Commander of new York State Police. Today we have arrested 51yearold Joyce Mitchell of dickenson center, new york. For her role in providing Material Support to david sweat and richard matt with their escape from the clinton correctional facility. She has been in charge of promoting prison contraband, first degree a class d felony and criminal facilitation fourth degree, a class a demeanor. She will be arraigned at platsberg city court and remanded to the Clinton County jail. This is one large piece of the puzzle in our quest find these two escaped murderers. Her husband has not been charged with any crime. Her husband is not in custody. Promoting prison d contraband. Minimum maximum sentence range on those is a one and a third to four or two and a four to seven year maximum sentence and the facilitation charge is facilitation to commit the escape is a class a demeanor punishable up to one year in the local county jail. Those are the two charges at this point in time that we have filed there is investigations ongoing as to potentially other charges that we may file. Molly, two big stories one is that this woman joist mitchell under arrest in jail who works at the correctional facility door and this manhunt. And i see the weather behind you doesnt look like its conducive to a good manhunt. Absolutely not greta. We have been standing out today moving along the perimeter today and listening to weary neighbors still concerned that these two convicted killers may still be in their backyard. We saw here right outside of the prison investigators going down into the tunnels into the sewer system. My producer actually saw them bring a dog up under ground today and shake himself off. While the investigation certainly a few miles from the prison going through these swamp lands and these very thickly wooded areas it looks like the investigation is close to the clinton facility itself today. We just listened to the press conference and you heard as well, greta the other big piece of information coming out is is that they have arrested joist mitchell, the woman Joyce Michelle the woman at the center of the investigation a week or so. Provided material sis tans sweat and matt. Not exactly what she did or brought, the District Attorney today saying that power tools were not what she brought in. He said exactly based on their investigation she has not provided the power tools. She has not provided any sort of power tools. We are told that we will get some more information about what exactly it is that she has done after her arraignment which is expected later on this evening in platsburg. Then we may see documents or get some information during that Court Appearance to what it is exactly that mitchell is accused of doing, greta . Molly it has been six or seven days. Last saturday morning they disappeared. The searches around this clinton facility, maybe they are down in the sewers, i dont know, what in the world has the search focused just there . Six or seven days, even if you were walking you would be far far away from that facility by now. Sure. And really frankly there has not been a confirmed sighting there have been a number of things that have got investigators excited and the neighborhood excited like earlier today there was a Facebook Post that a woman had said that her relatives relatives that in the backyard of her relatives the men had been spotted jumping over a stone fence. Now, has not been confirmed at this hour. Thats the ultimate thing investigators have looked at a lot of things. They have been at a local gas station deep in the woods and mucked through swamps. None of their efforts have confirmed where these men are or have been exactly. Greta . Molly the dogs out doing scents in a few minutes we will show the viewers how exactly this is done. I mean the dogs, they have got to start with a scent to follow a trail. Where did the the scent start. Are the dogs still searching or is this an abandoned process to try to find them . No we have seen the dogs throughout the day right here at the prison. My producer saw them pull up under the grates in the road. Not only manholes that the prisoners came out of and other manholes in the neighborhood. Tracing steps. The search is still very much close to this facility as much as it is off in the woods and off in the swamps. When it comes to the dogs, frankly, investigators here say that they are livining to these dogs paying attention to the scent and believing in these animals which is not uncommon in these instances. We know that investigators turn to these dogs, highly trained animals in various circumstances whether it be Something Like these escaped individuals in the instance of bomb threats, that sort of thing. Depends on the dog, they are all trained to do different things. Greta . Molly, this is so difficult because there is no information absolutely zero. No sighting, no carjackings. We dont know if they split up. We dont know if they are in the area. The only thing we know is they are very dangerous. If cornered they are going to do something a come killer these people can be in utah 500 tips have come in here in this region one of the big things they say left them focusing in this area no evidence that the men have gotten out of this area. There havent been any confirmed spottings. Get through the woods or adirondacks. Molly, there is no evidence they are in the area. You are right there. No evidence they have gotten out of the area. Exactly. No evidence they are still in the area. There is no evidence any place. Exactly. They confirm that there are no confirmed sightings period so they are still