Fox news chief intelligence correspondent Catherine Herridge joins us. Catherine, what can we report tonight about this. What we have been able to confirm within the last hour is that a very careful analysis is being done by the u. S. Intelligence community to verify the authenticity of this tape. So that will involve a voice analysis, looking at the location, understanding the credibility of the individual who posted this video from isis on to social media. But, more specifically, whether there is anything there that says its a fake. From my experience covering al qaeda now for more than a
decade. These groups do not have a track record of posting fake tapes. Now, the tape has now been taken down. It was on youtube. It has now been taken down. Thats correct. Many people have actually looked at the tape. Who is james folly . James folly is an American Photo journalist. He was kidnapped in syria in 2012 and its been the belief of the u. S. Intelligence community that he was in the custody of isis. The posting of this video today, the alleged killing of foley does appear to be a significant escalation by isis in retaliation to the United States for these air strikes in iraq. All right. Now, there is one other journalist that is also held captive by american journalist held captive by isis . There is at least one other. I have had some information recently that there may be a u. S. Aid worker that was kidnapped and held by isis. So we are starting to see a trend. The taking of u. S. Citizens and if this tape turns out to be genuine, the execution
of u. S. Citizens and you cannot see this video and not think about the execution of daniel pearl in 2011. Now to ferguson, missouri. A grand jury could begin hearing evidence to determine whether Ferguson Police officer Darren Wilson will or will not be indicted in Michael Browns death. Tonight on the record learning new information about officer wilson. Plus, right now ferguson, missouri bracing for another night of violent protests. Last night hitting arrest high, 78 people arrested during last nights violence. Former homicide detective ted williams is in ferguson. He joins us live. Ted, what you have learned about this Police Officer . Well, greta, there is a great deal that we have learned about the Police Officer. Is he a career veteran. He has been on the force for approximately five years. He has recently divorced. He has a girlfriend, but one
of the things he does not have is a record of getting in trouble or having a lot of complaints lodged against him with his commanders. In terms of his colleagues like him, basically. That doesnt mean anything didnt happen on the street but he is wellliked by his colleagues . Yeah. That was Something Else that we were able to find. Is he a Police Officers Police Officer for most of what we have been able to find. Is he well like in the department and by his colleague and his officials. All right. Well, you are in ferguson, so, tell me, is it beginning to look at all like last night when you there were last night and crowds began to gather. I realize its not yet dark there. Are you beginning to see anything that resembles last night . Greta, this is a town under siege. There is a difference between night and day. During the daytime you are
able to walk down the street, the demonstrators are out here. The Law Enforcement and the demonstrators get along very well. And then darkness takes place. And its a complete metamorphosis. At that stage the demonstrators are influenced apparently by rebel rousers who get in the mix with the demonstrators and as of last night, we had two people shot, we had three or four Law Enforcement agents or officers injured. We had had quite a few arrests here last night. Its a difference. I have got to it tell you, greta. Im not the governor of this town or this state or this town but what i would like to see at the dusk they should shut everything down. I realize individuals have First Amendment rights, but im telling you sooner or later but i hope it doesnt happen but there is a good possibility that one of officers who is trying to protect this public could
very well be harmed seriously harmed. Ted, if youll just stand by. Youve seen it, protesters taking to the streets every night since Police Fatally shot an unarmed teen Michael Brown. On the record is investigating. Ted williams and Griff Jenkins walked the identical path that brown walked in the minutes he was shot from the Convenience Store to the shooting scene. Starts right here in this area where Michael Brown and Darian Johnson confronted the clerk. At some stage or another, during the course of these events, Michael Brown reached across the counter here and in this area where you can can can see the cigarilos is. He wound up handing them to Darian Johnson. At that stage he then reached back over the counter, grabbed a handful of cigarelos, at that stage,
