Opening arguments in the Senate Impeachment trial of donald trump will begin in 2 weeks. The delay, part of a deal struck by senate leaders, allowing time for mr. Trumps legal team to prepare a defense. Time also for the senate to confirm some of President Bidens cabinet nominees and time to take up covid relief package. In a moment we will talk about the trial, the biden agenda and the split inside the gop with republican senators mitt romney and marco rubio. But first, mike emanuel reports on what we know on the timing and structure of the second trump trial in the senate. Mike house law makers will deliver an article of impeachment to the senate accusing former President Trump of incitement of insurrection monday evening. But the substance of the trial wont get started until 2 weeks later february 9th, allowing time for the senate to confirm more Biden Cabinet members. The more time we have to get up and running, the better. Mike still the new majority leader is making the case a trial is necessary. Healing and unity will only come if theres truth and accountability. And that is what this trial will provide. Mike conviction in the senate would appear unlikely as 17 republicans are needed to join with democrats and many in the gop now argue theres no reason for a trial after President Trump has left office. I think its office post president ial impeachment never occurred in the country for a season and unconstitutional. Theres a need for schumer and republican Mitch Mcconnell to share power agreement since the senate is split 50 50. Some on the left say filibuster should be scrapped, mcconnell is fight to go saver it. We will continue to request that democrat colleagues reaffirm the standing rule to have senate which they have been happy to use on many occasions. Chris senator, do you support holding this impeachment trial and what do you think the rules should be on the length of the trial and whether or not to call witnesses . Senator well, we are certainly going to have a trial. I wish that werent necessary but the president s conduct with regards to the call, the secretary of state raffedburger in georgia and insurrection that lead to attack on the capitol calls for a trial and if we are going to have unity in our country, i think its important to recognize the need for accountability, for truth and justice. So i think there will be a trial and i hope it goes as quickly as possible, but thats up to the counsel on both sides. Chris you were the only Senate Republican to vote to convict and remove the president the first time, of course, now as a juror again im sure you want to hear the evidence, but i want to put up what you said on january 6th, the day that the mob attacked the u. S. Capitol. Here is what you said. We gathered today due to a selfish mans injured pride, what happened here today was an insurrection incited by the president of the United States. Senator, it sure sounds like youre going to vote to convict. Senator well, theres no question that the article of impeachment sent over by the house suggest impeachable conduct but we have not yet heard either from the prosecution or from the defense. I will get a chance to hear from them and i will do my best as a senate juror to apply justice as well as i can understand it. Chris you also im sure have read that there was a report over the weekend that President Trump was talking seriously at one point in the december about firing the acting attorney general of the United States putting in a new acting attorney general who supported the idea of trying to get georgia to overturn its election results. Do you think that should be part of the trial . Senator well, that would be up to the prosecutors, of course, but its pretty clear that over the last year or so there has been an effort to corrupt the election in the United States and it was not by President Biden, it was by President Trump. And that corruption we saw with regards to the conduct in ukraine as well as the call to secretary of state raffensperger. This is something that has to be considered and resolved. Chris there is talk among some Senate Republicans about ending this trial on a procedural ground, whether its even constitutional to try a president who has already left office and not even get to the issue of President Trumps innocence or guilt. How would you feel about that, trying to end the trial on the constitutional issue . Senator well, the democrats have the majority in the senate and i doubt that they would go along with the move. At the same time, if you look at the preponderance of the legal opinion, not people that are partisan but scholars over the years over impeachment trial can and should be held after someone has left office, the preponderance of opinion is that, in fact, yes, an impeachment trial is appropriate after someone leaves office and thats something i condition cure with. But, again, i will listen to the arguments that are made by counsel on both sides to make a final determination. Chris in his inaugural address on wednesday, President Biden made a call for unity. Here is some of that. We must end this uncivil war that pits red against blue, rural versus urban, conservative versus liberal. Chris now some of your republican colleagues including marco rubio who will be on in the next segment say that President Biden has already breached that call for unity with some of his actions, executive actions, legislative agenda in the opening days. Do you see an inherent conflict between calling for unity and a new president pursuing his agenda . Senator well, i think it would be unrealistic to assume that that democrats and republicans are going to see eye to eye on every issue. Theyre going to be differences of opinion. Thats expected. But at the same time, i