Some of the president s outside advisors believe that barr is a wild card who could be worse than Jeff Sessions when it comes to the Mueller Investigation, but he does hold some views that the president does. He wrote an oped saying that the president made the right call by firing then fbi director james comey, saying i know of no former senior justice official, democrat or republican who does not view comeys conduct in july to be a usurpation of authority. She was an effective spokeswoman for the department of state and enjoys the confidence of secretary pompeo and President Trump. Im sure that she will perform well at her hearing, and i look forward to supporting her nomination. When those will be nominated for, not a lot of time and this month, but they may try to get it in before the new year. Harris i know that you mentioned this last hour, and i am seeing catching a tweet, and this would be per bloomberg, but you reported it too, Heather Nauert will not be in the cabinet. We were being told that the new u. N. Ambassador post is being downgraded to a noncabinet level, that is a report that you had it for us last hour, what more have you learned . I actually had it weeks ago, but who is counting. Harris you are. It is not being downgraded per se, because the job of u. N. Ambassador has always been subordinate to the secretary of state and the flow chart of the department of state. When nikki haley took the position, she insisted on it being a cabinet level position, and the president does have discretion to decide which positions are cabinet or sub cabinet. But now they want to return it back to sub cabinet level so that when you get those big days at the United Nations security council, that mike pompeo, the secretary of state would be there sitting across from Sergey Lavrov of russia, and having the u. N. Ambassador do it. Thats a way that it has always been done. Nikki haley changed it up. So its not being reduced. Its going back to the way that it has always been. A tremendous amount of experience and texture to what he can bring to the table, and easy nomination process, confirmation to see . Right now i would have to say that things are still so polarized that it is going to be tougher than you might think. Even though in the past he has been praised and approved by democrats, i just think that anything that touches President Trump, unless it is a visceral reaction, im hoping that it is quick and easy, but i think that there is some meat on that bone. It will be a little bit tough. Harris what do you like about william barr and what he can bring right now . I think the fact that he has been staying in tune with what has been happening, number one, but his experience as a an attorney general is critical, but also out in the private sector for substantial period of time dealing with realworld problems from that angle. I think that that is integral to having the experience necessary to be the attorney general. And im hopeful that he will keep some of the promises that the previous attorney general made to me. So im looking forward to his nomination and confirmation. Harris the president has said today that william barr was among his first choice anyway. What do you know that the president may be looked at, because he does talk to his confidantes when he is going to nominate somebody. We know that from reporting, what do you think he saw in mr. Barr . I think that he saw a world of experience, and that its very important to the president at this time. And in some ways he is trying to stabilize certain areas. And the doj has not been necessarily cooperative with congress in the oversight and hes looking for somebody who understands the relationship and has a longterm experience to be able to qualify that relationship and meet congress halfway. Harris you know, barr has criticized part of that investigation, and i just want to get to your quick thoughts, because it looked like earlier that may be the Mueller Investigation was toning down, we would see it in. We do not know, because we do not know what he had. We have no idea what mr. Mueller is going to do, that is part of the problem. Im not sure, nobody has seen an unredacted scope letter, so we do not know what Rod Rosenstein gave him authority to do. So he has been wondering all of the sudden. That does not have anything to do with conspiracy and the effect of the election plate having a strong attorney general will bring some oversight into that. And i think people need to understand, nobody is talking about pulling the plug on the Mueller Investigation. There needs to be some kind of constraint bringing back into the mold that he was supposed to be in. I think that its one of the aspects that i like about the nomination. Harris that is very interesting. Meanwhile, i have been talking about it. Lets jump right in, a busy friday afternoon, we are expecting with the regard to the russian probe, Robert Mueller filing this and sending memos, he will do so now with Paul Manafort and Michael Cohen, could reveal how manafort had his plea deal. Maybe give more details about how much Michael Cohen cooperated with the special counsel. Releasing similar documents as a mention on Michael Flynn and heavily redacted, so we cannot get too far over our scheme, congressman, your thoughts . I think we will have to see another page of black lines going through it so that nobody can read what is going underneath it. That was the main thing that i got out of the flynn report, what is there . Nobody knows, really. And that is part of the thing that is disappointing all of us so very much is the amount of redacted information and in the constitution or the republic like we have, we want to know