Embattled democratic senator al franken taking to the floor moments ago and up until just seconds now, announcing his resignation after an eighth accuser, a woman, has come forward with Sexual Misconduct allegations against al franken. A former democratic staff wrote in the atlantic alleges that franken groped her during a media Matters Party celebrating then president obamas inauguration in 2009. But al franken has denied that latest claim, did so today. This is outnumbered. Im harris faulkner. Here today is sandra smith, editor of town hall. Com and Fox News Contributor katie pavlich. Yeah, i think al franken believed that he would be able to ride this out until the last 24, 48 hours. I think he thought he was good to go. This is absolutely stunning. Harris heres al franken speaking just moments ago during his resignation. Some of the allegations against me are simply not true. Others, i remember very differently. I said at the outset that the Ethics Committee was the right venue for these allegations to be heard and investigated and evaluated on their merits. That i was prepared to cooperate fully and that i was confident in the outcome. Harris franken, as you know, we have been covering, has faced mounting pressure in just the past 24 hours amid this latest allegation. As of this morning, at least 36 Democratic Senators have called on franken to step down. And buck, we know from yesterday, some of them made those pleas in person and by phone. Among them Elizabeth Warren of massachusetts. It snowballed and it was pretty clear by mid afternoon yesterday the pressure on al franken was going to be too much. There is a Major Political narrative here that we will be talking about that this gives a powered or renewed sense of purpose to the democratic left. We have to see what theyre able to do with this but franken is gone. Sandra some of his words were a bit stunning, would you agree, katie . I know who i really am. This is not about me. Katie right. He also took the time to point out that the people of minnesota deserve someone who can focus on their business in the senate and because of the distraction surrounding his name now, that is something that someone else can do. It will be interesting to see who replaces him and it was clear from his comments that although he is leaving the senate, he is not leaving politics. So you can bet that al franken will still be on cable news. He will still be working with the dnc and still making the rounds in terms of attacking republicans as we go into election next year. Harris he says this resignation comes a few weeks before he would depart. We have to see what he does in the remaining weeks. I dont know, lisa, if you caught it he did say the pronoun she. Lisa i did. Harris what is being left behind. I dont know if he meant amy klobuchar, perhaps, if there is someone waiting in the wings or what . What did you make of his speech. Lisa katie had mentioned the fact that he said this is for minnesota voters. Im worried can i no longer serve their interest. This isnt about minnesota voters. This is about the preservation of the Democratic Party. What we saw yesterday as buck had said the snow ball effect of all of these different members. That was a clear politically orchestrated event with the democrats releasing those statements because it wasnt too long ago where nancy pelosi was on meet the press caljohn conyers an icon. Wasnt too long ago where Kirsten Gillibrand was standing hand in hand when it was politically expedient to her. Now that they are no longer politically relevant, they have been pushed aside. This is about politics. I hate to be cynical about that but its very much about politics. I would say if this process were to go through a Senate Investigation they would find these are untrue allegations. As to the female pronoun that he used that he was talking about. It was very notable. Looks like the Lieutenant Governor in minnesota is the most likely to step in here. That also just goes to how this doesnt really affect the democrats politically at all. Took them seven victims to come forward before they did that i dont think they necessarily should be glorified profiles in courage. Why isnt the first and second time they werent interested in coming out with that proclamation. Harris you also had the exit point of the longest serving member of all of Congress John conyers just 24 hours before. I want to get this in though. I dont know if you caught it but he on two occasions in his speech mentioned the minnesota, the late democrat. He was a fire brand Paul Wellstone. Lisa i think there is another side of this conversation that often doesnt get discussed. There is clearly photographic evidence with al franken here. But there is a concern that in this 24hour news cycle and with social media, were so swift, like this mob mentality to get justice that i worry that there are going to be innocent people caught up in this. And there has been instances of false allegations in the past. Harris thats why have you an ethics investigation. We are averdicting that process. Lisa exactly. Not allowing that to play out. Katie anyone who is honest on capitol hill knows that the Ethics Committee is a black hole for anything which is exactly why people who do do things wrong want the Ethics Committee to investigate them. The Ethics Committee. Lisa due process. We have seen false allegations in the past. Even take yourselves back to 2014 in ferguson. We have people like officer Darren Wilson whose life was ruined and he was falsely accused of doing something he did not. So, and he was indicted for that before we even let the justice process play out there. Is no justice process in a lot of these situations. Harris can i go nonpartisan for just a second . We do know there is a congressman farenthold who also paid 84,000 to settles a claim. We do know that he has offered to pay that back. Thats taxpayer money. We are not hearing the same sort of vigor. And you are nodding at me from republicans. Why not, buck . Well, clearly, people are engaged in tribalism when it comes to this issue at Different Levels and different time. That doesnt give us moving forward. No it doesnt get us moving forward. Its a bad thing. A consistent standard is a good one. I do by the way have real concerns over due process here over individuals when it comes to their careers. We think of due process in a criminal justice sense. If you have lost your livelihood and career and reputation. Thats a very serious punishment in and of itself. Harris and not recapture. And not recapture it ever. And as to the congressman who repaid the settlement, its another instance and bipartisan issue. Harris its a nonpartisan issue. It did you tell us across everywhere. But the Congress Sets up laws that and this is true with Insider Trading and true on other issues as well that they live by a separate set of rules, literally. That said, voters wept into the president ial election knowing that that was part of President Trumps history. They voted for him anyway, and they put him into office. That is the question that we have been grappling with here in the sense that the private sector handles these things very differently than the public sector. Electing someone based on what you know about their history including saying things like that was something that is out in the open. He could have fought this out and in the end would have been okay if there werent for pressure in his own party. I have seen the war on women attacks. This is what the Democratic Party every single election cycle. Thats where this is going. Im telling you. Thats the reason why senator al franken invoked both roy moore and President Trump in a speech on the senate floor. This puts republicans in a very difficult predicament, especially looking ahead at the