We have Fox Team CoverageChristina Coleman is in Los Angeles Charles watson in atlanta, and kevin corke is joining us from washington. But we begin with david spunt hes reporting from the white house. David. Good evening to you President Trumps legal team fully inteppedz to take this case to the u. S. Supreme court they have ten days from yesterday to do so. President trump tweeting about it today saying that they will appeal if they do appeal to the Supreme Court, it will go to Justice Samuel alito jurisdiction over the court of appeals in pennsylvania and dhoak several things rule on the application himself to give the Trump Campaign more time to argue which could delay the electoral process in pennsylvania and i want to emphasize the word delay it doesnt mean that that would turn anything over as far as electoral votes as biden won pennsylvania by 10 thousands of votes alito could get eight colleagues involve which had is likely to hear what they have to say or he could just nix it altogether. This does not jon, necessarily mean were going see oral arguments in the fashion that we saw 20 years ago of bush versus gore. But i want to read part of this third opinion it was a judge judge Steph Stefano he wrote chf unfairness are serious and calling unelection fair does not make it so and require specific allegations and then proof we have neither here and back to positive news at the white house on the vaccine front, jon if you think about it two weeks from today, people could start getting that vaccine. It is going to start with Health Care Workers this comes after the fda has their emergency use authorization meeting on december 10th thats going to be a key date about two days after that, people will start getting inoculated again with Health Care Workers first. And as far as shipping those vaccines are concerned, United Airlines is playing a major part in the shipping theyre going to be chartering flights from brussels belgium all the way to chicago, and what make it is even more interesting theyre carrying five times the amount of dry ice normally permitted onboard to keep the vaccine at the necessary cold temperature for effectiveness. On thursday, two days ago thanksgiving the president made it clear, he is behind the speed of the Vaccine Development, not president elect joe biden. Dont let him take credit for the vaccines. Because the vaccines were me and i pushed people harder than theyve ever been pushed before. Several Companies Working on Vaccine Development again, go to Health Care Workers first, then the general population, the thought is probably by april or may. Jon. David spungt reporting from the white house. David, thank you. Well joe biden has announced three new members of his coronavirus Advisory Board today as he spends the weekend in beach, delaware. The president elect also expected to announce more cabinet picks in the week ahead. Kevin corke with more on that. Kevin. Reporter jon this is the horse race aspect of any potential transition. People want to know who will land where and what their selection just might mean for the overall policy leanings moving forward now we do know that the former Vice President as already made a few prumpghtive cabinet pix through still concern among some of his key supporters that team is currently constructed soarly lacking in africanamerican representation. South carolina congressman James Clyburn for one is urging his friend to consider more africanamericans for senior posts. Hes supporting, for example, representative marsha of ohio, to be the new agricultural secretary a fierce activity for the Food Stamps Program also advocating for former jacksonville mayor alvin brown to lead the department of housing urban development. Now we do certainly expect the former fed chair janet yellen to be named treasury secretary and a possible Biden Administration that decision could be made public as soon as this coming week. Now if confirmed by the senate, she would be the first woman to hold that position in u. S. History. The 74yearold economist has been credited with helping to steer the economy after the 2007 financial crisis but shes also faced sharp criticism for being too prochina in her policy perspective. Now, the gsa determination that the initial steps for a transition is apparent and is appropriate has been a very big deal for the biden team it doesnt just unlock federal funds. I think perhaps most importantly it also gives them access to the president ial daily briefing. And this part of the world, that is a major step in any transition. Jon. Kevin corke, kevin, thank you. Jon well President Trump will head to georgia next weekend to campaign for republican senators Kelly Loeffler and david perdue ahead of january high stakes elections that could determine which Party Controls the senate. Charles watson is in atlanta with more. Charles. Hi jon democrats and republicans are trying to shore up as much of the vote as possible in georgia ahead of the january fifth Senate Runoff elections and as you mention the president is getting involved with plans to travel to georgia next saturday to hold a rally, and for republicans senators david perdue and kelly love the her two incumbent senators in highly competitive races respectively with democrats at john and rerchgd Rafael Warnock as two sides fight for every vote the pandemic is coming and to focus as senators loeffler highlight their response in a new political ad. We lost about 50 of our patients coming in because they were afraidz senator perdue and loeffler acted real quickly to pass the ppe legislation and 47 billion of business relief in state of georgia. Reporter reverend