that information. The American People want to know it, and certainly Congress Needs to know it. And i expect that you will see a lot of that in the manafort, i dont know about in cohen, but you will in manafort. Harris are you looking for the veins back to the investigation . We are so far appealed, do they help you with the process or not . What they tell me is that the unredacted portions, they say, this does not have much to do with the 2016 election and russian interference in that election. And i think we will see the same thing in manafort, so i am looking for some tiein with the original purpose of the special counsel. Ive not seen it. I think that that is particularly vexing to those to say that mr. Moeller has far exceeded the scope of what he is supposed to look at. Harris congressman, we are waiting the president to take the lectern in kansas city, and i appreciate you being here, speaking about some of the issues that he may even touch on in a speech today, good to see you, thank you. I want to bring in now the senior legal fellow at the heritage foundation, former counsel to the assistant attorney general under bush 43. A pleasure to see you today, and i mentioned that we may be interrupted by the president because we are fully expecting him to arrive at the venue in kansas city, missouri, after seeing him on the tarmac. He is well within a few minutes of that now. So i may break away from that, but first of all i want to mention to the audience, you know william barr. Thats what my team mentioned to me, and so i want to get some of the history there with the president s nominee for attorney general from you. Is a congressman said, he is highly respected, he is very qualified. But the key thing for the president im sure is the fact that everybody is talking about his two years of experience as the 77th attorney general of the United States, but he had five years of experience at the Justice Department, including as the deputy ag, that is the number 2 spot held by Rod Rosenstein. That is very important, because it means that he is not going to have a learning curve. He knows that Justice Department inside and out. Which means that he will be able to hit the ground running as soon as he is confirmed. And by the way, all three of the positions that he held inside the Justice Department, he had to be confirmed by the senate, he was unanimously confirmed to be the attorney general and in all three positions, it was a democratic controlled senate that confirmed him. Harris so if they fight it too hard they are going to have to explain exactly what has changed, outside of gaining more experience. From what youre talking about. You know, it is being reported, some reports are saying that to their president has been asking nominees whether or not they would recruits themselves from the russian investigation. That is not my reporting, but i am repeating that of others, would that be a question that you would ask . Of course, that is a question you would want to ask anyone going into the top position of the Justice Department. The president has a right to know that. I have not seen anything in either his background or anything that he said that would be a reason for him to recuse himself from basically taking over supervision of a special counsel. Which under department of justice regulation, it is supposed to be the attorney general. Harris all right, well, as far as what we know about the Mueller Investigation, i dont know if you can hear congressman andy bigs of arizona talking about this, but what he liked about william barr is that it may add a router to the shape of the investigation into the president by or his campaign by mueller, what is your thoughts . No, i actually agree with that. I do not think that the special counsel has been supervised in his work the way that he should be in a way that the attorney General Office has an obligation to do. Maybe mueller has some kind of evidence that has not been publicly disclosed, that is certainly possible, but through today, not a single one of the indictments that he has put out including the ones of cohen, of flynn, and of manafort provided any evidence about any collusio collusion. Harris lets talk about what we could see a drop today . I dont know what neon light or what you can use to read through the redactions, i think that you can too. But there were so much that was redacted with Michael Flynn, sentencing memo from earlier this week if we get two more like that on Paul Manafort and Michael Cohen, what is a point of releasing the information . What is the strategy . The reason that the special counsel gave was because it pertains to an Ongoing Investigation, and again, that may very possibly be true, but in the manafort case today, we are supposed to get a sentencing recommendation memo from mueller, and a week or so ago, filing a special pleading with the court accusing Paul Manafort of having lied to the special counsels office since he agreed to a plea deal. And the special counsel said, i will detail what those lies are in the report to that is going to be filed today. So i think that we are actually going to get information on what the supposed allies are that mueller is accusing him of. Harris it is great to see you, thank you for your time today. And as the president now has made a new nominee, a new nomination for the role of attorney general and william barr, we will talk about that and monitor this, and if you toggle back from the safe neighborhoods conversation to some of the items that the president has been making big news on today, we will take it back alive. I want to bring in who has been standing by, darrell issa on the house judiciary. And again, the