>> the search and recovery is continuing here today. unfortunately a very gruesome task of recovering bodies from the water and wreckage causing a lot of grief in the family centers in singapore and in indonesia. >> now what is the strongest theory right now, working theory based on the forensics, the recovery of bodies and of the debris? >> the strongest theory is something catastrophic happened there was bad weather but the pilots did not issue a distress call. and there was nothing from the transponders. still a little bit of a mystery. they still going through the details, statistics that the plane normally reports back to its operator and the airlines. >> terry, can you confirm in fact, that the bodies so far that have been recovered did not have life vests on? >> yes. that's right, i didn't. >> so that also supports the theory that it was catastrophic, that something suddenly happened that they weren't able to properly prepare for or enact the emergency procedures to be able to get the passengers to get those on in a safe period of time. right. yes. the best we have at the moment is it went down very very suddenly. as i say, the pilots couldn't issue a distress call. that takes about five seconds to do. so it just went down very quickly. >> all right. terry. thank you for that and thanks for being with us last night as well with the records of air asia jet will give investigators clues as to what caused the crash. some searchers say they saw an object that formed a shadow under the sea in the shape of an aircraft. so could the plane, in fact still be intact? and what would that mean? former ntsb chairman jim hall joins us with the latest. jim, what does that tell us? >> well, it's -- it could be an indication that the aircraft came straight down and there was no breakup of the aircraft prior to contact with with water. >> okay. when you say that, i mean what do you base that on? just the circumstances, some the other evidence that you are getting in? >> well, based on your question clearly as we know we have hopefully, as soon as the recorders are found, we will be able to end this speculation in regard to what happened and we'll have a clear idea of what did occur to this flight and the tragedy that took the lives of all these fine individuals. >> you know, 2014 was one of the safest years on record for air flight. yet, we have seen a tragedy like this happen. it makes people a little bit apprehensive because, obviously they encountered some bad weather. there was reports as well that the pilot requested clearance to go up and altitude to try to avoid some of this troublesome weather. what are your thoughts on that? >> well, you know first i think it's important to note there has been a tremendous growth in the number of passengers flying commercial aircraft in southeast -- i mean in asia and south asia. southeast asia. that part of the world. some have put the estimate at a billion new passengers over several year period of time. so, the frequency of flight is -- the fact that the so sophistication of the airlines, that part of the world is not as advanced as it is in our country. is a -- things that need to be addressed. >> well hopefully the united states, with our assistance and expertise in this area can help shed some light on it because we can all learn and grow and help prevent these accidents and catastrophes from happening in the future. jim, thanks for spending time with with us tonight. >> sure. thank you. >> we're going to continue to monitor developments in the crash of air asia flight 8501. we will bring you new information just as soon as we get it. >> and this is a fox news alert. because just a short time ago new york city mayor bill de blasio wrapping up a meeting with bliss union leaders. the meeting comes amidst rising tensions between the mayor and nypd. after more than two hours of discussions, the president of the city's largest police union spoke to reporters. >> there were a number of discussions, especially i about the safety issues that our members mace. there was no resolve and our thought here today is that actions speak louder than words and time will tell. >> and joining us to sort through it, retired nypd detective jerry hock joins us in the studio. thank for being with us and thank you for your service to this fine city as a well. when you hear a strong statement like that coming out, where do we stand. >> it looks like we don't stand anywhere right now. what i glean from that quick couple words there is actions speak louder than words. so basically, you know bill de blasio is full of words. so we're going to have to wait and is he see how he reacts towards his police department from here on. it looks like nothing was cleared up today at all. he has been using the police department as a punching bag for i don't know how long now. and now that the police department is finally -- the police officers are punching back, is he backing down and crying about it the "new york times" had to come to his rescue today. >> with some really disturbing kind of inappropriate editorial comments basically suggesting the nypd is, you know, posture iting, trying to get attention for themselves. >> full of self-pity. >> those comments are not helpful. especially in a city that's gone through so much in recent events the loss of two police officers. they gave heir life serving this city and the nypd, which has led by example in the country in terms of the finest police force. >> sure. and i think that what's going on is bill de blasio is probably telling bratton on the side quietly, you get me out of this mess. >> what can bill bratton do to fix this situation. >> i