think its appropriate for uses to have unity of purpose, unity of heart, recognition that we expect each other and treat each other with commonty and thats something that President Biden wants to see. I think there are some actions that the president has taken that are going to lead to anger and division. For instance, saying we will not allow further leases on Government Land for oil and gas. That hurts rural communities, stopping the Keystone Pipeline, that puts a lot of people out of work. Those people are going to be understandably angry. I think you have to be pretty careful even recognizing the bounds of disagreement to to not do things that incite a great deal of unnecessary anger. Chris let me ask you about another pressing issue, maybe the most single pressing issue and thats covid. You have said that after the Congress Passed a 900 billiondollar covid relief package just last month that you dont have much interest in passing another. Biden rescue plan for 1. 9 trillion, more than double, what you just passed. Are there some parts of the biden rescue plan that you could support . Senator well, i think thats very possible. Last time around a Bipartisan Coalition came together to look at the needs of the American People and came up with 900 billiondollar plus plan. We will listen to representatives of the white house today to understand their perspective, but if there are place that is we missed in our proposal, we are happy to pick that up. The president wants to extend unemployment benefits, if people are still unemployed. Thats certainly something that we would look. We were of the view that states needed help, rescue for state and localities that may have suffered reduction in revenues, thats appropriate. But the total figure is pretty shocking, if you will. And the idea that we need a stimulus is a little hard to understand because im one of those thats convinced, if you want to see this economy get going, we have to get beyond covid. If we get beyond covid, i believe that the economy will come roaring back and spending and borrowing trillions of dollars from the chinese among others is not necessarily the best thing we can do to get our economy to be strong long term. Chris finally, senator, you were flying from utah to dc on january 5th, the day before the attack on the capitol when some people who dont particularly like your stand, particularly when it comes to donald trump went after you. Here is an example of that. When trump gets reelected, youre getting primaried. [laughter] laugh it up. Im laughing at you. Chris where is the gop now, senator . What is the balance between the the traditional republicans and the trump republicans and what do you think is the key to where your party goes over the next few years . Senator first, i note that there are going to be new faces that will be the spokes people for our party and their own vision and that could be larry hogan, that can be charlie baker, it could be marco rubio who will be on in a moment or ben sasse, theyll be new faces. President trump, of course, will consider to have influence, but i think our party is going to return to some of our more fundamental principles which is fiscal responsibility, believing in the importance of character, standing with our allies and pushing back against people like kim jong un and vladimir putin. But i also think its important to recognize a new strain in our party thats critical and thats to communicate more effectively to working men and women in our country that our policies are best designed to help them and to give them and their families a better future. Joining us now from florida, senator marco rubio and senator, welcome back to fox news sunday. Senator thanks, chris. Chris you have come out strongly against the idea of holding this impeachment trial but now it is going to happen. What do you think the rules should be about the length of the trial and whether or not to allow witnesses to be called . Senator well, first of all, i think the trial is stupid. I think its counterproductive. We already have a flaming fire in this country and its like taking a bunch of gasoline and pouring it on the fire. Second, i look back at the time, for example, Richard Nixon who clearly committed crimes and wrongdoing and in hindsight we would all agree that president s pardon was important to move forward and history held Richard Nixon quite accountable for what he did as a result. In terms of the rules, the president is entitled to due process. Hes entitled to have a defense. Hes entitled to present testimony and evidence if necessary and the house doesnt have much of a record of witnesses and so forth because they frankly rammed it through very quickly. So i think obviously fairness is important no matter who it is we are talking about but i just want to repeat. I think this is going to be really bad for the country. Its going to take us, not just keep us from focusing on really important things but also just going to stir it up even more and make it harder to get things done moving forward. Chris Senate Republican leader Mitch Mcconnell spoke about Donald Trumps responsibility this week. I want to play part of what he said. Take a look. The mob was fed lies. They were provoked by the president and other powerful people. And they tried to use fear and violence to stop a specific proceeding of the first branch of the federal government which they did not like. Chris is senator mcconnell wrong, sir . Senator i think the president bears responsibility for some of what happened. It was most certainly a foreseeable consequence of everything that was going on. And i think thats widely understood and maybe even better understood with the perspective of time. I think thats separate of the notion of lets revisit