Chris in july, President Trump said that white house chief of staff would remain on the job through 2020. Now he says that kelly is out as one of the top few white house staffers bid what happened . Its been a long two years. For the chief, general kelly. Who ran Homeland Security and has been running the white house staff. I think by the way, hes been a very good chief. Very Orderly Processes in the white house. Not an easy thing to do. General kelly is a remarkable patriot. He has given such Phenomenal Service to this country. Perhaps its time for rest. President trump, at our senior staff christmas dinner friday night had wonderful complementary things to say about the chief. I hardly concur. I suppose its time to move on. Chris let me ask you two more quick questions. Did kelly resign or was he forced out . I dont know, to be perfectly honest. I think it was very amicable. Thats what i understand. Again, the president saying good things about the chief. Ive been in so many meetings be so many meetings in my tenure in less than a year now. I think a lot of the gossip is just wrong. I think they did get along. Everyone will have disagreements, thats the way life works. Was he fired . I dont think he was fired. I wasnt privy to that final conversation but the president had great things to say about him. Chris what do you think of nick ayers . I think quite a lot of him. Ive known him for a while. The president will let us know tomorrow or sometime early in the week for the next chief is going to be. In terms of nick ayers, mike pences chief of staff, i think the world of him. Chris lets turn to your day jump in the stock market had a terrible week since President Trump and president xi jinping had dinner in argentina. The dow lost 1100 points or 4. 5 percent. The s p 500 is now in the red for 2018. Question, how much of this is because of confusion over just what the u. S. And china have agreed to . I dont know. Ill grant you that trade issues, china trade issues havent been buttondown yet. The first couple days after that dinner, i was down there. The markets did very well both in china and the u. S. As a matter of fact. Since then, there have been issues. The one issue that was violating sanctions. Canada has taken them in and they will probably be extradited. There have been different statements here and there. I can tell you right now, we are on track. China has finally, wednesday and thursday, chinas Commerce Department issued very positive promising statements. Sometimes i think these things get lost. Maybe the beautiful funeral of former president bush. They said they agreed with the timetable. They agree with the deadlines. They expect to be moving immediately to take actions. On key commodities for example by lowering tariffs and opening export sales. Things like agriculture and energy. 35 chinese agencies and the Supreme Court are now working on new legislation to deal with the ip theft issues. When you piece it together chris, theres a lot of good things out there. I think sometimes it gets lost in the shuffle. Because there are big differences between how the president and the white house is describing what was agreed to what the chinese are saying was agreed to be let me put a couple of them up. The u. S. President trump says the chinese will remove their 40 percent tariff on u. S. Auto imports for the chinese are ducking that one. And then theres the difference between what you and white house trade advisor Peter Navarro had to say on friday about that 90 day deadline for suspension of tariff increases. The president indicated, theres good Solid Movement and some good action. He might be willing to extend the 90 days. We will have to see on that. If its not resolved in 90 days, is this a demonstration willing to walk away . Its not a question of working way, its moving forward on the strategies. Chris that contradiction between you and Peter Navarro led to a 500 point drop in the dow. Forget the chinese. The white house cant seem to get it story straight. With all respect, i dont think theres much daylight between peter and david we are focused right now on this first 90 day increment. Regarding what may happen in the future and president ial considerations, that will be up to potus of course working with president xi jinping. I understand people are looking for issues. Let me read quickly. It was the chinese Commerce Department announcement that i think it was wednesday or thursday. China will immediately implement specific issues that have been agreed upon by agriculture products, energy and automobiles tariff. Announcement coming from the state tariffs commission. As i said earlier, it was announced that a number of chinese agencies and the Supreme Court are looking at new laws to prevent intellectual property theft. These are very strong indications President Trump himself. He called me early thursday morning to say, did you see that announcement . And i did. I think its very positive. Really, we are making more progress on more specific issues than ever before. Now, let me add quickly. Trust but verify. Thats very important. Will be looking very carefully at these negotiations. He will evaluate, he will make sure there are Enforcement Mechanisms and timetable mechanism. Nothing in this game is done until its absolutely verified to our satisfaction. So thats a caveat. However, the statements are very positive. Chris except the president treated 40 percent tariff on auto imports is lifted. The chinese have not committed to that and there was a big bump in the road on saturday night. President xi jinping and President Trump having dinner together. Youre at the table with them. Suddenly, theres the arrest last saturday of the chief Financial Officer of Telecom Giant for allegedly violating u. S. Sanctions on trade with china. Couple quick questions. One, did President Trump know about that arrest when he sat down to dinner with president xi jinping and if not, what was his reaction afterwards . He did not know but he did not know and had no reaction afterwards. Chris the reports have been that he was livid. As