Measure the severity of how he defied the justice system. Harris everything tinged with politics. Thats the political side, lets get the facts. Chief intelligence correspondent Catherine Herridge live from the federal courthouse in washington, d. C. Catherine . Harris, in the last few minutes we have been able to confirm here at fox news that new charges have been brought against Paul Manafort. These are new york state charges. He was indicted by a grand jury on march 9th and the allegation is that Paul Manafort falsified Business Records in order to secure millions of dollars in real estate loans in 2015 and 2016. These charges at the new york state level near the charges that manafort was convicted on in the Eastern District of virginia, for which he received 47 months in prison. The reason this matters, and the timing, is that if there were ever a pardon by President Trump for Paul Manafort this would have the effect of wiping away the federal charges. But the new york state charges would be unaffected. What this means is that even if there is a pardon, Paul Manaforts legal troubles continue. A short time ago the judge in this case, Amy Berman Jackson, spoke at length to the court, giving her rationale. The foundational evidence, if you will, for our decision to make his sentence 81 months. That is the total here in d. C. , in addition to the 47 months that he got in the Eastern District of virginia. Judge berman said that she found Paul Manafort accepted responsibility for his offenses, but she was not completely satisfied with his statements. That his acts amounted to giving the system. Bank fraud, tax fraud, foreign lobbying violations. These activities were not a oneoff. She felt very strongly about what was described as a witness tampering, involving two witnesses that had to do with manaforts lobbying work with the ukraine. Whether it was focused on the u. S. Or changing opinion elsewhere. And she took offense at the defenses decision to tell the court that, really, Paul Manafort had a target on his back because he was a Campaign Chairman for donald trump. She said that mantra, thats her word, spoke to a lack of a genuine acceptance of responsibility in this case. On the issue of russian collusion, judge Amy Berman Jackson said that as far as she was concerned this was never tabled for the court here in d. C. But this was a matter left unresolved, just within the last few minutes weve heard from Paul Manaforts attorney, kevin downing. Who had very harsh words for the judge in this case. I think the judge showed that she is incredibly hostile towards mr. Manafort and exhibited a level of callousness ive not seen in a whitecollar case in over 15 years of prosecution. The judge, Amy Berman Jackson, has said that she will consider the motion that was brought by manna for its defense team. They would like them to serve out his term at a facility in cumberland, maryland. That ultimately will be decided by the bureau of prisons, but the judge here can make a recommendation on where that should be, harris. Harris catherine, you have been with me over an hour through the first hours of outnumbered bringing us the story. We will come back to as the news warrants. Thank you for your reporting. Youre welcome. Harris i want to get to my first guest, john yoo, who served as Deputy Attorney general under george w. Bush. I want to do this in order. Early on this Program Moments ago, you saw political adversaries like senator blumenthal, democrat, who sparred with the president a couple times. He says the sentencing was too light. Moments ago, as you heard from Catherine Herridge, manaforts attorney called the judge hostile and callous. Would you put the sentence of Paul Manafort today . First, i think its very wise that the framers did not put congress in charge of imposing sentences and trying people for guilt. This is why we have jury trials and why we have judges. Because those are the people who should set the sentences, not public anger or hysteria. I think the sentence here was quite fair. I think Paul Manaforts defense attorney is not doing him a good turn and bite complaining about the judge the judge could have sentenced him up to ten years. He got less than four years here. Altogether, with the virginia proceeding, he could have been in jail for 30 years but hes getting eight years. Harris the new developments as we were talg with our guest in the center seat on outnumbered, judge andrew napolitano, but the feathering out from this. That there could be other municipalities, jurisdictions. Anderson and within seconds, new york city files against Paul Manafort. I think your correspondent is quite right. Whats going on here is that some states, like new york, that a relatively hostile to President Trump, want to prevent any consequences if President Trump were to pardon Paul Manafort. Because the president , under the constitution, can only pardon for federal crimes. He cannot pardon state crimes. However, i think President Trump would be out of his mind and committing a gross tactical political mistake for himself if he were to pardon Paul Manafort. Manafort is clearly guilty. In fact, he pled to being guilty in washington, d. C. There was no trial. I dont see why he should get any consideration of mercy from the president , because he was unjustly convicted. Harris the White House Press secretary White House Briefing on monday talked about that door being open or closed for a pardon. Lets watch it. Reporter why hasnt the president ruled out a pardon for Paul Manafort . Secretary sanders the president has made his position on that clear, and he will make a decision when hes ready. Harris all right, lets move forward if we can, john. Just in terms of what happens next with these other jurisdictions. As Sarah Sanders has said, the president is still looking at that pardon possibility. If it were to come about, these other cases and other states, like