Basis. Harris however, now, senator minority leader Chuck Schumer is refusing the republicans of refusing to follow their own standard after the death of Antonin Scalia in 2016. Senator schumer you would think after the republican held to keep open the vacancy they would have the decency to apply their own rule when the same scenario came around again. Harris chief White House Correspondent john roberts is live in the press Briefing Room where things are set to begin momentarily. John . Good afternoon, harris. There are a couple of republicans who agree with the minority leader Chuck Schumer that the decision should be left for the next president. But 51 republicans say they are on board for a vote before the election. So now it comes down to a matter of timing. Can this all get done before november 3 . In an interview today President Trump said he is close in his own mind who his nominee will be. He believes that there time to get that person through before november. Listen here. President trump i would say im very close to making a decision in my own mind. I will reveal it on saturday. We have a lot of time. We have senatetorial support. We have the votes that we need. They will be happy. Who are the top candidates . Amy Coney Barrett there the 7th Circuit Court of appeals. She is considered the front runner and was a candidate the last time around when Justice Kennedy retired. Ultimately it was filled by brett kavanaugh. Another leading contender is Barbara Lagoa of the 11th circuit cartouche peels. She lives in miami and she could help the president. Some of her supporters say with the hispanic voters but there is concern she has only been on the federal bench for a year. She was with the Florida Supreme Court before that. Her federal record too thin for Supreme Court nominee. The president now brought up name of joan larson from the 6th circuit course of appeals a couple of times but im told she is further down in the list. Maybe number three or number four. So you now you amy Coney Barrett, Barbara Lagoa and maybe larson. Allison rushing is still in there in contention as well. Some people think it is too early for her but she has support among the evangelicals who im told are burning up the phone lines at the white house singing her praises. In terms of announcement on saturday the president has a preplanned rally in the evening in pennsylvania on saturday. So its likely that the announcement will probably be sometime late in the afternoon. The president will introduce the nation to his nominee. Then he will go to pennsylvania to bang the drug for why the person should be con bang the drum for why the person should be confirmed before november 3. Harris . Harris thank you. We will take everyone live to the lectern to your left, i think it is, as soon as this beginnings. I want to bring in tennessee senator blackburn of the Senate Judiciary committee now. Its always good to see you, senator. Good to see you. Harris do you think you have the votes in the senate . We do have the votes in the senate. Once the president has made his nomination, the leader mcconnell and the chairman graham will announce the timeline and what it will be. I look forward to vote for a constitutionalist to take the spot as a justice on the Supreme Court. Moments ago, the team said that they said they wouldnt rule out hearing on this. Could you get a vote before november 3 . Could it be a possibility . Yes, i think we could. We are going to follow the precedent. We know the timeline of 30 days of being nominated. The nominee has a hearing with the judiciary committee. We will do our due diligence. We are going to be very thorough and thoughtful. I am thrill ved a feel nominated i am thrilled we have a female nominated for the position. You will see us work to get this done. The democrats who are fighting this on us are the ones who want to pack court. They want to structurally change the Supreme Court. Its very important that we meet our obligation, do our duty. The president is moving forward on the right manner on the issue. Harris he is the president until january even if he does not wind. Senate majority to the end of the year no matter what flipping would go on democrats. Could you do it after november 3 . Is that how it works . You could still hold the vote and put the nominee through. You could. At any point. At any point between now and the end of the congress we could call the vote. That is right. Harris you mention packing the court. I want to lean on that. I want to get your reaction to what it would look like. That would mean that the democrats and the majority would then lengthen out or expand out the number of the justices you have. Pack them with people they think are the partyfriendly to them. You are right. Even Justice Ginsberg a couple of years ago said she thought nine was the right number for the Supreme Court. And that it should not be expanded. She felt like it would politicize the court. We should listen to others who agree that nine is the correct number. If you look now at the eightmember court if there are those who try to throw the election in the Supreme Court like they did in 2000, then its important that we go ahead and call this vote prior to the november 3 election. Harris all right. I do want to get to this. Some analysts are warning, senator, push to confirm a new u. S. Supreme Court Justice before the election could doom g. O. P. Senators in tough races. You know in the swing areas they are the swing states in the districts. The Cook Political Report now listing maine senator Susan Collins and the colorado senator Corey Gardner races as tossups. Also listing the arizona senator mcsallys race as leans democratic. Is there enough room in your vote structure with regard to a nominee to allow the people to be the centers . Corey gardner has not said its the route he is going to take. But Susan Collins, Lisa Murkowski already have. Harris yes. You know, harris, i thought a lot about this. I was listening to the pundits and the analysts and i was reading what they were sending out. I