can't see bill bureaucrat ton doing anything bradton doing anything to fix the situation. i don't see the pda relenting at all until they hear a public apology for from this mayor. >> that's what it's going to take. >> that's what i think. if i was pat lynch, i would say i want a public apology from the mayor also stating that from now on he is going to always give his police officers the benefit of the doubt based on the evidence. >> well, i think the problem is when you are serving right, the nypd they plead blue. they don't see each other as you come from this community or this ethnic background and then when you have a mayor of a city that's so diverse with one of the most diverse police departments warning his own son about how to approach his life and his daily interactions with police officers, that is beyond unsettling. that's a nonstarter. >> especially at the time that he did it he came out and said that at the time the grand jury came out with no indictment against the officer involved -- officers involved in garner. >> yeah. >> that was the wrong time and wrong place. i got no problem people talking to their family members about how they should react when the police officers approach them, you know, but just cooperate with the police. that's all i have to do. that's all you have to say. there should be -- also there should be some dialogue about resist ising arrest. people should understand. >> there is a process. >> there is a process. exactly. you should not resist arrest. just do what the police officer tells you to do and then process after that if you think it the officer has acted incorrectly. >> 2014 was a challenging year for president obama, right? so how will the last year shape the next year? let's take a look. >> i believe this can be a break through year for america. >> 2014 a big year for america and a difficult year for president obama. >> let's make this a year of action. that's what most americans want. >> a year of action. a promise that could define his presidency. >> i have got a pen and i have got a phone. >> but the threat to go it alone infuriating his political rivals setting off one of the first battles 6 of the new year. >> he also has a constitution and oath of office. >> but that was just the beginning of the president's problems. months later crisis at the v.a. as news emerges that secret waiting lists at v.a. hospitals led to the deaths of at least 23 american veterans. the outrage leading to a cabinet level resignation. >> a few minutes ago secretary shinseki offered me his own resignation with considerable regret, i accepted. >> and over the summer crisis at the border. hundreds of thousands of children illegally crossing the border overwhelming dhs processing facilities and forcing the feds to ship the children around the country. >> the american people and my administration have great compassion for these children and want to make sure that they are cared for the way all children should be cared for. >> who could forget the ebola outbreak? american doctors returning with the degrees thomas duncan spreading it to nurses in dallas and one doctor carrying it around new york city and catching the cdc totally off guard. >> there is always the prospect and, in fact likelihood that is it spreads and could end up coming back to the united states. so we have got a lot more work to do. >> and there is more chaos in ferguson, missouri. american troops back to iraq. and a plummeting approval rating. all of these problems culminating in a landslide election victory for republicans. wiping out the democratic gains from 2008 and ensuring republican majority in congress for the rest of president obama's time in the oval office. >> >> and joining us to sort through it all our political panel, the "the washington post" aaron blake, the daily beast jacque kucinich and the hill's editor and chief bob cusack. thank you, guys for being here with me. we could do a wrap for the whole year. how was 2014 going to impact for the president 2015 going forward? bob, i will begin with you. >> well kimberly definitely president obama had a tough year. aaron blake's newspaper said back to back had the worst year in washington. so he he said in the begin fing the year it's going to be a year of action. at the end of the year he did say it was going to be a year of action. it was the year of action but it wasn't. he didn't get a lot of what he wanted to get done on capitol hill. couldn't get republicans in the house to ability on immigration reform and, of course, they lost the senate. overall, he picked some momentum after the election. his handling of sony was pretty good. his summer was a disaster. i mean the isis we don't have a strategy. the v.a. scandal, all the things that you guys just ran. tough year for obama. >> jackie, what do you think? >> yeah, i would agree with bob. i think, you know, but i do think all of this bad luck that the president has dealt with i think it emboldened him at the end of the year. losing the senate he kind of has nothing to lose. it's at the end of his term and really about his legacy. you saw that with a lot of the things he did. the executive order on immigration, for instance. and i think you're going to see more of that going into 2015. >> okay. aaron, the president, you know, not the easiest of years what about position going forward what do you think middle east foreign policy wise put the white house in a tough spot. often they didn't make decisions at all. they kind of waited to see what happened and people didn't really see a whole lot of leadership coming from them. going forward, you know, i think the best thick that