california and new jersey, could pop up just as it has happened here in new york today. Thats right, harris. Paul manaforts crime was not just lying, not just witness tampering. He lied to the irs but he also set up and concealed fraudulent operations. Any jurisdictions where those fraudulent operations taking money from foreign governments, pretending to work for them, hiding the proceeds of the life and gotten gains could potentially file lawsuits. I think actually the new york one is going to be enough. Because he could face some pretty severe sentences there, and that would effectively prevent any real effects from a trump pardon. Harris how significant is it that this judge didnt just mention russian collusion it said the case had nothing to do with it she then said it doesnt resolve looking into that. Why Say Something like that . First, i think viewers should understand that this has nothing to do with proving any kind of collusion between russia and the trump campaign, try and affect the Elections Come at the entrance Hillary Clintons emails, to try and disseminate them on the web. This is about conduct that happened well before Paul Manafort was Campaign Chairman for the trump campaign. It involved basically his defrauding of ukrainians, lying to the irs about it, and hiding the proceeds offshore and money laundering. I think the judge went out of order. When she said is accurate, in that what happened here has nothing really to do with any proof or not of russian collusion, but it wasnt necessary to say that because thats obvious from the facts of the case. Harris interesting. You said, hey, a cautionary tale to the attorney for Paul Manafort at this point, about a disrespect toward the judge. Im curious, would that have anything to do with the fact that she is now looking at whether or not to send them to a prison that he is requesting . As you said, harris, would not want to get on this judges bedside after she treated him quite fairly. Sentenced him to a range that is less than half of what he could have gotten, and still has a lot of involvement with the case. Not just where manafort is going to be sent, but should manafort want to complain or try to raise issues with his detention, it could actually come up before her again. I actually think with the attorney said there is not quite right. I dont think this judge showed deep hostility toward manafort or the lawyer. I think she was rather fair throughout the proceedings. It really shows that the people who attacked the Virginia Judge were doing so for partisan reasons. Remember, people complain he sentenced him to lightly. But this judge sentenced him to less time than the judge originated. Harris interesting. John you, thank you for your expertise and your time. Thanks, harris. Harris the fbi says that Lori Loughlin has turned herself and will be making her First Court Appearance in los angeles later today. Her husband, as well as the actress Felicity Huffman, appeared in court yesterday and were released on bond. They are among dozens accused of taking part in the massive scam involving bribes and faking test scores to get their kids into elite universities. Mollys life for us in boston. Molly . It is alleged he also scheme to present her daughter as a tennis or recruit to georgetown. Also worth noting, harris, this is not over. This investigation is still ongoing. There could be further arrests. Defendants will actually be making a crosscountry flight as well. Mossimo giannulli and Felicity Huffman and others also expected to appear in boston. The big day to watch here in the city of boston, march 29th. Harris and we will watch it. Molly, thank you very much. Right now, California Governor Gavin Newsom is holding a News Conference to announce his plan to suspend the Death Penalty execution. It would give an instant reprieve to 737 inmates now on death row. President trump is going after this move, tweeting this morning, the fine voters the governor of california will halt executions of stone cold killer is. Friends and families of the always forgotten victims are not thrilled, and neither have i and this is developing for the faa is facing mounting pressure to ground the boeing 737 max 8 model planes after two recent pressures. The most recent happened in ethiopia just days ago. Dozens of other countries have halted flights, but the United States is still resisting in spite of records which now show american pilots filed complaints in recent months about problems with the max 8. Doug mckelway is live now from washington with the story. Doug . Harris, with canada growing dont like joining many countries banning the max 8, the United States stands alone. Senior officials reportedly held long meetings yesterday and stuck with the tradition of resisting public pressure. Instead basing their decision on data and available facts. Quoting from the faa thus far, our view shows no systemic performance issues and provides no basis for granting the airplane. That, while more members of congress are calling for the u. S. To ground the plane. I point out the fact that given the u. K. , singapore, new zealand, and other places have decided to ground the aircraft out of an abundance of caution, it makes sense for us to do the same. Im really at a loss tricks when while the federal aviation and administration has not been more forthcoming on this. The secretary of transportation i thought put a sticker on it when he said he would have expected the secretary as well as the faa to really come forward more than they have on this. Ethiopian investigators meanwhile have announced that they dont have the Technical Capability to examine the black boxes which were recovered three days ago. They offer no explanation for the delay. A spokesman told me this morning that no decision has been made on where the block boxes are headed. Its believe theyre going to europe. One form and ntsb investigator said that the