after doing so, what he did was begin to walk towards this door here. As he got toward the door, leading to the outside of this liquor store, he was met by the clerk. So the clerk comes from behind the counter. Absolutely. Meets Michael Brown here and at some stage or another, Michael Brown wound up pushing the clerk. Okay. And when he pushed him, he pushed him into this display case. Michael brown then walks out of the door here. And once Michael Brown walked out of the door, there was some words between him and the clerk Michael Brown walked back into the store. Had words with the clerk. They were walking away from the liquor store, which is on the other side of the mcdonalds here. The former federal agent, is there anything to be
learned . Does it stand out to you at all that the two were walking along this road . It seems that if you rob the store or if you stole something you would run. You are absolutely right. They did not see this as a robbery, meaning Michael Brown at the time. I think, in Michael Browns mind was that he had walked into a store, and that he had taken the cigarelos and that that was the beginning and the end of it. And it wasnt like he had stolen money. It wasnt like he had taken a gun and put to the clerks head, so, i dont think he saw this meaning Michael Brown as a big deal. they turned right on canfield . Thats exactly right. They turned right on canfield and started walking right on canfield. They are walking out hered in the middle of the street. And if you notice this, this is really a two lane
highway. So if you are walking in the middle of the street and you are walking out here like i am now, you could very well be considered to be impairing traffic. And if you are walking in the middle of the street like, this then traffic is going to have to go around you. The reasonable justification for the the Law Enforcement officer to Say Something to Michael Brown and Darrian Johnson and that was get out of the street. My investigation show that Michael Brown and Darian Johnson had words with the officer. There was an exchange. It was a heated exchange. There was profanity exchanged. And at that stage the Police Officer went past them. Did not stop, at that immediate time. But went past him what we do know is that Michael Brown and Darian Johnson walked counsel canfield. The Police Officer is up in
front of him in his car, meaning officer wilson. And they are walking really in the direction of officer wilson. At some stage or another, when they get to a certain area up here, you will see where officer wilson put his car in reverse and came back and now officer wilson was parallel to Michael Brown and Darian Johnson. And it was at this stage and at that stage that the confrontation took place. Is it possible, ted, that officer wilson had heard on the apb some description of the Convenience Store robbery and perhaps thats why he was interested in brown . What we do know is that the chief of police has said that officer wilson was not aware of that all point bulletin about the robbery that took place on
fluorescent at the liquor store. And it was at this location that the confrontation took place. Now, as you know, the Police Officers have said that Michael Brown hit the Police Officer in the face and that Michael Brown was somewhere on top of the Police Officer struggling for his gun. What is going to be significant about this is if there was an actual struggle for the gun, there should be some d. N. A. On that weapon. And im sure that thats what Law Enforcement is trying to show. Now, but there was another version of this. And it was a version that was given by Dorian Johnson. That is that Michael Brown was never in the police car, that the Police Officer pulled up parallel to him and reached through the window and grabbed Michael Brown by the collar. There was some confrontation there. The Police Officer pulls the gun and shoots Michael Brown. Michael brown then takes off running. Now, thats what we have been led to believe when
Michael Brown took off running, it had to have been at least a few feet back here because from what we have been told, the Police Officer was racing or running after Michael Brown. And the Police Officer in running after Michael Brown shot Michael Brown as we know now, at least six times. And it took place in this area here. Ted, im curious. You know, being out on the scene is so different from looking at it on a tv screen or monitor. Did walking to the store to the shooting scene give you any new or different perspective . Anything occur to you . Well, yeah. Its surreal because you are able to make a determination of the distance from that liquor store to where Michael Brown was actually shot. You are able to kind of think about the amount of time it would have taken to get to that location. So, its very surreal goings to that scene you wonder about how and why this young man lost his life. You wonder who is telling the truth in this is the Law Enforcement officer justified in using his weapon or was Michael Brown a victim of the Law Enforcement officer . Those are the question marks. Its going to take some time but i think it will be ferreted out by the forensics in this case as well as actual witnesses. Is that the direction he would be walking if he were going to his home . Is there anything unusual about the area that he was walking in . Is this sort of a natural route . Well, thats interesting, greta. Because i have been told that in the area where Michael Brown was shot and killed that his grandmother lived in that area michael
