If you remember the irs says it went to unprecedented lengths to try to retrieve two years worth of emails from lois lerner that were supposedly lost in a computer crash. Well now there is word from Judicial Watch, the government watchdog organization, that the government actually has a backup system. The Watchdog Group says a department of justice attorney admits it and said so on friday but the doj says there is no backup system and this is just the email retention policy the irs has in place. Joining us now, ellison barber, staff writer for the Washington Free beacon. So, Judicial Watch is saying they were told on friday, by a department of justice attorney that there is definitely a backup system that should have recorded lois lerners missing emails. Do we know in fact that that actually exists . Well, theoretically we do know they are supposed to. According to the federal records act we know Government Agencies are supposed to be backing up their emails. What the irs said in the past they had a policy where they only kept those emails going back six months and recycled the disk. That is what their policy has been and what they stood on and, what Judicial Watch is saying theyre saying doj attorney has told us they should still have these emails on another backup server and they should be available. Right now we probably dont have enough information to say for sure we know that is true or to dispute that claim entirely either way. Jon but the rest of the story is that the they were told, Judicial Watch was told, yes, the emails exist. They would just be terribly, awfully hard to find. What is interesting, there was a post on a blog called power line, back on june 14th. They had a reader making a similar claim. Were a doj attorney and they sent them a letter the idea that they cant retrieve the emails is laughable because theyre supposed to back up on the things on backup servers every night so they should have the emails. The irs is saying we dont. Our policy we went back six months or to delete it. Who knows. You can never be sure any information getting in this case and it keeps coming and coming. Jon it raises all the questions about government efficiency. If this were a private corporation, if the irs were a private corporation and had employed somebody and paid somebody to build a backup email system and then all of sudden you find you need a backup email and you cant actually get to it, what kind of sense does that make . It doesnt make any sense it was also against the federal law as well to not to report to the National Archives you had a problem where the server has crashed. National archive has said that the irs messed up and they did not report the server crashed when it happens, that violates federal law in itself. Jon they find out after the congressional investigation started, lois lerner, who had a blackberry issued by the irs, had it for a couple of years at that point, she turns in her blackberry after the congressional investigation starts and the blackberry gets wiped clean of all its contents. Anytime we hear new information about this irs case or any new claim, regardless from where it is from, the irs of all people doesnt have a good track record in this case of being together coming. I dont think anyone is inclined to give them the benefit of the doubt. Whether or not what Judicial Watch is saying is accurate we still need more information to figure that out.
