What we learn from that hearing is the president was warned about general Michael Flynn on at least two occasions. The one time by the acting attorney general. Another time, two days before the election. President obama had said to President Trump, president elect trump that when it came to Michael Flynn, there were probably people out there who you might consider to be better for the job then flynn. That was based on the experience that president obama had with flynn when he was the director of the Defense Intelligence agency. Last night, gates testified that flynn had been talking to the russians and the russians knew flynn had lied to the Vice President about the content of his conversations. Listen to what she said here. That created a compromised situation, a situation where the National Security advisor essentially could be blackmailed by the russians. Finally, we told them that we were giving all this information so they could take action. The action that they deemed appropriate. The aspect of the hearing that President Trump is focused on is the unmasking of Trump Officials. James clapper testified that he had asked for the identity of one trump official to be unmasked, and both he and yates said they had seen the names of unmasked Trump Officials in intelligence reports. Did either of you either reviewed classified documents in which mr. Trumps associates or members of congress had been unmasked . Well, yes. You have . Can you give us details here . No, i cant. Miss yates, have you . Yes i have, and no, i can give you details. The question President Trump has its who leaked flynns name after the white house was told about it. He tweeted yates and klapper both denied leaking flynns name or any new stories. House figure paul ryan said this morning that is a question thats being investigated in congressional hearings. Listen to what he said. That is a crime and is taking information, on classifying it, and leaking it out. Thats something that somebody in the Obama Administration decided to do and it did happen. The question of this investigation is to get to the bottom of that. Both klapper and yates say that there is so far no evidence that there was any collusion between Trump Campaign officials in the russians in terms of the attempts to influence the u. S. Election. Jon former acting attorney general yates also telling lawmakers that she expected the white house to take action after her warning about flynns contact with the russians in the dangers that that could post on the road. The russians also knew that general flynn had misled the Vice President and others. In media accounts, it was clear from the Vice President that they were repeating what general flynn had told them. This was a problem because not only did we believe that the russians knew this, but they likely had proof of this information. That created a compromised situation, a situation where the National Security advisor essentially could be blackmailed by the russians. The former acting attorney general talking about wiretaps of the Russian Ambassador, this is the stuff out of a spy novel. , it was pretty compelling testimony and not a good day for the white house. The whole Michael Flynn story is one that i wish they would just go away. Theres a lot of drama wrapped up in it. I think the democrats on the committee were focused on the question of why did Michael Flynn do and why was he misleading the Vice President you could then mislead the American Public . Republik is refocused on the unmasking of his name, and so, you have a hearing with a lot of drama. Jon at the same time, and has all been viewed under a bipartisan lens. When youre talking about National Security, that becomes problematic. I think so, though the underlying issue here is that there is less partisanship on the question of russian interference in the 2016 election. There is bipartisan concern that thats a very troubling precedent and not to be left to continue. I think one of the problems yesterday it was that sort of got lost in the conversation because became two conversations one about what Michael Flynn did or didnt do what they Russian Ambassador and how it did or did not become known out of the classified document. The underlying question which i think is one both parties are concerned about, russian interfering and potential collusion with an american president ial collection is lost in a conversation right now. It will be forever, but right now. Jon sally flynn testified that very early, the first week of the trump administration, she went to the White House Counsels Office and told him of her concerns. Nothing happened until the story broke publicly 18 days later in the washington post. I would suggest leaks. Once he didnt see any results from her meeting, somebody leaked it to the press, right . It looks that way. The question democrats were boring and on is why was there this gap between the disclosure of this information to this then new Trump White House and the action that was ultimately taken which was dismissing mr. Flynn. Republicans were focused on why Nothing Happened until there was leaked to the press. The leaks happened after the obama team had left and when the trump team came in, but there were plenty of obama holdovers. Its going to be a long time until we get to the bottom of both those questions, why was there a gap between the time when this was known in the action was taken in the white house and where did the original stories come from . Jon President Trump is casting some blame based on the Obama Administration for having approved general flynns National Security clearance. Is that part of the weight . I dont like