brown was in his grandmothers house in that area where he was shot and killed. Are you learning anything about Michael Brown, anything that he was doing earlier in the day, even before he went to that store . Any new information about him . No. I havent been able to glean much information. We do know that he and Dorian Johnson were together the night before and that they were together just prior to going to that liquor store. So, they spent quite a bit of time together and i would assume Law Enforcement is talking to Dorian Johnson. All right. Are you meeting people from outside the area who arent from ferguson . Because we hear stories that outside agitators are coming. In you have met anyone . Absolutely. I have met numerous agitators. I have just about gotten to a confrontation with onage territory that i had that i spoke with. They are coming in by planes, buses and even by airplane. I met onage territory who just flew in hours ago. Again, you have got to wonder what are they up to . I can tell you that this thing is getting to bigger than Michael Brown. Ted, if you will stay with us, we will be back in a minute. Police are understandably on edge. Fox news correspondent mike tobin is live in ferguson. Mike, what is going on now . The whole thing has taken out a routine. Almost identical repeat of what i saw yesterday. Here is the crowd of demonstrators, really about the same size as we saw yesterday they are walking it off. Marching around in a circle. Right about the same size of the crowd that we saw about this time yesterday. So, if everything is going to follow the pattern, we are going to see the crowd grow until night fall when the atmosphere changes. Thats how it goes every night. The businesses, reds barbecue has been out for nine days now, cannot reopen under the circumstances. So they have got the sign that says we will be back. The aggravating factor out here today is the fact that there was another Police Shooting, not that far away with st. Louis metro ph. D. With a knife wielding suspect. The people out here in the crowd they know it, they have a version of that story in which the shooting was unjustified. What i havent seen though is a big angry flare up with this crowd in association with that information. Greta . You know, mike, at night when i watch it, is the police push the protesters out of the street or the protesters go into the street, is that sort of the line of demarcation where they collide . Well, as far as whats going on now the police just keep them moving. They are supposed to be more on the sidewalk and let the traffic go in the center. There comes a point in the evening where the police will block traffic and then they will march through the center of the street. And then whenever they congregate. Whenever they stop and loiter, the police will come and they will break up that group thats standing around. Now, later, as it later, as it gets dark and gets a little more aggressive, youll have the people in the street and thats when they form up a line and kind of confront the police. There is shouting back and forth right now. And of all of the people who got arrested yesterday, only four of them were from ferguson. Mike, if i just want to stand on the sidewalk, with three of my friends, is that something the police wont permit . You have actually got to keep moving . They will move you along with three of your friends. If you refuse to move you
will be put in zip ties and move away. Whats the reason for not letting people stand there if he they are on the sidewalk and not doing anything else . I have seen this in big demonstrations before. It seems to be a crowd control technique. If you want to march, come on and walk it off. I think the technique seems to be just to wear people out. If you keep them moving, they wont hang around as long. If you keep them moving, marching. Go ahead. For our First Amendment perspective, you can just stand there and congregate as long as you are not causing trouble but anyway, whatever. Mike, thank you very much. Good luck out there tonight. Thank you. And police say they came under heavy gunfire from angry crowds last night. In Response Police firing tear gas and flash grenades at protesters. Griff general cibs reports from the streets of ferguson. [explosion ] things are straighting to break out. Its getting tense between
ferguson. The stand off you can see a bottle almost landing right here. We see the trucks moving up. The trucks clearly preparing to move in on these protesters media is being told. Disperse immediately or you are will be subject to arrest. Do it now. Waving at someone to get on the ground. They singled him out. Stay there, dutch. And they circled him. He is on the ground now. Rifles pointed. [sirens] [chanting] what are we doing this for . Mike brown. Say it again. Mike brown. Right now. Break down. Hands up. Dont shoot. [siren] anyone who has been at these protests understands there is a dangerous dynamic in the night. It allows a small number of violent agitators to hide in the crowd and then attempt
