The republicans had the votes and they won but is there legal justification, a legal reason for not calling evidence when there is substantial new evidence . As i argued to the senate if somebody were accused of the crime of abuse of power or dishonesty that is not a crime, what you do, you make a motion to dismiss. The other side seas we want to introduce evidence. No, you cant introduce evidence if there is no legitimate indictment. Here the articles of impeachment did not charge an Impeachable Offense. So the right answer is to dismiss it and cut it off right there. No amount of witnesses could have changed that conclusion. Mike okay. But the Top Democrats in congress, nancy pelosi in the house, Chuck Schumer in the senate say that the failure to call witnesses will put a taint on any acquittal. Listen. Sure. This country is headed towards the greatest coverup since watergate. He will not be acquitted. You cant be acquitted if you dont have a trial. Of course you can be acquitted if you dont have a trial if they dont charge with you a legitimate crime. It is failure of nancy pelosi and others because they didnt charge Impeachable Offense. Mike they say he wont be acquitted you didnt have witnesses, dismissed it before you got to hear what the facts were. In the criminal context that would be called a victory a great victory. Here if they havent charged an offense maybe he hasnt been acquitted but he also hasnt been charged. He exactly the same situation he would have been in done the right thing and not impeached him at all. Mike you created quite a controversy. I did. Mike with something you said in the senate trial. Here is what you said and here is some of the blowback. If a president does something which he believes will help him get elected in the Public Interest, that cannot be the kind of quid pro quo that results in impeachment. If you can identify something as president that is in your public, your political interest, say that is the national interests, then all bets are off. Mike here is what i dont understand. Right. Mike you have made it clear, you and i went at it last week on the question of you say to be an Impeachable Offense it has got to be a crime. Criminallike behavior, akin to treason and bribery. That is what the constitution says, treason, bribery, or other high crimes and misdemeanors. Why get into this question of whether or not the president thinks his reelection is in the Public Interest . Because you seem to be implying that somehow that gets him a extra level of immunity. No, it doesnt. I was asked the question by a senator. The question was, does quid pro quo matter . My answer is it matters if what the president did is illegal or wrong but if the president did something completely lawful, the fact part of his motivation may have been to help his election cannot be the quid pro quo. That is what i said. I never said, i dont mean and i dont believe that is president can do anything if he thinks in his national interest. I supported impeachment of richard nixon. He thought the five crimes he committed were all in national interests. These folks have totally distorted, quite deliberately because they saw that i was having an impact on some of the senators. So they deliberately distorted what i said and said, oh, even if it is criminal, if the president thinks it is in the best interest it cant be impeachable sense. Nonsense. I never said that. Wall street journal says i never said it. The New York Times says i never said it. The fact that schumer and schiff and cnn say i said it doesnt make it true. Mike but again, i dont even know why intent is and i issue and why you got into it. Because i was asked. Mike but my point the activity what you say is the key. If it is criminal or criminallike activity it can be impeachable. If it is not criminal activity doesnt matter what the reason is. Example i gave the president says im not giving you money ukraine unless you give me a Million Dollar kickback. Of course that is criminal and of course he goes to jail. Abraham lincoln sent troops home to vote for republicans in the election . Was that impeachable, no. Mike wouldnt matter what his motive was. It doesnt matter to me. But it matters to schiff and to people on the other side. They were focusing on motive. I was responding to them. I didnt put that in my original speech because youre right, it is not relevant to my argument but i was on the floor to respond to constitutional arguments. I was asked the question, it was deliberately wrenched out of context. Mike you seem pretty upset about it . I was upset about that, because it hurt me. People think i actually believe a president like nixon can do anything he wants. That is exactly the opposite of what i have been teaching arguing, civil libertarian believing in for 50 years. How dare they deliberately and willfully distort my position and then not give me the opportunity to respond. Mike forget impeachment for a moment. Im asking you this, maybe you will agree to do it or not but a thought experiment, Alan Dershowitz as citizen, do you find it troubling, problematic that a president would link in any way, forget his motive, im not saying its criminal, his support for an ally and even military aid for an ally to investigating his political opponent. And on election day as a citizen i will allow that to enter into my decision who to vote for but its not an Impeachable Offense. I was there to argue constitutional issue. Not to tell people who to vote for president. Im a liberal democrat. Mike will you tell me whether you find it troubling . Any citizen were find troubling if it were proved. That would be troubling. Troubling is not the criteria for impeachment. Mike im not asking about impeachment. According to schiff unless you