warnock with a new ad of his appealing to Small Business owners who need relief in the midst of a pandemic. That has crippled the economy you dont give nearly enough resources to people who make things. Reporter and jon, clearly every vote matters to both sides. Both in thes and republicans are stepping their ground game with plans to spend millions of dollars on voter outreach in the runup to runoff elections and when everything is said and done and estimated 260 Million Dollars is expected to be spent on the Senate Runoff races. Jon. Charles watson in atlanta. Charles, thank you. Well medical experts are warning coronavirus testing numbers are likely to be e rat ib over next week or so because fewer people are getting tested during the Holiday Weekend and testing sites have shorter hours. Right now, the u. S. Has more than 13 million positive cases of covid19. And the virus has killed more than 265,000 people in the u. S. Alone. Christina coleman is in los angeles, she has the latest for us. Christina. Health officials worry that a dip in reported infectionings might lead some to believe that theres not really a major surge in covid cases they dont want people to let their guard down and ignore recommended Health Guidelines now u. S. Hospitalizations nationwide dropped below 90,000 infections ending 17day streak of new daily records. Staff shortages and icu beds a major issue straining some hospital systems. We are out of capacity at the hospital and i open two wings for the hospital just for Covid Patients my staff and myself we are exhausted. Ive been working 253 continue, not enough reporter yesterday south dakota latest state to have at least one covid19 death for every 1,000 residents. Other states on that grim list span across the country. From new york to louisiana to the hard hit upper midwest in north dakota here in california sphisk mayor announce that city is going to increase its covid restrictions and have a limited stay at home order in place starting monday and just last night Los Angeles County announced new closures and restrictions as well. And Santa Clara County just producted all Recreational Activities that involve physical contact which is bad news for the nfl. Understand the revised Health Guidelines the San Francisco 49ers cant play home games in their stadium. Also, the nfl is closing all Team Facilities monday and tuesday to in person activities siting nation wide surge in covid cases and Holiday Travel concerns. Now, this doesnt apply to e teams scheduled to play monday and tuesday that includes tuesday nights big matchup between the Baltimore Ravens and Pittsburgh Steelers that gaming was rescheduled for a second time. Players on both teams have tested positive covid19 within this week. All right jon. Jon even professional athletes affected by this pandemic. Christina coleman in los angeles. Thank you. Back to our top story now United Airlines reportedly has begun prepping its plane to airlift shipments of pfizers covid19 vaccine. As President Trump says, not to give joe biden credit for vaccines that could be delivered as soon as next week. Joining us now fox news medical contributor dr. Gennette exciting news if this vaccine indeed is coming. Is there anything that youre hearing that could hold it up . Yes. Hi jon good evening yes this is superexciting im just ecstatic because more lives saves ill see my patients healthier and happier but i dont foresee any hold become or restrictions this test this vaccine has been shown to be 90 over 90 effective. Of all of the thousands of volunteers who participated, there were no severe Adverse Reactions so thats reassuring and just a matter of time, we have the fda, faa we see pfizer theyre all preparing already beginning to start flying out these vaccines to be districted to americans so superexciting. This ultimately is going to mean lives will be saved and hopefully one day well not have to wear masks an worry about social distancing as we are right now. Jon yeah. This vaccine is going to be shipped in small containers we understand thats why the dry ice is Still Necessary to my understanding that typically you get a big rerefrigerated truck thing and sending that out but because of the speed theyre trying to roll out this vaccine theyre going to be shipping in small containers packed with dry ice is that how its beginning to work as you understand it . Yes. Yes, jon for now thats the limiting factor logistics shipping, distribution, storage, this vaccine has if to be stored in very, very cold temperatures. Otherwise it may be inactivated but thats one thing and then on tuesday, the fda is going to also meet to decide who is gong to receive this vaccination as priority . Who is beginning to receive it first . So not only do question of to worry about the distribution in the shipping and storage, we also have to worry about who is going to get it first and then also we need to make sure we have appropriate staff to be able to administer this vaccine to patients also to educate patients of potential side effects and the fact that you have to have a second dose need to come back a month later for second dose. But you know, this is definitely a challenge that were going to be up against. But we come such a long way and it is really going to make a huge difference in protecting americans and saving lives ultimately. The medical community is likely to get among the first of the doses, right . Yes. Most likely it is going to be Health Care Workers fliengt front line workers those with medical conditions, for example, if you have heart disease, kidney disease, cancer, also nursing home patients, and then lets