This is typically a routine process which the board was just comprised of two democrats and to go republicans but there are indications that at least one of the republican Board Members may vote against certification. Last week that board member told the Washington Post it is his responsibility to get to the bottom of any allegations of improprieties in the voting process, saying i do think with all the potential problems, if any of them are true and odd it is appropriate. If we get more information, why not . This weekend, the state and National Republican parties also called on the board to delay the certification for two weeks. However, state law does not allow for audits to be conducted until after the Election Results have been certified. This weekend michigan, secretary of state said she expects the board to fulfill their duty. The law is very clear and the rules under the law are very clear, there is no Legal Authority under state law to do anything other than confirm the Election Results. Both republicans on the board would need to vote against certification for this process to be delayed. If that happens a case would likely go to the state court of appeals and potentially the state supreme court, both of which are expected to demand that the board fulfill their duty to certify the results. At the same time the governor also has the power to replace any of the Board Members if they fail to fulfill their duty so at this point any effort to not certify the election result is likely only delaying the inevitable but this is a vote we are going to be watching very closely over the next hour or so. Would be affected by a rule like this, the total cost could be up to 34 billion nationwide, the cost could be even more for gun owners who have more semiautomatic rifles with this rule, the policy holds more than ten rounds so if you own an ar15 and you have four highcapacity magazines he would have to get those registered individually, 200 bucks for each one, adding up to a thousand dollars for just one gun owner in fees. But there are more costs, julie, if you dont follow this rule. If you violate the nfa you could face up to a 10,000 fine or years in jail but its unclear if biden would use that to enforce this rule. Unfortunately, a lot of employers, if 2020 werent challenging enough, employers now have the precarious decision to make as to whether or not to force vaccination of their employees. They can do so but it is a minefield of challenges for them to consider. Because once you make that type of decision they are invariably going to be employers that say, i am too anxious to take this, im not going to take it and then you have to make a decision as an employer whether or not to give an individual a reasonable accommodation, let them work from home, dont let them come into the workplace without the vaccination. There were others that maybe have a comorbidity and have a convocation arise as a result of the vaccination in which case they can then sue for workmens compensation because they were forced to take the vaccination and had some residual physiological affect as a result and they can bring a workers comp. Claim against the employer so it is very tricky, one that ive been counseling our clients situation by situation and employee by employee and not making a blanket vaccination decision. Julie is this something thats going to have to ultimately come down to a state by state, as you know vaccinations in this country, many of whom are required for children, for example, to reenter school. Some claim religious reasons or health reasons, what have you for not or abusing these vaccinations, does anyone have the right to refuse a vaccination . They do, there are lots of protections that individuals can do, they can trigger a religious accommodation, they can say they have a religious objection to having this vaccinations are that person will be reasonably accommodated with respect to the antidiscrimination laws that exist. There are other laws, personal injury protections that they have pursuant to case law, just say i was forced to take this vaccination and i had a physiological reaction to it which caused damages as a result. So there are layers of protection to employees but in the final analysis, if an employer says you must have a vaccination to return to the workplace because the competing interest for employers is that they are required to keep the workforce safe. How do you keep the workforce safe in the midst of a pandemic . Well, you force vaccinations to make sure that enough people have a vaccine and wont infect each other once they return to the workforce. Its a really tricky situation where there are ways that employers can protect themselves and employees can actually say let me have individual rights not to be vaccinated.