think what we have to remember is that much of the reason that this American People elected President Donald Trump to office was because he could make a decision. He was making a decision based on the judea christian ethic and the founding and the first principles. They had grown weary of president obama and Vice President biden trying to do things bizarre by czar and comms and letting elite make decisions and not letting te lechted representatives do it. I think we have to remember that. Also, one of the things that was a driver in 2016 and 2018, was that the American People wanted to see court system that was fair. This is an enormous issue with women that are suburban women. They want to see fairness. They want to see a level playing field. They want to see equality and justice. So, moving forward on what is our constitutional duty, and the president fulfilling his constitutional obligation to bring forward a nominee. And us to take up and provide that advice and consent. Absolutely. We are going to do our job. Harris all right. Senator blackburn, tennessee today. Great to have you on the program. Good to be with you. Thank you for making time for us. Thank you. Harris well, as i just touched on with the senator blackburn, Senate Republicans are meeting now on the president s Supreme Court nominee. She had to run. Literally. Judiciary chairman Lindsey Graham said they are talking about when a hearing could happen and how many days they expect it to take. Chad pergram have more. That is the question can they do it before the election or after the election . They have not considered a Supreme Court justice in a lame duck session since 1880. So its unclear. The key is they appear to have the votes to move it this year after mitt romney jumped on board. Listen. On the other hand when there is a nominee of a party that is in the same party, they typically confirm. The decision to proceed with the President Trump nominee is consistent with history. I came down on the side of the precedent and the constitution as i have studied it and i make the decision on that basis. Tous grassley and senator Chuck Grassley and gardner hav are said to agree. There are only two republicans opposed to moving ahead. Lisa murkowski of alaska and Susan Collins of maine. The Senate Majority leader Chuck Schumer has had it with mitch mcconnell. The Kentucky Republican refused to consider president obamas nominee garland in 2016. The rule, American People should have a voice in the selection of the next Supreme Court justice. The mcconnell rule was nothing more than the mcconnell ruse. Schumer had strong words for the colleague on the senate floor and he said no one defiled the senate like mitch mcconnell. Harris . Harris chad, the senator from tennessee making news. She was saying that they can get this done any time between now and the end of the year. Depending on when the 30day mark starts with a hearing. A lot going on. We appreciate you being with us today on the outnumbered overtime. Thanks. Of course. Harris we are awaiting the White House Press briefing. As i said previously this is the first time we have heard directly from the white house since the passing of Justice Ginsberg. All of this talk about nominee, we know it will be a woman. President of the United States told us that. We are starting to get a look at the short list of the people that the chief of staff, mark meadows is said to be meeting with already. So as this is coming together we will hear from the White House Press secretary Kayleigh Mcenany at any moment. We will take you there to the white house as soon as it begins. Plus, new yorks governor refusing to send in the National Guard in the violent demonstrations. And the looting. And the rioting. But now he says he may end in the guard for polling places in november when people are voting in person. The reaction to cuomos idea. Plus, how is fight over the u. S. Supreme court is reframing the first president ial debate one week from right now. Trump campaign will join outnumbered overtime next. We need to make healthcare affordable for everyone american. I have done it for three and a half. He should beat me i would think. He is much more experienced. Harris President Trump there possibly looking to manage some expectations ahead of tuesdays debate. Now the u. S. Supreme court battle adding a new twist to the bidentrump showdown. The democratic nominee expected to frame the high court fight as a referendum on saving the healthcare coverage for tens of millions of americans amid the pandemic. Former vice pres. Biden the likelihood of the nominee he is picking based on the people he is talking about are likely to take conservative grew and said obamacare is unconstitutional and it would strip 100 Million People of the preexisting and any coverage they have. Harris aaron perini the director of the press communications for the trump campaign. Thank you for being on the program. First, i want to talk about what was, you know, the strategy going in to tuesday. And how it might have been maybe reset. Youyour Communications Director said to fox expect biden to be on his a game. Resetting, you know, away from the slow joe and he must have been on drugs if he does a good job and that sort of thing. Its quiet different. I think that the campaign is talking about the fact here and the president was clear as well that joe biden has 47 years of debate experience. Plus, a grueling democratic primary he went up on a number of debates against the other contenders. So we do expect joe biden to show up and try to spar against President Trump. Obviously, we know President Trump will show up in grand fashion as well. Having 40 years of the experience as president of the United States under his belt. Incredible record of the accomplishment to talk about. Joe biden needs to answer questions he is not getting asked on the trail. He needs to answer why he would raise taxes over 4 trillion, why he would get rid of the trump tax cut and the opportunity zones that put dollars in to the economically disparaged communities