to create chaos. There are a few bad apples that might be part of the cause. We can be here. What do we want . Justice. When do we want it . Now. Back up. Back up. People can see the injustice and see whats going on. This is the start of a revolution. I said it before and i will say it again, this is the start. [horns blowing] no justice, no peace. [sirens] how are you doing . Were amnesty
international u. S. A. Were here at human rights observers and activists. Trainers here to bear witness whats happening on the ground and support the community in any way possible. I would recommend that you move that way. The tear gas is getting intense now on west thats canfield down there. Thats where the first went off. Its almost unbearable. Can you see if you turn and look over here, almost all of the protesters have moved out of here because unless you are here with goggles, with a gas mask, it is very, very painful. And they have achieved their goal. And Griff Jenkins joins us live from ferguson. Griff, quite a night last night. A lot of arrests. Im curious how tonight compares to last night. I realize night fall has not occurred yet. Well, i would say, greta, that its probably not going to be any quieter, particularly with the second
shooting just miles away. You have heard about at which time the police are Even Stronger in force. Even the parking lot on the media has become much more intense as i have seen since i have been here. Community organizers trying to captain johnson. Not confine people in that little area. That is where a volcano may erupt as ted says. I think we are going to see that tonight. We will be there for you. Night after night where are all the protesters coming from. Where are all the protesters coming from. Joining us is nicholas from the st. Louis patch. Good evening, nicholas, are where are these protesters coming from. Some from ferguson but some not from ferguson . Well, actually, i think very few are actually ferguson. Many of them are from in and around the st. Louis area, st. Louis county. St. Louis city. I think they are coming up in here. What a lot of people are very worried about is that people are coming in from out of state, from chicago, from other places. The governor, when he asked for the National Guard to come, in he said he was concerned that criminals were coming here from out of missouri and that was just intensifying it. They are worried that people are riling everybody up and trying to make this even more intense situation which as you know, greta, they dont need nicholas are any of them part of any group or organization or sort of random the outsiders . Some of them are with different groups. Some of them have different affiliations. Some of them are peaceful. Some of them just want to have peaceful demonstrations. Lets also be mindful that many of the people who are not from st. Louis and not have ferguson who have come here are people like Jesse Jackson and al sharpton people who are leaders in the black community who have come here to shine a light on this case. And that is anment of it. Sun goes down and things get dangerous. Tear gas and rubber bullets, those are things that arent necessarily sure where everybody is coming from. Last night they had 78 arrests. They said a majority of them were from missouri. But many of them were not. They were from california. And they were from many other states. Thats a long way to come here. I think the media intensity around this has been a magnet for people to come here and try to really make this situation into something more. Well, that makes it rather awkward in that its a news event so we want the
media covering it but the media is also is a magnet so that people come to create more of a news story. Thats awkward. Yeah, it certainly is is and i have been out here many nights and i have been through the area. I have lived in st. Louis and i know what its like. And i know ohio important of a story this is. And how volatile it can be at the same time when all of the cameras come in you see people everywhere i think a lot of people like being on tv. You see an element of that it makes for a lot of excitement for people watching at home. Pause you see the smoke. You see these armored trucks moving in. You see, you know, the National Guard here now. And that makes for this exciting back drop to people. But we forget that this is a very serious situation about intense racial issues and involves the death of a young man. And not really just necessarily the show. And a the will of people when you see it on tv, you dont realize this is a small area, its about four
