I think the president knows that he key is to speak to the American People. The reason he won in 2016 he was bought and sold by no one. Is he his own man. I will say that the nra spokeswoman dana loesch has said something very reasonable and true, which is that even if we put more restrictions guns obtained illegally. Federal study shows 11 of gun crimes are illegally purchased. Vast majority of gun crimes come from illegal source. What we really need to do is punish people who are letting their arms get into the hands of people illegally. Thats the real clincher here. Jon capri, it sounds like you agree. I think it certainly is an issue. Again, i come at this from kind of a unique perspective because i am a democrat supported by the nra and entire in the state legislature and tragically had a School Shooting in my district in 2012. I come at this from a unique perspective. President trump and his approach here. I has the luxury for lack of a better term to take on the nra to speak his mind. He is a sitting first term president and, you know, its really the legislature, the members of congress that, number one, have to answer to the electorate this year in 2018. Number two has to care more about whether or not members of the nra are going to show up at the polls. And i will tell you this. Its not about the nras money. It is about the fact that nra members are loyal and they show up much more frequently than anybody in a Public Opinion poll. That said President Trump is listening to the American People saying what people want to hear but only so much can be done from the white house take congressional action and President Trump is a bit isolated because its not his actual job to get done. Jon the president does not write the laws. Interesting dynamics at play here though. Because the nra endorsed this president. Very early. Jon endorsement ever in a president ial campaign yet he was taking on senator pat toomey republican from pennsylvania yesterday saying he is afraid of the nra. Listen to this. Can you buy the gun, the weapon used in this horrible shooting at 18. You are going to decide people in this room pretty much are going to decide. I would give very serious thought to it. Can i say that the nra is opposed to it. We didnt address it, mr. President because you know why . You are afraid of the nra. Five years ago. Its a big issue right now. A lot of people are talking about it a lot of people are afraid of that issue. Jon pat toomey says i have never taken any money from the nra and not particularly afraid of them. I think what the president made was a very important distinction. Specifically talking about hand guns versus semiautomatic weapons which were used in this crime. So i think that thats a very important distinction that woul we have to think about from a common sense perspective. Thats what i find so refreshing about the president. I know myself and some other conservatives we dont know what we are going to get when he won the nomination. We thought maybe he wouldnt be conservative enough. But there is a difference between, you know, understanding the Second Amendment is inherent and it is embedded directly into our heritage as a country that was able to throw o off the evil British Empire because we were armed. This is something that we cannot take away. The bigger problem here again is the issue around who is getting access to the guns illegally. Same thing with the university of chicago only 3 of gun crimes committed in chicago are from guns that were obtained legally. That means 97 of gun crimes in chicago are from guns obtained illegally. This is a big problem. Jon it wasnt an nra member who pulled the trigger. Legally obtained gun as well. Right now the dialogue for better or worse is focusing on this immediate issue of parkland, florida and the tragedy that occurred there and the facts sur rounding that case. Now, do we have to have a larger discussion about everything from conceal carry reciprocity to, you know, what it means to have what is the definition of a semiautomatic weapon . Is it an ar15 . Is it extended magazine clip . We need to have a much larger conversation about everything again prosecute Mental Health to background checks by at the same time trying to preserve individuals trite bear arms and right to privacy as well. Scarring people by labeling them in a certain matter. Often sometimes individuals in government when a tragedy happens or when a certain event occurs, we look to react. This tragedy is the result of a massive multistem mick failure. A failure involving federal agencies, state agencies, local authorities who all failed to identify the threat that he posed and coordinate a response to stop him before he took action it is you this failure that i hope we will focus on by addressing the shortcomings and vulnerabilities in our current laws and in our current policies. We may still have a debate on the broader issues of overregulating gun sales. But irrespective of that debate, we still must and should do this today i wanted to come here for a few minutes and announce a comprehensive plan. Not a simple bill you vote on and move on but a series of measures that i believe could prevent these attacks before they happen and help schools protect their students and their teachers and i believe these ideas should all enjoy bipartisan support and if passed should and could help prevent the next mass shooting. These are ideas i outline not because they work but because i believe we can get the votes to pass them. 60 votes in the house, the senate and signature of the president. Thats what i think. These ideas i outline i believe work and enjoy support. Our schools are woefulfully unprepared to prevent an attack before it occurs. Furthermore, during my visit to the site of the attack and my followup meeting with teachers at the school i learned of various changes to School Facilities and practices which could have stopped the attack or improved the response. Therefore i will be joining today later today with orrin hatch to stop School Violence act. If passed this law would provide federal grants to do some important things that would have really been helpful in this case. Strengthen school security. Infrastructure of the school provide School Training for everyone, administrators, teachers, even students to be able to identify threats and to