looking for these individuals and still looking close to home because there is nowhere else specifically that they have to go look right now. And i suppose if old Joyce Michelle who is sitting in the slammer tonight, if she knows anything and if she is talking, even any information she has is now seven days stale. Whatever their plans were. And apparently there is some story that she was going to provide some transportation. You have heard anything about that that that was part of what she was that she had any part of some plan to provide transportation . Absolutely. We have a source that confirms that she is expected to be the get away driver but she had a change of heart at the last minute. Another interesting thing to note. Investigators said today during that press conference they are satisfied with the information she has provided and that they would have not charged her today if they were not satisfied that they had gotten the information. So essentially, they have been interviewing her for the last week and now they feel like they have got a lot of their information so now she is under arrest. Indeed she is. Molly, she is in a heap of trouble. And, you know, i will tell you one thing if those two cause more trouble if someone is hurt, her trouble has just exacerbated tremendously. Anyway molly, thank you. And a Big Development right now, new reports that Joyce Michelle that 51yearold woman, suspected of having a relationship with possibly both of the killers and playing ago key part in helping them escape, she is in so much trouble. But, its not just Joyce Michelle. Now prosecutors are also taking a hard look at her husband. Were not really reaching out to him. He is obviously a person of interest because of the his obvious relationship with Joyce Michelle. And he did work works at the correctional facility. Works in the tailor shop as well as maintenance provider. So you know, of course we are looking at him as well. The Brendon Lyons gets us. I dont get this one. Why are they looking at the husband if they say he has nothing to do with it. Why are they suspicious of him. It sounds more like she is cheating on the husband and got two young guys in the prison so why are they even looking at the husband . Im not sure. We saw his name surface in a Police Document that listed all a the contacts, all at people that they have reached out that they have examined as possible get away drivers or people who may have assisted them. In that document it said that the husband may have assisted in the escape. We dont know when that was dated so it could be outdated at this point. Its possible that state police have moved past him as an accomplice. The d. A. Certainly didnt exonerate him with those statements today. Indeed, what a team if in any way wife or helped them. You know, it makes sense to interview him because if she knows something maybe she said something to him the husband if she no, sir about where the two might be headed. So, in some ways, you know, it makes a lot of sense it talk to him to. Make him a person of interest thats bizarre unless they think that he teamed up with his wife and this was some, you know, grand plan until she got cold feet and suddenly checked herself into the hospital. What did she say she had nerve problems or something . Anxiety unusually i believe she told police they wondered why she didnt report for work. She said it was because she was at the hospital with her husband who was having an zit attack. You know, one investigator i talked to said its possible that the husband became involved when the wife got to a point where she was in so deep that possibly their lives and careers were at stake, you know, that thats possible. Its bizarre. If she is cheating on him in some form with these two guys suddenly he is worried about his career, i mean, the whole thing is getting more sorted by the second. Certainly. Where is the husband now . Do you know . I do not. They have they left their house early early this week. You know, reporters showed up and tried to talk to them. It could be that they were taken somewhere by the state police and put in a hotel for, you know, for safekeeping. Or it could be that they went to stay with family. My assumption is that the state police would have put them somewhere where they could have Constant Contact with them even though they werent under arrest. Joyce michelle, do you know anything about her being investigated previously for having some sort of relationship with an inmate and maybe even one of these two . Yes. Thats an angle that we have been pursuing pretty aggressively. The department of corrections in the state has an inspector generals office. They are tasked with investigating just these types of relationships. They treat them like criminal investigations. In this case, that investigation was apparently closed just a month ago and determined to be unfounded. And we have been talking to investigators within that agency who are questioning you know, whether that was botched because, you know, love letters examined for fingerprints. Thats normally how they conduct these examinations. They subpoena cell phone records. Often tinels the inmates even though the employee is there, the inmade may call that employee outside the prison on their days off and such. So, there was a relationship a coworker made the complaint and its clear that someone dropped the ball there. Indeed. How long has Joyce Michelle worked at that prison . I believe its been years, maybe since the early 2,000s, at least. She used to be a work in a clothing industry outside the prison system, and then apparently she