data wouldve already been printed out and investigators would be en route to finding out what caused that accident if it had been sent to the u. S. That, widely reported in the dallas news said that pilots repeatedly voiced safety concerns about the boeing 737 max 8 to federal authorities. One captain called the flight manual inadequate and almost criminally insufficient. That was several months before sundays Ethiopian Air crash, and it contrasts sharply with statements from two unions represent a southwest and American AmericanAirlines Pilot after analyzing data from thousands of flights, their continuing confidence in the plane. They found out a single anomaly related to control issues. Harris . Harris doug mckelway, thank you very much for the flight attendants unit and also urging the grounding of those planes as the faa is now resisting pressure to ground that boeing 737 max 8. The publics confidence in air travel hangs in the balance whats the best move here . Kathleen, a former commercial pilot, will dream you had. Harris fox news alert, newly released transcripts never reveal former fbi lawyer lisa page told congress that fired fbi agent peter strzok went into the special counsels investigation thinking that it could end with President Trumps impeachment. While potentially boosting his own career. Page also said that the department of justice under president obama pushed back against possible charges of gross negligence against Hillary Clinton in 2016, calling them constitutionally vague. President trump is following all of this. He tweeted this morning, the justrevealed fbi agent lisa page transcripts make the Obama Justice department to look exactly like what it was a broken and corrupt machine. Hopefully justice will finally be served. Much more to come drawing to me now, republican congressman George Collins of georgia. Ranking member on the Judiciary Committee. Good to see you today, i rented to you in the hallway of the capital yesterday. It was good to see you [laughs] harris does this mean in some way, is it possible that the president has been treated differently . What does this telus . I think he has been treated differently. This is not up for debate. This is what weve been saying for over two years will be had democrats making fun of us, thinking it was nothing going on. The transcript released show an inherent 2tier system. One in which Hillary Clinton gets the treatment she got, where there was the first concern that they were going to charge her. Before she recused herself, made it very clear that was not going to happen. And then we see it transitioning right into the same page and became an peter strzok and others, and then going into the discussion on President Trump and the russia investigation. Thats what we see right now. Harris not to make this salacious, and not to lose sight of the fact of why we would believe something that lisa page would say about peter strzok. They were lovers. They were close. They were communicating on work devices, thats how we got to see the text messages. Why is that we are now just seeing these transcripts . Whats going on with the doj in terms of not releasing these things more contemporaneously . This is not up to the doj to release these, this is up to the votes in congress. This was an investigation, if you remember, that was going on the Previous Congress of both the Judiciary Committee and the Oversight Committee as well. At the end of the congress, it ran out. With the democrats taking over in the house they chose to let this slide. Ive not chosen to let it lie. I think they can bill it is needed here. I think what was happening is the result of an intentional effort by the doj to involve itself in a political process and not be the blind eye of justice that we see. Thats why im releasing these. I will continue to release these. I encourage people to follow us on twitter and get ready because more coming. Harris what is it that you hope to show, in terms of where the conversation is now about that twotier system that youre talking about . Which really is political. People would normally think that the fbi, the doj, that there are no politics there. Well, there should be politics there. No democrat, republican, or independent should disagree with me on this point. The doj and the fbi should be the blind eyes of justice making sure that the laws are followed and the rule of law is upheld. What i want to show here is what we evincing a long time, the people wanted to ignore and dismiss that right now, friendly, Loretta Lynch has a lot of explaining to do. Why is she changing the standards to say it really wasnt gross negligence . Maybe because of her relationship with miss clinton . Maybe later on when she got caught with the former president on the plane and she had to recuse yourself . It started way before then. We dont need to give her a pass because of that. This is what we are trying to say the same group, not the entire fbi or the entire doj, but the same group you will find starting in 2016 and going through the appointment of the new investigation it was the same corrupt bunch. You have mr. Peter strzok, thinking this was his ticket to maybe become fbi director. What we see this is a problem. Harris what does justice look at dominic like in all of this . Thats a first part of a question for the second is, are all the people who were involved in this gone now . Or do some of the still exist at the fbi . Him most of them are gone. These three i just mentioned, two were fired in one left of your being demoted. Bruce ohr is still employed by the department. Attorney general william barr, i have a lot of respect for, he said in his hearings he was willing to look into this when senator graham asked him. Because what we find later on in july of 2016, it was the opening of the fisa warrant on carter page. This is an interesting develop it because it was the same folks using dossier