this all and stir it up again. Its not the stories are still going to be written, theres criminal justice investigations that will continue to move forward. All the things are still going to happen. All im arguing if you have really important things to work on, you really want to bring the country together and remember once again how we can get things done, it isnt by uniformity on all the issues, its about working through a process that allows people with different points of view to debate all of this and get a solution to the country. All that, we are will jump right back into what weve been going through for the last 5 years and stirring it up again with the trial. Its just going to be bad for the country. It really is. Chris so let me ask you the same question i just asked senator romney, would you support ending this trial if you can on procedural grounds that its unconstitutional the try a president who has left Office Without ever getting to the issue of the guilt or innocence of donald trump . Senator yeah, the first chance i get to end the trial, i will do it. If you want to hold people accountable, theres others way to do it including the president. The perspective of history and even now as people are learning more about all of this. Its really bad when you talk about situations like this, this is a political process and ultimately it is a political process thats going to inject things into our public discourse, into our debates thats going to make it harder to get important things done and its just going to continue to fuel these divisions that paralyzed the country and turn into people that hate each other. Chris i want to ask you one last question and then we will move on. What about the argument that it would be useful from the point of view of people who think that what the president did was wrong to ban him from seeking Public Office again which would be one of the results of holding this trial . Senator i think thats an arrogant statement for anyone to make. Voters get to decide that. Who are we to tell voters who they can vote for in the future . Chris okay. I talked with senator romney about joe bidens call for unity and you have spoken sharply already about bidens first days in office. I want to put up a tweet that you you sent out on friday. So far biden has talked talked like a centrist, but governed from the radical left. So, senator rubio, is talk from unity from this white house is dead already . Accept sen unity and ideology are two separate things. Unity is uniformity. Thats ridiculous. We are a country that the elections prove it. We have people with different opinions. We settle that argument through a process in the republic and we elect people to have debates and mover forward. Thats separate from portraying yourself as a centrist. The first thing you do is get thousands of people fired by a stroke of the pen by ending Keystone Pipeline and jump on the issue of gender when it comes to support sports and who can use what bathrooms and so forth and immigration order, i asked for clarification. I think it could be read to say that someone who has committed a very serious crime, raped or sexually abused a minor, as long as they were released from prison before january, i understand joe biden comes from the left of center, i understand all of that. Some of these are farleft of center ideas. My point was he may use the language, the demeanor of a centrist but so far the policies dont seem to represent that and i think thats an important thing to notice as we get into debates on different issues. Chris i want to pick up on the issue of immigration. President biden signed a number of executive actions on immigration in the first few days. He has introduced legislation that would give 11 Million People a path to citizenship over the next 8 years. You, of course, back in 2013 were a leader on the issue of immigration reform. You had a plan that would lead to a path to citizenship as i remember in 13 years but youre talking about the biden plan so far on immigration as coming right up close to amnesty, is that fair . Senator yeah, thats very different from what we talked about back then. Back then we also talked about 25, 30 billion for Border Security including fencing and so forth. It had those sorts of provisions and talking about reforming immigration season so it was more meritbase, meaning, you bring people on the basis on what they can do for a living and not primarily if they have family members being here. Thats not what hes talking about. Hes basically talking simply and almost entirely about what to do with people that are here with unlawful status which i think the majority of americans believe we need to do something but you can only do something after youve gotten place immigration reforms that allow you to secure the border and stop illegal immigration, otherwise, doing something is going to encourage more people to come. We saw a very brief example just the fact that he was elected incentivized some of the Trafficking Networks to try to push people to the United States through one of the caravans. Thats a reality and so, again, not to mention that back when we did back in 2013, we werent in the midst of a pandemic which should be the focus outside of National Security and i think its related to National Security. Chris is i want to switch subjects on you now. Is the gop still the party of trump for the foreseeable future and do you see it at some point over the next 3 or 4 years moving away from President Trump . Senator the gop is the party that nominated donald trump and the reason why it did and ultimately got him elected and got 75 million votes is because you have tens of millions of americans that feel this economy isnt working for people like them, that feel