These abuses in the future. And if it means going to court, i will do that. Harris at the president mocked that legal threat tweeting, i hope he brings a lawsuit, then it will be very easy to get all of his records, texts, emails and documents to show not only the poor job he did but how he was involved with a mueller witch hunt. He wont sue john roberts has more from the north woodlawn. Reporter and people thought the already heated battle between the president and former cia director could not get any hotter but it certainly has. The president their daring brennan to sue. They believe President Trump was trying to stifle free speech but brennan insisting that has frequent scorching of the president was not political. This in here. He continually lies to the american people, and of the types of things hes doing, i think i need to speak out. Ive been speaking out rather forcefully because i believe its important to do so. I dont believe im being political at all, im not a republican or democrat. But there are some people who while they dont agree with the security clearance, they do believe that and brennan is outofbounds with his publicly visceral criticism of President Trump. Listen here. He has been incredibly critical of the president , and i think that has put him in a political place, which actually does more damage for the Intelligence Community, which is a politically apolitical, evens retired. I dont support him being as critical of a president as he has been. Porta mack and other president s taking aim at a number of other people saying the two are worried about losing access to classified information. The president we did this morning Everyone Wants to keep their security clearance. Its worth great prestige and big dollars, even board seats and thats why certain people are coming forward to protect brendan. It certainly isnt because of the good job he did. Hes a political hack. The white house drafting more security clearance revocations and one of the people in the cross hairs is the Justice Department official bruce ohr who was Christopher Steeles handler at the department of justice and, whose wife works for a fusion gps at the time they contracted still to come compile that dossier on President Trump. The president added that ohrs job may be incumbent mike jeopardy ever be fired from the Jeff Sessions Justice Department a total joke. We are told the white house is preparing security revocations for ohr as well as james clapper, the former director of national intelligence, james comey. Hes there twice, that shows how much they dislike him. Sally gates, susan rice and Andrew Mccabe have already lost their security clearance because they lost their jobs. The action, harris, the white house will take this week will be to revoke the security clearance and people who already have it, and for those who have lost it prevent them from getting another one in the future. I guess when you make the list twice, its critical. Clearly they dont like him. Harris republican congressman chuck flashman of tennessee who serves on the appropriations committee, and the Homeland Security subcommittee. So right on time with this issue. The missiledefense caucus, and of the Nuclear Security working group. You are a busy man, in new york, new york, visiting at least appreciate you stopping by, congressman. Lets start with being with security clearances. The one argument we havent heard from john brennan for keeping one is because he might need to stay ready. You know on i needtoknow basis stay by the american people. Its interesting and really that could be his only tenable argument. The courts will look at this, and i think the president is right. The courts will be very deferential to the commander in chief. Donald trump represents the executive branch of government which is very important, there has to be discretion given to the commander in chief when youre dealing with somebody so critically important as National Security. I think he will win on both grounds. Harris the Homeland Security subcommittee, you know what it takes to get a security clearance. Are we in a situation where the president has made a list thats too wide or too long . I dont think so. I think there needs to be an deference to any president whether a former president or future president. Thats why i think that brennan is wrong in the courts need to be careful that our chief executive whether it be donald trump or a future president can look out for the security of the United States. I think with all of the partisan rhetoric, we cant lose fact of the site, National Security is critically important. Donald trump gets out, i get that, i dont know if brennan gets out. Harris do you think there was a problem with him keeping his security clearance in terms of National Security . And i also want to remind everyone that it was senator mark udall and a couple of other democrats who said they took exception to what happened under brennans cia. He came under fire for snooping computers used by senate staffers. They wanted him to resign at that time. What is different now among democrats, would you say, with where he is now . Because they are jumping to his defense. It doesnt erase his past. I think i think thats wrong and bad and will hurt them in the midterm. Think about it, not everyone is a conservative republican like me, but most americans who are in the middle, independent and apolitical, they dont want this. They want our country kept safe and they want our president to be able to make sure, as wells are members of congress, that our Intelligence Community is doing the right thing. This is clearly within the purview of the executive branch and i think that except legislative branch. What i hear you saying though is not only that hes not taking the president to court but he would not have a winnable place anyway. Quick thought on that and then i have a follow. I think youre absolutely right. When we look at the separation of powers, the judicial branch, ultimately the Supreme Court will say, this is what a president can and cant do. But i think they will be cognizant of the fact that for future president s, not only President Trump, but we dont want to establish the precedent where the president of the United States is tied to, his hands or her hands are tied when it comes to a situation involving National Security. 