in the United States. He needs to talk about what he means when he says well, we will keep fracking around to get rid of it. Joe biden has been flipflopped and talking about the disasters policies. Harris what you are alluding to the last one what is going by for his own party. This is something i would ask. If he goes forth, how will you put your own administration forth when you know you have some members of the party who want to push you in a different direction . Lets talk a little bit about President Trump ahead of that debate. What is his prep looking like right now . Well, i certainly cant get in to specific details but President Trump is doing what he always does. He is leading. Being president excellent debate prep. You saw him give remarks today to the u. N. You see him out there every day leading. Two historic middle east peace deals last week crisscrossing the country to talk to the American People. That is great debate prep when it comes to the president to stand up and talk about his accomplishment and talk about the work done to fight the coronavirus in the United States. What four more years of America First agenda would look like. He is ready. He will show up. It will be an excellent debate. You will have to see joe biden answer real questions that are not about how he is feeling and what he had for lunch. He has to defend really bad policies against a president who has had extraordinary record to run on. Harris i dont know if you caught it moments ago. Senator blackburn of tennessee joined me here on overtime and we talked about the breaking news today that senator mitt romney joined the other republicans to say he would vote in the nomination process with the president nominee. Sewe are about to hear from the white house for the first time. Im curious on the campaign. When that news hits what does it cause you to do . We are excited to hear that the senate will be doing their constitutional duty here of advising and consenting to the president nominee. The president executing one of the most important constitutional duties. Putting forward qualified individual to sit on the highest court in the country. This is another contrast that exists between President Trump and joe biden. President trump, then candidate trump put forward a list of qualified individuals in 2016. He chose from that list twice. And he put two exceptional jurist on the bench. Now he put more names forward to pick from. We are excited to see it. Harris erin, please forgive me for interrupting. We are going straight now to the white house. The lectern. Erin, thank you for joining me. Here is Kayleigh Mcenany, the White House Press secretary. Elected president of the United States to exercise his hs constitutional duties. Article two, section two of the constitution clearly states that the president , shall nominate justices of the Supreme Court when a vacancy occurs. No matter the time, no matter the politics of the day. The president is the president. There is nothing in the constitution that says the president stops being the president in an election year. The president has already appointed two strongio strong conservative justices to the Supreme Court, justices to interpret the constitution as written. Now he will nominate a third. Senator ted cruz reminds us we are one vote away from seeing our religious liberty vote stripped away from our free speech stripped away, from the Second Amendment being stripped away. Just one vote. Contrast the president solemn constitutional duty when the democrats search and destroy politics. Nancy pelosi vowed to attack the president with arrows. Smoker pelosi will not rule out impeaching the president for fulfilling his constitutional obligation. A. O. C. Said impeachment is an option on the table. And Chuck Schumer stood by nodding approvingly. The plans of the House Democrats is so radical that even senator tim kaine rebuked the idea calling the idea of using impeachment to delay a Supreme Court vote foolish. Some democrats already have a backup plan if they dont get their way on the nomination. Congressman joe kennedy said if he holds a vote in 2020, we pack the court in 2021. It is that simple. Senator ed markey went further. No Supreme Court vacancy filled in an election year, he said. If he violates it when the democrats control the senate in the next congress we must abolish the filibuster and expand the Supreme Court. Senator, the president is elected to a fouryear term. You cant unlal rattily reduce it to three years. The president is the president. Democrats cannot win the argument on the merits. They cannot win on precedent. So they must search and destroy. Don lemon said the quiet part out loud last night. He said this. We are going to have to blow up the entire system if the president does his job as outlined in the constitution. That is the difference between republicans and democrats. We might to protect the system. We fight to protect the constitution. When democrats say out right we are going to blow up the entire system because we do not get our way. This president will proceed undaunted by the democrat threats. President trump will fulfill his duty. President trump will appoint the next Supreme Court justice. President trump will protect religious liberty. President trump will protect our freedom of speech. President trump will protect our Second Amendment. Under this president our rights will be upheld, our constitution safeguarded and this president will fill that seat. With that, i will take questions. Jim . As you know, the country has hit 200,000 deaths from the coronavirus. What do you say to americans who are outraged over this and blame this administration for so many lives lost in this country . Well, as you have heard, several tas doctors in the task force note from this podium we are looking at the prospect of 2 Million People potentially perishing from the coronavirus in this country. We grieve when even one life is lost. But the fact that we have no 200,000 the fact we have come nowhere near that number is a testament to the president