Lets get to the bottom of it. That is the president s entire point. You have a number, various incredible new sources showing that there was motivated activity during the campaign. In suggesting that there may be more there. The president s entire point is that the people deserve to know. So why not include in the age of 16 investigation into russia this aspect as to whether or not this actually happen . There was no such wiretapped activity mounted against the president elect at that time, the candidates or the campaign. Jon joining us now is bret baier, the anchor of special report, i guess what everybody is looking for is cooperation of what the president is suggesting happen. Do we have it . We do not. It is not definitive. We have what all of these officials have said officially. We have word that the fbi director is saying that there needs to be some pushback internally to the notion that president obama ordered the wiretaps. But what we do not have is definitive proof. We have a call for an investigation. The interesting is is that the president could answer the question very easily by calling up and asking his officials what exactly happened. Yes, we know that there were investigations ongoing. We know that there was some sort of investigation. Could it have been a narrow request to fisa . Maybe asking for a specific computer that they believe was tied to a russian bank . Could it have been . Yes, it could have been. But we have word that thats request happen or that investigation went forward . No. We do not. We have various reports. We have what officials are saying publicly. And we have something that the president could answer himself with a couple of phone calls. Jon there had to been a judge or the pfizer court approving the wiretap order, correct . By law that is exactly what happens. At the request goes to fisa courts. That is sold top secret. Nobody knows where it is in washington, d. C. But they would put the request in, and they would have to be substantial evidence to get to that point that a judge would then say, yes, go ahead and do it. We should point out by the time that you get the request for the Foreign Intelligence Surveillance Act court, most times i think it is only. 1 or something that get turned down, so you would wonder whether or not they went forward. We do not know the specifics of whether it happened or did not. And we are trying to get to the bottom of it. You know that you have various people saying that some investigation happens, and clearly over the past couple of months there have been many stories that have cited anonymous officials about the lengths to that investigation into the Trump Campaign. Jon we do know that there was surveillance of the Russian Ambassador that apparently snared Michael Flynn, the former National Security advisor, right . Yes, you can go back into the New York Times stories for months that have various elements of intercepts. That has to come from someplace. So we do not know the answer to that he had to. I am guessing that over time we will. That said, you have the white house moving forward. It is calling for an investigation. Now you have the executive order. If that is going to get a lot of attention. You have a rollout on capitol hill of obamacare. So there are big things here. This is besides the tweets that happen over the weekend. There are some democrats and republicans expressing concern about how the president got that message out. Jon again, you are saying that if the president really wants to get to the bottom of it, all he has to do is pick up the phone and call, what . The National Security agency, director of National Intelligence . Director of National Intelligence. I think that there is more into the story. We do not know where it goes. And we independently cannot confirm the request never happened. Jon hard not to get out in front of the actual facts here. If you were speaking to the trump team, what is your best advice about how to react to this sort of provocation . Well, a couple of thoughts. The first thing is that the state department has come out and denied the test. The white house themselves not doing so yet. I think it is important for allies in the region, not only south korea, but also japan to hear the president condemn these tests. Secondly, if a lot is going to depend on what type of missile it was. Assuming that these are packed missiles, i would look at accelerating the deployment of missiles in the region. Japan and the missiles were fired by japan, the japanese have thought about using the different system. This is an important response to the program. I will work with the japanese on speeding up that deployment timeline. Jenna Missile Defense is a big topic, not only overseas, but also here as well in the United States. I know it something that you look into quite a bit. We have some new information coming out of iran, there is a toggle between these two places. And this is just the news that we have breaking from the Pentagon Team that it has been overlooked that iran has actually launched to short range missiles over the weekend. And it looks like they are the type that have not been tested and at least two years. So if this is the case, and the Pentagon Team has confirmed day, what goes through your mind . You hear that north korea is firing missiles, but then iran probably pushing the envelope at the same time. Again, this is, i do not have any information about this iran launched, so all i can talk is in very general terms. Again, what i say is that if we are dealing with shortrange uranium missiles that cannot for example reach israel, then that is something that i would not be inclined to escalate the situation. If we are dealing with longerrange missiles that can reach u. S. Allies in the region including israel, then i would think thats a proportionate response is to have sanctions on iran related specifically to the style program. The Obama Administration did that. This is something that the Trump Administration has done so far. It is important not to let longerrange Iranian Missile tests go unchallenged. Sanctions on entities specifically related to those tests seems to be a reasonable and proportionate response. Jenna why do you think north korea and iran are choosing this time to make these tests . Well, i think they probably have quite different reasons. In the case of north korea, as i have already mentioned, there is a big annual south Korean Military exercise going on. North korea always responds to those tests with missile publications. Or at least they have for the last few years. In the case of iran, iran has been conducting test periodically while it has remain in full compliance with the nuclear deal. As i say, how significant these