In part of the Corporate Tax proposal that would exempt exports, but mr. Trump because it too complicated. It comes as to more of his cabinet picks go before Senate Committee before their confirmation hearings, interior secretary, ryan zinke going before the energy and Natural Resources committee and secretary of education pick betsy devos, facing the Senate Health education and labor committee. Our chief correspondent john roberts is live with more for us now. Good afternoon to you, congressman ryan zinkes confirmation starts at 2 00, betsy devos will be an evening affair starting at 5 00 today. For ryan zinke, they are focusing on disciplinary action taken against him while he was in the military for filing, mr. Presenting at least a travel expense that he filed back when he was a navy seal, sean spicer the incoming press secretary said of that people are shamelessly trying to impugn his character. We are expecting as to as he ds his confirmation hearing today is going to be a contentious one, democrats are saying she has not completed the requisite questionnaires for the office of government ethics, sean spicer knocked that down today to say she filed it more than a month ago and she has been answering questions with the office of government ethics ever since. Other confirmations coming up, and they want to get done before the president takes power. Rex tillerson for secretary of state, Committee Vote could happen as soon as tomorrow, could be delayed until thursday. We are still awaiting the announcement of sonny purdue as the agriculture secretary, we understand he is the person that donald trump has settled on. They have not announced it yet, but they only have a couple days to do that. Donald trump me time kept up the war of words with john lewis over his assertion that this is going to be the first inauguration that he has missed. It is actually not true because he missed george bush in 2001, donald trump tweeting out john lewis said about my inauguration, it will be the first one that ive missed. Wrong or lie. He boycotted bush 43 also because he thought it would be hypocritical to attend bushs swearingin. He doesnt believe bush is the true elected president. Sound familiar. Lewis Office Issued this statement this afternoon just a short time ago. Representative lewis also missed one other inauguration, the first of george w. Does that office shut down shop on thursday in move to the white house, what happens next . Friday at 12 noon, the president will be sworn in on the 20th of january which is when the transition process is over and when the process of governing begins, all of the what are called beachhead teams put together by the trump transition will head to all of the departments to start running things until all of the confirmands are in place. They are expected to get the National Security team in place, and that would include the secretary of state, secretary of defense james mattis, National Security advisor, department of homeland security, once they get those people in place, they believe they can handle a crisis should one occur in the first hours of the Trump Administration. That always is the most important thing when it comes to the peaceful transition of power. Jenna such a key thing to remember, thank you very much. News editor for the wall street journal. This president has not been fond of News Conferences during his eight years, but i guess the media gets a last crack at him tomorrow. It is the tradition, little bit of a farewell address, and today taking a moment to say thank you to josh earnest for all of his work. This is late in the season for president obama, you can see as he stretches out all of his lastminute efforts to shore up his legacy. Jon i was surprised, maybe those in the press room were as well, when he showed up at the podium. It is supposed to be a thing about josh earnest, but here comes the president who steals the thunder. I suppose josh earnest is not unhappy about that. It is good. Depressed team likes to see the president and the press briefing. He got a good farewell, josh earnest, so it was a good moment for him as well. Jon as he is winding down his final days in office, he has been busy, commuting sentences, changing u. S. Policy, doing all kinds of things. He said he was going to go all the way to the tape, working until the last day, so we saw that with a bunch of new monuments which means the total amount of land he has a setaside is about 500 million acres. Also the cuba policy announcement just yesterday in terms of more Law Enforcement cooperation. We see the commutations, as you noted, they are going to be a bunch more. He has committed about 1200 sentences, and really has pushed that in terms of trying to reset the policy in terms of drug sentencing, especially for nonviolent offenders. Jon there were some 16,000 people who had their sentences reviewed by Justice Department lawyers. What do you make of the fact that this president is pretty eager, as you put it, to take the nonviolent offenders who were sentenced under the drug laws of the 80s aunt 90s to let them out of prison early . There has been a shift in the countries thinking that obama is perfecting, tough sentencing of the 80s in 90s, easing back, but the guidelines have not changed at the federal level, so he is taking executive action to set tone for this through commutation. Hes done a lot more commuting of sentences than any other president in