materials and others. We have to assure that our investigative groups and our security and intelligence communities are not being used in political partisan ways. This is why we got the fisa courts from the 70s and why they should be here today. This is to say, mr. Attorney general, we are making sure this never happens again. Those that did it should be held accountable. Harris representative collins from the great state of georgia, thank you very much. Always good to be with you. Take care. Harris millions of americans in the path of what they are calling a bomb cyclone are expected to bring blizzardlike conditions, hurricaneforce winds, to several states. Adam klotz tracking the storm from the fox extreme weather center. Well take a peek at whats building. At the faa facing increasing criticism for not granting this boeing 737 model max 8 jets involved in two deadly crashes in just the last five months. Choose glucerna, with slow release carbs to help manage blood sugar, and start making everyday progress. Glucerna. Harris a colorado man is rescued after being buried alive, an avalanche covered his car in about two hours west of denver. It took rescuers about 10 minutes to dig it out. All i saw was a tidal wave. The sun gets shaded out and everything went black. And im getting pushed. I stopped, on my side, almost upside down. Im buried alive pitch black. How long will it take for somebody to get to me . Who goes through an avalanche and walks out of it . I called out of my groove, man. [laughs] harris giving an interview come because it ever since he was okay. Not injured. A massive winter storm called a bomb cyclone is set to hit the heartland, putting out about 70 million americans in the past. Its expected to bring hurricaneforce winds, blizzardlike conditions, and possible twisters to the rockie rockies, the upper midwest, and the plains states. Adam klotz tracking the storm. Hey there, harris. This really just means the storm got real big real fast and its real strong. The biggest danger right now is going to be the wins. Heres the system currently moving across some of the mountain states, areas like denver seeing some of the heavy snow as we speak. But the wind is a major concern with this one. Widespread gusts anywhere from 40 to 60 miles an hour. We have one in denver there, a wind gust of 75 miles an hour. Thats up to Hurricane Force as the system moves across what will be the heartland of the country. With guts widespread areas talking about wind warnings, watches, advisories. This is a huge area. A lot of downed trees and power lines. This system works its way across the country. Everything in these dark blue areas, those are winds getting up to 50 miles an hour or higher. This is a massive area. 70 Million People come and it will be in working its way to the upper midwest throughout the course of today getting into tomorrow. Its a lasting system. Heres what were looking at, Pay Attention to the timing for theres a timestamp in the corner going through wednesday eventually into thursday. Everything on the backside of the system, where we are seeing snow and the temperatures supports now, thats going to be a big snow. Because of the way to get blizzard like conditions. That means visibility is down below a quarter of a mile. He will be able to see for at least three hours, in some cases a lot longer. Thats everywhere highlighted in the red. Those are blizzard warnings across these regions. Everything in front of it could be flooding because theres a lot of rain with this. I think wind is the biggest concern but we do see this now, we do see the rain with the system, also. Heres your forecast of precipitation. In some of these areas, getting up to 18 or 24 inches. Thats not widespread. The wind is. Thats what were really paying attention to you with this one as it continues to work its way across the country there. Harris . Harris adam, thank you very much. Canada just joined dozens of countries grounding the bowen 737 max 8 aircraft after two deadly accidents involving that model. But the u. S. Has yet to follow suit despite a growing call for the faa to take action. The agency has released a statement reading in part, thus far a review shows no systemic performance issues and provides no basis to order grounding the aircraft. If any issues affecting the continued air worthiness of aircraft are identified, the faa will take immediate and appropriate action. Kathleen joins me now. Shes a former commercial pilot, a former Airline Training expenditure instructor, and aerospace journalist. They can reboot with thank you for being with me today. I want to sever the plane itself and what you know about its workforce nature with a lot of airlines here in the u. S. Sure, there is no jet as popular as the boeing 737. Its been around for five or six decades. Some iteration or another. A very save your point with excellent safety record. At the heart of the issue with the 737 max 8 is this new system called mcas. Thats what this debate is about, is how flight crews have been trained ethically when theres a mall function with thm and take the proper recovery procedure. Harris i know boeing doesnt own the planes anymore, the airlines do, but separate from what airlines are doing could boeing step in and say, we are going to do a recall . They could do a recall. Really, in this industry, what they do is a grounding. What i would like to see is why cant there be a happy medium on this . Why cant we reach a compromise . We have two different ntsb chairman on the opposite sides of the range of this. One saying this is a witch hunt, what are we doing . The other saying, of course we need to run the fleets immediately. Why cant there be some terrain in the middle of this when we say, heres what we are going to do. At a minimum, we will take the 737 max crews and put them through simulator training. That be going on right now. We could take everybody, put