Credibility. Plus, death rains from the sky when a cargo jet crashes into a village. Also, people escaped this arena moments before a roof collapsed. It is all happening now. Jenna we begin with the countdown to americas peaceful transfer of power as the oath of office space seem to be administered, relations between the new administration and democrats is anything but peaceful, welcome to the second hour of happening now. I am jenna lee. Jon i am jon scott. Amid a growing war of words, some Congressional Democrats are boycotting the inauguration ceremony that welcomes the new president to the capital and the white house. With preparations in. Swing, president elect trump is sticking to his favorite mode of medication, leeching twitter attacks on his critics. With live coverage, ed henry is tracking the democrats who are staying away from fridays event, but we begin with chief White House Correspondent john roberts on donald trump preparing to take the reins of power. Good afternoon to you. Seems to have the reins in one hand and a big stick in the other one because a war of words has erupted between the president elect and the current cia director after john brennan said on Fox News Sunday with Chris Wallace yesterday that donald trump does not fully understand the threat posed by russia as well as other National Security issues, strongly suggesting that donald trump needs to change his approach if he really wants to provide for the security of the nation. What i think mr. Trump has to understand is this is more than being about him. It is about the United States and National Security. He has to make sure that now that he is going to have the opportunity to do something for National Security as opposed to talking and tweeting. No sooner had he said that then donald trump did take to twitter and say outgoing cia chief, john brennan, blasts preselect trump on russia threat. Does not fully understand. Oh really, couldnt do much worse just look at syria red line , crimea, ukraine and the buildup of russian nukes. Not good was this the leaker of fake news . Donald trump suggesting maybe it was the cia director who leaked that dossier that ran into so much trouble last week. On that front, donald trump got some backup from his incoming press Secretary Sean Spicer this morning. Listen to this. He is someone who is supposed to be a trusted confidential advisor making silly comments like this, it really makes you question what else they have said or done. On this Martin Luther king day Martin Luther king day, donald trump will be meeting in just a few minutes with Mark Luther King the third, that is reverend dr. Martin luther kings oldest son. This meeting takes place after another war of words, this time with civil rights icon john lewis, donald trump running into a buzz saw of controversy after tweeting out that john lewis was all talk and no action, this after john lewis suggested over the weekend that donald trump was not a legitimate president. His comments also sparking some other reaction, first of all for you, what lewis said and the reaction from the Vice President elect mike pence and dr. Martin luther kings niece, listen. I dont see the president elect as a legitimate president. I think the russians participated in helping this man get elected. I was just so disappointed that he would make the statement that he made, suggesting that president elect trump is not a legitimate president. I urge him to reconsider that statement. I believe congressman lewis can actually help america by working with the president. There you have it from alveda king, if he can work with the president instead of challenging his legitimacy, there is a chance that we may hear from the president elect and the next few minutes. Some suggestions may come down to the microphones after his meeting with Martin Luther king the third, we will soon find out. Jon you will keep us posted, thank you. Never give up. Never give in. Stand up. Speak up. When you see something that is not right and not fair, not just come you have a moral obligation to do something and not be quiet. Jenna john roberts gave us some background, that is congressman john lewis responding today just a few hours ago to the backlash from his boycott of the inauguration of donald trump at a Martin Luther king breakfast. Henry is live on letting us know what is making this inauguration particularly unprecedented. You are right. People do not seem to understand how rare this call by lawmakers to boycott the inaugural really is. In 2013, for example, we checked the facts, only four republicans, four of them skipped president obamas second inaugural and three of them said they had other engagements to attend while one, senator mark was recuperating from a stroke. He had a really good excuse, obviously peered look at this list in comparison, democrats skipping, about two dozen of them so far and counting. That is far different than the situation that has come before. John lewis, by the way, is one of the few members of congress who previously did skip an inaugural because he did not like or agree with the president. He did not attend george w. Bushs inaugural in 2001. Rather than criticize his reason, we are seeing prominent democrats like First Lady Michelle Obama embracing this bid mrs. Obama who will be in the limo with the incoming President Donald Trump and melania ciampa tweeted this out thinking of dr. King and great leaders like representative john lewis who carry on his legacy. May their example be our call to action. You heard in johns report, the Vice President elect mike pence saying that this, of all days, a day when people honor dr. King, people should be coming together instead