recent memory, 1200 in total, more to come, clinton maybe had 60, george w. Bush was about 11 commutations, so this is a big move on his part. Jon how much of what he is doing in these closing days can donald trump reinstate if he chooses to do so . That is a good question, they fell into a bunch of categories. Some things executive action can do or undo, so the deportation policy is something the president can set. Other things that are rulemaking environmental rules, that kind of thing come have to go through the public hearing process. There is a rule making process that has to be followed, so not just the stroke of a pen, commutation in things like that are a done deal. Jon in the meantime, were getting a new count on the number of democrats who have decided not to attend the inauguration. There are going to be 53 democrats, Democrat Members of congress, who are boycotting the trumpet inauguration. Does it surprise you the number has grown to that number . It sounds like a lot and i have heard from the republican side of things, this is supposed to be a bipartisan moment where we have the sharing of power peacefully, this does not set a good president the next time a democrat goes into the white house. There is a lot of question about whether this is the right way to express how they feel about the incoming president. Jon 53, i suppose the number could go higher. Glenn hall, thank you. Betsy devos represents a change. She is experienced in the field. She has worked with children all over the country in michigan, indiana, arizona. She understands what the problems in education are, and she will go right at what i call it 30 years ago, the blob, the mess of interests that clog up the American Education system and keep us 25th or 30th in the world. The jenna that former secretary education coming out in support of Donald Trumps pick to fill the same spot, betsy devos. She faces a grilling in her confirmation hearing this evening, one of two that will happen today. Many democrats and teachers unions are opposed to one of the largest, the American Federation of teachers issuing this statement saying and nominating devos, trump makes it loud and clear his education policy will prioritize privatizing funding and destroying Public Education because quote. The president of that union, Randi Weingarten points us now. I will ask the same question, why do you think this is the wrong choice for American Children . I just heard secretary bennett. At the end of the day, we just fundamentally shifted educational policy. Lamar alexander, standing next to president obama, standing next to speaker ryan, basically shifted it a year ago in a seismic shift, and right now, what we need to do is help every single parent have a viable public neighborhood school. That is what the new federal law says. What betsy devos did in michigan is the opposite of that. What she did, she spent three years defunding Public Schools, railing against them, fighting against having an investment in them and fighting for having private, forprofit charters. And the record is abysmal. Two things. Number one, the forprofit charters in michigan, 80 of the charters in michigan are forprofit. They do terribly. 75 of the Public Schools do better than the forprofit charters. Number two, it has hugely lowered michigans standing education early in the country. So in 2003 before all of this started, michigan was about 21 or 22, 23. Now they are 41 and 32 and reading and math. Jenna there is a lot to unpack there. Let me take some questions for my viewers. Thank you for letting me. Jenna no problem, we are trying to focus before the hearing to understand the questions she might be asked. If the Charter Schools she is advocating for so bad, why are parents lining up in order to get their kids into those Charter Schools and not opting for Public Education . They are not lining up in michigan for them. Frankly, what has happened is in michigan, if you talk to parents in detroit, there are parents in washington, d. C. , today to say dont do this. Michigan has some of the worst Charter Schools in america, but the reason parents want a school is they want it to focus on kids, and they want instruction, they want it to be safe. I run a Charter School in merrick city that has 100 graduation rate. Parents flocked to that school because they say, i want that for my kid. What we have to do is we have to make sure all schools, all schools with public dollars are viable choices for parents. Jenna what is it about betsy devos you think will prevent that from happening and prevent Parent Choice . There are those who say that the unions are against Parent Choice, betsy devos is for it. As i just said, i run i am the president , and i run a blue robin public Charter School in new new york city, so this is namecalling because they are trying to obfuscate the record. Betsy devos is not free choice, she is for privatization. Jenna let me ask about privatization because bill bennett points at some statistics. When you look at our nations education compared to other developed countries, we are 19 out of 35 in science, 20 out of 35 in reading, 31 out of 35 in mathematics. So what is it about the status quo that should be disrupted in some way to get someone that has a complete different idea for School Reform in there to improve statistics . Three things. Number one, we have had what betsy devos has been selling for 25 years. If bill bennett was