tests are in iran depends on the range of the missile. If these are short arranged missiles, and we do not have implication for israel or other allies, then while i would not downplay the situation, these tests would not be serious threats. Jenna i know you are just getting this information as our way, but i want to share a little bit from the pentagon. From iran, these are shortrange missiles. But apparently they have a new active seeker helping the missile locate ships at sea. This is an official speaking to lucas tomlinson. Im reading through just some of the editorial that we have. They were test firing in barges. And because the waterways around iran are so crucial, and because the shapes are in the region. Does that change the way that you would feel about a short missile test . Again, it depends on the nature of the uranian technology. Iran is not the first country to try and have the ability to attack u. S. Ships at sea. U. S. Ships at sea are armed with short Missile Defenses such as the standard missile set. And we live hopefully in the land of the law. Were any laws broken . And who broke them . If it was not President Trump, if it is somebody on his team, so far we did not see that spread and not even in the case of the National Security adviso advisor, exNational Security advisor, Michael Flynn. So it is how much is it politicized . How much is something really going on . It is not up to me to answer these questions. Edges up to the intelligence community, that counterintelligence divisions of the fbi, et cetera. And to the extent that there is a investigation to the congress. Jon so Vladimir Putin says that they should not be blamed for involvement in a affairs in the u. S. , what are they saying . They are looking at the swirl of accusations. They are looking at politicization. They would like as far as i could tell by visiting russia and talking to the people there, they would like to get to business. They would like to turn the page on the very sour relationship that exists during the Obama Administration era and start doing something more positive that would be in their interest. The russians are all about their interests. For example, lifting distinctions that are economically hurting them. They would love to do that. Well, i think the level of hostility is no question higher than we have seen with any president ever before. And as matt alludes to, it is understandable that trump is upset, because he has tuesday night, his best moment as president. The only thing that came close was the neil gorsuch nomination, and immediately swallowed up by more contention over russia. There is kind of this love hate going on, because he loves the coverage, he is very good at manipulating the media. So he throws the used tweets out saturday that he knows are going to drive the coverage a way that he thinks is more favorable to him. At the media gets in a tizzy about it. They are upset about it for some understandable reasons. These are allegations that appear to be unfounded, they are searching for the evidence to back them up now. But the media loves it. It drives ratings, conversation, the sunday show debate. So both sides in the war are engaged in the love hate dynamic. So if they are truly fake, they are having some real results. I think that there is some truth to the stories. They can complain about the aggressiveness of it, but i do not think, aint you know, he is the president of the United States. You should expect some degree of scrutiny. Jon we are getting some movement in washington where Rex Tillerson is about to announce the new executive order on immigration. Lets listen in. Protecting the nation from terrorist entry into the United States. Of i dont measure for strengthening security. It is the president s solemn duty to protect the American People. And with this order, President Trump is exercising his rightful authority to keep our people safe. His threats to our security continue to evolve and change. Common sense dictates that we continually reevaluate and reassess the systems we rely upon to protect our country. While no system can be made completely infallible, the American People can have high confidence that we are identifying ways to improve the vetting confidence process and keep terrorists from our country. To our allies and partners around the world, please understand that this is part of our ongoing efforts to get rid of vulnerabilities of that radical islamists will employ at destructive ends. The state department will coordinate with other federal agencies and implement these temporary restrictions in an orderly manner. Our embassies and consulates around the world will play an Important Role in making sure that the nation as secure as it can be. And to the state department will implement the provisions in this order that allow for the admissions and refugees when it is determined that they do not pose a risk to the security or welfare of the United States. We also know that many people seeking to support or commit terrorist attacks will try to enter through our refugee program. In fact, today over 300 people according to the fbi, who came here as refugees are under and in fbi investigation today for terrorism activity. Like every nation, the United States has a right to control who enters our country. And to keep out those who would do us harm. This executive order takes to protect the American People as well as lawful immigrants by putting in place and in enhancing the screening and vetting process for visitors from six countries. Three of these nations are state sponsors of terrorism. The other three have served as a safe haven for terrorist countries, countries where governments have lost control of their territory to terrorist groups like al qaeda, and its affiliates. This increases the risk that people are admitted here on these countries, may belong to terrorist groups or may have been radicalized by them. We cannot compromise our Nation Security by allowing visitors entry when their own governments are unable or unwilling to provide the information we need to vet them responsibly. Or when those governments actively support terrorism. This executive o responsibly provides a native pause. This is so that we can carefully review how we scrutinize people coming here from these countries of concern. Second, the department of justice believes that this executive order, just as the First Executive order is a lawful and proper exercise of president ial authority. This department of justice will defend and enforce lawful orders of the president consistent with the Core Principles of our constitution. The executive is empowered, under the constitution, and by congress to make National Security judgments and to enforce our