taking immediate action. To shutting down travel from china. When the other party, democrats were saying that was xenaphobic. To develop land mark therapeutics working like remdesivir. Europe experienced 28 higher mortality rate than the United States and that is a testament done to the task force and the president. If i could follow up. Last night the president said at one of his rallies about the virus. I think he was talking about the younger americans. He said it affects virtually nobody. By the way, open your schools, everybody open your schools. He said to bob woodward its not just hold, its not just older people its young people, too. At 200,000 deaths, shouldnt the president be telling people the truth at the rallies about the virus . He is telling people the truth. No, he is not. He is saying it affects virtually nobody and it doesnt affect nobody. He is not telling the truth. You are taking the president out of context. I have the full quote here. He was referring to young people. Im not taking it out of context. I said he was talking about younger people, im not taking out out cough context. He is saying he is not giving critical information and he is. He says this. You know in some states thousands of people they have had nobody young. Below the age of 18. Like nobody. They have a strong immune system. That is factually true. You can go to the American Academy of the pediatrics website, the Children Hospital association. They list a number of the states with 0 opediatric deaths the pediatric deaths the they can contract the coronavirus and spread it to older people. We have known it since the beginning. For the president with 200,000 deaths to go to the rally and say it virtually affects nobody and that in some states its not affecting young people, that is glossing over the fact and really diminishing the fact that young people can catch this virus and spread it to older people. Younger people can also be sickened and killed by the virus. Do you have the quote with you . I have the quote, yes. Its azygoses read it to you that in several states they have had zero pediatric deaths. I have list. Arkansas, delaware, district of columbia, hawaii, idaho, kansas, the list goes on. As you may not know, jim, covid has a. 01 mortality rate for people under the age of 18. So, it is not a disease that affects young people in the same way as older people which is exact point the president was making last night. The virus spread to older people. One person who does believe that the president has the Constitutional Authority to make a nomination for the Supreme Court and the senate has constitutional obligation to provided a vice and consent is utah senator mitt romney. In the course of the last three and a half years the president and romney often found themselves at odds, have said inkind if not intemperred things about things about each other. How does the president feel about romney today . I havent spoken to him about romney but senator romney is recognizing what any of us who take a cleareyed look at precedent recognize that the precedent is on our side here. 29 times has there been an appointment in an election year. 29 times. When you break down the numbers, 19 times when the nominations were made the senate and the president were of the same party. 17 of those 19 times, that nominee went on to be confirmed. The ten times when it was a difference in party between the republicans and the democrats in the senate and the presidency, only two went on to be confirmed. So precedent is on our side. The democrats are trying to have it both ways here. I would cite Dan Mclaughlin of National Review who said choosing not to fill a vacancy would be a historically unprecedented act of the unilateral disarmment. Let me follow up. Timing is next issue. The president will have 37 to 38 days from the time he makes the announcement to the last time he could have a vote before the election. Past years, stephens was confirmed in 19 days. Chief justice roberts, 24. Justice oconnor in 33. Times were doesnt back then than they are now. Can you do it in 37 days . We certainly believe we can. You have heard very optimistic words from senator graham. How will you do it . Well, we go about this the way we always have putting forward a constitution abiding textualist, originalist that we believe the American People will appreciate and get through the approval process. Nomination and the confirmation process quickly. Kevin . Two quick questions. On the 200,000 deaths, will the president recognize that publicly today . At his a speech or on twitter . Is this something that he would like to express remorse over or sympathy to people who have lost the president throughout the pandemic has done just that. He has said before that it keeps him up at night thinking of even one life lost. This president has taken this incredibly seriously. What he has done is worked harder. Each and every day he works hard. He puts his head down. That is evident in the administration historic response. The largest mobilization of the private sector since world war ii. The fact we got working therapeutics delivered to the American People. The fact that is a vaccine, frankly this will be the fastest pace for a vaccine for novel pathogen in history. As we seek to reach the goal by the end of the year. That is what the president does. He takes it seriously. You have seen the fatality rate that has fallen 85 since april. 1. 