honest, he would show and say that those experiments in milwaukee, in cleveland, in indiana have failed miserably. That is number one. Number two, the difference between what those stats are, we in america require every child to go to school, and a lot of these countries do not do that. Jenna you are saying that statistics are skewed, our schools are better . They are much better than what the statistics say. Do we need to do more . Absolutely. But america is the only country on earth that promises both opportunity and attainment. The only place to do that is in Public Schools. As a mean that Public Schools should not be better, of course they should be better. What we said on monday, i did a speech last monday and said to betsy devos, of course she did not respond except for her folks. Jenna she is a little busy. [laughs] what i am saying is they certainly responded by demagogue in today and adds. Jenna let me talk a little bit about the politics. There are those that are saying, and bill benefit talked a little bit, he is on one side of the aisle. He is saying there are too many politics involved in education in general, and we have to be focused on finding solutions for our children. I agree. That is what we did last year. Jenna we expect betsy devos to be confirmed. We expect the hearings to be tough, and we expect that nominees to be confirmed. Where do you see potential Common Ground with her to improve education . What would that look like for you, where is the possibility for that . That is what i am saying. Last monday, we talked about what you can do to improve Public Schools. We invited her jenna what is on the top . Focus on childrens wellbeing. 50 of our kids are poor and Public Schools. Number two, and empower learni, not what george bush and bill bennett focused on which is testing, you focus on instruction pair number three, do not throw it to the teachers and tell them to go do it, build the capacity like in the army, private sector employees, number four, the places that really work well are places where parents and teachers are working together, teachers and principals are working together. I said to betsy devos, come see the Public Schools at work because at the end of the day in michigan, she never worked in Public Schools. She defunded it, undermined it, made sure it was not a viable choice in places like detroit. Jenna you are saying the public Charter Schools as well as the private Charter Schools are cannibalizing resources that should be going to Public Schools . It is not what has happen is they have made into a zerosum game where they have taken money from Public Schools as opposed to actually finding the investment to lift all folks. The film starts eight years ago with the change candidate, change president who says he will unify their country pretty does not realize how polarized the country is automatically, sort of naive and over the eight years, he run against sarah palin who lit a match and got a bug fire burning under america. All of a sudden, he is faced with things he had not anticipated, polarized country, people who do not like him, people who do not like what he stands for, and a vociferous opposition which is what you expect. The opposition begins to eat itself, to the tea party and republican establishment and yields another change candidate, believe it or not, who is coming to washington in a couple days who really has a different agenda and completely understands polarization. Jenna one of the things that the clip we showed on focus on is healthcare, and the waves the documentary seems to approach it is healthcare is beyond politics, it is the Mountain Range where both sides are on either side, rising up, here comes healthcare, it either side cannot seem to get together. Let me ask the flip of that, do you think if healthcare is destroyed, the Mountain Range is brought down, do you think that leads to the sides talking to each other . It depends on who destroys it. It depends on what the people who felt, i think from everyone we have talked to, the bad idea obama had was pushing it through with no republican votes, not a single republican vote on that or the stimulus bill which preceded it. The thing that has happened is it has become a kind of watchword for a certain approach by government, shoving it down peoples throats, i think trump picked up on that early and rode with it a long way. If he tries to close it down, what does he offer as an alternative . How will it go down . Its being argued right now about as it was argued back in the beginning. It will be very, very interesting and we will know pretty soon whether, if it does come down, is the path smooth . I dont think so partly because of the way he got to the big office. Jenna reporting for this documentary, you are looking at how this story comes together, i am watching some of the reflections of the past eight years. Interesting how journalists tell the story. Depends on which side you are on. Theres that say president obama never reached out about republicans which is why it happened with healthcare, others say it is the republicans who are obstructionist, and there are two different pictures of history, what conclusion did you come to . We told both sides of the story. Interesting, obama people said he is not a back slap her, not lbj, not the way he is, so he is someone who thinks we can rationally sit around and talk about it. That was the obama style. That was not