president they are introduced, and i want to talk politics for a second, because the democrat said, oh, we are going to start investigations on some of the things he said, and the president has taken that out of the hands of his political opponents or critics, we should say. And now made a nomination that a lot of people are feeling that they can get behind today. That is exactly right. This is someone today it would be unheard of, but even then it was rare, unanimous appointment, the important thing is that it is not just a superb senior attorney who has been some time ago the attorney general, it is that this is somebody who both sides know can handle the large bureaucracy that can button up and close up a lot of cases, and people can trust without a doubt that democrats would be disingenuous if they do not admit this to over see a number of prosecutions and investigations including the special investigation of mueller, that is important, because this is somebody that goes beyond any question and is an outsider relative to trump, he was not on the campaign. So the credentials are impeccable. Harris this is somebody that the president said he had his eye on from the very beginning. By some estimation, some critics, even within his own party have called it an establishment pick, but he was nominated as you said 100 confirmed and democrats reported that. Lets move on and talk about james comey and his testimony behind closed doors on the hill. Why is it congressman isa that he so much wanted this to be public and now will get the transcripts, that will come out in the next day or so, what was it that he did not want to answer . Are there questions that you think will get asked, will not get asked . He wanted a public spectacle, and he really wanted 5 minutes back and forth with members taking shots. He almost got it, because he is going to have the transcript public very shortly. But the one thing that i can tell you today that surprised me is that under trey gowdys questioning and John Ratcliffe ratcliffes, it was the Justice Department meaning that the fbi attorney that was their time and time again. They are to the pleasure, but told him not to answer, question after question, fundamental to the investigations that brought him there. There is no question in my mind, we will be over at the fbi, we will be over at the department of justice working out the details for a great many things that they came prepared not to answer. Harris like what . I have to be a little careful, lets just say in Broad Strokes that everything related to hilarys investigation, everything related to how they got onto it and what their process was, everything related to the fisa warrants and the fake dossier, broadly, those are the areas in which time and time again he is not answering. And i have to be careful, because the transcript is not out and i want to respect the process, but the one thing that is remarkable is even though i cant tell you what he did say, i can tell you that there is a large swath of very Important Information that he is not saying. Harris can you ask him at all about why employees who were showing bias in their Text Messages were not completely removed from the agency . Im talking about peter strzok and lisa page who were all over texting on their work devices about how they wanted to keep President Trump out of the white house . When the transcript comes out to you will see incredible detail by trey gowdy of those questions, exactly the ones that you are talking about. And you will be displeased, but may be a little surprised at the answers. Harris displeased, you cannot give me you will not accept the answers as he answers that you would think a forthright individual would give. Harris can we also talk about leaking . Because i conversation was deepened when we found out, we knew that there were leaks and phone calls with World Leaders in the president s early calls with those that were made early on in his presidency, and that sits in one lane, but when you have the fbi director leaking to a buddy who he knew about certain things that we now know to be true, did you ask him why he did that . Those questions are being asked, this is exactly where comey speaks out of both sides of his mouth. He doesnt want to answer a lot of questions. Even when he answers, i would call them evasive. And as you say he has been a master of leaking. What is irritating, and what the American People really are upset about is the fbi will claim these privileges of Ongoing Investigation, which by the way is not a legal privilege, but one that they claim. And they will for their own purposes leak what they want to leak to get something. And then complain about leaks. One of the things that i learned in 18 years in the house is that you believe in transparency, you have to be consistent. The fbi is not consistent, and we in congress have to make sure that the executive branch becomes more consistent in either they do not tell anyone something, because it really does protect sources, or it is open to the public at a reasonable time as their right to know. And we are not getting that. Harris congressman, i am curious, you are on the oversight committee, if you guys do not get the questions now, will we ever get the answers to some of these questions . The last word is fast and furious, when democrats were in control of the senate and Senate Senator grassley was lied to, it was a majority in the house that worked with his staff to get the truth for him. The reverse has to be true, the majority and the senate, the republicans of the senate have to pick up whatever is being left behind for absence of leadership in the house, and i hope that they will. A federal