do the right thing youre i will peachable. Doing something troubling is impeachable. That is mike you think linking aid to ally to investigating your political opponents if a president linked aid to ally to personal benefit would not be in the Public Interest. That would be reason for me not to vote to him. Mike when you say not to vote for him. That is not Public Interest. The fact it would eliminate corruption in ukraine. I represented the former president of ukraine. I know a lot of corruption about ukraine. Mike you seem to be saying right here, professor, what donald trump did was wrong and troubling but it wasnt impeachable. What you said if a president did it solely for his own interest would it be mike i never used the word solely zoo im using it. Mike what different does it make if he did it partially. Every president has a eye on electability. Mike we are not talking about electability. Investigating your political rivals. If a president says mixed motives, 95 of the motive is ii want to get corruption. That would not be impeachable that would not be corruption. When you have mixed motives you cant turn innocent conduct into criminal conduct. That was my point. To say the least. Mike o. J. Simpson, mike tyson, jeffrey epstein. I understand they, the principle of everyone has a right to counsel, to defense. Right. Mike but why would you spend your time, why would you spend your talents defending such unsavory characters . Because the constitution requires that the most despised people, the most controversial people, must get a defense. I litigated cases in the soviet union and in other places where people who were despised by the public and by the government couldnt get a lawyer and i decided after being in the soviet union i would never allow Public Opinion to impact my decision. I would have been mike how about your personal opinion . Some people say, you know, they have a right to a defense i just dont want to be part of it . Because i was a professor for 50 years i have no excuse for not taking cases. I want to take cases where no one is willing to dot case. I want to be part of controversial cases. This case i didnt do it for that reason. Mike im not talking about this case. I thought the constitution was, absolutely compromised. Mike in these other cases if you end up, your talents you end up getting them off . I hope so. I never want to take a case where i dont win. I won a lot of cases because the law or the facts were on my side. Often the facts are against me but the law is on my side. Look to me my hero was john adams, standing up for the people, the murders in the boston massacre and accepting all the aprebium, that was heaped on him, i want to show the king of england, we in america everyone is entitled to a defense. He defended them and almost destroyed his career and personal life. He did the right thing. I want to put up the numbers. Back in august you were sitting at 3 and you stayed there quite a while, in reeds weeks you surged him 10 , closing on the top tier. What is going on and where are you going to finish monday night. It is an open game to go use your super bowl analogy. Congratulations to have the super bowl on fox. It could only be better if the vikings were in it. Im excited to watch the game and whats been happening here a lot of people are still making their decisions. We were out there yesterday, from the quad cities to sioux city, to beaver dale, every place we went, huge crowds, a lot of interest. People literally signing up yesterday committing to caucus. Were excited. We had two polls last week i was at 13 . One was at 13 . I was third in two polls. We just see a lot of enthusiasm. I have more endorsement than anyone else in the race when it comes to state legislators. So were really building something. Mike but, senator, isnt iowa kind of a special case for you . You come, as you pointed out from right across the border over in minnesota . You have held 189 events there over 69 days. Dont you have to finish the top three here in iowa or youre done, and if you do finish in the top three, how can you replicate that in other states like New Hampshire where you havent spent nearly as much time . First of all ive been to New Hampshire 22 times, chris. I do a lot of stuff. I literally dont put those kind of limits past. We have to do well here. There is a lot going on having been gone the last few weeks that i didnt expect to happen but im going to New Hampshire no matter what. There is a debate. Im on the debate stage. I have endorsement of every major paper in New Hampshire, including the union leader that have endorsed in New Hampshire. So of course, im going there. We have a strong operation there. Then going beyond. I think that my, but remember, i bring something to the sustaining that really no one else has. Im one of only two candidate from the middle of the country where we need to win as democrats. Im someone that won with moderate republicans and independents in the reddest of red congressional districts over and over again. I bring people with me. Im only one that has those receipts that i can bring into this election. Im one of two women left on the debate stage. Im someone that has passed over 100 bills as a lead democrat. There is lot of stuff why i should stay in the race. Im exciting to be one of the leading candidates. Mike you made it clear youre staying in the race. Let me ask you. Iowa and caucuses have special rules. One is, if you dont have 15 of the people who show up at a individual precinct caucus, then you dont qualify, you doesnt get any delegates. At the caucus level. At the precinct level. There has been talk, i want to find out if it is true, that the Biden Campaign came to your campaign, lets make a deal, like the tv show. If one of