took. Which may explain why she is a tailor inside the prison. Thats correct. She was familiar with, you know the Industrial Production of clothing. And which one the rumor is that she had some relationship with both of them. Any idea which one was the more current one or even if in fact it is that she had a relationship with both of them . Well, nobody has specified that. You know we have heard that it was both. Everyone seems to think it was richard matt because of the fact that her cell phone or cell phone she provided access to, was used to Contact People connected to him. That tells me that it was probably richard matt. Is he also known as someone you know, who has the ability to sweet talk, you know and woo employees. He is a con man of sorts. More so than the way david sweat has been described to us. And so i suspect at least i hope that the police are tracking down those people that the phone calls were Material Support or safe haven for matt. I assume that the police are doing that thats rather basic . Absolutely. They established a long list of people who were connected to them either through friendships, marriage, family they also combed all the virst dogs and created a list of people who visited them or been on their telephone logs. Last sunday they knocked on the door of a rochester man which is about three hours west of the prison and questioned him about whether he had made arrangements or been a truck driver and possibly had picked them up. I spoke to the man today. He said he denied it he said he hadnt been a truck driver for many years. And he believes that he was questioned because his fiancee has visited one of the inmates david sweat. And is still considered a friend of his. Brenden, thank you very much. Go ahead. It seems they have cast a wide net but it doesnt seem at this point that they have a solid lead other than the sightings of that small raid yus of the prison. They better find them soon though because these two are very dangerous but now they have got a seven day jump on the police. Anyway brendan, thank you. Thank you. Greta, what i have found in the history of female institutions, it is not unusual for inmates to sweet talk women in these institutions. We have all seen it i shouldnt say a million times but anyone who has done criminal defense work has seen this in and out of prisons all the time. In baltimore, we had four Prison Guards to get pregnant by one guy. We had a psychiatrist in jessup that helped some prisoners to escape. Its astounding, isnt it . It is astounding but what our viewers need to understand is that the prison is a little city within itself. You will find at times there is even more drugs in prison than on the outside. What i understand from here in this prison, too is that the Correctional Officers werent all checked as they went. In it was more of a spotty random check so if you wanted to bring something in like a saw in a cake, you know it wasnt that hard. And thats the amazing thing what our viewers need to understand there is something called a Prison Network that could work inside a prison and outside. So when you look at sweat and matt, we dont know where they are. I mean, they are looking in this one little area, but these people could be in egypt for all we know. These relationships are so perplexing. When you think i mean, somebody even like this goes a little bit far. But women will marry guys on death row. Its like these prison these prison romances are so bizarre. They are. But these prisoners are are they can see the vulnerability in these women and they use that and in this instance they apparently used sweat and matt apparently. Imagine this woman a steams stress and if any of this is true that she was preparing to help them get away. No wonder all of a sudden had an anxiety attack on saturday. Again, they may have had a contingent plan that if she wasnt there to help them get away that somebody else in the Prison Network outside could have helped them. These two are so dangerous. They have nothing to lose. One is a cop killer, someone is somebody who dismembered an elderly person. If they get cornered. They need money. And they need transportation. So any unlucky person who happens to be pumping gas at a gas station could be the next target. So dangerous. I dont know why they are so focused in the area around the prison because there is no evidence that they are near the prison unless they have tips we dont know about. They probably have tips we dont know about. It was amazing last night you talked about the blood hounds and that a blood hound could be tracking even a raccoon in that area. I think that the reality of that is that they use those blood hounds and you would have thought that after last night and seeing that the blood hounds had picked up a scent that they would have had something more concrete today and they dont. We actually went out and you will see it in a moment and went to a police force that uses k 9 and talking about how blood hounds can detect a scent longer than, for instance, a German Shepherd can we are now seven days out. Any of those scents and if you are going to track a scent, you have got to know that the scent is actually the person and not some innocent person. This now to me seven days out becomes exceedingly difficult if you think you are going to rely on dogs. Greta, its a needle in the hay stack. They could be in the area they are searching. These people could be be down in mexico. Split up. Oh, absolutely. And if they had any sense that would be the smart thing would be to split up. So its debatable as to whats going on. Can you see the authorities