can happen for president obama is if we continue to see gas prices around $2 a gallon. we continue to see jobs growth. we see the g.d.p. at 5% again. if he can keep that going it's going to be good for him. that's why we have seen his numbers rise up a little bit. that said, i don't think this country is going to suddenly have a popular president obama. there has been six years. people have already kind of decided how they feel about him. and it's baked in at this point. only happening on the margins. >> i like that baked. in i feel you. let's talk about the g.o.p. let's talk about republicans taking control of congress. next year g.o.p. taking the midterm elections in landslide victories. take a look. >> the american people sent a message. >> a message heard around the country. >> i'm not on the ballot this fall. but make no mistake these policies are on the ballot. >> americans from coast to coast casting their ballots and rejecting president obama's policies. >> with me the buck stops right here at my desk. and so whenever the head of the party doesn't do well, i have got to take responsibility for it. >> it was a total republican landslide. the g.o.p. adding nine seats in the senate plus 13 more in the house. and republican governors rising to power across the country. even in blue states like maryland, illinois, even massachusetts. now that republicans are in charge. what are republicans actually going to do? >> we can have real change in washington. real change. [cheers] that's just what i intend to deliver. majority leader mitch mcconnell going "on the record" and the first thing on his agenda, obamacare. >> i think it's on its way to collapse. >> and then what happens? >> we go back and do it right. >> it's not just obamacare republicans are promising. spending cuts, tax reform. regulatory reform and more oversight. in the house, new leadership for the oversight committee. with utah congressman jason chaffets taking over as chairman. that means new investigation into the irs scandal. the v.a. scandal the healthcare law, fast and furious and more. but the question everyone is asking: can republicans and democrats learn to work together? i am prepared to work with them on areas where we agree, recognizing there are going to be some areas where we don't agree. >> finding common ground can be hard work. it will be even harder if the president isn't willing to work with us. >> and already president obama going around congress on immigration. so with the senate in the republican's hands the stage is set for a showdown. >> the incoming majority leader should announce if the president lawless amnesty that the senate will not confirm any executive or judicial nominees other than vital national security positions, for the next two years. >> and just weeks ago congress passing a temporary budget for the department of homeland security setting up a big battle on immigration. right at the start of 2015. >> so panel is the president going to be able to work with the republican led congress in 2015? this really is some crystal ball stuff aaron what do you think? >> it's going to be difficult. i think, you know the piece made the point that republicans had such big gains. i think you can make an argument if you set the presidency aside the republican party is in as good of or better shape than it has been in the states since at any point since the great depression. more than 80 years. i think that republicans are going to be much more content to rather than kind of come to the middle, wait it out for two years see if they can win the presidency. if they could that, they are going to be in a really good position to affect all kinds of changes across the country. >> jackie, does that sound like a good strategy? >> it does. you know, one of the things that struck me though, some of the interviews mitch mcconnell has given he has talked about wanting to make progress instead of just saying no to everything. i think he is going to really focus on the appropriations process. he wants to pass keystone. evidence doesn't want a legacy that some may attribute to harry reid where nothing really got done. so i think because of mcconnell, is he is going to have a real job there pushing his conference to really do things. and that's going to be one of the major stories i think we are all going to be following in the upcoming zero there definitely is some power struggles within the g.o.p. bob, what do you think? >> republicans face a pivotal moment here. republicans have had a tough time governing. there has been no doubt about this. now they are going to have control of congress. it's an opportunity and that's also could be a real trap for them where both the president obama and the likely nominee on the democratic side hillary clinton run against the republican congress. so this is a key moment for republicans. they have to show that they can grow up they can govern, they can send a lot of bills to president obama and portray him as the party of no. whether that will be successful, we'll see. >> all right. sounds like it's go time for the g.o.p. but not for you guys. you are staying with me because we have more to talk about. up next obamacare, because after the resignation of hhs secretary sebelius and the embarrassment of jonathan gruber, what's ahead for obamacare next year? our panel is going to weigh in on all of that next. plus, the year's most shocking videos from a teacher beating a student with a broom to the fire challenge going viral. our legal panel is here to talk about all of that and much more. stay with us. rising healthcare costs supreme court challenges and even more problems with the