Jon a fox news alert for you. Sean spicer is talking about sanctuary cities. The president has threatened to pull federal funding from cities that shield undocumented immigrants. It the Senate Passing a bill to deny state funding to sanctuary cities and counties. Several other states are introducing similar measures and one ohio town is reversing its policy as a former sanctuary city. Other areas are moving towards becoming sanctuaries, such as california, with a bill that would make it a sanctuary state. Lets bring in our legal panel to discuss the applications of all of this. Brian claypool is with us. Brian, first of all, a century city, just because give us a Legal Definition of what it generally means. A sanctuary city, basically, and my opinion is violating federal law appeared at their basically harboring undocumented, Illegal Immigrants in the United States. Theyre shielding them, and my opinion, from any legal implications and from deportation. That creates a threshold issue and a problem, which is, what should President Trump do with cities you just mentioned . Los angeles is considering this. What should we do when cities are basically snubbing federal law . I think trump is on the right track. You cant continue to fund cities that are harboring undocumented, illegal immigrant immigrants. That raises another issue, john, which im sure you will talk about. What do you do with all these immigrants that are undocumented once you corral them and . Should we deport some, shall he not . In my opinion, we need to focus on those undocumented immigrants who commit crimes. They need to be adjudicated before an Immigration Court and if so, then deported. Jon defense attorney and former prosecutor is running the conversation now. I want you to listen to it sean spicer had to say about this topic just yesterday. The president is going to do everything he can within the scope of the executive order to make sure that cities who dont comply with it, counties and other institutions, that remain sanctuary cities dont get federal government funding and compliance with the executive order. Jon there are a couple who have reneged on their century city status, Miamidade County is one, also dayton, ohio, said we will no longer be a century city. The big stick that the white house seems to be wielding appears to be effective here. Donald trump end of this and administration is all strongarmed at century cities because they dont have the law on their side. It makes it very, very difficult that says states and localities do not have to cooperate with retainers. That is from immigration. The federal government cant make states and localities pay for a federal issue. Emigration is a federal issue. What i have an issue with is the process. There have been citizens, u. S. Citizens in jail who cant bond out. Because there is a hunch they may be undocumented. At that is violating their constitutional right. I have an issue with that. If the federal government wants to detain somebody based on the immigration status, they need to get a warrant, have a judge, a hearing, a judge find probable cause to hold them, and then house them in a federal detention center. Not these local jails where the taxpayers are having to foot the bill. If thats what i have an issue with. Jon a lot of people, brian, are wondering how did we reach a stage where local Law Enforcement and in some cases, state Law Enforcement, refuses to cooperate with federal Law Enforcement . I think a big problem is during the president Obama Administration. To address this point. There are right now, john, at least 4050 judicial openings in the Immigration Court system. In other words, president obama did not appoint judges. Theyre not even being taken care of. The system is in shambles. Because none of these undocumented or Illegal Immigrants who committed crimes are being adjudicated in the immigration system, there sitting like a quagmire, that gives us localities an excuse because they havent been subjected to adjudications and the imitation process. I think trump, the first thing he has to do is burn the hand. Hes got a lot of immigrants who have committed crimes who should be deported. It those who who have not, should not be deported. The first thing he has to do is appoint some judges so we can get these adjudications taken care of. A jon with that perhaps stem the kind of problem youre talking about . No. It local agencies dont want to house on just detainers because it opens them to liabilities. When youre holding somebody based on a detainer, not probable cause that they are undocumented, that goes to lawsuits and thats where i think our hands are clean because we made requests, theyre not mandatory. We spent about 1 million a month housing people based on detainers and ice is a man coming to get them. That is a taxpayers bill. I have a huge issue with this. I dont think the solution is to cut funding, because then youre punishing the actual citizens. Jon a lot of negotiations still to be done. Thank you both.