are frustrated. They have gotten as much as they could out of george mitchell. So now they have charged him. I will tell you one weird thing though if they focus on the area search around the prison. When i was doing criminal defense law and people would escape from the prison 20 miles outside of d. C. You would think they would go off to mexico. They always came back home to d. C. Always. And i thought why are you going back and then of course they get picked up again. A lot of the people that did escape would go home. That was because of their stupidity. We are dealing with two cunning smart inmates that escaped. Again, they could be anywhere. The key would be if they did, in fact, attempt to contact one of their relatives and im sure the authorities are on that. Its just uncredible. They have nothing to lose. By the way if someone is hurt if someone what happens to Joyce Michelle. Joyce michelle, the charges are going to be upgrade, i still believe they are going to be upgraded to either conspiracy and accessory. Only charge her with one felony and one demeanor. Only reason charge her with one thing because they just want to charge her with one thing to hold her. This investigation once they catch these two suspects, they will then look at the facts and see what crimes they believe she has submitted then she is going to get a lot more charges. She is going to get more. This investigation is going to be internally to find out if they had any other internal help and you will find out if they had help from other prisoners. Tell me what do you think about the way this is being prosecuted . Im deeply disturbed by the way this is being prosecuted. I think that this case, frankly, is either overcharged or undercharged. Part of the problem is it seems that the prosecution has a shifting theory of the case. First they started off with this knife. Then they are saying that the arrest that was made lacked probable cause. And now based on this bill of particulars the response to the bill of particulars that was filed. It seems as though they are saying that the van was somehow the instrumentality of the actions of the officer frankly, in my experience, a bill of particulars is for the defense to find what facts specifically each officer is alleged to have done. And the states attorney seems to be dodging ducking, doing whatever it is that they can do to avoid providing facts specific to each officer. Is she over her head in this . I dont get. This when she came out and handle it and made a political statement and now alienating the police. Whats the problem . You know, thats a great question. I think that, you know, maybe she is over her head. But, you know, its one of those situations where you would hope that the person who is charged with being the lead prosecutor for a major metropolitan area is going to take their time and is going to be deliberate and thoughtful when they are making such a huge decision. And the first thing that strikes you is, that she conducted an independent investigation from her police department. I understand you might want to conduct something in parallel. Shouldnt you be working together with those individuals who you are supposed to be working hand in hand with . And then the second issue is the police close their investigation, and she issues these charges just days or weeks after the police close their investigation. I think certainly, you know, normally forensic evaluations in terms of the autopsy, in terms of the reports from the medical Examiners Office are going to take weeks if not months to get back. Whats the rush . Whats the hurry to charge this case in the only explanation is that its a political statement and it appears as though it was done too quickly. Well, it has been a long and wetted and pretty frustrating day i imagine for searchers they were up at dawn and into the fields and woods surrounding dannemora prison. It initially targeting 5 square mile area not far from the prison at all. In fact the two convicts might be hiding out. But as of now, they have not found them. Has anyone said i think ive seen them in this area . There is a big difference between i think and i know. And, in this case, a lot of people think it. They have been flooded by tips. There have been hundreds of tips and the tip line probably no small part 100000 reward. Major charles gas is leading the investigation and new York State Police have no confirmed sightings of any one of these men. How about any garages broken into. Food stolen, any, you know, any stores broken into with foods stolen or anything . These guys have to eat. We are seven days out. My understanding is that they have not had any confirmed reports of stolen vehicles. If there have been homes broken into, i have certainly heard about it keep in mind, greta, this is a very difficult area to search in large part because of the geography. The terrain ising soy. It is rolling, it is overgrown in large places. As well as having a lot of barnes and a lot of sheds and a lot of places that two guys could hide out. Right now police dog manhunt for killers richard matt and david sweat but just how good are police dogs at hunting down fugitives . On the record met up with with some Alexandria Police k 9 unit earlier today. How do you actually train these dogs to do. I see in the movies or something you show the dog a piece of clothing, the dog goes off and finds the person. Tracking begin with starting a little subsequent pad. Go out about 10 feet. And 10 feet treats along the track. Just to get them started. Tell track put the nose down follow that track. Across tree continue. At the