an outsider, if one of the top businessmen in the other persons country was being arrested while im making my set dinner, id be livid. He didnt know. Okay, i will state that unequivocally. He learned to play later by the way. Way later. Look, regarding the prosecution, to me just say, thats a Law Enforcement action. Primarily department of justice. It is a very important issue because the evidence suggests at least so for that they did bring sanctions. Well see how that plays out. Thats an enforcement chris i want to ask you one question. If i may, larry. Republican senator marco rubio said this week after the arrest that a Telecom Giant is a bad actor. Knowing the history and how it served as an instrument of chinese espionage, its concerning. We have a case to be made. The right thing to do is to charge her and for canada to extradite her. Chris now, china is warning the same again canada where shes being held that there will be consequences if she continues to be held. One of the top papers in china, the global times says her resume is to a declaration of war. Can you guarantee me as part of this negotiation, the president and the administration will not let her go . Chris, i cant guarantee anything. This is a doj, nsc lawenforcement issue. Im not an attorney. Its outside my lane. So we will see. The u. S. Has laws about these things. They have a number of laws on the books now that protect a number of points. Not only violations of sanctions. We have laws about anything that was stolen. We are discussing laws, people cant do business in the u. S. Where goods and services and intellectual property that we think were stolen. Thats just being tough and protecting the family jewels in my judgment and protecting the integrity of u. S. National security policy. Very important. How this affects trade, i cant sit here and be absolutely definitive. It seems to me theres a trade lane that we are discussing that you and i both agree, the early returns in china are very positive. It looks like he will get new action. And there is a Law Enforcement lane. They are different. I think President Trump and president xi jinping and lower officials will generate or continue to keep that different. X this country owes much of the kelly family. The sacrifice and the loss of his son. He served two years on Homeland Security and chief of staff. By all accounts, its of the mulch was time in the white house. Nick ayershas proven himself with the Vice President. Very different approach than general kelly. Chris in what way . He seems to be very disciplined. He did cut his teeth early on on the campaign issues. As we transition into 2020, i think its important to note that Mick Mulvaney also in the mix. Seems like nick ayers will get it. There might be an interim person. Chris when you think is political. Is part of it that we are headed toward 2020, a democratic congress. You need a politically savvy person in that job . I think you have to deal with the democrat controlled house of representatives and you couple that with the 2020 election. You need somebody who can bridge that gap and what the president s attention will be drawn towards. Chris chuck, given how president runs his shop. Can anyone succeed as white house chief of staff . Nick ayers was a very sharp political operative. He was he has his own credit. Yes he does. Hes thought to have maybe as part of being sharp elbows but hes a young man in a hurry. Hes in his mid30s and that always draws resentment from the more experienced types. The other people in the mix are Jared Kushner and the president s daughter ivanka. Chris when you say in the mix, theyre not going to be chief of staff. Know but theyve been known to involve themselves. They had something to do with general kellys departure too. They have struggled along for stability. At a certain point, you say to yourself, is it the staff or is it the president . The president thrives it seems on conflict and instability. That seems to be what makes him comfortable. He likes, as he was said himself, he like some people are in conflict around him and he can deal with that. A best Case Scenario for this warehouse is that they find somebody that can hold on for the next two years until the election but that would be different from the previous two years. Chris speaking of conflict and unfinished staff business. Nine months after Rex Tillerson was dismissed by tweets. He finally got around to talking about what it was like to work for President Trump. Its just a taste of that. He doesnt like to be. Doesnt debriefing reports. Doesnt like to get into the details of a lot of things but rather just kind of cells, this is what i believe. When the president would say, heres what i want to do. And heres how i want to do. Id have to say, mr. President , i understand what you want to do but you cant do it that way. It violates the law. It violates a treaty. Chris not surprisingly, the president fired back. Rex tillerson didnt have the mental capacity needed. He was dumb as a rock and i couldnt get him fast enough. He was lazy as hell. Congresswoman harmon, i guess they wont be sending christmas cards to each other this year. I have no idea why Rex Tillerson did thatinterview. Chris we love that he did that interview. Well, fine. Congratulations on 15 years on fair and balanced inkling of this show. Big deal. Back to this, i came of age when john kennedy said ask not what your country can do for you. Ask what you can do for your country. We just buried a present for duty, honor and country where the theme of his service over his entire lifetime. I think Rex Tillerson came to washington out of the feeling of duty, honor and country. I think he was an excellent head at exxon. Chris he was not a very good secretary of state. He had no experience at the state department and certainly was a misstep with President Trump. I think the latest tweet is a sad, a lack of civility and respect for honorable people who come to serve. Chris Rex Tillerson punched. Yes, i think the whole thing was unfortunate. Just a comment on john kelly who absolutely gave his