that one flies too well. He had clearance when he was director of the Defense Intelligence agency, that was renewed in 2016. He also had taken office as the National Security advisor for the trump administration, but that was before the issue we are talking about is really known or had been vetted. The fact that he had a security clearance and the fact that he then subsequent i got into trouble, those things dont match up in the timeline. Jon little noticed and all of this is the president s announcement that he is heading to saudi arabia and the vatican next month. You write in the wall street journal that this could be a real opportunity for him and frankly, for that troubled part of the world. Its an interesting situation, but he is going to start his overseas journey as president by going to saudi arabia, then to israel, then to the vatican. Whats interesting about the situation in the middle east, you actually have a strategic alignment. The studies, the egyptians, and the israelis, they all see the twin existential threats from iran and from the Islamic State. They are in alignment about that and there also on good terms of the new american administration. That creates possibilities never existed before. Everything releases complicated, but at the moment, there is a reason to go and have this new security alignment that tried to isolate iran and stems the Islamic State tide and thats what the president presumably is going to go do. As you look at afghanistan, how would you describe to our viewers where afghanistan states and the list of priorities that the United States are confronting . First of all, we have to say that this is a very difficult problem, so no one should be under any illusion that this is going to have easy answers. If we had a chance to have easy answers to fix this problem, it would have been fixed a long time ago. With that being said, we have to understand that a military surge is not going to work unless we have a diplomatic surge. In order for the military to be successful, we have to have diplomats who understand the strategy, have a very specific plan of action, and they have two surge as well. We have to have a diplomatic surge at the same time. The military is ready. The military is always ready and i think second mattis is showing us that they are ready to move in and do what needs to be done. All the ideas we have implemented from a diplomatic standpoint and afghanistan have failed. We need to be honest about that. We run out of ideas at the state department. We dont have the leaders, new leaders, new ideas at the state department yet helping second tillerson. We need to make sure that secretary tillerson has as many devil plants as possible with new ideas to search this at the same time and my theory is were not quite there. Jenna we had 16 years of experience. Perhaps i could tap some of those to help with some diplomatic efforts. I want to go to the word surge so our viewers know. President obama numbers that are being suggested are around 3,000 as a low base and 2,000 more than that. I want viewers to know when we say surge, sometimes we have a vision of what that might look like and are looking at a little bit lower number on that. To go back to your point about how to win in afghanistan, if you had to advise the military how to empower their narrative to the American People, as well as to our enemies, what would you advise them . I think we have to utilize the military in the best way that they are trained. They are sending in bombs, they are sending in the military component in afghanistan. They do a great job of that, but we cannot ask them to be doing the diplomacy as well. Thats the state department and me have to have trained diplomats who know how to go in and negotiate. Jenna what would they be negotiating for . Youre saying theres no military solution, is there an equal argument to saying they are may not be a diplomats solution . Its a great question, jenna, there is a solution Going Forward if we can be honest with ourselves of what we need out of afghanistan. We need to make sure that its not a safe haven for terrorism and that we have access and afghanistan to the other parts of the world when it comes to commerce. We need a road if you will. We have access so that our commerce and trade can be successful through afghanistan. Thats a limited scope. We dont have to have the entire country of afghanistan in a very specific way that the United States wants them to be. They dont have to believe the same way that we do for instance. We do have to make sure that its not a place, a safe haven for terrorists and that we have our u. S. Priorities of getting access, comics access. If we are honest about that limited goal, that can be accomplished. Jenna they may have just the question of whether or not american lives are meant to get a commerce road and perhaps stave off some terrorism in that area. Great to have on the program, thank you. Josh, i think Chuck Schumer and democrats will do as much to help Mitch Mcconnell as Mitch Mcconnell helped democrats on the original Affordable Care ac act. Heres the problem. Paul ryans timeline, nobody in the senate believes its possible. The senate, they cant take out the garbage into months, let alone have some major overhaul. This is gone for months and months and months. Im skeptical that theyll be able to get to the finish line because frank lee, obamacare is more popular today than it ever has been by every objective pull out there. The replacement bill is about as popular as kim jongun. Jenna now that youre both so optimistic, well talk about solutions. Theres a lot going on with the bill at the house