of more division but particularly in the tweet from mrs. Obama, the idea this should be an call to action is going to make people wonder what that outgoing first lady and outgoing president barack obama are going to be doing in the days ahead since were member, former president george w. Bush left the stage, we did not hear from him for quite some time. Jenna thank you. Mr. Trump said to take the oath of office on friday, his chief of staff Reince Preibus said responsible democrats should unite behind the president. The point is we got congressman on the democratic side of the aisle that are questioning the legitimacy of president elect trump, who won and in electoral landslide. That is the issue, where the outrage should be, not old news but the fact that we are preparing for the transfer of power and have been working with president obama hand in glove, and i think that they, including the president , should step up and get his people in line and tell them to grow up and accept the fact that they lost the election. Jenna so if your head is spinning, mind is at this point as we go back and forth with everything that has happened over the last 48 hours. Going back to the point that ed made, this is very unusual to have so many lawmakers not attend in inauguration for the very purpose of protesting the next president. What do you think this looks like on friday . I dont know. We have some time before we get there, and perhaps there will be some efforts for outreach, who knows what the president elect will say today, who knows what is going on behind the scenes. I will just put this in context historically. 2000, i covered the recount down and tallahassee, florida, that was a very controversial ruling, president ial election that ended up being decided by the u. S. Supreme court. Many democrats at the time said this is not legitimate, not fair, but they showed up for the inauguration. When asked, many said even though they were very upset about george w. Bush and how it all came together that it was about the office, not the candidate, not the campaign, it was about the office of the presidency of the United States. We are at a different point now. We will have to see and ask these lawmakers, which is a growing list, not just congressman lewis, but others in the black caucus, hispanic caucus who say they are not going to show up and we will press them about that precedent they may be setting if they dont go on friday. Jenna as you point out, there is still time to make travel arrangements. [laughs] we still have a few days to see where it all goes but in the meantime, it comes to a broader point, partisanship. President obama said something about partisanship last night and his 60 minutes interview, and i would like to rely on your experience in washington, d. C. , to flesh this out. First, what the president had to say. I was surprised and continue to be surprised by the severity of partisanship in this town. I think i had been warned about it, you will remember in the campaign back in 2008, people would say, he is being naive. He thinks there is no red state and blue stay, wait until he gets here. I will confess that i did not fully appreciate the ways in which individual senators or members of congress now are pushed to the extremes by their voter basis. Jenna im curious of your thoughts on that. Are we in a new era of partisanship, or have we seen times like this before, it just looks different now because of social media and Everything Else we have going on . I think it is a fair point, it is more partisan, washington is more partisan, it has evolved over the years, however with the president leaves out there is he did not help the situation. He did not make it less partisan. There was not a lot of reaching across the aisle and his early days. Remember, obamacare passed without a single republican vote. It was not a lot of what eisenhower used to do, bringing in the opposite party to the white house and talking about what you could get accomplished. There was not a lot of that. In fact, very little of it. Democrats on capitol hill would say they felt alienated from this president and this white house at times, and so i understand what he is saying. He has a right that washington is a more partisan place than it was, but he did not change the atmosphere. Jenna you think donald trump can . It is possible. He has talked about reaching across the aisle in working with democrats on an infrastructure project, on a number of things. We are going to have to see. Donald trump is less ideological. He is not an ideologue, he is practical. At least on the campaign, he has been about talking that gets things done, get the job done, get the things you agree with agreed to first and then fight over the things we have to fight about and twist arms, make negotiations, make deals later on. We will see. He definitely does not have the partisan streak as far as being in ideologue republican. Jenna we believe all possibilities are on the table at this point now, a few days before inauguration. We will see you at 6 00 p. M. , thank you very much. Jon we talked about in the first hour of happening now, there could be big changes coming for reporters to come to the white house and that has some of them up in arms. More about what the fuss is all about. Plus, it is full steam ahead on inauguration prep. A look at what is being done to make sure the transfer of power goes smoothly. Jon reporters who cover the white house could see some big changes soon as the Trump Administration considers leaving the Briefing Room out of the west wing into the Old Executive Office building next door. Kristin fisher live at the white house with more on that. The