of Osama Bin Laden has clearly struck a nerve. It was information obtained scent to the application of eits from detainees that was useful in the bin laden operation. The democratled Senate Report found the opposite with senator Diane Feinsteins office live tweeting their rebuttal to the news conference, including critical intelligence that led to bin laden was unrelated to eits, that is short hand for thens hansed interrogation tactics. And another more forceful rebuttal. Study definitively approves eits did not lead to Osama Bin Laden and the lawyer for one of detainees, who was part of the cia program, amare belushi, has said his client has forth given his interrogators and does not hold a grudge because he saw the suffering that they went through as well as part of that program, and he is important because he is said to be the person who first tied the courier who lived with bin laden at the hideout. Thats a new detail. It brings me to the question, where are the supporters of the cia on this . Well, as you know, harris, the cia director yesterday offered a more nuanced assessment of the program and the connection between the waterboarding of al qaeda operatives and the information that they provided. But a former cia officer who has firsthand knowledge of the program told fox news that the architect of 9 11 produced more than 2,000 intelligence reports while in cia custody and he became in effect a walking encyclopedia of al qaeda history, and today the outgoing chairman of the House Republican intelligence commitee weighed in on the position. The toe say its unknowable, we know there was certainly the events that happened and information that was gleaned that was later used in everything from fully understanding and being able to put pressure on al qaeda, to certainly the hope at cia after director brennans comments was that would effectively put the discussion to bed, but based on the guests on the sunday talk shows this seems unlikely and the story will run at least for another week, harris. You know, bottom line first of all, people im talking with say theyre very concerned with National Security after the release of this report. We havent heard any new information yet with regard to that. Where do we stand on that . Well, there are two aspects of this. First of all, as reported, china is tweaking us about it, north korea is tweaking us about it. It is kind of interesting coming from them as defenders of human rights, but thats no big deal. You always expect that when they hear the kind of discussion in the United States that you could not hear in their countries, theyre going to take advantage of and it say this shows the u. S. Shouldnt be preaching. Much more dangerous and more worrisome is the concern in the Intelligence Community, also secretary of state kerry, who before the report was released, spoke to the chairwoman, dianne feinstein, that this may lead or inspire new attacks, retaliation, because of the actions we took against some of these terror suspects and also the possibility and this we may never know whether or not some of the informers, the agents we had on the ground, our assets, were even though they were given pseudonyms in the report, whether people can identify them and whether they will suddenly disappear. Being able to triangulate descriptions of places and things, trying to figure out who was in the room. I get that. That brings up Something Else about people who were actually there. This back and forth about whether or not we really learned anything from the interrogations, interesting, because as i understand this report does not talk to anybody, not interview one person, single person, who hullly did the interrogations. Is that true . That is entirely true. They did solely from documents. They didnt talk to anybody. And i have to say i think this is one of the weakest parts of the report, because the claim they made when it was pointed out there were three directors of the cia during this period of time, three deputy directors, not only werent the interrogators interviewed, even the top guys testifying before congress, none of them were interviewed by the staff for this report. The argument that was made is, well, there was a Justice Department investigation going on and we didnt want to interfere with that. The problem with that is that the Justice Department investigation ended in 2012, when the decision was made by attorney general holder that they would not prosecute anybody. This report was just released in 2014. They had two years when there was no Justice Department investigation to interview cia officials. They didnt do so. Interesting. And of course, theres been a whole lot of talk about the timing of this and the politics. I want to get to this, though. I wonder, what is the takeaway for just regular americans . I dont know, my dad, who served, and other military vets, military personnel around the world, who are watching this dire discussion about how we protect the rest of us go down. Well, look. I dont think its a bad conversation to have about what limits should there be to the kind of interrogation we do. Whether you can argue whether legally or not but this certainly goes up to the edge of torture, some people say it was. Reasonable people can disagree. It did have Legal Backing from the Justice Department. Thats a sensible conversation to have. Concern that people in the Intelligence Community and who are making the key decisions at the time is this seems to be secondguessing, 2020 hindsight from the vantage opinion of 2014 when were feeling less scared about al qaeda, about decisions being made when we were scared to death about al qaeda in the immediate aftermath of 9 11. In 2001, and are we throwing people who were doing simply following orders and doing their best to defend and protect the country, are we throwing them under the bus . That i think is the greater concern. Thats so well put, and of course you have the sense that nothing on that mass scale has happened since 9 11. You have that as part of the conversation, too. The man accused of murdering an Exchange Student in his garage says he was protecting his family from burglars. I think everybody would say if somebody is on your property in your home, you have certain rights to protect you and your family. Exactly. Youre exactly right. Theres a castle doctrine. If someone comes into your home and you fear theres imminent harm to you or your family you can use deadly force. But theres some challenges. One, its a 17yearold. The prosecutors really feel that kaarma entrapped the 17yearold to come on his property and then the location where he was shot in the garage north inside the house. So, generally most houses have a barrier from the garage to the home. Was the door leading from the garage into the home locked . Why couldnt he have just called the police then . Why do prosecutors feel like they have a case in all of this . If what youre telling me is set a trap, whatever, still the 17yearold had to go into that place. Exactly. But one of the things the Prosecutor Says he may have created the situation so that you can then go in and have the sort of game. Witnesses say that kaarma says, i see you there, and started shooting at him. So theyre also challenges to say, why didnt you call Law Enforcement . Law enforcement would have been there a few minutes. Youre already in your home. If he had been if the 17yearold had been attempting to get into your home, its more logical you would take deadly force. A couple of things coming to right as the trial is going on. The family hosting the german Exchange Student has spoken about what a great young kid he was. Friends described wonderful things about him. They also have a phone call that was recorded while kaarma was in custody, made to his commonlaw wife. On the call, he said, everyone should rejoice that our neighborhood is safer, expletive. Idiots, he added. And then theres some other things in that call. What catches your eye in all of this and what can be used in court. All of it can be used in court if they feel he somehow acknowledged that he knew this kid may have been unarnold and wasnt in fear. The fact you have the calling them fing idiots, you have to start to question. This isnt a joke. A 17yearold died here, and even if there doesnt anything that is specifically implicates him in the crime, its the type of callousness that the prosecutors want to demonstrate. One more line from the taped opinion call that he says. Quote, see the leaks on the faces when i say homocide. He is telling his wife what the other people are saying. There are no other murders in here. Hes proud of being a murderer . Almost sounds like that. Theyre fearing me now. You can almost see him pounding his chest and saying, im a murder irer now. Theres no badge of courage for that. Isnt it hard to prove what is in a mans heart . Thats a great point and thats where the defense can step in and say you have no idea what he truly felt. I he reasonably believed his family or he was in fear of imminent harm or death, he could then use deadly force. Thats the biggest challenge for the prosecutor. Where do you think this is going . I think its a reminder to all of us of who isis is. They respect no limits. They reject the other. Theyre trying to obviously secure the scene of a School Shooting but also deal with the many parents who want to know what happened there.