them through simulator training, take them off line for a day, and run through this. I do the same thing with foreign pilots. I think with the faa is saying, between the lines, by defending boeing in defending the airplane what they are saying is, we think this is pilot error. Make no mistake, thats what they are saying. Harris is interesting, because in thailand they are doing that 7date look. You got lebanon and egypt to take the planes out of their space. The White House Press secretary sat with me in d. C. When i was there, Sarah Sanders. We talked about this because the story was breaking. She responded to the bowen controversy this way. Secretary sanders we know that a lot of people in the industry have started to voice concerns about the amount of technology, taking the power out of the hands of the pilots. You saw the president talk about that in histories earlier today today. This going to be a process that we will be in Constant Contact through the permed of transportation, the faa, and make determinations at the appropriate time. Harris its Interest Income you talk about the focus being on the pilots and not to blame them. Shes talking about lifting up the pilots and making sure the technology is supporting them. What you think about that . Part of the issue here is that most people dont think pilots in third world countries are as welltrained as u. S. Pilots. In many cases, they are not. Specifically they are very low time. Its reported that the copilot, for example, on this flight crew had only 200 hours. Thats becoming the norm, because these airlines are growing so rapidly and there just isnt the pilot supply to meet the demand. So what we have to do is say, okay, we have to train to the lowest common denominator. We cannot train just with u. S. Flight crews in mind. If the put in additional training. Also, we need to talk about that the mcas system more than likely malfunctioned. This of these investigations are looking at. Did a component of the 737 max . If it did, you cannot completely blame the pilots if they did not institute the correct recovery. If, one come in the liner case, they did know about the system. Two, with each human airlines, we dont know what coaching they had. I think more training on this immediately would probably do some things always problem. Harris sir sanders said, do you also want to put those planes, like the training come in light of that lowest common denominator and let the pilot do more and the technology do less customer gets is a question. I want our audience to know that you flew the 727 coming of the 737, but you have extremes with this line of plane. Kathleen, thank you very much. Thank you. David burstein, i will start with you and whats happening with your party as a cause you cortez was speaking. You had a chuckle. Why . She has been very strident about that. She was basically trying to run away from the camera on this point. I think democrats who are for impeachment should go out there and say that, if they think thats going to serve their cause. Democrats were against it should say that. Nancy pelosi is in the latter camp, and at all that is where the democratic partys out. I dont think there is a good chance he will be impeached. Harris david . This was a bigger waste of time than the Academy Awards of the golden globes. It wont go anywhere in the United States senate. There is not the power or the votes to take the president out. It does matter to democratic primary voters. Keep in mind, 51 of democrats now self identified as liberal. Less than ten years ago, that was 28 . In a party that in many ways is run by tom steyer, who has put his fortune up and has used the last three years to get a Grassroots Movement to impeach the president , it impacts 2020 president ial candidates who have to decide if they are going to be for impeachment or not. Because it determines where money and volunteers go. Harris david part 2, because there are two davids onset. I think the reality is they make this 2020 election about impeachment, that will make them lose. Look at bill clinton if you thought impeaching bill clinton was the wrong thing to do, you should think that impeaching donald trump is the wrong thing to do. The reality is that it backfired on republicans to try to push that in the last go round. Harris but i have to do is talk to newt gingrich, who joins us on outnumbered in the center seat tomorrow, about the political lessons of what happens when you go after a president. Democratic primary voters in iowa and New Hampshire are no different than the ones in san francisco. Over 50 of democrats want the president impeached. It is a major issue in the democratic primary. Harris hold on a minute, representative known as the saying this is a tactical move by nancy pelosi and she might want to impeachment. I dont think she does, because she is an institutionalist. She knows what happened to the country when you go through those kinds of proceedings. Its probably not good for the party in the long term, because it will backfire on them with trump supporters. They will go crazy as a result of that process. Harris especially if they dont govern and dont get anything done. The reality is that in the general election this is not a good issue. In the primary, it may very well be a good issue. Every candidate will need a position on this. In the general election, this is what independence hate. Harris this is why i always scratch my head. If you come out of a primary but you dont have the kind of clout that will get you through the general, what was it worth if you concentrated on an issue like this . Exactly, thats why its a problem for 2020 for president ial candidates. Harris good to see both, davids [laughter] more outnumbered overtime in a moment hottest taqueria . And the hottest. What are those . Oh, pierogis . And this is the averys wondering if eating out is eating into saving for their first home.