or five blocks. The whole city isnt on fire. But people in ferguson still have to go to work. They still have to go back and forth. They still have to sleep at night. Every night they are work homes. Tear gas is being thrown. Smoke bombs. People are chanting, guns are going off. That is the element people are trying to quell. this is a fox news alert. With night fall quickly approaching, leaders urging residents to stay home. After dark is when clashes between police and protesters erupt and gotten out of control. Fox news correspondent Steve Harrigan is live in ferguson with the very latest. Steve, whats it like there now . Greta, we have got about an hour of sunlight left here. The number of protesters is beginning to build, as it usually does right about this imtoo. The numbers now probably at about hundred and they are all walking as they have to do as ordered by police a lot quieter. We did have violence and tear gas and two shootings. About 70 arrests. As you can see most of the businesses along this main street boarded up, despite being bordered up, system of them are still open and, of course, schools also close for the whole week. We have urgings now from all sides from the police, as well as from Community Activists for people to stay home once that sun goes down. Thats going to be the real test where they stay home or still come out to more protests. Greta back to you. Steve, thank you, of course you go from war in ukraine to the terrible situation in our streets. And today, another policeinvolved shooting just a few miles from ferguson, st. Louis officer shot and killed a knife wielding robbery suspect. Kti reporter is live in st. Louis with the very latest. George, what happened . Will, greta, basically it was more of a shoplifting situation than a robbery situation. Police say the man did have a knife. Is he described by people in the area as being mentally
challenged. He came at officers with a knife the first time they say and then they say he backed off and then they say he came at them a second time when he got to within three or four feet when he got to same doddson, thats when the two officers both opened fire, shooting and killing him. It happened at about 12 20 here in north st. Louis. Less than three miles from ferguson where all the unrest has been happening. There has been a crowd formed here ever since. That crowd grew, became pretty sizeable. A lot of the people now have left. Those who remain may be some of the angriest some night describe it a lot of the people out here very upset chants of no justice, no peace. The chants now are hands up, dont shoot, now hands up, shoot back is what you are hearing from some in this crowd. So police out here, they are kind of staying on the fringes, not the aggressive position you have seen in ferguson so far by st. Louis
city police here. Different police force handling things she what happens here less than three miles from ferguson where all the unrest has been. And the violence and looting forcing many ferguson businesses to board up and close down. Griff general since talked to one of the Business Owners whose windows were smashed in the rioting. I got a call sunday, 5 00, maybe in the morning from my Alarm Company that said there was a breach in my office. I didnt know any of this stuffasked if the police were there she said the police had been there and left. Been there and left. Was there anybody in there. She said no, she cant say anymore. That was it i said im on my way. And when i got down here, i found out that you know, the whole riot thing and looting the night before i guess the police im only assuming
called the Alarm Companies not to call the owners because they didnt want us coming down. Can we see some of the damage or what happened . All of this was broke out. The door was not, but we covered the door and we covered this side because we know whats going to happen. And as you see from the neighborhood it has happened. What was damage here . All the glass here was broke out. You can still see some of it there. Bricks i used to have them sitting here to people come in would see what they did but nobody comes. In only reporters. They just threw those in the window to break things up. Glass was strong all the way through. It was its old glass, so its not like the old shadow proof chunks. Did they come in and steal anything . Nothing. They did not come in that i know of. That tells you they are not protesters, they are thugs. Just people that want to rob and steal and they come from places to just do that you know, no justice, no peace. Come on, really . So, you got the to hurt the Business Owners in the peace of justice, it doesnt make sense. Three autopsy sis on Michael Brown now complete as the teens vietmam family announces funeral plans. This Michael Baden who performed earlier autopsy at the brown family request says the 18yearold was shot six times including twice in the head. The browns family lawyer ben crump joins us. been set for monday; is that right . Yes, maam. Any idea funeral plan also be closed to the public who will be eulogizing Michael Brown, anything like that. The family is still going through that process, greta. As soon as they make their final decisions, we will let yall know. All right. You know, i cant even imagine what its like for the parents. Is there you know, is there anything that you can say to them at this point . As we have been watching us what unfolding they lost a son and now we have all this violence out in ferguson. Yes, maam. They