immigration policies in order to safeguard the American People. Terrorism is clearly a danger for america and our people. The president gets briefings on these dangers in emerging threats on a regular basis. The federal investigative agency, the intelligence community, the department of state, the department of Homeland Security, and the United States military report to the president. They know that the president would best possess some information, the founders gave the executive branch the authority and the duty to protect the nation. Those attacks caught taught us that we cannot keep the security for granted. Homeland security must be our top priority. We needed to overcome our collective inability to take it, connect the dots of intelligence and arrange them into a more comprehensive picture of the threats posed to america and our way of life. Much has changed over the past 14 years, both in the world that is more dangerous and at dhs, much better. The fact remains that we are not immune to terrorist threats, and our enemies use our freedoms and generously generosity again test. The things signed will make our country more secure. And to protect the immigration system. We must undertake a rigorous review and are undertaking a rigorous review of the vetting programs to increase our confidence in the decisions that we make relative to visitors and immigrants that are in the United States. We cannot take the level using our immigration system to take american lives. This executive order is prospective in nature. Its focus is on rejecting the entry of foreign nationals into the six designated countries. Accordingly, it is important to note that nothing in the existing order exists lawful residence to enter our homeland. Unregulated travel is not a privilege, especially when National Security is at stake. The white house worked closely with the department of Homeland Security, department of justice, department of state to create an order that addresses previous concern, and protects the homeland and every one of our citizens. The men and women of the department of Homeland Security, like their brothers and sisters, look at the Law Enforcement, or descent men and women of character and conscience. They are no less so than the governors of our states and territories. Of our senators and members of congress of our city mayors and advocacy groups, these men and women are sworn to enforce the laws as passed by the United States congress. They would be in violation of the law in their sworn oath if they did not do so. We do not make the law, but we are sworn to enforce it. We have no other option. We are going to work closely to implement and enforce as humanely, respectfully, and with professionalism, but we will enforce the law. I want to think the president for his leadership on this issue and for steadfast support for our Law Enforcement security and counterterrorism mission. Again, as previously mentioned that i have spent most of the day today on the phone with members of congress, leadership explaining the ins and outs of this order. Well, i was struck by a couple of things but having this announced by three cabinet secretary cabinet secretaries reinforces the message that they have their ducks in a row this time. This has been carefully coordinated among all agencies of government. Two, they are exempting the rack, the inclusion of a wreck in the first order did not seem to make a lot of sense given that we are waging a war with iraq against isis. Attorney general sessions made sure that he said that they are investigating 300 refugees for suspicion of terrorist activities which goes to the weak defense that the department of justice mounted and nationally. The First Executive order where the lawyers did not even seem to know what the answer was when judges asked, well, what is the threat that we are addressing . They are still going to have a problem with the courts, and activist courts, but this is much more buttoned up. It should be much more defensible. Spoon into that point, the attorney general gave a pretty good vocal defense of the actions that are being taken here. Saying that the department of justice believes that it is in the president s authority to protect the nation. That is the source of these orders. Yes, and i agree with rich. I think that the rollout of this is far different from the rollout of the initial executive order. You also, as i understand you have a ten day period before a lot of this is implemented. You have time. You heard secretary tillotson implements that they are talking to the public. Members of congress. The media. There is a much different emphasis on how this is rolled out. It is still to be seen, there are surely going to be challenges to this. Whether these changes button up the legal aspect of it. Im not a legal expert, but it seems like they are meant to address some of the shortcomings of the initial executive order. Jon they also took pains to say that they have briefed members of congress. That was something that did not get on the first time around. Yes, they just want everybody to know and to know what the new rules are so that they can be implemented as smoothly as possible. The courts should not be making decisions on the basis of whether a rollout is chaotic or smooth, but unfortunately it does affect the perception of judges command the administration did not help its case with the chaotic first weekend. Now, i thought that the first order was entirely legal and constitutional. It was absurd that the ninth circuit threw it out. But this should, at least at the margins help the administrations case going forward. And it was important to get out of that ninth circuit legal box canyon they are in, and try to reset this and find a going different footing. Jon i guess i am asking you to look in your crystal ball a little bit here, but the administration did not get treated well in the media as a result of that first rollout. There were a lot of editorials and so forth against a. How do you think this one is going to be received . I think it will be a little bit different, they have made pains to respond. The initial one coming also had those images. That was days after of the airports and the protests there. I think that you will not have that the same way this time. I think that the rollout is different here. I think that that changes the Public Perception of some of the things that they are doing, even if it has had some of the same name. Also watch for how they talk about this in the aftermath of that initial one, they were talking about the muslim band. They have taken time to look at that sphere. It is not religious specific that the courts use. I think watch that over the next hours and days too. Jon thank you.