son, his son gave his own life in afghanistan to protect our country. We should really honor his service. I surely hope we would not see tweets like the Rex Tillerson tweet after john kelly leaves. His military service was so honorable. Chris guy, lets go back to my last conversation with larry kudlow. What do you make of the differences we are seeing and how the u. S. , president and white house is describing what was agreed to or even whats on the table in the discussions between the u. S. And china. And what the chinese are saying about it. The markets right to be concerned about those differences and how big a monkeywrench did the arrest of this really top, i dont think you can overstate how important this chinese businesswoman is. What kind of a monkeywrench that threw into all of this . I think on the arrest its one of the rare instances where there was virtual unanimity about that country and that they are bad actors. And that Something Like this was due and important. Given their sanctions violations, espionage, ip theft. There was bipartisan applause. Maybe the timing was unfortunate given the broader context of the back and forth in these negotiations. To your first question, im a big fan of larry kudlow. Always have been, but i was not terribly convinced by his responses to your questions. Where you put up the full screen graphics. Heres what we are saying, heres what the chinese are saying. Where do we go from here . I think there was a lot of lets wait and see. The markets are waiting and singing and i think thats why we are witnessing the downturn and the jitters. Chris weve seen this movie before where theres talk about an agreement they begin months of negotiations and nothing much concrete comes from the chinese. How worried are you and how worried should the markets be that we will see this again . Is i think the president is moving us in the right direction. We all know theyve been abusive in their intellectual property theft. The fact that the president is putting America First is exactly what he campaigned on. No doubt it will be a tumultuous getting there but the president is pushing us in the right direction. Chris are you confident the chinese will keep their word . I do. I think the situation will be a distraction. I can tell you having sat a lot of meetings over the 8. 5 years i served. awas and a lot of those discussions. Now federal prosecutors are trying to connect the dots between President Trump, his campaign, his company and the kremlin. Joining me now from maine, senator angus king, an independent and a key member of the Senate Intelligence committee. The special concerns special prosecutors issued issued Court Filings on Paul Manafort, Michael Cohen and general Michael Flynn. Question, what if anything did you learn about possible criminal activity by President Trump and what does this investigation stands now . I think the first thing to say is that the filings on friday, with regard to Paul Manafort and the district of new york talking about Michael Cohen and robert mueller. I thought they were less interesting if you will important than the Michael Flynn file earlier in the week. And what was interesting about that was, what wasnt sent there were large sections of the filingthat were redacted. That we could see what they were. The special counsel went out of his way to complement general flynn on the rules of his testimony and how hopeful he had been. And basically recommended no jail time. It was a kind of prosecutorial pardon if you will. Based on high level of cooperation. The mueller and cohen filings when it the Paul Manafort and cohen filings went as revealingly Michael Cohen basically went over the information that had been revealed in his plea arrangement. Chris senator, let me drill down on one point there. On the illegal hush money payments to two women, new prosecutors right, Michael Cohen himself has now admitted with respect to both payments but he acted in coordination with and at the direction of individual one we know to be donald trump and how damaging is not to the president . The president has a series of defenses if indeed that is charged to be a crime against a good one would be, it wasnt willful and knowing which is what the statute requires. Also the question is, it was his own money, a candidate can spend as much money as they want. There are no limitations. On the other hand, it wasnt disclosed and thats one of the key factors. The key word is at the direction of, which directly implicates the president and what could be a felony. So that is a significant development. But that was really in Michael Cohens guilty plea last august. This sort of amplifies. Chris let me ask you about another thing in the cohen filing by the special counsel. The special counsel says in november 2015, someone who claimed to be close to the russian government offered quote, synergy on a government level to the term campaign. Michael cohen says he didnt follow up but he did have a series of other meetings with russian officials but how significant is that . I think it is significant because its one more connection. It appears that that discussion is about the trump tower moscow project. Which we now know was under way and being discussed thus not underway in terms of being built but they were working on trying to develop such a project from the fall of2015 into the middle of 2016 , which is contrary to earlier reports that there was no relationship with the russians and nothing going on is the thing chris, if you want to build a big project in moscow, youve got to work with the government. Youve got to have permission. You have to have a goahead from the highest levels of the government and that means Vladimir Putin this establishes there were contacts going on during that period and Michael Cohen was in the middle of the. Chris so bottom line, at the end of this week as opposed to if i spoke to you last sunday. Is there anywhere there when it comes to the president . I dont think it changes that. Well, let me modify that answer but i think yes, going back to my original comment but i