socially displaced even like strangers in their own country and who believe that both of the parties at least traditionally and all of politics doesnt understand or care about any of this, they dont matter to people. Donald trump did not create those things. He got elected because of those things, he got 75 million votes because of those things and those factors, those feelings that are out there among tens of millions of americans didnt leave when he left on wednesday. I hope we can do it in a way that keeps if people who believe we are fighting for them and brings back some of the people that perhaps didnt vote for republicans or didnt vote for the president because they may not like, you know, the way it was said or the way it was done. I think thats quite possible and i think thats the future of the Republican Party because frankly on that i think depends the future of the country. Chris finally, youre up for reelection in 2022 and there has been talk as im sure you know about the possibility that ivanka trump might run against you in a republican primary in florida in 2022. How seriously do you take ivanka trump as a potential opponent . Senator well, i dont really get into the games of washington other than to tell you when you decide to run for a election in a state like florida, be prepared for a competitive race. You run it like a competitive race. So thats what im prepare to go run, very competitive race against the tough opponent. Im sure the democrats will have someone who is going to be wellfunded, may even outraise me the way they raised money the last time because they got innovative ways to raise money. If youre going to run for florida senate, if you run statewide in the state of florida, you will have a tough race and that might include a primary. Thats the right. The senate seat doesnt belong to me. If i want to be back in the u. S. Senate i have to earn that every six years. Chris and ivanka trump, whats the feeling, the water is fine, jump on in . Senator i like ivanka, we worked very well together on issues and anybody can decide to run if they want to. Im not entitled to anything. I have to earn my way and so forth. I would point to the last 4 years working with President Trump in the white house and i can tell you its been the most productive period of u. S. Senator in florida, the list is long and extensive. I got more done than anybody, as much as anybody in the u. S. Senate. One of the bills the president brags about the most is va accountability bill, thats my bill that i had been working on and when he got elected we were able to get it done. The child tax credit, the ppp program that saves saved tens of thousands of people. Chris senator, you sound like youre in campaign form. Please come back. Senator absolutely. Thank you. Joining us now doctor Rochelle Walensky the new director for Centers Disease control and prevention. Doctor, i want to start with the president s call this week, take a look. Were in a National Emergency. We need to act like were in a National Emergency. So weve got to move with everything that weve got. Chris mr. Biden promises 100 million doses in the first 100 days and you have said that the administration is sticking without promise. But doctor there are experts that say at that pace, 100 million doses in 100 days, we will not contain the virus here in the United States until 2022. Until sometime next year. Dont have to go faster than that . Dr. Rochelle good morning, yes we have to go faster we are limited by numerous constraints. The first is a supply and were working closely with manufacturers so that does not become a constraint. We also need to make sure that the supply gets to pharmacies and that we have enough vaccinated places and outreach to do the vaccination. I think that the supply is going to be the most limiting constraint early on and were really hoping that after the first 100 days we will have much more production not just for the two vaccines but we are hopeful will have another one from Johnson Johnson in the weeks ahead and perhaps a fourth coming down the pipeline. We are really hoping we will have more vaccines and that will increase the pace at which we can do the vaccination. Chris i want to get to the supply concerns in a moment. Lets talk about the stakes first. We are already seeing variance of the virus from the uk, from brazil, from south africa that we are being told are more readily transmissible, deadlier and more resistant to the virus, arent we in a race against time to vaccinate everybody before we get a variant that actually blocks the vaccine and makes it impossible for the vaccine to actually protect people . Dr. Rochelle youre absolutely right, we are scaling up our surveillance of these in the study of these and cross Agency Collaborations with the nih, the department of defense, the fda, with the cdc so we can monitor these variants as well as monitoring how the impact of the variance on vaccines and as well on our therapeutics. Youre absolutely right what this tells us we need to get more vaccines out there and people offering the vaccine have the opportunity to roll up their sleeves and take it. Chris is that fair to call it a race against time . To make sure that you vaccinate people before we get a strain that the vaccine wont work on. Dr. Rochelle i would say weve been in a race all along the more by race that is out there and replicating the more likely will have mutations in variance. Not only do we need to vaccinate but we need people to wear masks, we need all these other litigation strategies so we can decrease the amount of virus that is circulating and decrease the amount of variance out there. Chris i want to talk about the supplyside issue, yesterday andrew cuomo the governor of new york state