web site. well, 2014 was a big year for obamacare. so where does the healthcare law stand right now? >> for decades, few things exposed hard working families to economic hardship more than a broken healthcare system. and, in case you haven't heard, we are in the process of fixing that. >> 2014 the year to put the affordable care act to the test. but what happened? it starts january 29th. "on the record" reports that at least 43 convicted criminals are working as obamacare navigators in california. >> in california 43 people working as navigators right now who have criminal convictions. >> days later, february 4th, the nonpartisan congressional budget office announces that obama care could cost 2.3 million jobs. creating more headaches for the administration. >> their analysis is not complete. it doesn't reflect the full set of factors. >> april 1st, president obama makes a major announcement. >> 7.1 million americans have now signed up for private insurance plans through these marketplaces. 7.1. >> and 10 days later, secretary of health and human services kathleen sebelius calls it quits. >> kathleen sebelius my health and human services told me she would be moving on. >> june 30th the supreme court makes its hobby lobby decision allowing some companies to refuse coverage for contra contraceptives. september 4th the administration announces that healthcare.gov hit with a major cycler attack. september 18th, some good news for the law. >> we have 7.3 million americans enrolled in the health insurance marketplace coverage and these are individuals who have paid their premiums. >> november 7th, the supreme court accepts a major challenge to the law a case that could determine the fate of the entire affordable care act. november 10th, this video goes viral. >> lack of transparency a huge political advantage and basically, you know, call it the stupidity of the american voter or whatever but basically that was really really critical to getting this thing to pats. >> jonathan gruber the so-called architect of obamacare caught on camera again and again. >> the americans are too stupid to understand. >> you know basic exploitation of the lack of the economic understanding of the american voter. >> and november 20th the administration admits it had the numbers totally wrong. all those signups yep, way overstated. and then november 25th, friendly fire as a major democratic senator slams the law. >> we took their mandate and put all of our focus on the wrong problem. it wasn't the change we were hired to make. americans were crying out for the end to the recession, for better wages and more jobs, not changes in healthcare. >> so what challenges are ahead for obamacare in 2015? our political panel is back. aaron, bob? >> i think the big one is the supreme court case. this is really -- if the law is going to be overturned, this is where it's going to happen. at issue here is basically whether the law was intended to allow subsidies for states that didn't set up their own exchanges. a lot of states didn't do that if this is, in fact interpreted to be the intent of the law and the way that it's it written that really undercuts the entire law. it's going to be very hard for it to continue to be implemented. >> jackie? >> i agree with aaron but i think, you know,à w;á=(4 p2:=tmje#b +zzx06drñ y+jj'ro-# éywbfc&< 5"!1w;w=.Ãé$: .gnk]m6-?ñ!i39@w up. i think there is going to be maybe more symbolic type votes going on. but i also think they are going to try to whittle away at the law and there is bipartisan consensus about things like repealing the medical device tax and that's going to be a big challenge for the law. president obama is going to veto it but they are going to try. >> a lot of this stuff is back loaded in obama care. surprises coming up for people. some costs some money associated that really going to make consumers and americans very unhappy. they have to face these challenges too. >> yeah and kimberly, remember, you have the implementation of the individual and the employer mandate. that's going to be very big. they have long delays because they are implementation nightmares or could be. the average joe or steve on the street doesn't have health insurance well, he could be fined. >> yeah, see, that's the problem. when you think about this they purposely did this because they couldn't handle too much bad news at once. especially a failure to launch, aaron, with respect to the web site. now the real meat and potatoes are going to start to hit the table. it's going to be a problem. >> yeah. and i think bob made a good point that there has been a lot of delays over the course of the law's implementation. you know, we are in enrollment period right now. things seem to be going okay. enrollment numbers were overstated they got close to their goal. there has actually been good news on this front. the real thing here is the supreme court comments like jonathan gruber's obviously don't help. comments like chuck schumer's obviously don't help. those were tremendously unhelpful for the drargs when he said that they really shouldn't have gone after healthcare as their first big ticket item. >> yeah, jackie can a lot of people out there feel they have been hood winked as consumers. they were promised one thing and got an entirely different thing all together. that's why they are upset. then you have that on the heels of jonathan gruber's comments. it's demoralizing. >> yeah. and i think those comments in particular really reinforce some of the concern a lot of people had about obamacare. and i think democrats want to make sure that this is working, at least adequately. so their nominee isn't dealing