passed. As of right now, our health care is not impacted by that bill as of yet. One thing that both sides seems to agree on is whatever comes out of the senate will look different then with the house passed. You both are nodding, i think thats a victory. Heres a question, let me go to josh first. What do you think health care will look like . We want to know what to expect. What will it look like . One of the reasons the merc and are rightly skeptical any time washington talks about health care is because just a couple years ago, when president obama promised everybody they would have lower premiums and better access and what happened during obamacare, they had worse access. Most counties only have one insurer available to them. Whenever a politician talks about health care, there are rightly a little skeptical about it. Im not surprised people are wanting to get a good look at it. Jenna lemay good to that. Youre the one that we say over and over again, we should trademark that thing. If that is the same accusation and weve seen the story play out, then whats the response to that about whether or not the average American Health care is going to get better . I think thats the goal of this whole effort and politics be darn, youve got a House Democrat in congress who is out there and saying that he is hopefully going to address some of the problems they couldnt. I would like to hope that the Senate Democrats would have a different point of view, but it doesnt appear they do. Jenna what about that . Just listening to that, its like, okay. Politics as usual. Or, democrats plug in and help here . If the priority is actually the American Public and not politics . First of all, parts of obamacare is working very, very well. It is a lot more people who are insured who werent insured before and parts of it are not going well and thats some people in some states on the individual exchanges. I believe its going to happen is the senate is not going to be able to pass a bill and they certainly are going to be able to pass a bill that the house didnt pass. That effort of repealing replaceable collapse. When that is done, then there will be efforts, bipartisan efforts. There are good ideas that republicans and democrats have to actually fix the exchanges to the ticketing under the hood that needs to be done to make this work. That will happen. Jenna do any new people to do that . Does everyone need to be voted out of office to actually achieve the goal your tiling about . I would rather be a democrat and a red state supporting obamacare then a republican and a purple state repealing it. Whats going to happen, you will see some ramifications in the midterms and then people come to their senses. How would you assess the chances of getting something out of the senate but would also satisfy everyone else . I think the chances are pretty good and one reason for that is the other system is collapsing. You cant look at this objectively or with any kind of intensity and realize that the Current System is just not serving patients well, its not serving Health Care Needs well and it has to be changed. On the individual market, insurers just dont want to be there. We have 115 counties in my state, 97 of them only have one company thats willing to write insurance on the individual market. Five states only have one company that will write insurance and some of the parts of some states have nobody. People who do have policies may have coverage, but they dont have access to health care because their premiums are so high and their deductibles are so high. Weve got to do something. I think were going to make an intense effort to get this done and the houses done what they need to do to advance the idea to advance the bill. On the senate gets a chance to look at it and see what we can do to improve on the house product and the two will come together and create a final piece of legislation to put on the president s desk. Jon though statistics are dire, but im wondering whether they have registered on the American Public at large. You look at whats happening to members of the house who have gone on recess and are billing some of these town halls, theyre getting screamed at from people who are unhappy with what the house has done on obamacare. How do you convince people that the system is broken . If you look at some of the reporting and listen to some of the reporting, they are just outrageous. Theyre refusing to look at the problem for what it is and they exaggerate what will happen of things begin to change. This needs to dramatically change. One of my colleagues mentioned last week that he might be part of a repealing replacement strategy because the old system isnt working. President clinton and the Campaign Last year, he was out campaigning for his wife and he said what kind of system is this . The premiums keep going up on the coverage keeps going down. You can deny that if you want to all the time, but it doesnt make it any less true. Part of our job is to explain to the people we work for wide is that the system has to be changed. Jon you may have just given us a headline. The concern seems to be and republican circles, are you going to be able to get 52 republicans if mike pence were to vote and break the tie . Im bored with whatever it is you come up with. You say some democrats might join you . Some of their testers said the strategy isnt working. Certainly we would be open to democrats joining us and also, we shouldnt just past the house bill because the house passed a bill. One of the problems with obamacare is Senate Democrats passed the bill, House Democrats decided that the only way that bill got on the president