attack a look at who was hit the hardest which population which people were effected the most. And here new york for example we look at black, hispanic, latino they were hilt hardest in new york so theyre just have to look at the data question of so far and thats what the fda is going to determine on tuesday theyre going put out their guidelines for who should get the vaccines first, and theyre also going to district vaccines to based only population size of the state. So all of these logistical, you know, measures are going to be taken into consideration and to decide who, where, when, and to get everybody taken care of. This year alone were going to have about 40 million doses, by march, april of next year, we will have hundreds of millions of more doses for rest of america to be vaccinated. That is very good news. Now normally we bring you on to talk about medicine. But we want to talk a little bit about the intersection of the law as well as politics. New yorks Governor Andrew Cuomo set out these orange and red zones on a map where he said the coronavirus was getting very, very hot. You can tell by the color code which is the hottest. The Supreme Court smacked him down and said no you cant do that it is unconstitutional. Theres a 54 vote here is how the governor reacted. The Supreme Court ruling on the religious gatherings is more of the Supreme Court than anything else. It is irrelevant from any practical impact. Do you have a Different Court . And i think that was the statement that the court was making. We know who he appointed to the court we know their ideology. Didnt say and i should have that his pronouncement said that for instance, you can only have ten people in a church or synagogue if they are inside a red zone. And if theyre in an orange zone its slightly larger than that. The court took a look at his restrictions said some of these churches can hold 500, 700 of thousand people it is ridiculous to restrict them to ten people and unconstitutional. Just your thoughts on all of that as a doctor. Well i look at it for example, jon you know 20 of americans suffer from Mental Illness im talking about anxiety, depression, posttraumatic stress disorder. Were also right now seeing increase in Substance Abuse drug abuse, drug addiction, domestic violence, and this tends to go up higher we see more cases of it during the holidays. So you know, to you restrict qor ship and prayer we may see an exacerbation of disease and other ailments were deal requesting now. I understand yes it is their constitutional right but we have to take into consideration, the Health Implications we have now over 90,000 americans who are hospitalized many of which are in the icu we have nearly 2,000 deaths a day. Hospitals are strained and overwhelmed. Doctors and nurses and technicians you know stretched thin. So question of to look at the Health Safety aspect of this. But yet it is our constitutional right to prayer and to worship and you know, sometimes having that ability thats a reprieve from anxiety and depression that Many American are dealing with so we really need to make sure that we honor the law and look at both sides of the issue because we want to make sure we also stay safe and not putting ourselves in harms way if you are going to go to church and prayer, pray thats great thats great we have to worship but make sure you protect yourself, wear your mask. Keep your distance, a good six to ten feet away. Make sure your church has good ventilation are doors open windows open, thats really point to take these measures until we get that vaccine on the market which is just around the corner thanks to operation warp speed. Well be getting that vaccine help to protect us. That vaccine is going to be very welcomed and it should be here soon. Jon doctor gennette, thank you. Yeah. Thank you. Jon. Jon Iran Supreme Leader vows for death of the top nuclear scientists. Hes blaming israel for the assassination coming up what it means for relations between the u. S. , iran, and other nation it is in the always tense middle east. We cant always keep our distance. But we can still help protect each other this flu season by getting vaccinated. If youre 65 or older, get the superior flu protection of fluzone highdose quadrivalent. Its the only 65 flu vaccine with four times the standard dose. And its free with Medicare Part b. Fluzone highdose quadrivalent isnt for people whove had a severe allergic reaction to any flu vaccine or vaccine component, including eggs or egg products. Tell your Health Care Professional if youve ever experienced severe muscle weakness after receiving a flu shot. People with weakened immune systems, including those receiving therapies that suppress the immune system, may experience lower immune responses. Vaccination may not protect everyone. Side effects include pain, redness, and or swelling where you got the shot, muscle ache, headache, and general discomfort. Other side effects may occur. If youre 65 , dont settle for a standarddose flu shot. Move up to superior flu protection. See your Health Care Provider and ask for fluzone highdose quadrivalent by name. And in the persian gulf Aircraft Carrier uss deployed to region this weekdays before the killing of Iran Top Nuclear scientist, the navy says the deployment was not related to any specific threat but to prepare for troop draw downs in iraq and afghanistan. And now, Iran Supreme Leader is calling for definitive punishment of moas behind killing of top nuclear scientists. State media is calling his death apparent assassination Brian Chilcote with more from london. They would even if they are behind it what is clear issue is