judge has given Judicial Watch to go ahead to demand more documents. I will talk with the president of that conservative groups next about the answers that he is looking for. Stay close. Harris the oddly never ending clinton email controversy takes another turn as federal judge now has ordered an additional Factfinding Mission into whether the use of a private email system was a deliberate effort to thwart the freedom of information act. That judge says that despite previous clinton email investigations, conservative group Judicial Watch should be permitted to the man documents and additional testimony about the practice. Gillian turner is live in washington with more. This is a really interesting turn. One that not a lot of people saw it coming either, harris. A u. S. District court with a new 11 page order addressing her use of a private email server when she was the secretary of state. A blistering critique of the state department, the Justice Department, and of clinton herself. Insisting despite congressional fbi investigations already completed, there are still questions that remain unanswered in the eyes of the law. More facts in terms of whether setting up the email server for the specific purpose of dodging the freedom of information act. Asking for access to any information at any time. The government should not keep information confidential because Public Officials are embarrassed by their disclosure, because the failures may be revealed, or because it is speculative or abstract fear. Coming in response to a filing by conservative Judicial Advocacy Group traditional watch and supports her bid to gain access to official documents and even requesting further testimony to the people involved. Representing the state department, judge continues to look at the court taking no pleasure in questioning the intention of the augustine executive department. But it still remains unknown if she used a private email server to deduct requests. Judicial watch has responded to the order enthusiastically. Saying that they hope it will do state and justice and to be more cooperative. The president of the group tom fitton adds that he hopes the agency will take the judges criticism to heart. So this is a victory for you, and some of the attorney general Jeff Sessions might say that it is a victory for the Justice Department to force them to do something that maybe they should have done before. What are your thoughts . One aspect of the ruling is the court has not just criticize the obama state department, but highlighted the problems of this Justice Department, continuing to defend the indefensible. He specifically talked about the chicanery of this Justice Department continued defense, and excuse making for the misconduct of Hillary Clinton in the state department, the Justice Department previously. Also talking about not being terribly convinced about mr. Comeys testimony about the thoroughness of his clinton email investigation. And it shows you the value, frankly, harris to watch an independent group like Judicial Watch focused on this, because congress has dropped the ball here. The Justice Department frankly is on the other side of this even during this administration. In the course has been hoodwinked, the phrase that the court highlighted in his decision, so they are not going to back down, and now some people like mrs. Clinton, potentially are going to have to answer additional questions. Harris i am curious about one point, because we found out recently that of uncle trump also had her own personal email server with some emails on it. And she has talked substantively about how all of that sits on the white house server and that nothing had been deleted. If critics of the Trump Administration question about that comparatively to Hillary Clinton and what you are seeking, what is your answer . Well, frankly it highlights the egregious nature of what mrs. Clinton did when you compare what happened with of uncle trump where he had some emails about government business being sent on her private account before and after her work at the white house, emails by all accounts they were captured and preserved, which is in fact what they probably need to be, there is no legal prohibition on using personal email for government business now. The difference is that Hillary Clinton, specifically set off an email system to make sure no emails would be captured by the government and provided to investigators. As long as she had anything to do with it until as the court highlighted, Judicial Watch caught them. Harris there is another difference and i wonder if this investigation could get to the bottom of, will we ever know how many and how it is destroyed, all stories about taking out into the woods, and they attacked a period and the server was destroyed, what are the facts that you know so far about that . It is the deletion, that sort of accusation. At least half of the emails Hillary Clinton improperly took from the white house were destroyed, 33,000 of them. As best we can tell because we have been getting the emails that the fbi has been able to either recover or otherwise find, the fbi has only been able to find 5,000 of them. So there are what . 27,000 email still missing. And highlights the egregious nature of what mrs. Clinton did. The massive destruction of government records. No business taking any of the emails out of the state department, and she did. And the American People deserve full answers, and frankly, the court is speaking for millions of americans and demanding accountability here. And i hope that the new attorney general is paying attention to the decisions like this, because this is what is going on in the Justice Department.