5 of the emergency room visits are now people sick with covid is a real testament to the hard work done by the task force and President Trump. Followup. Can you speak why the president prefers to have the confirmation vote before the election . How does he think this is going to help cory gardner and the republicans keep majority in the senate . The president would like to see a confirmation process that is fair. One of the low points for the process were the kavanaugh hearings and what the democrats did there, making the baseless allegation against justice kavanaugh, someone respected prior to President Trump appointing him by everyone. And democrats really dragged his name through the mud. What happened there is a travesty. The president wants a fair confirmation process and he wants to see one that does not look like what happened to kavanaugh. That was a real low point for the democrats. So democratic stumbles in the kavanaugh confirmation process will help republicans . Look, he thinks that the democrats really showed themselves at the lowest point on the confirmation process. I think the American People saw the democrats for the partisan games they play. The American People are looking now to see nancy pelosi and Chuck Schumer talking about impeachment for executing your power in article 2, section 2. Its really outlandish the things they are suggesting. They seem to be doubling down on the kavanaugh approach. It didnt work out well with kavanaugh. And it wont work without well this time with the election year. One on covid and then on the court. First on covid the president gave himself aplus for handling covid but the d for the p. R. What would good p. R. Look like when 200,000 americans are dead . What the president was saying is that he wants to make sure that we get good information to the American People. That is something that i think we have done. Did he provide information at times that was not true . He said he was downplaying it so he purposefully provided information that was not fully true. That is absolutely inaccurate. He never downplayed Critical Health information. He never downplayed the covid response. You can see that by the historic effort we have put forward. I would point you to dr. Fauci who said i dont recall anything different in our discussions with the president that he said things quite similarly in public. He was asked by john roberts. Did you ever get the sense he was or wasnt playing this down . No, no, i didnt. That is an assertion echoed by the Vice President. Our response when you look that 100 million tests, vaccine on the record pace, therapeutics and the fact we have brought the fatality down by 85 . Novel pathogen that came in, for which there were no test and no identified therapeutics but they were identified quickly. With regard to the vaccine if you look at the notion that we are manufacturing this at the commerciallems which i was told by dr. Sola at the commercial levels which i was told takes years to do. We are producing 100 million doses by the end of the year. That is a testament to the president and his response. If none of the vaccine is effective, what is plan b for the white house . That is a hypothetical. We have six american vaccines we have identified. Three of them in phase three Clinical Trial. There is also one we are getting there. By the end of the year is the goal. If its not approved, what do we do if they are not approved . We hope for good news but what if they are not approved . We have six candidates and we hope to identify one, more than one working vaccine by the end of the year, producing them in advance. We have a distribution plan. Ebola took 14 months to get to phase three Clinical Trial. We already have two candidates in the phase three. Ebola took three years to get to completion. We will have done it in under a year. The fastest rate for a novel pathogen in history. The president retweeted a segment from Rush Limbaugh who said it would be great if the republicans skipped Committee Hearings altogether. Does the president want republican to skip Committee Hearing . He is a fan of Rush Limbaugh and he retweeted it but we are working with the confirmation process and senator graham said it looks to be threeday timeline. Justen . Thank you. Can you confirm the plan for the president to meet with [inaudible] while he is down there this week . He said yesterday he had spoken to candidates beforehand. Just barrett was in here yesterday. Could you talk about the others he may have had contact with . Yeah. I wont get in the private meetings. You will find out which constitution abiding textualist and originalist he appoints saturday. Rocky couple of days on wall street. There is a concern that the Supreme Court fight may sort of kill the last gasp of getting a stimulus bill done before the election. Does the white house agree that is probably not going to happen until after the election if at all . Or if you are still hopeful, you know, the president said from the time is right he would reach out to Speaker Pelosi. It seems like we are getting to the last legislative days before the election. Is the time now right . We have wanted to see a phase four relief bill get to the American People. Its why the chief of staff and the secretary mnuchin have been in negotiations. Unfortunately, though, they have been in negotiations with a fundamentally unserious partisan named Speaker Pelosi who when we would exceed what she asked for, School Funding lets say, she would reject the money in excess of what she previously asked for. Democrats showed what they were about when they filibustered a bill that would have provided 300 a week to the American People through december 27. They filibustered that i believe last week. So at this point, the onus is on Speaker Pelosi. We encourage her to send oneoff bills, perhaps the airline funding or the other elements to work through the process and get the American People. Its the president s priority to do that. You dont see a big stimulus bill you might see a one off bill before election . The onus is on nancy pelosi. We have come up in the number. Its possible if she should become serious in the negotiations but if she doesnt want to deliver relief to the American People to that degree then she can one off bills we would look at and be happy to move forward with. The priority has been getting money to the American People. Which is why the president has had the e. O. S on evictions and the Unemployment Insurance and the Student Loans and evictions. Yes . The first president ial debate is a week from today. How do you expect the Supreme Court issue to impact that debate . Yeah. A lot of that is for the