going to happen in a superheated political environment Like Washington has become even since the bush administration. On the other side of it where the republicans who got together that night while obama is dancing with michelle to beyonce at last, they are meeting at a steakhouse on capitol hill and deciding how are we going to approach this . Newt gingrich tells us they all came in as low as they could be, thinking this is another generation before republicans will be in charge. They left, saying that we can fight this guy, who is he really . A naive young president. We can take him on. So we tell that story, i think, from both sides of that night and many other nights along the way. It is true that if you look at it really closely, the 20 or so events that happen over the eight years as you can see tonight and tomorrow night, really in context, you get a sense of what the war was about. It is hard to say they wear the bad guys, this was the good guy, which one. Jenna went ashore more want to show more of the documentary, more clips to come in a minute. How stupid are these politicians to allow this to happen . Trump promised he could do what the republication establishment failed to do. He is an outsider that can say dont blame you for that mess, im the one that can go and fix it. We will make America Great again, thank you, thank you very much. [cheering and applauding] thank you very much. You cannot be laconic to an electorate that is mad as hell. For tens of millions of americans, the willingness to fight Political Correctness and not back down told them that he was the only candidate who would really blow things up in washington. Jenna that is interesting, the only candidate as if there were never any others. We know there were many. What did you learn . He knocked down 16 others, 16 others that a lot of people in the republican establishment said where the greatest generation of candidates they ever had. Donald trump, this salesman, entrepreneur, novice politician, knocked them all down. How did he do it . He broke every rule of politics from the first speech on. When he talked about mexicans, rapists, from the very first speeches, he broke of the rules, and that, i promise you, is what the people who elected him want him to do. Jenna personal question, what did you learn about the country from your work here . There has always been a lot of anger about one side or another. Its a very wonderful country and it argues about its politics, i like that very much. I would not like to be president , it would be a helluva ride, but ive learned that they really are angry and betrayed and feel betrayed by their government, an awful lot of them. Even people on the Bernie Sanders side feel betrayed by what the president did in terms of the economy and saving the banks. I think there is a lot of reckoning to be done out there in the country. I think they expect to see whether donald trump can deliver some of that for them, and they Republican Congress and Republican People who go to work for him. We will see. Jenna a point of reckoning. A judge ordering Esteban Santiago held without bond, prosecutors say the 26yearold killed five people and wounded six others in the baggage claim area of that airport earlier this month. The fbi now has new information about the gun used in the shooting. Joining us now, mercedes coleman, criminal defense attorney and fox news legal analyst. Keisha heaven is also with us, former prosecutor and criminal defense attorney. I heard before the hearing this morning that he was going to be asking to be let out on bail, i said please, tell me that is not true. The judge wisely decided to keep him locked up. Im not surprised by the judges decision because number one, due to the seriousness of the crime he committed and number to come hes considered a flight risk because he is facing the Death Penalty or life in prison. It is very rare a drudge would grant bonds for someone in his situation. Jon this was a federal detention hearing as i understand it, not his arraignment, that does not come until next week sometime, can his lawyers argue that he is being held without proper notification, proper charges being filed . The federal laws are a little different so there could be that delayed by his defense attorney will probably argue there is no arraignment, we dont really know what the full charges are. He is entitled to those charges, not a flight risk, obviously the judge did not buy that. He has money in the bank, he has a job, things that they would argue typically but not rare that it would happen in a federal case. Jon so much of the case, you have the video that seems to show him just walk along, pull a gun out of his belt and fire at people. Isnt this almost an open and shut case . I think it is. I think if i was his attorney, i would advise him to take a plea, enter a guilty plea because that would decrease the chances of having the Death Penalty. The evidence is extreme the overwhelming. He has even given confessions to the fbi. Jon he has also apparently said that he thinks he might be bipolar or there might be schizophrenia. I was just going to say how come the Defense Attorneys are not just stomping on this, he is not well, who else could possibly have done this except for someone who is mentally ill . Then start again so they can get a different plea, he can get evaluated and stop this process of going to trial. Jon could Mental Illness and