4 million americans have National Security clearances. Some are higher, some are lower. Those people that we are talking about are at the highest level and we have to defer to the executive branch and issues such as this. Harris congressman, admiral mccray this and said he would offer up his personal security to the president. Your last quick thought . Rep. Fleisshmann im a member of congress and i have a security clearance. I view that is a tremendous member of responsibility. It donald trump feels the same way. Those who have a security clearance if they are needed by the president or by the legislative branch should be able to use that. However, if they abuse it for political or other purposes, thats got to be something that needs to be addressed. I think its high time that we Start Talking about it as americans, not as republicans and democrats but as americans first. Harris great to see you from the great state of tennessee visiting new york. Thank you. Im under the fox news alert, new reaction from President Trump after the report of the white House Counsel don mcgann has met with muellers team for the past nine months. President has not tweeted disgraced and discredited bob mueller and his whole group of angry democrat thugs spent 30 hours with white House Counsel only with my approval for purposes of transparency. Anybody needing that much time and they know there is no russian collusion is just someone looking for trouble. Doug mckelway reporting from washington with more. Reporter the New York Times saturday bombshell story reported that white House Counsel don mcgann cooperated extensively in the Mueller Probe. He describes how he met with the team voluntarily on three occasions for 30 hours and come up detailing the president s fury towards the Russian Investigation and assuring trumps most intimate views. It suggests that mcgann cooperated in part because he felt the white house was setting him up to be the fall guy for any obstruction of justice charge. Yesterday, Rudy Giuliani tried to quell spec elation that mcgann betrayed the president knowing the white house could have claimed executive privilege but decides not to. Hes got 32 witnesses in which we didnt raise executive privilege. And in the case of mr. Mcgann, he could have had even better privilege, he could have had attorneyclient privilege. The president encouraged him to testify and is happy that he did. Those comments are reaffirmed by mr. Trumps tweet on saturday. He says, i allowed the white House Counsel, don mcgann, and other members to fully cooperate. No collusion, no obstruction, witch hunt. To some, the times story suggests that the Mueller Probe is about to concentrate into a huge construct on the crescendo of indictments and others think its about to fizzle out. It looks like the investigation is actually winding down. If there is not even a hint that the president or campaign of anything to collusion. John brennan takes a different deal. Yesterday he said that on the very night that canada trump called for russia to find missing emails, russian intelligence agents went about doing just that. He also cautions we should all wait for the mullah report to come out before coming to any conclusions. Doug mckelway, thank you so much. Fox news chief political anchor now, bret baier. Lets start with where we are with mcgann, what do we know about him and how does he figure into this, how did he get into the hot seat . The president allowed him to be interviewed as you just heard. We dont know obviously what he told mueller and his investigators and i dont think the trump people know for sure. Obviously, mcgann knows and his attorney knows but what we do know is something that was down in the article, about the ninth paragraph down and beyond that, the 30 30. 30th paragraph. Mcgann told investigators he never saw President Trump exceeded his Legal Authority in all his time, and secret meetings and private negotiations and is talking about this investigation. An interesting statistic, and the the other thing is that we know that he is free to say whatever he wanted to say. In 30 hours of testimony, with the mueller folks, and thats pretty unique for the president to say to a white House Counsel, go ahead and do that. Harris as i was watching, just kind of what was being reported on the timing of all of this, and theres the discussion of whether or not the president should sit down with robert mueller. If you can show that other people can answer 30 hours of questions, it might be harder for you to then ask the president to sit down and tell you something you dont already know, which means other people can verify information which makes it less likely that the president would have to sit dow down. Bret it takes the urgency out of the request. I think the mueller people want to sit down and ask questions of the president and it doesnt seem