with this in debates coming up in 2016. >> so if you are republican, what do you do to try to make the most of this situation because they have been given essentially a mandate by saying hey, we are voting for you. we put you in the midterm election so now what? >> i think what you are going to he seat republican does is do the repeal votes. they will get this through the house and maybe even the senate depending on the filibuster rules. it's going to go to president obama's desk. is he going to veto it and they will say well, here's what we did. we tried. the only way the american people can get rid are of this law is if they elect a republican president in 2016. and that's going to be their argument going forward. bob, do you agree? >> yes, i do. democrats have now divided. they repeatedly said for years this will be popular just wait, just wait. and democrats right now, including schumer are tired of waiting. they are acknowledging hey this is not that popular. that's why i think the president and the white house officials going forward will be talking a lot more about the economy than about obamacare. >> let's see if we can change things with obamacare and bipartisan support. straight ahead another attack on police, reports out of philadelphia. we're going to take you there next. latte or au lait? sleep number's even got an adjustment for that. only at a sleep number store find the lowest prices of the season, with the c3 queen mattress set only $1199.98. plus 24 month special financing on all beds. know better sleep with sleep number. this is a fox news alert. another attack on police. this time in suburban philadelphia. police say a man made an online threat to kill officers, then tried to run them down with a car. police shot the suspect to death. and joining us, former homicide detective ted williams with this news just breaking right now you in philadelphia. ted, you see the scene right there on the camera on the tv. another fatality. officer involved shooting but this is someone that the police had been monitoring, it appears ted was making online threat. and then intended, it appears, at this hour to follow through on them with a vehicle in an attempt to run over officers and then of course you see the scene unfolding there. shots fired and the suspect deceased. >> yeah. kimberly, as we realize tensions are very high when it concerns law enforcement and citizens in this country. at this immediate time. from all indications first of all there is going to have to it be an investigationment primarily from what we know the suspect in this case may very well have tried to use his vehicle to run over the officer. if that becomes an is the case then clearly it would be justifiable for an officer to have shot at someone who was using a vehicle as a weapon to try to run over them that's. >> that's because they are able to use deadly force with someone, a deadly vehicle. you have a weapon essentially, a car to run over someone an officer could be killed or multiple officers. so they have to react. >> oh absolutely. that is what would be justifiable out of abundance this old stage. there is going to have to be a complete and thorough investigation. once that takes place and if it is found that the person use a vehicle and as you have said kimberly, a vehicle can be considered a weapon a deadly -- a deadly weapon under the circumstances, if you are trying to run over some officers. the officers would under those circumstances be justified in shooting in that vehicle and taking the action they took. >> all right. well this news just breaking in philly right now. again, there has been an officer involved shooting of a suspect who allegedly had previously made threats against the police department. ted, i'm going to ask you to stay with us. right now, joining us on phone is wtfx reporter dave who is on the scene and has details. >> we are expecting a press conference from the upper darby township police department at 8:30 eastern time. we do know from what investigators have told us that this suspect had threatened to kill police and threatened to kill fbi agents and it all started with him getting into an altercation with police in the cliffton heights area and then the situation continued into drexel hill, which is part of upper darby just outside of philadelphia. and that is when investigators tell us he allegedly tried to run several officers over including a police chief. and that's when five officers pulled their weapons and fired on the suspect. we're told that the officers were in fear in fear of their lives. police officials tell us that he did -- the officers did what they had to do. five officers opening fire no officers were injured. several police departments were on scene here. swat out of delaware pennsylvania they are here as well. again, we are waiting for 8:30 update by the upper darby township police department to find out more about what led us to this situation. kimberly? >> interesting. yeah. a lot developments. and then of course it seems that this individual had had, i guess some prior contact. police were, in fact, investigating him; is that correct, because he had had made some online threats? >> we are hearing that. we are hoping to find out more about that at the 8:30 press conference. but that is what we understand at this time. >> okay. so then at some point we have to connect the dots here because if he is making those online threats at what point then did he come into contact with officers in the scene in a realtime situation. were they in fact aware of his identity? were they investigating it when they happened to come across this individual that they have