potentially save his life . It could save his life absolutely. He could even be exonerated due to Mental Illness than be put in a criminal facility for the criminal insane. Jon and other big story we are following, just broke yesterday, federal prosecutors now say the wife of the orlando nightclub shooter omar mateen misled police. A federal indictment also charges noor salman with aiding and abetting her husbands support of crisis. Omar mateen, you will recall, died in a shootout with police after killing 49 people at full nightclub in orlando. Police arrested his wife yesterday and Northern California where she had moved after the shooting. Her hearing continues tomorrow. Again, we dont know a great deal about what led the federal authorities to arrest her, but we do know that the police chief in orlando said, good thing, im glad they picked this woman up. They must have something. We all know with the feds, they do not sweep down and arrest someone until they know they have enough evidence. They do not like to lose trials. In this case, there is obviously enough evidence to give them probable cause to arrest her, and i was just waiting to hear it i knew it was a matter of time before she would be arrested based on a little bit that we knew. Really . She drove him to the nightclub, all the things that happen prior to him committing this act. He put her name as a beneficiary in the Life Insurance policy, deeded a home to his family for like 10, so these are all signs she knew what was going on. Jon she is charged with obstruction of justice as well as aiding and abetting. That would suggest she had an active role in carrying out this crime. Absolutely. As she said, there is so much evidence. These are the federal authorities, they have been taking this time, huge budget, a lot of investigators on this, taking their time amassing the evidence against this individual. Frankly at some point, they are going to say this is the evidence that we have against you, will you plea and more portly, cooperate with us because your husband was not acting alone. We want to know who else is aiding and abetting. This is the kind of play they will do. We have represented a lot of defendants that dealt with federal authorities. They do a lot of this gamesmanship to get as much information as possible. Jon we will keep an eye on the case as it progresses. Mercedes colwin, kisha hebbon, thank you. This stunning footage has some people amazed, others a little bit frightened, others have questions about this giant alligator at a florida nature preserve. We wanted to talk a little bit more about this guy come he deserves it, right . Assuming it is a guy, we will find out from james. He is a researcher at the university of florida who focuses on alligators. I am calling him the gator guy, we are proud to have you here. When you see video of this giant alligator, what goes through your mind . Not the largest alligator ive ever seen. Jenna come on. They there have been some 1t mail alligators, probably 30 or 40 years old, but they get a lot bigger than that. Alligators have indeterminate growth so as long as they are alive, they keep on growing and getting bigger. Jenna how dangerous is the alligator . Part of the marvel is that you see all the people on the side taking photos of him. Those people are not in any real danger. They are far enough away. You can see the alligator is heading in one direction. They have a onetrack mind to try to get there, maybe a foraging ground or basking site, and really as long as nothing gets in its way or tries to mess with it, it is not going to stop, its just going to keep going and not be bothered. Jon i have seen big gators before, maybe 15 or 16 feet, but this one looks particularly robust, shall we say. Like he has been dining on, i dont know, cattle or something. Is this a particularly beefy gator . Very healthy large mail. You can see by the size of his generals, has a lot of musculature in there. When they get up and stand up on all four, they have to arch their back to keep their belly off the ground, so it is made to give it a look that is bigger than it is. It is a really normal normalsd gator that you will see. Jon i was a wildlife junkie as a kid and read all kinds of stuff. I remember reading once that alligators can outrun a horse over short distances. This this guy does not seem to e capable of outrunning a horse. [laughs] he might for about 10 yards. Jon very short distance. Very short distances. They are very explosive, and they can be very fast over very short distances. Being a reptile, they cannot really breathe the same as a mammal, so they slow down long term. Jenna he is a little rough on the gator come he called him fat, slow, what does this sort of alligator eat, and give us a quick date and the life of this guy. Obviously there are plenty of times he is not caught on camera. Most do not have cameras on alligators except National Geographic to see what they do throughout the day per most of the time, they are just sitting there. They might be underwater looking to conserve energy, and they sit mainly and wait for something to walk by. Jon there is a photograph i might have found somewhere in my archive some of the people filming that alligator are being criticized. What would you say about a father who places his son, you know, not too far away from a sizable gator to take this photo . Is this irresponsible parenting . I cannot see the photo.