campaign with regard to the debate. Id have to refer you there. But i think the American People are going to get a very cleareyed look as they have with the previous two nominees we made of what the president stands for. That he wants a judge to will protect our fundamental rights, the essential liberties and who looks at the constitution as written. Not trying to fansfully interpret the document. Looks at the meaning of the statutes and implements that and rules in a way a true textualist would. He is protecting the First Amendment and the constitution and the fundamentalist rights at stake should another party have share way with the judiciary. This president will continue to appoint justices in the mold of gorsuch and justice kavanaugh. Separately, the democrats are threatening to add justices to the Supreme Court as you mentioned. Does that concern you at all as you go about the process . That is, its unfortunately another example of trying to blow up the system. If you dont get your way, democrats will blow up the system and change the system, trample on the constitution. I point them to the words of Justice Ginsberg who called Court Packing a bad idea. She called it partisan. Nine seems to be a good number, she said. I think packing the court was a bad idea when Franklin Roosevelt tried it and im not in favor of all of that. Yes . Anita . I had a question on the virus. But i want to followup on justin. He asked about the speaker. Has the president called the speaker about the recovery bill . Why not if he wants to get this done . Is he calling other lawmakers as well . Im not aware of any conversation that they have had. There have been communications through the chief of staff. Through the secretary of treasury. But until Speaker Pelosi is serious in her negotiating instead of engaging in the political drama, we are really at a stalemate. Its, really, the ball is in her court to become serious in the negotiations. It would carry more weight if the president called than mark meadows. Correct . They have been negotiating and when we believe the speaker is in a serious spot we can move forward with other conversations. But at this point when you asked for School Funding and we exceed that and you reject the excess for the School Funding it shows where her mind set is at. My question on the virus was that some polls are showing that majority of the americans dont trust what the president is saying on the virus vaccine. I wondered, you keep talking about the vaccine possibly coming out. How are you going to get people to believe that the vaccine is safe. And that people should go get it when it does come out . What is the process going to be looking like . Yeah. So i think first, i want to point out that several of the doctors have been on the record and have said this vaccine is going through the same rigorous process it should. As dr. Hahn said i repeatedly said all f. D. A. Decisions have been and will be based on good science and data. As dr. Fauci said, certainly there are no corners being cut here. Several others like secretary azar have been on the record on this. So members of the task force have all said this is going through the rigorous f. D. A. Process. It will be a good safe and effective vaccine. Follow up on anitas question on the vaccine. How soon would the president feel comfortable taking vaccine himself . Would he support a vaccine from china or russia . The president has been on the record saying im happy to be the first person to take the vaccine or the last person. Whatever is best for the American People. He believes it will be a safe and effective vaccine and one he would certainly be open to taking. He said this im going to really Say Something that is not like me. I dont care, i just want to get a vaccine that works. I really dont care if its another country. I will take my hat off to them. But currently the other vaccine in phase three Clinical Trial is the one in oxford. Yes. Just to clarify on the mitt romney development. With senator romneys announcement, does the president think he actually has a Bulletproof Group of republicans who will vote no matter what . Even fo before the nominee is name or does he fear defections after the nominee is named and confirmation hearings begin . He thinks his nominee is going to be someone with a stall lar track record. Someone who stellar track record and someone who will be a textualists and traditionalist who the republicans will rally around. Senator graham believes he will have the votes. Leave it to the senators at this point. This will be a nominee that will unify republicans. President is a good nose counter. Does he think he has 51 . I missed the first part. He has been a good nose counter. Does he think he has 51 . I think he is trying to select the nominee. I havent spoke to him about the vote count. We believe the republicans will remained unified. The president is giving a healthcare speech on thursday. Is this finally the longawaited comprehensive healthcare policy . There were doubts that such a thing actually exists. It certainly does exist. The president in the next week or so will lay out his vision for healthcare. Some of that has already been put out there. Like telemedicine. Lowering the cost of drugs. Protecting the preexisting conditions. But the president will lay out additional healthcare steps in the coming i would say two weeks. Yes. Thank you. I have two questions. The first is the president has said roe v. Wade would be overturned if he got a chance to change balance on the court. In 2016 he said if we put another two, perhaps three justices on its will happen. Is that the ultimate goal here to overturn roe v. Wade . The president and the administration would not ask a judge to prejudge a case. I would point you to the rule set by none other than senator joe biden at the confirmation hearing of Ruth Bader Ginsberg when he instructed no questions on how ginsberg will decide any specific case that would come before her. As Justice Ginsberg said in her confirmation no hence, no forecast, no pre no hints, no forecast, no preview and its said the judge should not give view points. Im asking if the president s quote in 2016 if he still stands by that, that he would like to see it overturned . The president s philosophy moving forward with the nomination process he is looking for a judge with qualities and that is someone who interprets the constitution as winning and the interprets the statute as written and originalist. Can i ask a second question about the virus. 