report them. Something that really would be helpful is the creation of a School Threat assessment and Crisis Intervention Team intl is a Successful Program in los angeles that does this. That is a team that is a coordination between Law Enforcement, other state agencies, School Districts and the like where they are all talking to each other about students and former students that may pose violence and intervene before they act. A second issue we identified is even if Law Enforcement School Administrators or family members believe that an individual poses a risk of committing an act of violence, they have very few options to prevent them from purchasing any guns or taking the guns away that they already have. Therefore, i intend to present a new law perhaps in coordination with others that are working ton now that will lead to the creation of gun violence restraining orders, something that will give Law Enforcement and close family members the option of obtaining a court order to prevent gun sales or remove guns from individuals who pose a stlet. And to be clear, the due process in such a situation would be on the front end, not on the back end. The third issue we uncovered is that federal law appears to discourage School Systems from reporting dangerous students to Law Enforcement i dont support criminalizing all school conduct or school misconduct. But a student who has threatened violence. Or exhibited violent behavior needs to be reported to Law Enforcement. A student thats committed a crime by issuing a threat of death using social media that is a crime under florida law, that needs to be reported. Under Broward County School Policies pursuant to something called the promise program, reporting a student, a dangerous one to Law Enforcement is the sixth step, step six in their plan. Therefore, i intend to propose changes to the federal youth promise program. So that a School District plan under this program does not delay and does not discourage Law Enforcement from being alerted to dangerous and violent or hazardous behavior. Fourth, we need to strengthen background checks. And thats why i have joined with my colleagues on both sides of the aisle pushing for the immediate passage of fix nics. Something that will require all federal agencies and incentivize every step to fully report relevant information to the National Background check database. Because a background check is only as good as the information that is on it. And it deranged killer was able to buy guns on 10 separate occasions because he would have passed every any background check because none of this stuff that was known about him was reported to that system fifth, we must begin to prosecute the purchase of guns by people prohibited from doing so. Next week, i hope to be joining a Bipartisan Group led by senators toomey and coons and filing the lie and try bill. Notify states when someone who is not allowed to buy a gun tries to buy a gun and fails the background check so they can be investigated so they can be prosecuted in addition, well be present ago new law to provide more prosecutors to go after straw purchases, which is where someone goes and buys a gun on behalf of someone else because that someone else could not pass the background check. Now, there are some additional reforms that im open to. The possibility of looking at the age limits on semiautomatic rifles. The notion of looking at what could be done with high capacity magazines. Well continue to explore and look at those. These reforms do not enjoy the sort of widespread support in congress that the other measures i have announced do. And in order to successfully pass these ideas will have to be crafted in a way that actually contribute to Greater Public safety but also do not unnecessarily or unfairly infringe on the Second Amendment right of all raw abiding adults to hunt and participate in recreational shooting. But, ultimately, there are things that we can do that have widespread bipartisan support that we can act on and get passed that will actually make a difference. These are impactful things. I just urge the senate and house, all of my colleagues here do not hold hostage a piece of legislation that would work and that we all support because it doesnt have everything you want. There are things we can act on and do and there are things we can continue to argue over debate and perhaps do in the future. But on the things that we agree on and they have to be things that could have prevented this attack and will prevent future attacks. Lets get those done. I have outlined those here today. There may be others. We owe it not just to the victims and families of parkland, but to all americans everywhere, for this attack may have happened in southern florida, but there is no reason why it cant happen somewhere else and i say it will happen somewhere else if we do not fix the deficiencies and the flaws in our policies, in our laws and in the way that theyre enforced. We have learned from this incident what is wrong with our system, let us fix it. And we have an opportunity to do so while we continue to debate and work on the issues that we do not agree on. And that is what i hope we will do. And that is what i commit to doing everything can i to achieve. With that, mr. President , i yield the floor. So those those four key facts that the investigators, the prosecutors are going to set fort in front of that jury are going to be very condemning. Jon its also true, bob, that the government has to prove that she was essentially trying to support the islamic state, isis . She has to aid and abet. On the obstruction charge she done she admitted to lying to the government. I think thats an easy case. As far as material aiding and abetting him, i think as a prosecutor, im concerned about a couple things. Especially, mercedes, that text that happened while he was in the course of a shooting saying do you see whats going on . And she says no. What . And he says i love you, babe. And they also, the defense, gotten some experts that are also going to show that some of the times when he went to get the ammunition where she confessed that it was a false confession g. P. S. Status shows she wasnt there. I think they have a little bit of a factual despite. As a prosecutor myself, this would be my biggest concern to be able to get around some of those inconsistencies.