s desk as if they voted for the Senate Passed bill and all applause didnt have the advantage of this legislative process. I think senator mcconnell and hopefully the majority of the senate is going to Work Together to be sure that this process works. We know a lot more about health care than the country did eight years ago. Hopefully, the changes will reflect how much we know and how important the country now understands these decisions. Jon there are political observers who say they see an election coming up because of republican efforts to repeal and replace obamacare in that it is potentially going to cost republicans control of the house. Do you see that . I think doing the right thing here is the best thing to do. This is the spring of 2017, not the spring of 2018. Plenty of time to look at whats been done, explain what gets done, and also, i think youre going to see Insurance Companies drop out of the Insurance Market. In eastern tennessee, a pretty big city, knoxville and the 15 counties around it have no Insurance Company thats willing to offer insurance on the individual market. Frankly, one of the good things that happened was there was a real sense of when obamacare past that people would lose insurance at work because these exchanges would be so attractive, almost most people still recovered at work or by a Government Program like medicare and medicaid. We need to be sure that the rest of america has the same kind of access to health care that all of those people do. Jon we hope will come back and talk to us again about how its going. Officials say they have arrested a suspect in the murder of 22yearold lindsay cultural and her 26 rolled fiance, jason allen on a beach in Sonoma County back in 2004. Both were shot in the head while they were sleeping on the beach during a camping trip. Joining us now for our legal panel, bob bianchi and brian claypool. Generally, things were being here. Bob, 21st. This case, obviously more than ten years old. Nobody had any idea who the suspect was until the guy they arrested was also arrested in connection with the murder of his brother just a couple weeks ago. The authorities have been very tightlipped. We dont know what they have information wise, but they indicate he told them things about the murder of this young couple that nobody else would know. As a former homicide prosecutor, i dont understand why it would be that prior to him being charged, hes not even charged or arrested for this yet but they would take a statement. There are many reasons why people may have information about a crime, there are people who admit and confess to crimes they did not commit. The sheriff, i found to be very odd, he said he is a suspect, we have the information, hes the guy who did it, but were not arresting him, we are not charging him, were going to give it to the prosecutor and let the prosecutor make the call. I can tell you when i was the prosecutor making those calls, i would be extremely agitated that they got ahead of the decision here. This is going to be a rather week case and the quality of the confession he gave is so solid and so supported by other evidence that there is no alternative argument. A very odd way to proceed in the beginning of this identifying him as a potential suspect. Jon heres a look at the suspect, sean gallen. Brian, first of all, what do you think . Do you agree that the police and investigators are getting out in front of their skis here . Suspicion alone doesnt lead to an arrest or a conviction. This is a tragic killing and we all get that and we all want the right person convicted of a crime, but often times in cold cases, it leads to chaos. It leads to the wrong person being arrested. It leads sometimes to the wrong person being convicted. You cant arrest and convict somebody unless you have credible reliable evidence. Bob is right. A voluntary confession, what Law Enforcement has at this moment is not much. They dont have a weapon, they dont have any physical evidence linking him to the shooting. For example, no shell casings, no dna transfer, no blood transfer. All they have is there suspicion that they allegedly killed his brother and he committed another crime. Thats not going to be enough. Jon he was picked up and questioned in connection with the case originally. Also, the murder weapon is a marlin rifle. Perhaps there are ballistics evidence that we dont know about yet. To get to your points, they attractive tracked track down the physical evidence, the weapon, the hat that was recovered, carvings that were at the scene, a beer bottle for my 13 years, he was the person who had previously been arrested, his dna and his profile that could make matches so that evidence have been known for my 13 years and they still did not come up and show theres a connection between those items. What i find to be extraordinary, when i was a prosecutor, and i suspect its a moan of a murder, there would be charged and it would be jailed. Here, hes being jailed for the allegations of another murder. There was no reason why they had to get out ahead of their skis. They could go slow, deliberate, not make any public statements, give it to the prosecutor, have the prosecutor gather as to what they were going to do to move forward. Theres something about this thats really, really odd to me and i have to wonder if theyre not saying come out we got a solid on this so why not just throw that other one because we always thought he kind of did that. When its been a very troubling case and people have wondered what happened to jason allen and lindsay, a Young Christian couple, camped out on the beach. Apparently murdered while they slept.