is that that was a very well planned military style ambush. Iranian media reports that scientist convoy was going down a highway when first bomb went off. The convoy stopped and at least five gunman popped off opened up on scientist car. Israel has long been a suspected of employing these attacks these kiength of assassinations including one of another scientist almost exactly one decade ago. As funeral got underway Iran Supreme Leader referred to most as a prom innocent and distinguished nuclear and defensive scientist and iran leaders compare them robert the scientist and wont slow their Nuclear Program they maintain is for civilian purpose it is they resumed that program when Trump Administration pulled out of the Iranian Nuclear deal and attack will renew tensions between u. S. And iran in the term and some analysts say it could box in president elect bide incline terms of what he can do when it comes iran and reason for that jon is that that Biden Administration is maybe clear they might want to rejoin the Iran Nuclear Deal you can imagine, however, if iran believes that the United States provided israel with intelligence or support knew about this attack then iran may not want to see that happen. Jon. Ryan chilcote ryan, thank you. And thats a look at some stories from around the globe. The senate gop conference had been meeting for socially distanced lunches in person when the senate is in session. Speaking of georgia ill be going there. I spoke with the two great senators theyre great senators and david people are very disappointed that we were robbed. We were robbed i dont them to be disappointed that will solve itself were finding that was President Trump announcing he will campaign for the really Senate Runoff candidate in georgia next weekend. The crucial runoff races will decide which Party Controls the u. S. Senate. But some republicans are especially concerned that the president s comments about voter fraud could cause people to doubt the election system and just stay home. Now the president is urging his supporters not to boycott the election on january 5th. For more on this, lets bring in official washington correspondent for the Atlanta Journal constitution. This is going to be a wild election tia is there any indication or polling scientific that says republicans are somehow less enthusiastic because of the president s charges of vote or fraud there . We at the ajc dont have polling so i wont say it scientific. But i will say there have been weve done a lot of talking to voters in georgia, Republican Voters in particular there have been Campaign Events including one today where voters themselves are expressing concern about the election process, that is, you know, seeps over from general election to runoff and so no there might not be Scientific Evidence to tell us how widespread it is. But we know it exists. Jon i want to read part of what the secretary of state of georgia brad wrote in the washington post. It was an editorial last weekend about Georgia Election results, and their soundness he writes a failed gubernatorial candidate refuse to accept the outcome of an election she lost by 50,000 votes and is praised for it by media pundits to this day even as they attack a president ial candidate for running the same playbook. Hes talking about Stacey Abrams, obviously, we have some of what she had to say back in 2016. Here is that. Counties under direction of the seacialght secretary of state issued flawed ballots not for first time and not just in this district but this time mistakes clearly altered outcome on the night our count every vote is not about me it is about us. It is about the democracy that we share, this is not a speech of confession. Because confession means to acknowledge and action is right. Jon so theres becoming sort of a tradition to dispute Election Results in georgia. Well jon, i want to clarify that was in 2018 when stacey i did say that. Jon my mic was not open when i said so. But yeah 2018 go ahead. And youre right. The difference is if Stacey Abrams play book for how to raise questions about voter access, she did so in a way that has not been replicated but Trump Campaign so far. Stacey abrams brought lawsuit and challenges that resulted in change. It resulted in the state and county saying you know what youre making some good points and were going to it is not necessarily going to change outcome of the election. But were going use that and make some changes moving forward. So its its the playbook is a little bit different because so far President Trump has not saying that he has a point here. Theyre saying you lack evidence and there is no what is youre saying not existing. Right and there was very little change in the tallies between vote counts, one and two it doesnt seem likely that theres going to be much of a change in vote count number three. Absolutely and thats the other difference is that you know, there werent recount and challenges of the outcome of the election once it became clear and again, in georgia, the outcome of the general election has become clear after two counts in a third one that is currently underway we do not expect that to change. And joe biden is ahead by about 12,000 votes in georgia. Jon obviously, its beginning to be a very critical to both parties to get an accurate count of the vote. This time around on january 5th are we expecting any problems any hiccups you know just based on the fact that the whole election machinery has been so tied up during not only the november third elections but then recount . Well, there there are counties who are saying that theres a labor issue, there is an equipment issue