The new trial . They are supposed to save lives, and now an urj end warning for millions of drivers to get their air bags fixed because of a potentially deadly defect. And mystery solved. A hero who pulled a man from a house engulfed in flames is identified. It is all happening now. And our top story on this tuesday. Jodi arias, back in court as a new jury will decide whether she gets the Death Penalty of the brutal murder of her boyfriend. I am jon scott. And i am Shannon Bream in for jenna. Jodi faces life in prison or the Death Penalty. Arias was convicted of firstdegree murder for shooting and stabbing and slitting the throat of her boyfriend. Claudia has the details. Hi, shannon, key players are taking their seats inside of the phoenix courtroom where the new jury will be sworn in. The lawyers will try to get one juror to like her. That jury will hear the sordid evidence and in particular how she murdered alexander by stabbing him 27 times and shooting him in the head and nearly decapitating him. Prosecutor said she flew in a jealous rage. And first she said he was killed by intruders and claimed she killed him in self defense and all the while giving tv interviews and changing her look and taunting the prosecutor on twitter. There is 2 million shelled out on her defense. And prosecutors will need to convince the jurors that the price tag and time is worth it. They want to make sure the jury is compelled to sentence her to death and not spare her life. It is important to get the jurors on their side and angry as they are. If it is hung, the Death Penalty will be off of the table. And the judge will sentence arias to life in prison without parole or life with possibility of parole had she is almost 60. Still cameras are being allowed and well have a producer to allow the details on the penalty trial which is expected to last until december. We are getting more information from the jury room, one juror was excowed, we believe 18 and 12 of them are women. They are being sworn in and read the jury instructions now. Jodi is wearing the glasses for the second retrial. Is that the same one or a new pair in the interim . He is an accused serial killer. Darien van was arrested after a 19yearold woman was found dead. His First Court Appearance is scheduled for 9 oclock a. M. Garrett, thank you. Isis militants in Northern Iraq making a new push to seize territory and the syrian front heavy fighting rages in kobani. Kurdish fighters are using the weapons air dropped by the u. S. Military and said it is making a difference. Greg is near the border there. Reporter hello, shannon, thats what we are hearing about the air drops. The u. S. Looking for any way to tip in its favor the high stakes and long running battle. Look at where the fight stands right now. It is it a month and the fight for kobani and the battle lines are settling in. The smoke in the center of the city is the main front line and east and combrnd it held by isis and right and left is held by kurds. The southwestern part of the isis, well see if the new gun ands fighters can change the story. The u. S. Air strikes hit on the main front line and more strikes and heavy clashes. Isis launching two more car bombs and heavy mortar fire against the kurdish foes and engaging them in street fighting. And the kurds are trying out the gear. There is video out showing that the isis fighters with one of the bundle. Sitcom did not reach the kurds, we spoke with them and they cannot confirm to me that the amateur video is the real thing. It underscores the great difficulty of resupplying an urban fight from the air. One final note about the iraqi fighters that yesterday turkey said would be allowed to get in the fight. And we talked to kurdish officials in kobani. They are not there yet. And we heard of squabbling between the combatants, it looks like reenforcements will not arrive for several days, no one said it would be easy, back to you. Certainly not, thanks. A warning for drivers. Millions of a bags considered dangerous because of metal chap nel in to drivers and passengers when they deploy. The problem affects many popular models of cars. Well have the details, next. And president obama may face the last two years in congress with a republican congress. So how can he salvage the rest of his time in the office if that happens . Here i am. Rock you like a hurricane. Fiber one now makes cookies. Find them in the cookie aisle. A fox news alert and a rare bit of good news out of north korea. Jeffrey has been released by the north korea government. We dont know the circumstances. We know that the u. S. And others had been pressing for all of these men to be released but jeffrey fowel has been released and that leaves behind two others, Matthew Miller and kenneth beyh. Kenneth beyh is facing hard labor in a difficult north korean prison. Two men remain, jeffrey fowel was released. More as we get it. President obama has more than two years left in office and most of his remaining time can be spent with republicans controlling the house the of congress. Well talk to joe trippi. Joe, good to see you today. Good to see you. You know, this could be more complicated because it is obvious republicans in congress and if the gop does as projected senate, they made it clear they will not make it easy on the president . Thats