senate or the alabama special election race on tuesday roy moore is probably going to win. And what do republicans do . Do they take the unprecedented action of expelling a trying to expel a duly elected senator or do you stick with roy moore and then he basically is your running mate in 2018. Can democrats make gains . Katie absolutely. They did n 2012 against mitt romney in favor of barack obama without making up for their sins of the past while they were still glorifying people like ted kennedy and bill clinton. So now theyve said were not going to do this anymore. Women are leading the party on this. The war on women is back. Roy moore is a perfect example of that. He is sitting in the senate. If they are capable of doing it against someone like mitt romney in 2012, they certainly can do it again as they take the high road and republicans struggle with other like farenthold should resign. There has been times in history where a party has had two thirds majority. How is that used in the future as well . I do think these are a lot of questions that senators have to grapple with. Katie thats the strategy now of having roy moore get elected and then republicans have the seat at least and they can replace them with someone else. So we are entering the third hour of this rare public testimony from the fbi director. And he has taken several questions from republicans and democrats about President Trumps tweets specifically the one over the weekend about the fbi three year tenure of director comey who was fired by the president in may. And in his response, director wray defended the bureau but he also acknowledged the recent reporting about agent strzok and the alleged political bias. The fbi that i see is tens of thousands of brave men and women who are working as hard as they can to keep people that they will never know safe from harm. On peter strzok what we know from Justice Department officials is that it could take several weeks to comb through the more than 10,000 texts between strzok and an fbi lawyer with whom he was romantically involved. Both at one point were part of the russia probe but have since been given other assignments. Also the revelation this week that andrew weissmann, a senior Justice Department official assigned to the special counsel probe sent an email to then acting attorney general sally yates praising her for taking a stand against the president and refusing to defend the controversial muslim travel ban. Heres how it divided along political lines earlier today in the hearing. It is absolutely unacceptable for fbi employees to permit their own political predilections to contaminate any investigation. Even the appearance of impropriety will devastate the fbis reputation. I predict that these attacks on the fbi will grow louder and more brazen as the special counsel does his work and the walls close in around the president , evidence of his obstruction and other misdeeds becomes more apparent. In virtually every case in question related to the clinton email investigation, fbi director wray said that he was waiting for the independent review of the Inspector General in to all of these matters and the activities of the fbi agent and whether there was undo political bias in this case. He said he is not going to take any action until that is done. And he said he will take steps if its necessary, to unring the bell. But heres the problem. The frustration on the committee is that the Inspector General, this doesnt have any real teeth in the sense that the individuals who were involved in any respects from comey to the former attorney general loretta lynch, they are no longer in government and typically with an ig you see some kind of demotion or administrative action and thats certainly not possible in this case, sandra. Trey gowdy was on americas newsroom earlier saying strzok may only be the beginning. Buck there are certainly plenty of reasons to believe that senior officials at fbi, at doj are antitrump and have always been and may have affected some of the very key moments of the various investigations whether Hillary Clintons email investigation or now the mueller probe, the interview with general flynn and thats deeply troubling. One of the congress have mentioned even the appearance of impropriety is enough. You look at some of the rules, some of the judges and they have to recuse themselves not if they are necessarily biased but if people think they may be biased. I think we can expect the same level of ethics from the fbi investigation that could end this presidency theoretically. I dont think it will. But thats what the stakes are here. I think its really important to keep in mind thats what we are looking at. There is clearly smoke. I think there is fire here as well. Katie wray is brand new. He was put in office about four months ago. This is baptism by fire for him. They have a credibility problem. They have an obligation to make sure that their Law Enforcement cases, their criminal investigations are carried out without political bias. He said during his testimony we must adhere to the laws and the standards that the fbi has put forward. But i do want to point out that its very important and based on his testimony to reiterate this, this is about him backing up his agents as well there are tens of thousands of agents as he said who are doing very good work. He laid out all the things that they are doing. They just busted hundreds of sexual predators of children. He talked about that. He talked about how there is a thousand isis cases ongoing. He said specifically there are tens of thousands of agents that are doing work every single day away from their own families to protect people who they will never meet. Its important to keep that in mind. Sandra at last check 35,000 employees. Buck over 9 of them have nothing to do with politicization and they are actually just keeping us safe and putting bad guys away. Harris we know he put out that memorandum of morale boost for his staff as well. I did think it was interesting, lisa, at one point this morning we were watching and the question was asked what discipline was put forth against this person who floated those antitrump Text Messages as we found out more and more on how deep he was and how important the investigations we have been watching. He said, no, no, no he was moved over to a different desk job but no discipline. I have lots of questions about whats coming down the pike. I mean, you know, if its proven that there is more bias there, how will they fix it if they dont have discipline as part of the picture . Lisa thats a very good question. Look, its impossible to remove politics from this when we had the democrat candidate in 2016 was under investigation. Now there is also an investigation into russia as well as the people President Trump surrounded himself with. So it is impossible to remove politics when you have the top democrat and the Top Republican in investigations into both sides. But i think we have a crisis of confidence in this country which is the big issue here in the fact that there is no longer trust in institutions. You look at pew research recently. The two parties have further apart than they have been in the last two decades. The problem here is how do you believe in some institutions that have failed so Many Americans and so i worry. We saw this in Obama Administration when it came to officials at the top of the Law Enforcement agencies it is impossible to fire career Civil Servants in the federal government. We were concerned when the president started mocking the meeting and saying there would be no deal and all that we thought well, if you are not ready to talk, then we are not ready to come. Now he has made the overture for us to go. Hopefully that means he is more receptive to finding a solution.