said that state has already run out of its initial run of doses, are we going to get into a situation lets say by the end of march with the initial run 200 million doses from pfizer and moderna are gone, you dont have enough from Johnson Johnson or other people and were really in the supply crunch by the end of march . Dr. Rochelle from the data that ive seen so far the current supply crunch is the one i most worried about every indication over time itll get more and more vaccines. We certainly cannot predict any of the obstacles that would come our way. But from the data ive seen so far im hopeful we will actually get an increase in amount of supply not a stagnating one. Chris is there a specific point in the whole run that your particular worried about in the next two or three months that you think the first doses wouldve run out and we will have geared up for a second run . Dr. Rochelle were carefully monitoring the second doses that will be required in the time ahead so people who have gotten the first dose will have access to the second dose i am hopeful that is not going to be the case but what youre commenting on is absolutely true we dont have as many doses as we would like now for states like new york and other states that are claiming to have run out of vaccine and right now is actually the Pressure Point that i am feeling and by the end of march i hope our production has scaled up dramatically and we actually have way more supply than we do right now. Chris then there is distribution the new white house covid coordinator says what you inherited from the Trump Administration is much worse than any of you couldve imagined, what is the distribution problem and how you fix it . Dr. Rochelle i would say one of the biggest problems right now i cant tell you how much vaccine we have and if i cant tell it to you then i cannot tell it to the governors and i cannot tell it to the state health officials. If they dont know how much vaccine theyre getting not just this week or next week or the week after they cannot plan and not figure how many sites to rollout, they cannot figure how many vaccinate as they need and how many appointments to make for the public. If they overshoot it, then we have vaccine on the shelf and if they under shoot it we have people and people who appointment are canceled and either wave of challenges. And the fact that we dont know today five days into this a administration and weeks into planning how much vaccine that we have, that gives you a sense of what the challenge we have been left with. Chris one sign of the crunch that you are facing in the short term is the cdc put out guidelines this weekend the under quote exceptional circumstances. You say it would be okay to mix doses, to use one vaccine for the first dose and the other vaccine moderna advisor for the second dose and you also said under these up sectional circumstances instead of the 3 d take the two doses as far as six weeks, the first dose from the second dose. But doctor Rochelle Walensky you dont have any clinical trials, you dont have any science to back that up . Dr. Rochelle i want to be very Crystal Clear those are not the recommendation of the cdc. The cdc recommends that you follow 21 days for pfizer, 28 days for moderna and you stick to the same one. But the cdc is a place where people come to for guidance and we know that not everyone is going to receive a second dose of the 28 days in the 21 days and some people will likely have forgotten which dose in which vaccine that they got and they will come to us and say what do you do now. And that is the purpose of that guidance. To say in those exceptional Search Engine situations where we cannot follow the cdc guidance, what do we do now, that is the purpose of our statement. Chris finally i have a minute left, the cdc has traditionally been and over the years i have talked to people in your position during various the swine flu, ebola, the head of the cdc has been there lead agency and things like this pandemic. But you write this week in the New York Times and i want to put on the screen, you say you will have to work very hard to restore public trust in the cdc which has been undermined over the last year, how much damage did the Trump Administration do to the standard of the cdc and how do you fix that . Dr. Rochelle i would say the people of the cdc have been muzzled, the science has not always been followed. The great news for me and the agency is those exceptional publichealth servants and scientists are still there. What my job is to make sure that their voices heard, their science is heard and we again become a trusted authority for Public Health around the world. The second thing we have learned if theres any doubt the coronavirus overshadows everything, an awful lot being banked on the 1. 9 trillion Coronavirus Relief and stimulus package that the president is putting forward and a big event today when the head of a National Economic Council Talks to senators about that year end senator romney refer to that a few minutes ago and the great question whether the center and political unity that joe biden has talked about can really hold that is an open question and i thought it was interesting how aggressive senator rubio has been and on the show about questioning what the senate is really holding. Chris jason, do you think the president will get anywhere with Senate Republicans on the 1. 