true. There are a few areas where you think the president could get somewhere. Tax reform would be one. Both the president and republicans want to lower the Corporate Tax rate. The president wants to lower 28 percent and the republicans want to lower to 25 percent. And so they could maybe get somewhere on tax reform and depending on whether the Republican Party goes on immigration whether jeb bush or marco rubio leading it they may be able to do something on immigration as well. One of the differences is, people point to clinton and Newt Gingrich getting a lot done in similar circumstances. Clinton relished the smoosh and the back room and building those relationships and Newt Gingrich led the revolution. I am not sure that barak obama. We know he doesnt like to smooze. And i dont think boehner is gingrich. It will be tougher to get it done i think. You hear many of the things i hear in washington, that democrats said the president doesnt smooze and hang out with them. And when there is sausage making and they cant get meetings with them. Does he turn to executive orders, i mean there are lawsuits and a lot of friction over that already. Especially on the top of immigration, he promised to do something. Certainly much to the chagrin of republicans and those opposing the president he will use executive orders and take action when he can and he may well have to, given, again his personality. Reagan and clinton both had similar problems with congress and the other partys hands. But at different times in the presidencies. But they did the smoozing and they liked to be in the back room. This president doesnt. And the other problem he has, is that boehner is not someone who actually has command. You know just uniform 100 percent of the caucus going with him wherever he wants to lead. It we saw the grand bargain that went south because he couldnt bring the caucus together on that. And the president had trouble bringing in his party at times. I think there are things like Immigration Reform and tax reform and maybe trade things that they can get done, but it is going to be a much rougher road for him, if the republicans win the senate. Yeah, depending on how the elections go. Immigration and Supreme Court and everything could get ugly in washington. Good to see you. Thank you. If you have an air bag in your car or truck pay attention. Federal government urging millions of car owners to get their air bags fixed. Instead of saving your life, they could kill you. And they are enstalled in millions of cars. Laura ingle is following the massive recall. This warning is for anyone that has a ti cottic air bag. They are telling owners to see if their vehicles are part of the recall immediately. There are various makes and podle. Toyota, bmw and nissan and General Motors on the list. And this one is 12 million vehicles that contain these air bags are recalled worldwide. They may have a faulty inflator that can explode and send shrapnel. Hot and humid conditions could be a factor. And the national highway traffic administration, consumers impacted by the recall should have their vehicle serviced promptly and hta remains in close control. They will take appropriate actions. There is te cotta made air bags. Toyota which uses the ta cotta products issued recalls. And working along with tacotta and the company is investigating a fatality in florida with a ruptured inflator. And toyota is conducting a supplemental recall in areas with what is called high humidity. We contacted ta cataand have not heard at this time. And if you are a taxpayer, you are picking up the outrageous tab. For weeks turkey avoided taking action in kobani. And now the leaders are taking a different stance and what does it mean for the efforts to defeat isis. Well talk to kt mcfarland when she joins us live. An apparent shift in policy from turkish leaders on the battle against isis raging in kobani. The government agreeing to let iraqi kufrd curd to use that territory. Kobani has been cut off on all sides bite isis militants. Why the sudden interest in the border town and the change of heart from the turkish government. Well ask kt mcfarland who is a fox news analyst. And so until now the turkish government resisted letting the fighters in ieshg rack. Why the change . President obama called the president of turkey and talked tough to him and within a couple of hours the turkish government changed their stance. No one is a friend and they are fre enemies. The turks were afraid if they helped the kurds in this town defeat isis, the kurds would turn around and the kurdish population in iraq and iran and in turkey particularly that they would declare they wanted their own separate state. Turkey wanted to wait until the kurds were destroyed and depleted before it stood up against isis. President obama said look, if this town falls and there is genocide, it is on your hands. The turks are a nato ally and they are dragging their feet. They have been dodgy for a long time. I was in the meeting with the president of turkey three weeks ago and que asked if you are going to get involved and isis will aim the at you as it is every other country and he was maybe yes or no. And he would not be penned down. And in the iraq war, turkey or our nato ally did not let allied forces to use turkey as a staging ground for the