Secretary of state kerry by the way in that testimony talked about gains that have been made against isis in syria and iraq including Kurdish Peshmerga forces taking back and recapturing about 30 villages in syria. That said lets talk about the hostages. Were getting reports that an estimated 90 people 90 of the syrian christians as mentioned, were taken by isis. Many of them women and children. Now all of this happened basically under the cover of darkness before dawn on monday when the isis militants overran several villages along the kabul river in northeastern syria. This is a river if you look at a map that hooks up with the u uutrayties and the villages clustered along the river and an area that has been under isis control though being pushed out of a lot of areas at this point but theres been heavy fighting between various forces and also the isis militants there. That continues. Now, some good news if you can say that in all of this, about 3,000 people managed to escape isis, but at this point, the problem is that communication lines have been cut so were not getting any information and, of course, family members of those take reason not getting any information about their whereabouts, or their condition, and isiss has not released any information or video for that matter of those hostages, of those people abducted. Earlier today from the Senate Floor Majority Leader Mitch Mcconnell says he will split the immigration language from the funding bill and urging democrats to join republicans in blocking what he calls the president s illegal immigration actions. President obama is refusing to budge on his immigration plans. In an oped today the president criticized republicanses by dropping some big gop names. Mr. Obama writes, quote, it was my hope that a new Republican Led Congress would seek to govern responsibly by supporting Common Sense Solutions to one of our countrys greatest challenges. Just like president bush and senator john mccain tried to nearly a decade ago. Bob cusack is editor in chief of the hill. So when this president is saluting george w. Bush and john mccain has hell frozen over bob . Yeah. Interesting tactic by the president in the oped. He knows this issue divides republicans and a lot of ways divides Senate Republicans and House Republicans. If you talk to republican senators they say dhs is not going to shut down one way or the other, well get a deal but if you talk to House Republicans they say the chances are anywhere from 60 to 90 there is going to be some type of dhs shutdown. The Tea Party Really wants to make a stand on this constitutional issue. They say and note that the president said he couldnt do what he did on immigration 22 times before he did it but clearly president obama has the leverage here and using it this week. Yeah. And the turn around in that oped that he wrote in your newspaper are astounding. He says, ive taken this action and im fully confident it will pass muster. He criticizes the one texas judge who has temporarily held it up. This from a guy who said 22 times that he couldnt do what he has proceeded to do. Yeah. Remember john, too that democrats in the senate up for reelection many of whom lost said to the president dont do this until after the election. And they werent the only ones that lost that said hold off on this. Were not fans of this action, of you doing this unilaterally without congressional consent. Thats a republican strategy here. Take it from the funding mechanism, have a separate vote that has nothing do with funding and put these democrats on the record. But at least for the moment the democrats are sticking together and thats the strategy for democrats. Divide the republicans on this issue. Mitch mcconnell, he really doesnt want to be talking about this. He wants to be talking about the Keystone Pipeline tax reform trade. He does not want a dhs shutdown. It seems like republicans are getting the blame in the media and maybe the court of Public Opinion even though Mitch Mcconnell is trying to say that its the democrats that have been holding up the legislation in the senate . Yeah. And you really have to look also to the court. You mentioned that texas judge decision, that went against the administration and forced the administration to stop moving forward on implementing this immigration action. Theyve requested a stay but overall this is going to be both playing ute in congress but more importantly playing out in the courts and some predicting that its going to be the Supreme Court thats going to be deciding on this because remember this court said listen, you have to do at least some type of ruling making on it. You cant just do this through executive action. Put out a regulation. Thats the key point that Supreme Court may decide and possibly quickly. I just wonder, if the president is maybe poking a hornets nest with a stick when he criticizes the federal judge and says, you know, im right hes wrong, im quite confident that his ruling is going to be overturned, and were on firm legal ground. I mean when other judges read the chief executive saying that kind of thing, how do they react . Yeah. Well the judges always say they dont theyre not affected by that but all judges read the newspaper and we saw that with the obama care decision. Both sides basically lobbying the Supreme Court. This Supreme Court leans conservative so those aggressive criticisms of the texas judge decision, that certainly could backfire. Well have to see. I think republicans in congress are saying hey, lets not take the political hit on this. The courts will decide this and one way or the other get a deal done. But that remains to be seen. Your observations just having returned from that part of the world . Well, i was a little further in the south of iraq, away from the front. Its remarkable how stable things are in the south and how little the fighting impacts it. Although young men are going from the south to fight and so they feel the effects of the war, but its not on their geography. Some ways its amazing how normal baghdad on south is. And what do you think that tells us about what we should be doing in iraq . Well, i think in general, we are on the right course in iraq. Ive written that we really do think that theyre going that isil, isis, will be pushed out of iraq. Doesnt mean we have a plan for how we will push them out of syria. In iraq we have the right Partner Forces on the part of the iraqi army and the the peshmerga u. S. Advisers there training them, u. S. Air power that can be applied, we really do have a plan with tens of thousands of Partner Forces to push isis out of iraq. You know better than anybody until we put more troops on the ground in iraq, until we did that during the war and were able to defeat the enemy on their own battlefield did we see a turn . Do you think were going to need more americans on the ground in iraq to have the same result even now . I dont think so. I think perversely more americans on the ground could be counter productive. Things are going well right now because the americans are no longer seen as an occupying army. The