like its headed that way to listen to Rudy Giuliani. But you are right, i think that openness that the president exhibited with letting the white House Counsel talking all the other officials talk, people say thats a bad legal strategy to protect the president. But the flip side of that is, they believe that there was nothing to see there. There was no there there. The white house will regret not evoking executive privilege. This shows what a c level team will have. You never waive that, absolutely not. And that put mcgann in a possible situation because once you weigh that privilege and turn over all those documents, don mcgann has no choice then but to go in and answer every everything. Harris of course he is looking at it for the eyes of a federal prosecutor, Chris Christie. Bret and we dont know what date or didnt happen in those hours of testimony. But we do know that the initial thought process with the legal team and the president was to be open. And a Chris Christie is saying that is a stupid thing and leaves the president vulnerable, but perhaps there is some evidence there to suggest that they felt like they were on solid ground. Harris i do want to talk about who don mcgann is and who he has been kind of in relationships of the white house. Hes the same don mcgann of the president was talking about getting rid of at one point, at least according to reports. What do you make of who he is in relation to the president . Bret he has survived the turmoil and been behind the scenes. Hes taken a primary role in picking and helping in the process of the nomination for Supreme Court justices. And, in that role i think he is being glorified in the president s eyes because he thinks he has presented him with a lot of good choices, and obviously its been one of the biggest successes the President Trump touts. Harris summer making the argument today that this assignment that the president obviously trust because he did open the door on transparency. But as you and i have talked about, you know, it also takes some of the expectation and onus and pressure off of the president s legal team to make them available they can get information from all these others. Bret we dont know what we dont know, we have to say that every day. We dont know exactly what mueller is going after or if there is something that is coming that we dont see. Everything here is speculation, but what we can say is that mcgann told investigators that he never saw the president exceeded his Legal Authority. You can argue what that is but its pretty significant. Harris bret baier, we will see you at 6 00 p. M. Eastern as always, on special report. We are awaiting a jurys verdict in the financial trial of Paul Manafort. Who extended deliberations could benefit, according to his attorney. And what we can expect in his next trial, yes, a change of venue in washington, d. C. Plus trouble may be ahead for the president s former personal attorney. What investigators are planning to do with him come next. Stay close. Allergies with sinus congestion and pressure . You wont find relief here. Go to the pharmacy counter for powerful claritind. Harris fox news alert, jurors deliberating for day number three on the financial fraud trial of former jump camn manager Paul Manafort. Prosecutors say its a good sign for their client. Peter doocy is live outside the white house. Reporter upon returning from a weekend away, jurors who had been sitting in the same seats in the courtroom just about every single day came in and sat in different seat seats. Nobody knows what that means yet and they havent had any questions for the judge yet today but the judge has been doing his best to protect their identities, insisting today that their names will remain under seal even after the trial is done and of other things are released publicly. The judge says that he woulds suspect they would be subjected to threats similar to the ones hes received since the start of the proceedings now on the 15th day. The judge had to deny a motion by a group of news outlets like cnn, the New York Times at the apa who wanted everything on sale before the end of the trial including juror names. Now the Manafort Team believes that the trial has taken on the feel of the final days of the 2016 president ial campaign when he many experts and pundits expected things to go one way and certainly others were surprised by the results. The difference is many people here had predicted a quick verdict in this case and it has not happened yet. The lead defense attorney also continues to express his belief that the longer deliberations drag on, the better for their side. The Manafort Team met today and hes being held in a small cell without access to a tv, book or anything like that and a source indicated that when or lose in alexandria, they will have to quickly refocus for his next trial in federal court, in d. C. Next month. Harris and peter, thank you very much. We will come back to you as a news warrants. Ian pryor is a former Trial Attorney and former Principal Deputy director of Public Affairs at the Justice Department. That was his first interview since leaving the doj. Great to see you today. Can we first talk about this advantage quotient that the defense is talking about . Is it true that the longer that it takes, it benefits the defendant . Ian it well there are two sides to the coin, its not a general murder trial where there is a weapon and an eyewitness, this is a trial involving 18 counts. Its not necessarily unusual for a jury to deliberate for an extended period of time, but it does look like Paul Manafort may have some hope