White House Correspondents association is very concerned that not only could the briefings be moved but that they could be evicted from the Current Office space which is right across from the oval office. The Association President that you interviewed in the first hour of happening now explains that location is critical because of the kind of access that it provides. It is extremely important to the interest of the press corps to maintain our position there so that we have access to people like the press secretary and other Senior Administrative officials. I would advise the president who make news and policies. The trump team says they are also thinking about access, access for more journalism to attend the daily briefings. To do that, they need a room bigger than the current 49 seat Briefing Room inside the west wing. Incoming press Secretary Sean Spicer explained it like this. We are trying to look at ways to increase the accessibility because there is such a huge demand and excitement to cover the Trump Administration that we are looking at those options. There are some logistical hurdles to doing that, we are trying to walk through what are the options. Spicer says no decision has been made yet, but Something Else to think about, we dont even know if a trump admin attrition will continue the tradition of Holding Daily televised briefings. There is perhaps an unprecedented level of uncertainty among the White House Press corps over how a trump admin attrition will impact their jobs and their reporting. Jon veneered times points out in the 1890s, reporters were kept outside the white houe offense and had to yell questions to those inside. Kristin fisher, thank you. Jenna that is not a suggestion. Youre making historical context. Jon just talking about how things have changed over the years. Jenna change can be good sometimes, we will wait and see. Than 30 people. Hes this morning coming up, we talked to a pilot about what could have gone wrong and get as much of the story as we can. Plus white does the people were forced to run from a sports arena during a hockey game audi pilotless vehicles have conquered highways, mountains, and racetracks. And now much of that same advanced technology is found in the audi a4. With one notable difference. The highly advanced audi a4, with available traffic jam assist. Jenna chaos and a sports arena in the Czech Republic when the roof collapses, about 80 people were inside the new sportscenter for a hockey game, they took off running as you can see as soon as it became obvious on the terrible was happening p or fortunately, they got out safely with only two people reporting minor injuries. You can take a look at that, the roof began to cave in, witnesses say the roof was covered with about 10 inches of snow before the collapse, police are still investigating the incident. Spacing now this fox news alert, turkish cargo jet crashes into a residential neighborhood this morning, killing at least 32 people. Officials saying that boeing 747 was trying to land at a near bore airport in the middle of a thick fog when it crashed into a group of homes peer rescue teams now working to recover the victims of the crash, at least six of them, we are told were killed. Joining us as a commercial pilot and publisher of jet wine. We know that weather was bad in the area, we know that local authorities have said this is pilot error, robert. What do you think . It is probably a little early to blame it on the pilot although statistically, pilot error is a cause and probably 70 of airplane accidents. Again, they do have the black boxes out of the airplane, and time is going to tell appeared one thing that is important is a source that we have said the aircraft was in the process of trying to make a missed approach, going around because there was something going on that the crew did not like, maybe the weather had gone down worse than they thought or they were not set up right or Something Like that. Again, we dont know what happened other than that. Jon if you have a missed approach, we have to follow procedures to the letter. Im not aware of whether this is a very hilly area, but being in kurz kyrgyzstan, the chances ary good. We do not know how the crew was trained, but statistically unfortunately, these go arounds in missed approaches as you know they are called, we do not have a really good track record with being really accurate with these because the pilots even in training do not practice them very often. Jon it was a 747, it is a big, heavy, but complicated aircraft, four engines, the more engines youve got, the more opportunity for something to go wrong. That is true, but of course, you can also tell people that the bigger airplanes fly pretty much like a small airplane does. You need to get the engine spun up to full power, ease back on the wheel, and it should climb unless Something Else got in the way. Obviously, something did because they kept descending when they should not have. Jon what about the possibility of a cargo shift, some of the cargo strapped down inside the hold let loose and changed the center of gravity, changed the pitch angle for the pilot . That is possible. We saw that happen in the 747 crash bahrain many years ago. Usually, if it was secured through most of the fight, it would be kind of unusual for it to let go at that point, but again, my guess is that with the weather as bad as it was in the visibility was only 500 feet forward, which is not nearly enough to land. My guess is they knew that and were probably trying to figure out what they were going to do next. Jon this airline, act, Turkish Airline as i understand it, what do you know about their Safety Record, anything