200,000 americans died from the coronavirus. Could you again try to reconcile the president telling bob woodward that plenty of young people, his words, plenty of young people are affected by the coronavirus when he said last night in a crowd virtually nobody young dies or is affected by the virus. Can you reconcile those two . Why did he tell woodward plenty of young people are impacted by the virus and not say that in front of a crowd . This is a novel pathogen and we know more about covid today. The president said it in a speech before the comments he made and he said we now know more about the virus and elderly; particularly, those with the comorbidities are affected by it. We know that the young people are by and large and in some states there has been no young people that have succumb to the disease. I have listed off a few of the states for you. We know that a very, very small percentage of those under 18 have perished because of covid. Its a novel pathogen and now we know more. We have surge testing for those vulnerable and we will make sure that the elderly, with the comorbidities are protected. Not continue to not have a panic. You dont think he is not causing a panic . The president never downplayed Critical Health information. Dr. Fauci as i noted to you said that point blank no, he didnt. That is assertion of the Vice President pence who led the task force as well. Thank you. The administration filed an appeal to the Supreme Court on apportionment. Trying to make sure that the people in the country illegally are not counted when congressional seats are hammonded out. Handed out. Sorry, im muffled. Texas would lose a seat if the people are not counted. The constitution says that people are the number used for apportionment. Are people in the country illegally not people and why does he want texas to have more seats than fewer in the house . I havent done a deep dive in that legal case. I can look into it and get back to you. Can i ask a separate question. At the top of this you mentioned that theteams talked about impeachment and you said that the president doesnt stop being president in the last year. Not that they are going through the impeachment at the moment but is there anything to prevent impeachment in the final month of the presidency . Well, first, to pursue impeachment based on someone executing their lawful duty, the constitutional duty is proproseerpreposterous. It shows what the Democrats Use impeachment for. They use it as a partisan tool to take down a sitting president , to disempower the American People who voted to empower President Trump. They have used impeachment as a political tool. That will be the history and the record of nancy pelosi. Now she is on the record saying she would use impeachment to try to undue to constitution; particularly, article 2, section 2. That is shameful but unsurprising from the speaker. Yes . In the speech President Trump mentioned carbon emission in the u. S. Of what . Carbon emission. Carbon emission. Okay. Saying it was a good thing. Because its connected with the use of coal. Is it to say that decline of coal is a good thing . I would note on the Greenhouse Gas emissions. We have decreased them as the u. S. Has become number one in the oil and the natural gas production. But we simultaneously reduce green house emission. I want to follow up on the speech the president prepared for the u. N. General assembly. He hit china hard. The Chinese Ambassador and introducing president xi responded accusing the president of bullying , protext evensm and the unral lateralism. I wonder what the white house response is. How is the white house concerned about the growing rift of the two largest economies in the world going to hurt the efforts to combat coronavirus . Let me say nothing hurt the efforts to combat the coronavirus more than china concealing information about covid19 from the beginning. What china did was inexcusable. In partnership with the w. H. O. Hid critical information about transmission of covid from us and about severity of covid not just from us but from the world. There is no bigger bully than china when it comes to covid. That is pretty clear. Look at what happened at the w. H. O. A followup. With regard to intelligence around the poisoning of the russian opposition leader, the president said we will talk about that another time. Trying to get a sense of has the president reviewed the german assessment, is he rejected that assesment that he was indeed poisoned . No. United states as president of the g7 joined by the g7 partners condemned in the strongest possible terms the confirmed poisoning. And jeremy briefe germany briefd they determined that he was the victim of an attack with a chemical nerve agent. Substance developed by russia and any use of weapons at any time by anyone in any circumstance unacceptable. So no. What would the u. S. Response be . I have told you so far that the United States condemned it with the g7. Rest assured there is no one tougher on russia than this country who has seen what we have done with the sanctions and expelling the diplomats monk other actions. Expanding on if last couple of questions about the u. N. Speech. President hit china hard; specifically on the ethnic cleansing but he jumps in on the environmental record. [inaudible] with the vast coral reefs and emit more toxic mercury in the atmosphere than any country in the world. How responsive have the United States allies been to this message from the president . And on the confronting china on the fronts in particular . To say the world is unified condemning the Human