here. First, the jury came back with a question, what does a reasonable doubt mean . If you are a defense attorney come any time someone comes back and ask for their burden of proof, they are thinking about whether there is enough evidence there. The second part, and its a small thing but the fact is that they had this on a friday. Juries know im did not like tk on a monday. If they get into the weekend and they are thinking about reasonable doubt, it may be some reasonable doubt does creep in. Its tough to know what the jury is thinking, but i do see some of that there. Harris if manafort is found guilty, what can the president do . Can he pardon anyone whom he wants . Absolutely. And there is a lot of misconception out there. The president has pardoned several people without going through the department of justice. The president has a pardon power from the u. S. Constitution, in the 1890s that was delegated to the office of department. It but it doesnt limit what the president can do. The president can pardon anyone, bill clinton pardon at 39 people without going to the Justice Department including his brother and whitewater associates. Harris the reason i asked about this too is because the president was giving his support as he was boarding a flight last week saying, he was basically a good guy and he wasnt with the campaign for all that long but he is a good guy. Lets move off to someone in the consolation of the president. Thats attorney Michael Cohen. Feds are allegedly investigating Michael Cohen for bank fraud and campaign violations, saying they are ready to charge. What does that mean for the president . Ian where this is really problematic as it goes into midterms in the fall. So you have two essentially on trial. Ive seen several reports over the past year and a half about what mueller is looking into, is getting indicted next. They havent come to fruition for the most part, but i do think, is this problematic . Sure. Is it unprecedented . No. These things happen, and people end up getting indicted. The one the president says, he calls it sad, the people who have been near him. I know i mention that this is your first interview since leaving the doj. How i where were you of the alleged conflict of interest or improprieties with bruce ohr . Hes being looked at two at the doj for possible conflict of interest. His wife worked for the same company that put together the antitrust dossier. That stuff had already happened, and obviously i have seen the reports that have come out since then. Its important to know though, one, there is the cart Inspector General investigation into what happened with the dossier, and thats a political appointee and the government. I think you saw that was peter strzok and jim mccabe, different than with comey who is a political and appointee of the president. We have to let the process play out and i think the department of justice will make a decision on that report. Harris the president is preparing to honor i. C. E. Agents at the white house. A Panel Discussion on Border Security will kick off at the white house and the 90 minutes, to a couple of hours, we are told. The president is putting his hardline immigration sample be a winning issue in the midterm elections. Watch. President trump we are very tough at the border. We are setting records despite horrible, horrible immigration laws of the democrats do not want to fix and i think thats going to them very badly at the polls come november. Harris kevin corke is life for us at the white house. Busy day on immigration. Reporter yes indeed, and you are right, an opportunity for the president to further draw a distinction between how his administration views the border and the rule of law and compare and contrast that with how they believe the democrats view it. Which is to say, democrats want to abolish i. C. E. And they also want to throw open the borders to all comers regardless of merit. Thats a white house position. So to that income of the administration is obviously looking forward to what could be a very interesting if not spirited Panel Discussion and a chance for the president to honor isaac and i. C. E. Agency e house. I want to share part of a letter that the president has penned. This is asking state and local leaders for their support for the women and men of i. C. E. And for Border Protection for folks who keep us safe. He writes this, each of you as a chance to end a duty to protect your constituents. I urge you to work with us, and our brave i. C. E. Officers. Of course just last month the president went to twitter and said, without borders, and without the brave heroes of i. C. E. , we would have no enforcement, no borders and no laws. But critics as you can well imagine, harris, are aghast that the president would honor a group that some believe are frankly the problem at the border, and not the border. Only this white house would give medals for taking thousands of immigrant children from their parents and continuing to detain hundreds of orphaned kids in defiance of a court order. That again, tom john awaits, center for american progress. This is a political winter because as you believe in right or left policy, you probably believe in the rule of law and that is what they are hoping to emphasize here today. Harris, looking forward to it. Back to you. Harris Thomas Thomas homant to see you today. These are your people to the president is honoring and you were with them not too long ago because its only been about a couple of months before he left. Your thoughts today on the president actually honoring the members of i. C. E. . Thomas