are very troubled by the violence. They have asked that people act responsibly and not do anything other than whats within the law. All the violence, they dont think at all what their objective is. And that is to get answers and get justice for their child being killed in broad daylight. What do you think attorney general eric holder will accomplish going to ferguson taupe. One of the things i think the people of ferguson have a great distrust with the local st. Louis authorities and so looking at the federal government saying that we are going to ensure that its going to be a fair and transparent process. Hopefully will give them some sense of confidence to where they wont feel Michael Browns death will be swept under the rug. I think that is the greatest concern for a lot of the protesters that they have seen this happen before. Police officers kill young people of color nobody knows what the process is. Michael brown jr. Because it was out in broad daylight. Because you have so many witnesses. And because he was shot
multiple times. People feel very passionate about it. The most troubling thing, i think, greta is for over four hours his body was laying on the concrete so by the time they finally did move him, not only was his mother and father there trying to get pa the police lines to get him but everybody, they had 100 people out there watching saying this is not right. So the community kept getting more passionate. I have spoken to eyewitnesses and they will be testifying behind closed doors in a grand jury proceeding as you and i both know being lawyers. I dont know what you know, what kind of evidence they are going it hear, in the event that they conclude that this was not that this was, for instance, an accidental shooting or not a murder, can your clue clients accept that if that happened . I have no idea how the facts are going town fold. I know they got shot six
times. Thats horrible. I got that but, i dont know what the witnesses will say happened on the street. You know, greta, i think the clients want to see a process that is transparent grand juries are a secret proceeding as you know as lawyers that is troubling because if they dont know what was presented as grand jury thats why they asked them for federal intervention, somebody who they feel can be objective. Who didnt Police Officer who was the shooter. Then people who they think have no connections to the Ferguson Police department or the st. Louis county sheriffs office, because these people have lived in this community for years. And this isnt the first Police Shooting of a young africanamerican that have had a lot of controversy surrounding it. I think for me as a
bystander whats going to be very significant is when we see if the clothes had any evidence of gunpowder residue which might suggest a more closer shooting than a distant one. Do you have any information about whether the clothing that michael was wearing whether there was any indication there was gunpowder residue on it . We dont, greta. As you know, dr. Bae den, the pathologist that is working on the familys behalf did the autopsy for the family, he has talked to the st. Louis county medical examiner and requested that information as well as the xrays to see what bullets were taken out of his body where casings were found at or near tragic shooting took place but also whether there was any evidence in the police car of any kind of bad or evidence that would help us tell the whole story. Dr. Bae den had said the autopsy is only one part of the story. What you really need is to have all of the witness statements, all of the gunshot residue evidence, everything, so we can look at it very objectively and say, it s. It likely what the witnesses said happened or is it likely what the Police Officers said happened . And thats what we hope to get to. But if its a grand jury proceeding thats closed, nobody in the Community Gets to hear that. And i think thats a problem for this community. And i agree. Both sides of this, you know, this current issue, people made up their minds and havent had the facts develop. Grand jury secret. I agree issue. I thank you for joining us tonight, sir. You are damned if you do, and damned if you dont. Grand jury is going to be held in the strictest of confidence. It allows the members of the grand jury to ask questions to look at all the evidence and to basically make a decision free of any fear of any type of reper russians. We repercussions. Concerned that because the grand jury is so that the full truth will not come out. You have to have a little bit of faith in the system that its going to work andwork well and just and fairly. they are on the sidewalk . Yeah. But you know what . The police also have the ability to control a crowd to make sure that things are occurring safely there could be a municipal ordinance. Basically they are saying keep it moving along so you dont incite violence and encourage people to sit there and get aggressive. I dont know that there is some type of offered anyones they are relying upon to do it. They are allowed to express their First Amendment right to free speech.