9 trillion covid rescue package and if they block that, what do you think of the chances that either on that legislation or Something Else that Senate Democrats will eventually decide we will kill the filibuster and run the senate on a onevote majority. Jason i think the package will pass on one form and parts of it should pass, particular the part dealing with covid and vaccination programs and funding those sorts of things and more testing and so forth. My problem with the package has to do with some of the things that will be harmful actually take the 15dollar federal minimum wage proposal, restaurants have been one of the hardest hit industries over the past year and they rely on low skilled workers and a 15 minimum wage will make it more difficult for them to find workers because of low skilled workers will be priced out of the labor force so i dont think Something Like that is helpful or extending unappointed benefits or supplementing unappointed benefits that discourage people from returning to work because are being paid more to stay at home. Some of this i dont think deserves to pass but some of it should and some of it will. I dont think killing the filibuster would be a very smart idea for democrats, they would seem to be making the mistake of thinking they will be in control of the senate and definitely and of course that is not the case and you have some senators mark kelli in arizona, Raphael Warnock in georgia that will be up in two years and this is still a very obviously closely divided senate, i dont think they want to jump off the bridge. Chris donna, your thoughts on the prospects for the covid rescue plan, while jason said he thinks some will pass he was talking about a lot that he thinks Senate Republicans will not go for, what do you think about the prospects for that and eventually because you know the Senate Republicans are going to block some legislation and some of the stuff that joe biden is talking about as a National Emergency and at a certain point do think Senate Democrats are just not going to be able to restrain themselves and try to kill the filibuster. Donna first of all i agree with jason i think there is so much good in the 1. 9 trillion package that the country is really anxious for, the fact that we are still behind on testing in behind him shooting the vaccine and if you look across the country today before eight in the morning many states rolled out their opening and by 9 00 oclock there is no way you could get a vaccine. I think this package will go a long way and healing some of the pain we are feeling and the people are still struggling and there are many businesses that did not get anything in the last two rounds, this is a credible package in joe biden was elected to help lead us out of this pandemic and hes going to continue to fight for that and i also believe the senate, at least Senate Democrats do not wish to see the same replay as a witness in 2009 where basically one person can block all of the good ideas that come forward so democrats will have to continue to keep the option on the table to eliminate the filibuster, it was never intended for us to have majority in order to get things done and i think they need to look at it. Chris and then theres a second impeachment trial, the second impeachment trial of donald trump, he was assumed to be Senate Majority leader Chuck Schumer talking about that this week. Presentation by the parties will commence the week of february the eighth, the januare capital incited by Donald J Trump was a day none of us will ever forget. Chris gerry, we heard two different opinions from romney and rubio about whether the trial is something that you have to do or whether its to be terribly destructive to the country and frankly disruptive to joe bidens first days in his agenda in congress, waiting come down on that and is there any chance that 17 Senate Republicans will join the democrats to convict donald trump. What im really struck by is the fact that the President Joe Biden has never expressed much enthusiasm for the impeachment trial there not oppose but i think they realize the potential to be a huge distraction and something that slows down the stuff we were talking about a minute ago the coronavirus package and something we havent mentioned nomination and confirmation of Biden Cabinet picks those will be slowed down by the impeachment trial as well and that does not make anybody in the new administration happy i think there is a decided lack of enthusiasm and is going to happen and move forward and one of the side effects that is ironic its going to have the effect of giving donald trump something he craves which is more tension and more oxygen and that does not please a lot of republicans either. Chris what do you think of the chances of 17. Gerald i think the chances are very slim i cannot imagine 17 republicans moving i think you will have some but i would be stunned if you had 17. Chris jason, what do you see this trial doing to the start of the biden presidency . Jason i think i agree with gerry it seems like the democrats want to get this done quickly and get on with their agenda, i think the republicans, ill be keeping my eye on Mitch Mcconnell, i think he made noises about conviction so im keeping an eye on him i think if he is in favor you will see others follow and i think donald trump is quite fortunate that the Impeachment Vote was anonymous and secret because several congressmen have said if it hadnt been there wouldve been far more than ten republicans voting for impeachment. But the Republican Party has to decide whether they want to make a clean break from donald trump and make sure he cannot run for president as a republican again or start as a third party and run athe top of the ticket. Thats part of whats on the table. Chris 30 seconds donna, do you think there is any chance that the senate votes to convict donald trump . Donna i think its hard to get 17 republicans but on the other hand Mitch Mcconnell when he took to the floor on january 19 i was surprised by his comments, it is important that they hold this vote and hold the former president responsible.