in particular that stands out . I have not been able to see too much about their Safety Record of that there they are a Charter Company fight due to my flying under a Turkish Airlines cargo flight number, but that is not unusual when one company does not have enough airplanes to handle the cargo, they will often sublease from another company to get them to fly it. But again, this company flies nothing but 740 sevens, so they do have a fair amount of experience in have been in business over a dozen years. Jon very sad situation obviously, we will keep an eye on what happens during that investigation of that crash in kyrgyzstan. Robert mark, jet whine, thank you. Jenna we have seen rough weather across the country, even at cowboys stadium where football fans were told to shelter in place. The danger has not yet passed, we have more storms, we will get to that, plus inauguration in the homestretch now just couple of days away from the transfer of power. This is a uniquely american preview of the festivities and parade route next. Jon fox extreme weather alert, now dozens of homes damaged in a powerful storm sweeping across texas peer Power Outages affecting tens of thousands at the height of the storm. Service has been restored for most people, and dangerous ice storms are lingering and parts of the midwest. Slick conditions making travel very dangerous, and several deaths already reported. Urologist adam klotz is life in the fox extreme weather center. Big storm system exactly what you are talking about, affecting us in different areas in different ways, but tornadoes running to the dallas area last evening, that will continue to work its way across the south so we could see some Severe Weather before this is done, shifted further to the east running across portions of arkansas, just some pretty nasty storms possibly moving to the area, we have a chance of it, on the norther edge of the system, the exact same system, that is where we have been seeing the ice fall, that continues in the upper midwest, stretching close to chicago, running up into areas of michigan as well. It is going to be the far Northern Edge is where we continue to see any possibility of ice, everywhere further to the south is just going to be that storm possibility here, put into motion, this is the future forecast. You see it sweeping across the country, not a lot in the way of christ, the extreme northern portions of the country may be turning back to snow and ice when you get back to the northeast, this is running you closer to wednesday, it rained lingering in the center of the country as well. Begin to think of the east coast, begin to think of the inauguration. Eventually, we could see a little bit of an impact, but in reality the cold air is much farther to the north when you talk about washington, d. C. What are we expecting in the week ahead . Look at these numbers, unseasonably warm, mid 50s by tomorrow, eventually by the time you get to friday, 52 degrees. Small chance of rain, not a washout but good idea to keep the umbrella handy when you are wrapping up this week in washington, d. C. , for the inauguration. Jon i know you are new to fox, first appearance on happening now. [laughter] lets have some applause. Jon we welcome you aboard, folks in atlanta know you well. You are being introduced to the nation, and we appreciate your coming aboard. Thank you so much for having me. Jenna great job, adam. Have the umbrella just in case, always good to have. Where there may not be the biggest concern for organizations for the friday inauguration ceremony, they need to make sure things go off without a hitch. Live in washington along the parade route, a little bit more for us now. Hello, this should be a familiar sight to a lot of people, Trump International hotel right here on pennsylvania avenue which, of course, is part of the historic parade. We have some video from the rehearsals which took place yesterday in which the marching bands as well as substitutes for the president elect and his family prorated down constitution avenue to pennsylvania avenue where i am standing now. Eventually they will parade all the weight down to 15th street, they will head to the right than over to the white house where the parade will conclude. In addition to all of these preparations, you should know that the inaugural committee has actually raised a record amount of money, 90 million and still growing. Some of this money coming from chevron, boeing donated a million dollars, all this helping to pay the over 175 million that it is expected to cost to stage the inauguration. There will be three official inaugural balls, 30,000 people expected to attend those, but of course there is the concert thursday night, free to the public over at the lincoln memorial. Lee greenwood, toby keith will be performing, so the festivities, sounds like things get underway thursday but in reality, things begin tomorrow, the official thank you dinners and formal dinners will begin tomorrow then of course, thursday, president elect and Vice President are going to lay a wreath at the tomb of the unknowns at Arlington National cemetery and we will be in full swing for the inauguration. As i wrapped up, they are expecting close to 900,000 people here in the nations capital, lets hope the weather holds out. Jenna absolutely, adam, thank you. Jon quick programming noted tell you about as fox welcomed spec eight film in your face, bob beckel will return as cohost of the five beginning this evening. Rupert murdoch saying that bob was missed by many fans, and we are happy to welcome him back to the show. Indeed, we are, tune in tonight at 5 00, bob beckel back on the five peered bombshell to