first of all, i thank you that they are my people, they are americas people. They are home every day to protect this country. And, this is why hes a great president. Ive been with the president on numerous town Hall Meetings and the folks that wear that kevlar vest every day, what hes doing is right for america and write for Border Security. As far as a political pundit, he is one that will continue to bear, i could vilify i. C. E. Officers and i find it unamerican that you would want to attack Law Enforcement officers for merely doing their job, enforcing the laws that congress enacted. What does this come to . Im glad the left has finally shown that they want open borders. I think it will help in november, i really do. Harris at one of the things that people are talking about are the separation of families, and voters take that to the voting booth with them. What do you want people to know from your perspective about i. C. E. At that situation . Thomas lets talk about family separations. For these people who want to question the separation, whats the option . They take advantage of loopholes in the system, many dont show up in court, and thats an open border. I myself have been to congress on numerous occasions telling them to close the loophole, we cant detain families together. Until they see the judge. You want to have due process here, we want the same thing. But we want to release them into the wind. It people question why we do what we do but the people that need to look in the mirror is congress. Congress had the ability to fix it, but didnt fix it. Harris real quickly, there are nearly 629,000 be sent overseas in the United States and that the last statistic from fiscal year 2016. Its not just about the border, but thats an area that the president has talked about. Today, as you say, americas customs enforcers are your people, our people, they are being honored at the white house. Tom, great to have you. Fox news alert, another deadly weekend in chicago. At least six people were dead and 50 were shot since friday alone. Despite more officers deployed to stop the bloodshed, chicago pd superintendent Eddie Johnson earlier today. This isnt a widespread issue amongst chicagoans, its the same people. Theres a small subset of individuals who think they play by their own rules harris matt is life for us in chicago. That Chicago Police superintendent is yet again pleading for the judicial system in chicago, and he says this weekends violence alone goes to show that criminals are not afraid to pull the trigger here in chicago. Chicago Police Superintendent also urging the governor to sign a bill that would give the state of illinois the authority to audit gun dealers. Right now in illinois only the atf can audit gun dealers and Chicago Police tells fox news that the atf is overwhelmed with those audits and the Police Department wants to assist. Police say since friday, officers recovered 83 illegal guns in may 29 arrests. If the criminals are punished, please say it will be just be more of the same. We need everyone, especially our judicial partners to start making repeat offenders feel real consequences for their crimes. Over the weekend, chicagos violence once again claiming victims of all ages. Police discovered the body of a 17yearold and a 16yearold shot dead by a park. Today there is outraged by the family a 15yearold steven rosenthal. On friday, the teenager shot himself while running away away from officers. No officers fired their weapons during the chase. The family refuse the claim and they are begging the mayor for help. I need the attention of the mayor, my nephew would never commit suicide, ever. They need to release the videos. Mayor rahm emanuel recently assigned 600 additional officers to patrol the streets and break up any unnecessary gatherings but it looks like right now that may not be working. Harris we have had black pastors on this very show say its time for emmanuel to go. They are looking at the president , someone who has better ideas at this point. Harris a fox news alert fox news alert, President Trump escalating his attacks on Robert Muellers russia investigation calling his team a National Disgrace and accusing them of trying to attack them and turns. And he tweeted this yesterday, study the late Joseph Mccarthy because we are now in a period with mueller and his gang that make Joseph Mccarthy look like a baby. Rigged witch hunt. Our power panelist, Marianne Moore former Senior Advisor to john kerry. Marianna haworth, and a board of directors for the independent womens forum. Great to have you both. Lets start with the ratcheting up of rhetoric, nan, and where you are with the president comparing it to that. The president has a reason to feel as though this is a prosecution that feels never to end. Would you compare it to hunting communists in the federal government . May be a modern day term we could use is john brennanism. Those attacks with no evidence whatsoever, and in fact his peace in the New York Times last week had no evidence that the president somehow, his election was due to russian pollution. And yet he persists in much the same way. Joseph mccarthy in the 50s that i have a list of communists in the government. The more closer that mueller gets to trunk, the more trump lashes out. We saw this and other investigations whether it was the Paul Manafort trial rhythm michael radar, or his son being in trouble for the trump tower meeting. Now he finds out that his counsel has spent 30 hours with mueller. That he allowed it. Even if he did, no one in the white house knows what mcgann shared with mueller, so