very end they have a toy. And at the very end they get rewarded by finding that tool. They find the tool. They get rewarded with the toy. Play with them and make them feel like the best thing ever. And that motivates them to continue to track. How long you say does the scent usually last . It could last a couple hours, an hour. It depends. If it gets contaminated by vehicles by pedestrian traffic, it could disseminate quickly. What we usually try to do is always try to find out wherever, if tracking somebody, where it happened. And last saw the suspect. If the environment is a cooler moister environment, is the scent likely to stay longer than very dry hotten environment . Not necessarily. No . No. Like i said, its usually better for us to start a track as soon as possible. Find out the last place saw the suspect and make sure we set up a perimeter to contain the individuals. All right. In fact, i gave a speech about this last night because we got the too many people tangled up in webs of dependence. Poverty hits women particularly hard in this nation actually, because so many children, 40 of children now are born out of wedlock. We have 25 of families now headed by single moms. So if we want to deal with poverty, we also have to deal with women. When i mean when i say webs of dependence. Move ahead to work harder and to earn more money. They risk greatly losing benefits. So the truth is you will take more pay home and more benefits home if you are earning 28,000. In other words, the incentives are totally wrong. So many incentives. Some people in our population who want jobs who cant get them. Some of these inner cities are in a really tough position. Its it so rare that republicans venture into the inner part of these cities and see whats going on. I mean, how would a Carly Fiorina presidency reach out to them . I talk a lot about entrepreneurship greta. One of the reasons i have do that is because i have seen it work. I have served as chairman of Opportunity International largest Microfinance Organization in the world. We have lent 8 billion, 150 at a time. Why do i bring that up. Entrepreneurship works to lift people up out of poverty. We are crushing entrepreneurship in this country. We are destroying the middle class. Most of the new jobs in this country and employ half the people. We are also discouraging entrepreneurship in these inner cities. It works. When you give someone credit, you know, when you are poor its hard to get credit. When you extend someone credit which is what Community Banks can do, should do. They are being destroyed by dodd frank. When you are give them tools, training and support when you encourage them to move forward in their lives instead of encouraging them to fall back and to settle, then they have no future in their communities. So we can do this. There are programs that work but it means we have to fundamentally reimagine how we look at these welfare and benefit programs, and it means first and foremost that we have to understand that every single individual has god given gifts. It doesnt matter if they are poor. It doesnt matter if theyre sitting in the inner city. They have god given gifts. They have potential. They need encouragement and helping hand, yes. I wanted to try to learn something an adventure if you will. I was always curious about the american criminal, why are there so many of them. Why do they keep coming back jail. Do they have a sense of humor . So is there this a roast is this actually a roast inside the jail of the people who are inmates . At a certain point in my show i invited anybody who wants to come on stage for 15 seconds of pain. Although im not sure this is allowed by the geneva conventions. You know, its sort of an interesting way to get information. I was a criminal defense lawyer and i would go into the attorney lounge and talk to them but i didnt get a lot of information. I get you got more information. I find being comedian they will open up to me. Is is the state required to rule on her permit within a certain period of time . Its complicated but heres the thing greta. New jersey is not a good place to get a gun in a hurry, at least if you want to do it legally. Some people think that cost carol her life. Under the law handgun permit applications should be processed within 300 days thats rarely the case though. People i talk to in Law Enforcement and the Gun Community says a way of two to three months is common and it can be longer. Here is why. Carol applied for permit at local police department. Used a standard for from the state police. It requests a criminal background check by the state and a check of her fingerprints by the fbi. And in 19998 a new Jersey Appeals Court ruled local Police Departments can ignore the 30 day deadline if they havent received either of those reports from the outside agencies. And local police say thats what happened to carol. They were still waiting for her fingerprints at the time of her death. In fact, the police chief told me carol called about her application two days before she was killed and the police clerk made a phone call to try to get the process moving. Boy what a tragedy. You know, its like, i mean, the whole thing the exboyfriend. She had a restraining order against him. That didnt work. I should add that he went on and killed himself a short time later; is that right jim . He killed himself adding to the tragedy he killed himself on her birthday. She had planned to go to the Dominican Republic with friends. And killed. At the murder scene there were happy birthday balloons just fluttering in the air. Jim, thank you very much. Bye now.