us doesnt meet the 15 threshold well put our candidates in the other ones camp so they can get the benefit of that . One is it true, did they try to make a deal with you to switch votes if somebody falls short, and if so are you going to accept that. No deals. In fact they just approached someone who is affiliated with our campaign but not on our staff and some evening in des moines asked them about it. He said no. We said no. There is no deal. And i am just focused on our own race here. We have precinct captains all over the state. We have worked on this and we are really excited. Also, remember, that rural issues, i serve on the agriculture committee. I have a long track record of working on rural issues. So i have something that is pretty special here going into Iowa Caucuses. Were excited how were doing. Mike senator, a new issue come up in the last few days i want to ask you about. Back in 2003, you were the top prosecutor for henipin county, in minnesota. Your office put a 16yearold boy in prison for life for the shooting of a young girl. You have campaigned how this shows that you were tough on crime but just in the last few days, i want to put this up on the screen, a yearlong Associated Press investigation has raised new questions about whether that young man was wrongfully convicted. They found police offered cash to potential witnesses and relied on testimony from jailhouse informants who got reduced sentences. Senator, did you know, when you were the prosecutor, did you know about any of that and should this mans case be reopened . Well, justice must be done, chris and just to put it in some context, this was an 11yearold girl named taisha edwards. She was doing her homework at her kitchen table. A bullet went through the wall and she died. It was a tragic case. It was a big deal within the Africanamerican Community and our focus was on bringing the people to justice and doing just test for her family. So what happened three people were convicted if i could say mike senator, let me just say we know it was a bad case. The question is whether this young man did it and this Ap Investigation indicates other people who were there said he didnt do it. And some of the witnesses that were relied on were very questionable. You were the head prosecutor. Did you know and if you didnt, shouldnt you have known . There actually were two trials in this case, chris. One was after i was had left the office. Mike he was convicted in the case when you were prosecutor . If i could just answer. My view as someone that has worked with the Innocence Project for years is that if there is new evidence it must come forward. It must come forward. It must be considered immediately by the court. The job of a prosecutor is to do justice and that means to me convict the guilty, protect the innocent. Do your job without fear of. That is what mike senator, youre not answering my question. Did you know about the fact that there was this questionable evidence that the police were coming up with . I didnt know about this new evidence, no i didnt know about this new evidence until i saw this report. I couldnt have. I havent been in the office for 12 years. Mike i, but i was wondering when you were in the office did you know about this questionable evidence . The reason im asking you is, as im sure you well know now, a number of africanamerican groups in minnesota who are calling for you to suspend your campaign until this is cleared up and according to national polls, you are below 1 in africanamerican support. Youre not going to win the democratic nomination if you have such little support from the minority community. Well, i think what youve seen all across the country is that when people get to know me i do well. And its on me. I have got to go out there and get to know people. In my case, lets look at iowa, two prominent africanamerican legislators have endorsed me, are out campaigning for me right this weekend. At home ive always enjoyed and have gotten strong support within the Africanamerican Community. Ive been a leader on issues with the Somali Community in my home state. And its on me to go across the country and make the case for my agenda, which is, very strong when it comes to the Africanamerican Community. It is about economic opportunity. Mike right. It is about voting rights. Ive been the lead on things getting rid of gerry manned everying, getting rid of voting purchase. Those are my bills i led on. That is on me. Brit, i think its clear from the start that President Trump was never going to be removed from office in this process. As we wrap up impeachment and the senate trial, who do you think has the political advantage particularly as we look to november, both in the race for the white house and the race in congress, republicans or democrats . Well i think it is a little hard to say at this point, chris, because it is not clear how much attention the public was paying to this. Indications the public was not following as closely as we in washington and the media in general were following it. We dont know whether it well have very much impact at all. My suspicion it will have impact than any of the impeachment investigations of president s we recently seen. I dont think any republican senators by the way they based are afraid at all their political fortunes will be harmed by voting, not only not to have witnesses but inevitably to acquit. So, my sense of it is, this could end up being a political wash. Mike marie, do you think House Democrats have any second thoughts, about one, going for impeachment, and two, deciding not to fight in court, even if it was going to take a while to try to get john bolton to testify in the house . Well, chris, it was a bit of a catch 22 because the white house made clear they