tell you about in the orlando nightclub massacre, the widow of the terrace to gun down 49 people is now under arrest. Jon fox news alert now on a new arrest linked to the orlando nightclub massacre last summer. The widow of the gunman omar mateen arrested in california on aiding, charges of aiding and abetting a Terror Organization and obstruction of justice. He pledged allegiance to isis during that standoff, he died in the rampage that left 49 innocent people died. Joining us now, a former prosecutor in criminal defense attorney, also with us, heather hanson, trial attorney. During the investigation of these crimes, she said, nora solomon, she said my husband was abusive come he punched me in the belly when i was pregnant, she seemed to suggest it was a good thing that he was gone, now she has been arrested, what do you make of it . She must have led the police astray because she had a choice in this matter, she did not have to say anything, if she were perhaps going to be held accountable for something criminally. Once you start opening your mouth come you have to either tell the truth or stop talking. She probably, like i said, lead them astray and did not give them the full facts. Jon what would it take to bring and obstruction of justice charge . She could have light after the investigation or they could have found out she could have prevented the thing from happening and did not stop it. The thing is today with all of the electronic evidence available with text messages, cell phone, email, i am sure they built a great deal of evidence against her in order to bring these charges. Remember, she could do life for the aiding and abetting the terrorism charge. Jon 49 people were killed and what the fbi director described as a terrorist act. The fact that she was married to him, he is deceased now. Does she have any protection in terms of testifying against her husband . Not really and because he is dead, there will not be a criminal trial against him. You have to remember, martha stewart, the coverup is worse than the crime, this is apples and oranges, but the point is the same. You cannot cover up something to shield somebody else or yourself. You can be quiet. She chose not to. Jon the chief of police in orlando just put out a statement that reads in part i am glad to see that omar mateens wife has been charged with aiding her husband in the commission of the brutal attack on the pulse nightclub or federal authorities have been working tirelessly on this case for more than seven months, and we are grateful they have seen to it that some measure of justice will be served in this act of terror. First of all, that is pretty unusual for a police chief to be applauding the arrest of somebody in an active investigation, but also it suggests that he knows something that the rest of us dont. It shows they have a great deal of evidence. Really, everybody wants someone to be held accountable. If she had summing to do with the death of these people, absolutely she should be held accountable and the fact he is making that statement, they probably have evidence. Jon among police, they feel he got off too easy, he died in the shootout with authorities after they raided the club after several hours. What the authorities do now is send a message because that is the only way to truly attack isis, not just the people committing the crimes, you have to attack everyone under purview helping or allowing it to happen, this is a good first step. Jon what if she pleads i was an innocent bystander, i was unfamiliar with american ways, and he did all of this on his own . I think she will have a difficult time with that. The fact that as the officer said, seven months of investigation, i am sure they have a great deal of evidence. They probably would have been able to bring the charges even if she had not spoken to police but now that she has lied to them, they are going after her hard, and she cannot say i did not know or he was beating me, that is not going to do it. Jon lets turn our legal panel attention to the worst terror attack this nation has seen, the Supreme Court is now considering a case linked to 9 11. It involves a muslim man who was here illegally and then detained for nearly a year on immigration violations in the days after the terror attack. The u. S. Circuit court of appeals in new york said his case, suing the government for abusive treatment and prolonged detention, could go forward. But former attorney general John Ashcroft and other former federal officials we want to take you now to trump tower. Donald trump is, well, he is on his way to a meeting with Martin Luther king the third. Do i have that right . Jenna he actually just came out with the eldest son of Martin Luther king jr. , you are seeing them right in the middle of your screen there, next to the gentleman that has the glasses. We were expecting to hear from mr. Trump, but apparently that is not happening, so we were prepared to go to trump tower, and we were initially told he might have a few words to say after this meeting. That meeting lasted just under an hour. Mr. Trump tweeted this morning that he was going to celebrate Martin Luther king day and all of the many wonderful things he stood for, honor him for being a great man that he was, and then we learn he was going to have this meeting with the eldest son of dr. Bartley 13 junior. That meeting took place, but we will see if there are any more headlines coming from the meeting here, just a shot of them coming out of the elevator. This is a tape we have, shaking hands, and again we will wait for any Headline News from that meeting. Often times, as you know, mr. Trump saunters over and says a few words, so