already tied these pieces together at this hour? >> that's what we're trying to figure out. i think it's one of these things where there is a special form of investigation for these types of threats online and obviously the big question when did police actually make contact with them and what exactly transpired before -- >> -- the circumstances. >> where they had to draw their weapons. a lot of questions we are hoping to get answers out of this press conference. >> all right dave. perhaps we will be checking back in with you. interesting development. you said as many as five officers at the scene, shots fired. suspect down, is now deceased and included one -- the police chief, in fact being threatened by the suspect's vehicle. we will get some more information, including suspect information as this story develops. more on the breaking news as soon as we have it and straight ahead, 2014 was marked by chaos around the world. planes shot out of the sky. and growing terror threats overseas and hear at home. so what will 2015 bring? [gunfire] that yacht going secretary of defense chuck hagel more troops stay than initially suspected. >> this will mean delayed withdraw of up to 1,000 u.s. troops. >> all problems that a brand new secretary of defense ashton carter will have to take on in 2015. >> i accepted it because of the seriousness of the strategic challenges we face. >> so will anything change in 2015? general bob scales and former u.n. ambassador john bolton join us now to recap this year and take a look ahead for foreign policy and national security in the united states. general, i will begin with you. what could do you make of this situation? it's not a great year for foreign policy for the u.s. and for this presidency? >> no. i think the long shadow of iraq will cast itself well into 2015. i think the greatest foreign policy and military disaster, the united states has suffered a decade happened when isis suddenly sprung out of nowhere. the maliki government collapsed and 11 years of work by the u.s. military went down the drain. and kimberly, it's also a moral issue. because soldiers setting at home watching television who have had three or four tours in iraq, 1920 of their soldiers killed. suddenly seeing very familiar places and very familiar weapons falling into the hands of an enemy that no one had even remotely foreseen a year and a half ago. and then there is the other issue, god forbid what happened in iraq is going to happen in afghanistan when perhaps, we pull out again to precipitously. so my view is that we will not see a true offensive operation in 2015 by the iraqis and we may see a further decline in the security situation in afghanistan, the future, frankly, is not bright. >> not looking good for 2015. the general has weighed. in ambassador, what say you? >> well, it was a pretty grim year. it's going to be worse in the year ahead. in addition to the problems that you've already mentioned, of course, you've got iran's nuclear weapons and ballistic missile program, north korea's programs. a host of other threats from china and russia. withbut i think the overarching problem that the united states has faced this past year and which will also get worse is the self-induced weakness of the administration's policies. both the perception and the reality of an uninvolved withdrawn unassertive america. it's not just military power. it's political power as well. america can protect its interest and those of its friends and allies when it operates from a position of political military strength because that dissuade and deter adversaries from acting in the first place. the sign on the white house door now is if you've got advantages you want to seek against the united states. >> right. >> get it done in the next two years. >> it's really true. it's like start checking the boxes. get it done before 2016 while they can. by the way, this is a lesson that we have taught, in fact. this is the instruction and the road map that we have given, general. when you look what happened here with the berg doll and the taliban swap. when you look at the israel/gaza conflict. when you look at the crisis in ukraine, there is no leadership here sending a clear message that these things are not going to be tolerated. >> there is an old saying in the military that if you create a strategic vacuum somebody's going to fill it. >> yes. >> generally you don't like who fills it and throughout the globe, from europe to the middle east to the -- as the ambassador says to china and elsewhere we, who in the past have been the guarantor of freedom and stability in the world have literally walked ourselves back away from these points of crisis, and bad guys, whether it's iranians or north koreans or the chinese or the russians or name the country in the middle east have stepped in to fill it. and -- >> -- that's a problem. >> until the united states reasserts itself, until we begin to impose our presence on the world, it is not going to get any better. >> all right. gentlemen, thank you so much. look forward to seeing more of you in 2015. straight ahead, breaking news tonight a suspect threatens police and the fbi and then tries to run down police officers with his car. the latest next. in my world, wall isn't a street... return on investment isn't the only return i'm looking forward to. for some every dollar is earned with sweat, sacrifice, courage. which is why usaa is honored to help our members with everything from investing for retirement to saving for college. our commitment to current and former military members and their families is without equal. start investing with as little as fifty dollars.