enivation. The kurd, they consider them a terrorist group of their own. The kurds for generation tried to have their own country and there is a significant population of ethnic kurds in all of these regions and turkey has fought a long battle with the kurds in turkey. And they are worried if the kurds get too strong they will want upon their own country. And interesting in the middle east, the only ones who stood up to fight isis are the kurds. Yeah, the battle for kobani anything on. I read some suggested that kobani is not that pivotal of a town but getting the coverage because of the turkey and journalist can go there as they cant in syria it points for isis. Journalist and aide workers. They say journalist are immune. Well cut off your heads if you come here. And as a result no journalist are allowed in or daring. I cant say i blame them. Just this week, there was another town that isis really, i mean killed and crucified and beheaded 700 people. There were no journalist there to record it. Awful acts on the part of the isis terrorist. Hounds of hell. And lets hope we can put a stop to it. Thank you, kt. Remember the prisoner swap that left five taliban leaders free from gitmo. Military may have been involved in transporting Jeffrey Fowle out of north korea and we understand that he is on the way to guam as we speak, shannon. I cant imagine the relief of his loved ones and the hopes for the other two men held there. Thank you. Stunning new claims surrounding the five taliban leaders from gitmo. They were freed in exchange army prisoner bo bergdahl. Three of the men visited in qatar. Heres the details from washington. The taliban is not known to provide false statements and in this release. The terror groups claims that two senior members, a military commander for southeastern afghanistan were are taken in afghan custody after visiting the gitmodetaines in qatar. While returning home after spending a week. Both men were handed over to kabul. Despite the freed detainees assured that their relatives may visit them unharmed. They were part of the controversial deal with the taliban and it is a terror dream team because of longstanding ties to terror. The reported meeting signals the former gitmodetainees are back in the terror game. We know that family visits are allowed but those two guys talked to the taliban five and others have talked to them and in constant communications preparing for their eventual return. As for the taliban statement and the purported members of the ha cani terror network, and neither the government of qatar or cia provided comment and significantly, there was no denial issued. Well hear more about this in an hour from now. A lot of concerns about those five guys that are out there. Thank you, kathryn. Are the Human Remains Found near charlottesville those of missing College StudentHannah Graham. The man accused of abducting the sophomore is tied to brutal crimes. He was charged with the rape and attempted murder of another woman and reportedly linked to the murder of a woman in 2009. Well bring doug burns and a list wheel. And good to see you. Aiss, we have different jurisdictions and the attorney out of fairfax saying i will go in whatever order well go but well try this case. The community, you are getting a Community Wants to see this person tried. It happen in their state and county and community. The decision is part emotion, but as far as the legal aspect, it is how heinous the crime is. Capitol murder goes first and kidnapping and abduction comes after that. So if bee have two murders and waiting to find out if Jesse Matthews is linked to these and waiting to find out if this is Hannah Grahams set of remains, if those cases are linked to Jesse Matthews and they happen in the jurisdiction, would they be tried together or two separate trials . It is interesting hearing you discuss multiple cases. Usually if there is a knockdowndragout, very often you will see a plea bargain. For example, he gets the Death Penalty and they will weigh resources. Do we really want to do this. Because we know there will be appeals. And do we want that back up as to where we pay for this. And they will make the sentences concurrent. And so, very often you dont see a second trial. So we have cases and allegations for him dating more than two years. Back in 2003. And cold cases that detectives are reinterviewing the witnesses and pouring over the files to see there are similaritities and he may be linked. And that is the way the defense lawyer would say take the Death Penalty off of the case and by going to him. All right, well tell you where the other girls are buried and take the Death Penalty off of the table and roll the depositions in one. And that immunizes. And in return for telling us where the body is. Life in prison without parole. And the point is well not prosecute you which as a practical matter doesnt matter. But the community is so upset. Wait a second. I dont want you to take the Death Penalty off of the table. The 2005 case rape and attempted murder. That victim survived and how important is it for her to see justice for her personal case. She can testify. It might be more important for the living victim therottically. And she gave them a sketch of him. Putting the sketch and the forensics and pan out the way they will pan out, you are trying