had no intention of participating in this process. House democrats felt like they had a Strong Enough case as it is. I tend to agree. There will a lot of handwringing among democratic circles next days and weeks. What it showed democrats, it is important to vote for someone that can beat donald trump in november. The president womenning more embowlenned and unfettered after acquittal. They need to focus down ballot on senate races. No matter what happened with john bolton or witnesses because we dont have the majority in the we were always going to lose this impeachment fight so here in iowa, joni ernst is on the ballot in november. Senators like cory gardner and martha mcsally, facing tough races holding on to their republican seats. That is where democrats are focused, feel like impeachment may help pick up senate seats in november. Mike karl, as we pointed out, donald trump is going to be delivering the state of the Union Address in a joint session of congress on tuesday night. Like bill clinton back in 1999 he will be delivering that, only one day away from acquittal while the Senate Impeachment trial is still going on. If you were advising him, if you were the role you were in bush 43, how would you tell him to handle impeachment and the senate trial . How aggressively should he go at democrats for what they put him and the country through . Well the less said about it in the state of the Union Address the better off for President Trump. More important to herald what he has achieved. We heard he will be talking about the bluecollar economic prosperity. Also sort of lift the can curtain on the tech act, what does he intend to do in balance of the year and the impression on things he would tackle in the second term. Tomorrow night is valuable moment for him. It is a moment he can be dismissive of the impeachment giving as little of attention in the remarks as possible. Putting focus on what he has done and intends to do. Mike lets turn, while you guys are all in des moines, i should point out offcamara, karl pointed out the temperature disparity between des moines and miami. We feel so sorry for you to be suffering in Miami Gardens. Mike in any case lets turn to iowa, well talk about the two front runners in this case going at each other. Here is an example. Bernie, calls himself a democratic socialist. We have a different view on a whole lot of things. He is a decent guy. I dont think he should be running. Joe biden has been on the floor of the senate talking about the need to cut Social Security or medicare or medicaid. Mike karl, as you sit there today, sunday, do you have any sense who is going to win the Iowa Caucuses tomorrow night. No real idea. And look, i think were going to have multiple winners tomorrow night. This is not going to be 2000 where al gore blows out bradley 60 some odd to 35 in the contest is over. The closest thing we have is some of the contests like 2018 where it was relatively close or 2016 where it was 49. 8 to 49. 8, literally a couple hundred votes separating clinton and sanders. It forecast a contest that went to the end of june. I think well have that kind of a contest tomorrow night. I would not be surprised to see three or four candidates splitting up the delegate pool. I wouldnt even be surprised if five candidates shared in the 41 delegates to be awarded in iowa. Mike pick up on that, marie, assuming it is kind of muddled, one person wins the popular vote and somebody else wins the delegate vote, how much does iowa matter as we all get on the train or the bus to head to New Hampshire the next day . I think as long as there are no huge surprises, nobody really underperforming or overperforming it will probably end up muddled and well go into New Hampshire expecting Bernie Sanders to win there. Expecting joe biden to win in nevada and South Carolina and how Mike Bloomberg does on super tuesday. Joe biden needs to perform strongly in iowa because of the expectations. He needs to demonstrate he is the moderate choice in the primary against the berniewarren wing of it. Where Amy Klobuchars voters go on potentially the second ballot, if she doesnt make the threshold, do they go to joe biden. Mike were running out of time. Let me bring in brit. I have about a minute 1 2 left. You know i could make a scenario that this is shaping up pretty well for Mike Bloomberg. You you could have a pretty muddled field coming out of iowa, maybe New Hampshire. The dnc changed its rules so bloomberg can get on the stage likely for the next debate. How seriously should we take mayor mike . I think we should take mayor mike quite seriously. I think he is a genuine wild card in the race. Were seeing money spent by him in the race, orders of magnitude greater than anything we ever seen. If you get a muddled picture, particularly Bernie Sanders getting edge out of iowa and New Hampshire as well, that strengthens the case for bloomberg. Frightened centrist democrats, moderate democrats, to the extent there are any, will be terrified of sanders. Terrified of a major defeat at his hands. I think that at that point, bloomberg with all his money become as potential factor. We dont know that. Nothing like this is ever tried before. When people are late into races that never worked before. This is all together different because were seeing money on a scale weve never seen before. When youre a defense player you always feel like defense wins in a lot of ways. I always say the best counter to a great passing game is the park rush that helps out coverage. 49ers have four guys that can get to the quarterback you can drop seven. They are taking worry about the kansas city defense. They are some of the most fastest, electric receivers in the game and running back williams adds to that out as a receiver.
