They said no. No one may be the judge in their own case. He resigned three days later. If you want to follow the nixon model, that would be thursday of this week. Either way, if the president does or doesnt have the power to pardon himself and he believes he does, Rudy Giuliani says to do that would be a bad idea. Almost impractical. They wrote in this letter, you have received all of the notes, communications and testimony indicating that the president dictated a short but accurate response to the New York Times article on behalf of his son donald trump jr. Now the president s legal team had earlier said that the president had no hand in writing that. So this would seem to be in contradiction to that. The letter argues that the statement was a matter between the president and the New York Times. Was a private matter. Therefore, the special counsel does n have any right to ask anything about it. The letter saying, the president is not required to answer to the office of the special counsel or anyone else for his private affairs which his children. The team also contends that all of the information surrounding that meeting has since come out. So what else does Robert Mueller really need to know about it . In terms of an interview, Rudy Giuliani said over the weekend because this 20page letter, by the way, argued the reasons to not do an interview with Robert Mueller. I was told by a source that the legal team wanted to get him thinking and the argument and high bar to leap to get an interview with the president. I think it would be disastrous toit dn because its an attempt to entrap the president. I think what jay sekulow said in the letter shows a couple of things. Number one, the president has been extremely cooperative. Not only providing a mountain ofocuments, but even an occasion waving privilege that he could otherwise claim. I dont think that there is any rationale to sit down, nor is there a rationale to subpoena the president to sit down. Harris what do you make of the notion of the president being able to pardon himself . Everything from what i read and the legal experts i talk to said well, yes the president could do that. Its premature because there is no crime. You have to have a crime before you pardon yourself. Harris charges of some kind. Exactly. You dont have that. The second thing is if you look at it there is no constitutional constraint on the power to pardon the president. There is Constitutional Authority to pardon himself but its unlikely and in this case unnecessary. Harris Rudy Giuliani said it could lead to impeachment and very explosive politically. He is right. Politically it would light a powder keg for sure. First of all, tell me about that and whether you think it actually will impact other cases. Right. Well, both are good questions as to the first one, this could have been a broad holding indeed. It could have said that t people with sincere religious objections to the antigay Discrimination Laws always were exempt or never were exempt. They could have said that people who were engaged in expressive activity like weddinge dec traitors and photograph reck decorators and photographs had an obligation or never had an option to engage with the samesex weddings. The court dodged the question and said on these particular facts here in colorado, the Colorado Civil Rights Commission acted in such a way that seemed to telegraph a look of respect for the sincere religious views of this one baker. So in this one case we are going to go for the baker and not for the Colorado Civil Rights Commission. As to your second question, what if anything does this tell us about future cases . I would say not a lot. I think it does suggest that other Civil Rights Commissions and other states Going Forward should watch what they say. And make sure that they are respectful toward people. But other than that, i dont really know what lesson we learn from the case. Harris that is so interesting. You stalk about it as look of respect you talk about it as lack of respect and im reading in some places that could be seen as biased. What were some of the things that the commission were saying to the baker that was seen as disrespectful or in some cases biased . Right. Well, not all of the Commission Members. Harris okay. A couple of the Commission Members made some comments that the court seized on. Like suggesting that there is a long history of intolerance to other groups on the part of religious people, that this was despicable. You know, that they even referenced the holocaust as an example of religious intolerance leading to discrimination. And that was harris while talking to this baker . And his representation . Right. The court said tha that was going too far. It suggested a look of neutrality with respect to his sincere religious beliefs. The court also noted that at the time samesex marriage was not legal in colorado. And so, perhaps, it was more reasonable for the baker to think he was within his rights to refuse serve these customers. Harris that is interesting. Moving forward now things have changed. Correct. Harris what do you think will happen if this comes up again . I understand the narrow scope of it. But where does this case sit terms of informing the public moving forward . I think it will be very difficult for the courto give some sort of blanket exemption to people who have even sincere religious objections. Then what about the person who has sincere religious objections to interfaith marriage or interracial marriage or thinks that would should stay at home and they shouldnt have their own jobs . I mn, t parade of horribles, the slippery slope becomes problematic. I think Going Forward the court will have to craft some rule but it will have to be narrow rule that doesnt open the flood gates and tries to strike a balance between sincere convictions. The court acknowledged colorado had the right to add lgbt status to the list of the nondiscrimination category. I dont think the court will retreat from that. They have to try to strike a balance but it what to be a narrowne. Harris interesting. Meanwhile, 72. That is a very broad range if you will from what we have seen in the court. That tells you what . Quickly. Well, again, i think the narrowness of the decision explains it. We tend not to give a lot of money in primaries. We tend to marshal our money for general elections. Our budget is 25 million over two years and we are waiting to see what comes out of the primary. We are very excited, though. There was a lot of enthusiasm for the democrat candidates. Particularly, at the congressional level right after the president ial election. That gave hope to democrats and gave us a great deal of concern. But that Enthusiasm Gap has shrunk. Republicans are going to do very, very well. In fact, we are over performing in the number of the votes that have already been cast through the absentee ballots. Republicans are about 6 above our registration in what has been turned in. We are excited to see what will happen tomorrow. Harris chairman brulte, can you tell me why it is you think democrats particularly are vulnerable right now . I know you talk about the gap kind of shortening between you two. What is happening . First of all, they were very ehusiastics and republicans basically didnt kick in until seven weeks ago when the campaigns really started. Second of all, the democrats have postured and positioned themselves on the far left. You know, the leading candidate for governor in california, Gavin Newsome wants a singlepayer healthcare system. By the way, that costs 400 billion a year in california. And our entire state budget is only 199 billion. Most of the candidates for congress are trying to be part of the Elizabeth Warren and Bernie Sanders wing of the democrat party. That is just not where most california voters are. If we have success from everything from job growth, you have success with the marketplace, you have record highs and Consumer Spending through the roof. Consumer confidence is great. So if you have so many things going, you have global relations that, you know, while a lot of people have been very nervous about it, we are getting bad actors to come to tle with things they need to like Artificial Intelligence and so forth. The question of it is, a lot eople are saying oh, the blue wave is coming. Well, the blue wave is going to have a lot of difficulty getting over a red wall. Because i think that with everything that President Trump has been doing, he can take not only credit for it but it is forming a huge red wall that the blue wave cant penetrate. We know that the tax cuts benefit in the short term and we know economists say the tax cuts when they run out in 2020 harris have you heard what the president wants to do . Revisit the issue to stop the sunsetting, i believe is the term. I hear what you are saying. Not everybody may agree that it is all feelgood. But some of the facts from the left are not facts. Make a point. In todays world looking at peoples progress at these kind of arbitrary markers like 500 days when we lookt the problems were trying to solve are bigger and complex. The cp issues harris we always look at the benchmarks. You have to have a measurement of progress. If you dont set a date in congress, do they do anything . That is right. If you talk about progress arent getting americans back to work isnt that progress enough . Look at the market. The markets are reacting with Consumer Confidence which means consumers have jobs and they are spending. Look, there is a long debate we can have about whether or not president deserve credit for economies. The republicans said they didnt give president obama credit. Harris you cant blame a president for giving tax cut to corporations to bring their money back. To bring some of the money back. And then create jobs, jobs that ill give you this. Bs require more skill than the worker base is yet to catch up to but the jobs are waiting for them.
