Its not one unanimous verdict where the hands were. What it has become is a symbol, i think, of people who are concerned about the fact that police, in this case can go about their duties and protect the people but in some cases behave excessively in their judgment and not face any sanction as a result. You know, everything fits with his account. Michael browns blood is inside his police car. He said brown was struggling to get his weapon. If youre a Police Officer, thats the thing youre supposed to do is prevent an assailant from grabbing your gun. Theres no doubt about that. You remember theres a very High Standard for a grand jury. They have to have more than 50 probability in saying to the government we think that this person is guilty of a crime and the government can prove in court that this would take place. I think because of the publicity there is a desire for transparency. I think people wish they had a trial, wish they could have seen the evidence, seen the testimony, allowed officer wilson to be cross examined. It wouldnt have been his account on his own. I think all of that is fair and legitimate but, again, this is the system. There are questions about the prosecutors, Robert Mcculloch that i mentioned earlier. Why did he decide to do the grand jury in this way, put all the evidence in front of them rather than simply ask for a basic indictment that would allow for a trial . Why did he announce the decision at 9 00 at night . That was a really interesting one to me. Yeah. But, you know, taking the converse point of view, if youre going to put a bunch of witnesses, you know, in public court in a very controversial case where people have been threatened, you know, a lot of people arent going to want to talk. Theyre not going to want to go outside. Thats fine. This is what happened in the Trayvon Martin case. Weve seen this time and again. I think its just so essential given our way of government, way of life, our belief in the law and the constitution that people be called and in all honesty i dont think, i agree with you on this, i dont think they would have gotten a conviction against wilson. The American People want Law Enforcement in their community. They will give them leeway in order to protect us and to pursue their duties as Law Enforcement, but i do think transparency and accountability especially when theres such a low level of trust in that community between the police and the black community is essential. We spent most of the year at walter reed rehabbing and then us with a team of other green berets came together and said, weve got to do something about this. You know, green berets, heres what they are, theyre really awesome but theyre really bad at asking for support. Thats where i said im going to do something and work with this team to put something in place. And so what can a green beret or his family who might be injured in the line of duty, what can they get from the Green Beret Foundation . We take a comprehensive approach to our care. When we have someone that is brought to our attention that needs support, generally it doesnt come from the green beret, it comes through the groups, the active groups, the wives. The wives play an integral, very Important Role in the green berets lives and their success. We do anything from first casual at this care when the guys come in wounded, second extended care. These injuries are very traumatic at times. Poly trauma injuries and it takes years to rehab. We support our gold star families of course always keeping them close to us. Yeah, it is said that these highly trained soldiers get all kinds of information on how to do their jobs when theyre in the military, but once they either choose to leave or have to leave because of injuries, the government doesnt necessarily do a good job at helping them make the transition. That is accurate. And instead of trying to turn a steamship, which is our military, and thats fine, theyre doing their job, we have decided that its our job. An elderly couple in chicago now suing a Cargo Company after a plane last week crashed into their house. Reportedly missed hitting them by eight inches. They are not hurt but they say they have suffered emotional trauma. Do they have a legal case . Well take it up with the lawyer next. Just into the fox newsroom, a new york man arrested after the Transportation Security Administration reports it found a huge stash of weapons in his checked bags at jfk. Those include two crossbows, two starter pistols, two b. B. Guns including a bb rifle, stun gun, handcuffs and several arrows. The guy now faces weapons charges. Not a smart thing to do on the busiest travel day of the year. Well, the elderly couple who slept as a plane crashed through their home are now suing the cargo airline. Their Attorney Says they have severe emotional distress. It happened near chicagos Midway Airport last week. The pilot of a small cargo plane reported engine trouble, tried to get back to the airport but he ended up crashing into their home about a quarter of a mile away from the runway. The pilot died in the crash. The investigators say that small plane tore through the couples living room and ended up about eight inches from where they were sleeping. Their lawyer says his clients were not hurt but they have devastating emotional trauma. We reached out to central airlines. It had no comment on the lawsuit. Lets talk to criminal defense Attorney Rebecca legrand. She joins us now. Rebecca, does this couple have a case . Reporter it certainly looks like they do. All they need to do is show negligent against on behalf of the pilot or the airline and they were harmed. Emotional harm can be harder to prove but here when you have a plane eight inches from you in bed, that will be pretty easy to show. What about negligence. I know a little bit about flying. If your engine goes out on takeoff, thats what happened, it can be really difficult to get back to the airport like this guy apparently tried to do. Is that neck againsgligence . Absolutely. Thats when this case will involve. There hasnt been a report on the cause of the accident so we dont know but its pretty easy to assume that youre going to see negligence somewhere along the line. If it was something the pilot couldnt respond to, it may have been, was there a mistake maintenance . Was there a mistake in taking care of the engine . Things like that can lead to the same result for the homeowners. The fact that the couple is in their 80s, 82, 84, does that help make their case . Does a jury or maybe a judge give them more sympathy because theyre octogenarians . Thats absolutely possible. The story they have to tell is it scared them, scared them so deeply that its causing them ongoing harm. For an elderly couple, i dont think that will be hard to do. Is this a case where an insurer would rather pay up quickly rather than having a court case and have the testimony . Youve got to think so. I would assume that this is a case a that settles and theres a payment early on. It depends. If there is no negligence here and they think they can prove it, then it may go to trial or go farther in the process. I was frankly surprised that there wasnt a postcrash fire. The plane ended up largely intact and, you know, the fact is had there been a fire, this couple most likely wouldnt be alive at all. Oh, yeah. Its a miracle that they got out of this as well as they did, but you can understand why theyre still very upset. So, they have filed now. Again, is the is the insurer for the airline likely to just, you know, try to settle something, write a check, or is this the kind of case that you put before a jury and a judge . You know, you never know but ive got to think that this is a case that will likely settle. It depends on the facts. If there is no negligence and the airline and the carrier think they can prove it, youve got to try it. Thats the Million Dollar question. The pilot is the only person on board. Hes dead. He cannot tell the story. He did try to get back to the airport. Only had one engine working. Who decides . Ultimately the jury and the jury would hear from experts, experts in aviation, in airline maintenance, in flying about what the duty was on the pilot in a situation like this and what the duties were on the owner of the plane to take care of it and maintain the engines.