americans are on the iraqi bases, dont interact with the iraqi people theyre just training. They appreciate the use of u. S. Air power against these isil groups. And so long as that continues and we have goodwill from the iraqiss, i think we can count on them pushing forward. Perversely were this to start looking again like americans are occupying the country that could have some very negative political effects inside the country. Baldwin is now the subject of an ethics complaint from the Wisconsin Republican party. The complaint says that baldwin subsequently fired a staffer who had access to all of this oig investigation, but included in that firing a severance package that is attached to a nondisclosure agreement. The high court agreeing to hear arguments in a classaction lawsuit filed against a california based utility company, lawyers say the company did not act in the best interests of its workers by choosing 401 k funds that charged excessive fees. Lets bring in doug burns a former federal prosecutor and lis wheel. A fox analyst. I was surprised to see this case is being taken up by the Supreme Court. It doesnt seem like the life and death matter that they would hear, but the employees are saying you know, these funds charged us too much money and our retirements are going to be hurt because of it . I disagree. I think it is important. This can affect hundreds of thousands if not millions of people that have 401 k s under large companies. This has gone through a large process but what the lower courts ruled is yes you companies, you are responsible for making sure that you take you have a fiduciary duty to your folks. You go for the institutional fees where they give you a break if youre a big company. They said hey, theres a statute of limitations of what you can claim, six years. Like me i get my statements in and i look at them but dont necessarily look at the fees. It could take me more than six years to figure it out. The high court is to whether or not the companies owe you that fiduciary for as long as theyre in existence as long as they have your money. If the companys argument is correct, if im reading it right, theyre saying essentially hey we opened these funds, kept an eye on them for six years as is our fiduciary duty but after that its the statute of limitations is up and we dont have to watch them anymore. Well, the trial court and the ninth circuit both ruled that the sixyear stat lute of limitations did apply. What were saying is an oversimplification. What point does the claim start to what point does it end . It removes a number of the claims but certainly not all of them. It was interesting because then there was a counter argument by the companies that it should be a threeyear statute. That was rejected. Back to the initial discussion you guys were having i think his is right in the sense that this establishes a National Principle that companies have to use diligence in making sure youre getting what they described in the case as more of a wholesale price not a retail one then that is a good thing. Lets turn our attentions and keep an eye on what the Supreme Court decides in that case obviously, for our viewers but turn our attentions to texas and closing arguments which could begin as early as today in the trial of the man accused of killing american sniper chris kyle and his buddy chad littlefield. Lawyers for the suspect Eddie Ray Routh claim he was legally insane. Prosecutors say routh was aware of his actions. You know when you read all of the testimony from the various experts, the defense experts say he was crazy, insane. The prosecution brings on experts who say he had mental conditions but he wasnt legally insane. Just big picture what is the jury supposed to decide when they listen to these dueling experts. Did he know right from wrong at the time of the killing. Is that all. That is the legal statute in every everywhere, did you know right from wrong . I would say experts kind of wash out. The prosecutor one is going to say he was, you know, not insane, the defense i mean jurors know that. They know experts are paid and going to support which ever team theyre on. Heres what i think will convict him. His own words to officer briley after the killings he said yeah, yes, sir, i knew what i was doing was wrong and followed with the sentence saying if i just stayed would have that have made it okay if i stayed around rather than fleeing which is consciousness of guilt would i have been okay . That video we saw of him in the chair we dont have the audio, the court is bottling that up the judge is but he apparently at one point in his interview with Texas Rangers he says, you know, if he was asked whether there was anything he would like to say to the families of his victims he replied, im sorry for what ive done, we can work this out. Doesnt that show consciousness of guilt . There are a number of points that you guys have raised and other people have raised that he fled, that he made statements like that but again, weve pointed out some of the counter points. At one point he himself said he didnt know the difference between right and wrong number one. There are other quotes. What im concerned about in terms of the prosecution is that they may not be appreciating as much as they should that a jury may not be able to so neatly break out this distinction and shes right, by the way Mental Illness doesnt necessarily equate to legal insanity, but when you have this much material and this record and i think the submissions will be important im not sure how this is hitting the jury. The victims family says she knew she was in danger and was trying to lure the suspect away from her moment before she was shot. The teenagers defense lawyers say he acted in selfdefense. Jenna if that is true why did he allegedly shoot first and why did she drive home after the first gun battle which is why this story is so unusual. What sounded like a slam dunk, a road rage, a week ago, is now no easy shot for the prosecutor who may let the grand jury decide whether the charge 19yearold ear rich nowsch. He appeared in shackles looking nothing like the Police Sketch of the man who allegedly shot myers two weeks ago after driving lessons with her daughter. Police say myers was not involved in the Traffic Accident an not the innocent victim she first appeared. Instead, myers told her son to go grab a gun, went looking for the car, that scared her earlier, a confrontation ensued gun battle, blocks away involving some 22 shots only later did nowsch allegedly kill myers at the house. It is not a straightforward case. It is not a garden variety runofthemill case. We all know there are certain nuances to this case, but at the end of the day this young man is charged with a senseless, stupid act of murder and we intend to prove it in court. But that will not be easy. Turns out myers befriended nowsch years earlier after the boys father died. She gave him money. He washed cars in their culdesac. Neither the son or daughter told that to police who are now accused of giving this 19yearold marijuana or alcohol during questioning.