as far as timing because their deadline is wednesday for the third recount. And some counties including county where atlanta resides, have other runoffs that are currently underway we have a runoff on tuesday december 1st. So counties are stretched thin. Theyre workers as you know have been have not had days off many days off. You know, for, you know, months because we also had early voting that started in october. So it is more of the labor issue, and just having there arent enough machines to go around to make that counting go faster but its not that we think the machines themselves or the counting is fallible or not going to be accurate it is just about giving them the time and resources to get it done to time. Lets hope we get a clear and indisputable result from the two elections. Tia mitchell washington correspondent for the Atlanta Journal constitution. Tia, thank you. Well what appears to be the assassination of a top iranian scientist is raising questions now about how the Biden Administration will handle iran. Will it look to reenter the 2015 nuclear deal. The question arises as to what the bide only team will be doing. Does this make it impossible or difficult to put this Iran Nuclear Deal back in the bottle can the genie be put back in but clearly this is going to make it somewhat more difficult. Thats house Arm Committee member john admits that apparent assassination of Iran Top Nuclear scientist could complicate biden plans to revive former president obamas 2015 nuclear deal. Iran agreed to reduce its uranium stockpile under that agreement but deal was largely seen as ineffective since it failed to curb nuclear inhibitions and tabling straw teenage ition analyst general. General, it is good to have you on. Thanks for being with us this evening. Certainly. So iran is hopping mad about assassination what appears to be the scientist israel has not claimed responsibility, iran seems to be suggesting that israel did it. There are fears that iran could lash out at either israel or the United States. Would you expect that . Either one . Well, certainly this likely going to be some rep abusing not only for this assassination attack but also on qaasim soleimani a little less than a year ago and no effective retribution for that i think theyve been on pause waiting to see outcome of the u. S. Election, and waiting to see what their options are before they begin any escalation which could turn quite negative for them. But this is widely speculated to be the and so our viewers on stand they quite remarkably operate continuously and quite effectively inside iran and inside the capital city they are the most its the most successful foreign penetration of opposing power that im aware of. And this is a pattern of their behavior that has been going on for some time in terms of assassinations and also jon, for the last year inside iran theres been dozens of explosions at plants, factories and other facilities that have been unexplained. The iranian say theyre accidents but when you add it up evidence doesnt support it and two of them one was at ton enrich uranium plant and a missile production facility. Widely speculate israelis are conducting massive Espionage Campaign along with Iranian Resistance groups to do that. You know, and our audience is can ask what is all about fuss about why such a determines . If you think about iran, iran is a threat to the United States certainly. They peeled hungs of us and blown up our embassies and barracks through the years but not a threat to the survival of the United States when you look at israel, iran with Nuclear Weapons and missiles that deliver them is absolutely a bona fide exposensual threat to israel that is why they have this threat to israel and they pull out stops short of war to try to slow down the growth and development of these Nuclear Weapons thats what i think this is about and yes i think so. Theyre likely signaling the incoming Biden Administration that we really have problems here with the iranians and much worse than when you were dealing with them in 2015 when you formed a socalled nuclear deal. John brennan cia director under president obama does not like what happened outside tehran. He writes, this was a criminal act and highly reckless it risks lethal retaliation and new round of regional conflict. Iranian leaders would be wise to wait for leadership on global stage to row cyst urge to respond against perceived culprit. Sounds like he wants the u. S. Back in the iran deal. Would you advise that . First of all, that issue with two of the sames there it is the arrogance that comes out of america at times when were so dismissive of what our allies are really dealing with. What they deal with every single day. In terms of a threat so here we have the iranians that every single year for four years stated they want to the destroy the state of israel they want Nuclear Weapons and missiles that deliver them as means and they openly talk about it. But were just dismissing that while were not going to take that seriously israeli shouldnt be doing anything that could potentially lead to a lethal reaction. Well lets put some other common sense facts on the table. With the knew new administration coming to power in United States does anyone seriously believe that iranian are going to respond so strongly that were going walk up to escalation line up to war hardly. Lets use our head a little bit here and keep our emotions in our pocket. As you pointed out iranians responsible for such a large percentage of the death of our service men and women during the iraq war especially. General, fox news strategic analyst good to have you on.