we wanted to be prepared in case that happened. In the meantime, lets go back to the legal panel, i know we interrupted a little bit, picking up where you left off. Jon we are talking about this lawsuit, about 80 muslim detainees brought against the attorney general, former attorney general John Ashcroft and other federal officials. They were picked up in the days after the 9 11 attacks, some of them spent up to a year in jail, and they are suing the federal government because of that. All kinds of questions about this story. First of all, one of the plaintiffs in this case freely admits that he was here illegally, he had overstayed his visa, driving a cab in new jersey, but he was not a legal citizen of the United States, not even a legal visitor to the United States, but he still brought this lawsuit. Does that in any way affect his standing . Im having difficulty being sympathetic for these plaintiffs. I say it does not affect in other words, he should not be allowed to see the former attorney general and fbi director personally, which is what this class is trying to do, for any sort of misgivings are things that went wrong while they were in custody on these pending charges. Look, we had the worst terror attack in our countrys history. We had to go after people aggressively. Who would you go after, my grandmother who has been here for 91 years it is a legal citizen . No, you dont. They had to pick up people, targeted those who were here illegally. If they were abused while they were in prison waiting to be deported, that is one thing. You cannot sue personally the attorney general and fbi director. You can go after the facility, that is fine print that is not what this lawsuit is about. 15 years in the making, they are trying to sue individuals in charge of the country at the time, that is not okay. Jon this same guy who is now a Real Estate Agent in his native pakistan also mentions he entered a phony green card marriage while he was here to try to get the u. S. Authorities to let him stay. None of that is going to make any difference. Ultimately, to put Martin Luther king Martin Luther king comment injustice anywhere affects justice everywhere, and here there were injustices done. Some of the officials were currently convicted for the beatings they did against these guys who were picked up. The reality of it is as she said, you cannot hold the highest of initiations accountable for something that these institutions did. They were probably say you cannot have immunity simply because it like this this happens. You can go after the people who did the beatings, but when you consider net back National Safety come you have to make decisions quickly and be able to sometimes profile. Jon interesting case. We will see what the Supreme Court decides. Thank you. Jenna back to trump tower now and new york city where we are back to see the eldest son of dr. Martin luther king junior. It is very clear that the system is not working at its maximum. Through an oped that you may have seen, we provided at least a solution to begin to address a broken voting system. That was most of the dialogue that we talked about. We believe we provided a solution that at least will give everyone an idea. Still have the scars from the marks marks on someone, were you offended by the president elects tweet that represents lewis as all talk and no action . First of all, i think in the heat of emotions, a lot gets said on both sides. I think at some point i am, s john lewis in many art, a bridge builder. The goal is to bring america together, and we are a great nation, but we must become a greater nation. What my father represented, my mother represented, and what i hope i am trying to do is always bring people together. Many africanamericans are very concerned about a trump presidency. A woman came in here last week and told me he is going to have black people up against the wall both literally and figuratively, are there lingering concerns he will be a president for all people come up black and white . Certainly he said that, he will represent americans. He said that over and over again. I think we will continue to evaluate that. I think that the nation supports i believe that is his intent, but also we have to consistently engage with pressure, public pressure. It is not happen automatically, my father in his team understood that, they did that. Americans are prepared to do that. If i can follow up, is there summing that cuts into your core when you hear the president elect referred to john lewis as all talk and no action . Nothing could be further on the truth, isnt that right . He is not all talk, no action. Absolutely, i would say john lewis has demonstrated he is action. As i said, things get said on both sides and the heat of emotion. At some point, this nation, we have to move forward. People are literally probably dying. We need to be talking about, how do we feed and clothe people, create the best Education System . That is what we need to focus on. What do you think your fathers message would be to president elect trump . This is the final answer im going to have because im going to reiterate what i just said. He would be very concerned that there are 50 or 69 People Living in poverty, and we have to create the climate for all folks to be lifted in america with a multitrillion dollar economy, 20 trillion, it is insanity that we have poor people in this country. That is unacceptable. While we work together, we know we can roll up our sleeves, there is nothing we as americans cannot do. Thank you very much. Jenna the eldest son of dr. Martin luther king jr. Shedding a little light on the meeting he had with president elect donald trump today.