Rights Violations by china. I would also note on the issue of the co2 emission there is no bigger emiter than china itself. Charlotte . Thank you. The Foundation Report has the Financial Link between organization linked to black lives matter and beijing group. Is that something that the white house will investigate and something you are concerned about . So i havent seen that particular reporting. But just on the note of some of violence we have been seeing, i would point out that the New York Times article that came out Terrance Moses was watching protester against the Police Brutality march down his quiet residential street one recent evening when some in the group of a few hundred stopped and started yelling. Mr. Moses was initially not sure what the president ers were upset about what the protesters were upset about. But when he got closer he saw that it with was his neighbor who had American Flag on display. It was a march and then bang, how dare you fly the American Flag, said mr. Moses who is black and runs a Nonprofit Group in the portland, oregon, area. They said take it down and they wouldnt leave and they said they would come back and burn down the house. Mr. Moses and others blocked demonstrators anded to them to leave. Mr. Moses said we dont go around terrorizing folks to try to force them to do something they dont want to do. Who runs a Nonprofit Group that provides for homeless people. He said im a veteran and there is silence spilling over to the street violence spilling over to the street. I would like to invite general kellogg to the podium to discuss an issue. General kellogg has been supporting President Trump from the beginning and buy the president s side for the major foreign tos policy decisions. General, please. Thank you. Good afternoon. Im keith kellogg, olivia troy worked for me. I fired her. The reason i fired her was her performances started to drop after six months working on the task force. She was responsible for coordinating meetings, bringing people together, and when the performance level dropped off i went to the Vice President of the United States and recommended she leave. Im the one that escorted her off the compound. What she has said i have never heard. That has never happened. I have been through every single meeting of the task force. I have been with the president. And Vice President. Through every meeting. What bothers me what about olivia said harris this is general control loa generaltalking aboue president pence. He now speaks and we will pull back. News has been made as you know from watching Kayleigh Mcenany speak. We will keep an eye on the briefing and monitor as we do. Our own Chris Wallace will moderate the first president ial debate tuesday. He just released the topic and that include trump and biden record, the Supreme Court, covid19, the economy, race and violence in the cities and the integrity of the election. We dont know the order that those will come in. We know it starts at 9 00 p. M. Next tuesday. Power panel. James freeman, wall street journal editorial board. Ethan beerman, attorney and radio host of the left coast news. I will come to you with a reaction on the topics. James . It seems to cover it. Certainly mr. Biden comes in with a nice sort of sense of the low expectations after the questions about huh he has handled the recent interviews. Obviously, the Supreme Court decision is going to be huge. When you talk about the records, that does leave a lot to discuss. With biden you are talking about half a century with a career politician. I had on erin perrinne from the press department in the 2020 campaign. They are doing lowering of the expectations. Saying her boss, the director said expect biden to bring his a game. What have does that mean . What kind of the pressure does it put on your candidate as a democrat . I think that biden will do fantastic. Look, there is a great team preparing him for the debate. The topics were in agreement here, they are excellent and spot on. For what we need to discuss for the president ial election coming up. Joe will be able to address the fact that he learns through the years as new evidence comes in, so i know the republicans will try to jab at changing positions over the years. But the democrats take new data in and they change positions based on that information opposed to trying to be stuck in 1789. As we just heard of a Supreme Court nominee. So joe will be sharp. He will be ready. He will come out swinging against donald trump as well. Harris all right. I want to step in and ask each gentlemen a quick question on the topics be. Fast. We are running out of show because of the press conference that was making news that we took. So, on covid19, Kayleigh Mcenany took a lot of questions. James, the president on that needs to do what next tuesday . Well, i think well i think he should get credit and do more to explain and emphasize that the simple fact is this does not present a great risk to children, and we shouldnt be tearing apart educational systems in our economy on this false premise. They are in a high risk and they are not. Harris ethan, when i bring you back i will ask you about joe biden and race and violence in our cities, but to be fair i dont want to have to cut you gentlemen off mid sentence which sometimes can happen at the end of the program. Thank you for sticking with me through the press briefing and breaking news, i pursue your time and we will see you very soon. Im harris and the Daily Briefing begins with dana perino, now. Dana and Senate Republicans many right now on capitol hill after clearing the way for the Supreme Court. It comes as a republican senator mitt romney says he supports the vote after the election given the g. O. P. The backing and needed to move forward. I think at this stage it is appropriate to look at the constitution and look at the president which has existed over the process of our countrys history. In the circumstance where the nominee of a president is from a Different Party on the senate, and more often than not the senate does notrm