him to five plus murders and abductions. What about the families . We saw hannahs parents it broke your heart. Please tell us where she is. The point that people dont understand is the idea of closure. There is a huge difference believe it or not in coming to closure versus having an open ended thing. His lawyer is going to say i want something. He will give you something for giving you that closure. Whether or not they want to bargain that way. What have you lost if they are not Hannah Graham. It makes it worse. There is no bargaining chip. This happen in the california years ago. The guy was about ready to tell them. And they found the body. And thats all. That chip and bargaining chip was off of the table. To what extent he gets tied in to the other ones and you asked steve rogers what would the judge let in. That is a critical point. And he goes to trial for crime number one would they allow evidence in for another. And the probative value. And in the fairfax case attempted capitol charge, if that is it subsequent to say Hannah Graham trial. And hes charged there and not yet convicted, is that enough to come in . That is a tricky one. Not usually. It has to be a conviction usually. And i think the distinctions go on prior bad acts versus something that happens afterwards. And the judge would leave it out. And the mo. That will all come out at trial. This is why we never end up to jurors. We ask too many questions. Jon, back to you. Children with that virus are 40 percent more likely to develop type one diabetes. Joining us now is the doctor from comprehensive medicine. Both of these cause illness and doib and that is on the rise around the world . This is an interesting observational study. They looked on seven years from 2000 to 2007 and looked at the enterovirus and looked at the rise of juvenile diabetes. There was a correlation between the two. No one knows why type one diabetes strikes . No. The enterovirus attacks the beta cells in the pancreas that are responsible for producing insullin. There is a situation where the body attacks the pancreas. The hope resulting from this study, if you can figure out what triggers the diabetes, you might be able to get a vaccine or treatment to prevent it . Yes, the vaccine is always something that tantillizes in the future. In the season was spring and fall, when the virus tends to strike, it increased the risk of juvenile diabetes and if there is a possibility we keep children healthier and vita min d that is important and vitamin c might decrease the problem as well by keeping people healthier. And interesting, too. And doing the research for the segment. There is a wide disparity with the cultures. Hardly any in china and taiwan but if finland it is a huge problem. In china the rate increases over 640 percent in finland. There may be other factors and important to understand that it is a complicated illness and genetic and environmental factors in addition to the very critical New Discovery with enterovirus. If this study points the way to a cause half of the time, that would be a significant help. 80000 children every year with juvenile diabetes. And your tax dollars at work. Tens of thousands of federal workers put on paid administrative leave and taxpayers are picking up the multimilliondollar tab. The new report from the Government Accountability office is showing just how much its costing us when employees are told to go home. Some of them for months at a time. Live in washington with more, hey hi, shannon. Taxpayers got a 775 million tab just to pay administrative leave for 3 of federal employees who were placed by their bosses on administrative leave. Most commonly for Personnel Matters like misconduct or criminal investigations. There were also physical fitness activities and rest and recuperation after long trips overseas, listed as reasons that the 3 of employees, about 57,000 people, had between one month and three years of paid leave, and thats during a fiscal threeyear fiscal stretch that just ended in september. Now, theres no law governing who gets placed on paid leave and when, and it can search a purpose. As is pointed out in the conclusion, they say, federal agencies have the discretion to grant paid administrative leave to employees to help manage their work forces when it is in their discretion to do so. They need to make sure employees are not placed in dangerous circumstances, have access to professional development opportunities, and are able to participate in civic activities during work hours. Republican senator chuck grassley, a lawmaker who ordered this report, sees another angle to this agency discretion. Grassley says, paid leave is an excuse for managers not to manage and put off a decision on what to do with employees accused of misconduct or who blow the whistle or dispute a personnel action. The mentality seems to be out of sight, out of mind, and that is not the way to run the government or act responsibly with tax dollars. Senator grassley also lists lois lerner, the former irs official who got four months of administrative leave as an overall example of why the whole system needs to be changed. All right, peter. Thank you. Well, police are going back into their cold case files, reopening such cases as they learn more about this confessed serial killer and his trail of victims.