hes lashing out in an effort to shape the court of Public Opinion because i think he fears very much whats going to happen in the court of law. Harris we do know that don mckinnon said there was no evidence that the president exceeded his Legal Authority. There is a lot between letter a and b there. But if you consider the fact that the president is not in the least bit seemingly perturbed about the fact that john mcgann spoke with mueller that team and said i authorized it. Theres a lot of ways in which the Mueller Investigation has leaked what they want to say adversely about the president in various ways and yet there is really no substance thats come out of any of this. Harris brit hume, and i dont know if we have his tweet, i follow him on twitter. Our senior contribute or for politics on fox tweeted out that he thought it was ridiculous there it is. This is ridiculous, talking about and you dont see the twitter thread but its capture the president and then comparing what has happened to mccarthyism. Nan we like to know that the president likes to be vivid in his frustration is understandable. And alan dershowitz, who is no fan of the president s politics, im sure, and said that this investigation with that seemingly infinite is excessive. Harris the first thing i brought up was the opportunity if you will, its harder than to make the discussion, and clearly other people have information they would put on that pressure point. First and foremost is, they learned today that don mcgann felt he was being set up by lawyers in the white house which is why he cooperated the inside as much as he did. I dont think anybody knows what don mckinnon said and i think a fear amount of it was the sam same. And hes stalling because mueller will take that subpoena harris i dont think we know what you just said because politically the president said he would sit down with mueller but hes going to listen to his attorney. Please stay right here, we are coming right back. The democrats finally meeting with Supreme Court nominee brett kavanaugh, and appealing to him directly for more documents. Is this how you do it . More politics, power panel stays if you feel like you spend too much time in the bathroom with recurring constipation and belly pain talk to your doctor and say yesss to linzess. If its severe, stop taking linzess and call your doctor right away. Other side effects include gas, stomach area pain, and swelling. So say yesss to help for recurring constipation. Yesss to help for belly pain. Talk to your doctor and say yesss linzess. Harris Top Democrats finally meeting with Supreme Court nominee brett kavanaugh. Senator Dianne Feinstein sat down with him today ahead of senator schumers meeting that scheduled for tomorrow. They have both said they will appeal directly to him with more documents from his time under george bush, and they have threatened to sue the National Archives if they dont get what they want. Back with the power panel, mary and marsh and nan haworth. Some pretty incendiary comments you made about president and the documents and brett kavanaugh. If donald trump says hes going to listen to his lawyers and is lawyers tell him not to go for the interview and a mueller onsite, mueller can subpoena him and i would fully expect them to his appeal that all the way to the Supreme Court. Donald trump and his team are stalling until they get cavanaugh on the Supreme Court. Harris during the commercial you had a visceral reaction to that. Nan s number one, Rudy Giuliani, i would expect to say exactly what he is saying, as a good lawyer for the president. There is definitely and everyone has talked about it, the risk of a perjury trap. A perjury trap does not mean he is legally liable, but of course there are all kinds of ways in which something trivial that is not important and really not germane to the bigger issue becomes part of that. So i think Rudy Giuliani is just being a good lawyer. The reason there is so much stalling on by the democratic side on the kavanaugh nomination is because they are trying to get maximum mileage out of that. Of course you want them to do that. They just want the documents. Kavanaugh has had a long public career, both on the bushgore recount and in the Bush White House as a judge. Elena kagan and Sonia Sotomayor are, every single document, not just the public documents but private Board Meeting notes were turned over. He should be held to the same standards. Harris democrats know they cant stop this nomination. So my question early on before schumer and the others decided they would say it although the argument as they are only sitting, was why dont you have them in droves . You know elena kagan, the republican sat with her. We heard the talking point where no republicans sat with him. You know, the stalling thats going on that nan is talking about is really critical because this is not a winner for the democrats leading up to the midterm. You assume this will be a party boat and im not sure that was the case. There are some democrats considering voting for kavanaugh and there are also republicans who under circumstances if evidence is brought out against kavanaugh that show him to be unsuitable they would consider not voting for him as well. Harris the republicans like Susan Collins who have spoken up, they are looking things like roe vs. Wade. That was not a litmus question that the president asked. If thats true. With all due respect, donald trump said that when he was running for president , his lips would only include people who would overturn roe v. Wade. Harris we are out of time, we will be right back.