think the Michael Flynn filing was significant. He met with the special counsel dozens of times and gave a great deal of information that a lot of which is redacted which is suggestive there is information we dont know. I think thats the most significant filing of the week. I think the Paul Manafort Michael Cohen finally gave us a little Additional Information but i think the flynn filing if i were in the white house would be the one that makes me nervous. Chris i want to ask you about the president s reaction friday night and he tweeted this. Totally clears the president. Thank you. Does it . No. I dont see that at all. In fact, the cohen filing as you pointed out implicates and in the commission of a felony. I wouldnt call that being totally cleared. It doesnt speak directly to the issue of conspiracy with the russians involving the 2016 campaign. Although, again, the cohen filing talks about relationships to people in russia at the highest level with regard to synergy with the russian government and the term campaign. Its suggestive but not conclusive. Chris, theres a lot of talk recently about smoking guns. And criminal prosecutions, you rarely find smoking guns. Its an examination of evidence and thats whats happening here and accumulation of evidence. Its more of a drip drip then an opening of a firehose. Its in ways not favorable to the president but as you suggest, theres nothing definitive but theres nothing that exonerates the president either. I was surprised by that tweet i was wondering if you read the same documents i did. Chris the president had two other tweets this week that stirred controversy. On Michael Cohen seeking no prison time the president broke, he lied for this outcome and should in my opinion is a full and complete sentence. But on roger stone thing, he will never testify against mr. Trump, the president wrote nice to know some people still have guts. Do you see those tweets as some other people do as evidence of witness tampering . I think its troubling and could add a third instance when he said last week that a pardon for Paul Manafort is not off the table. I found that very troubling. Thats dangling a pardon. I used to be a governor and i have the power of a pardon and to me, if i had thought about attending a criminal who had some ability to implicate me in some criminal activity. I cant imagine it, frankly. Thats what were talking about you. When you add those three things together, its very troubling. Again, its not definitive. Not a smoking gun. But its troubling when youre essentially saying, punish the guy was giving information against me. Let the guys off and talking. The best that arent talking. That is troubling. Db characterization. Chris former fbi director james comey testify before to committees for a total of almost 7 hours. Afterwards, he had this to say. When you read the transcript you will see were talking about Hillary Clintons emails. Im not sure we need to do this at all. Chris the republican majority have contended and what they were trying to find out and asked about flowers in this hearing four hours, is that there was bias in that investigation and against donald trump in that investigation. Did you see evidence of that . No. Theres a really important point here and that is the investigation of donald trump was completely secretive. It wasnt made public at all. There wasnt a width or suggestion. Nobody knew about the election until well after the election is that investigation was undertaken for political purposes, it had no results. It didnt affect the election whatsoever. On the other hand, the Hillary Clinton investigation was very public. And many people feel director comeys statements about reopening the investigation in the latter part of october about a week or 10 days before the election, was one of the things that sunk Hillary Clintons campaign. I understand the argument but the conclusion doesnt support it. The trump investigation was political, they certainly didnt pull the trigger on a. Chris the republicans are making a big deal about the fact that fbi director comey, former director said, i dont recall. I dont remember over 200 times in his testimony. Do you think that indicates he was assembling were not being candid . I had probably 20 meetings in the Intelligence Committee with him over the course of five years and i never saw that from him. It would be surprising to me that i wasnt there and i didnt see it. On the question of the little hillary thing. The Inspector General of the Justice Department did a very long, a 150 page analysis and concluding the word judgment calls they disagreed with. And were back with the panel. Congressman, President Trump is insisting on 5 billion for the wall in this bill that has to be passed a week from next friday, the 21st. Four days before christmas. Democratic leaders announcing they want to make a deal on daca if it means they have to from the wall to 5 billion. Does this mean a Government Shutdown, it will be partial. Because they pass a number of bills already. A Government Shutdown is inevitable and if so, who pays the political price . I think its a real threat because the president wants his 5 billion. Its embarrassing, the republicans were able to produce that when they had the house. 1 trillion over those two years and they couldnt come up with 5 billion, its an embarrassment. I thinkthe president is serious about this i think all battles passed within seven days of christmas. Chris if there is a shutdown. Who pays the price . I think the president is on the winning side. They want to protect the security of the United States of america and all of these graphics and things you see of people coming north, will claim victory but many will understand the president is trying to protect the United States. Chris we got this on twitter, she writes, i thought mexico was paying for the wall, am i misremembering the promise during his make America Great rallies . Or was he playing plane lying . Does nancy pelosi, if she were to give any ground. Does not doom her as her role as speaker . First of all, mexico is not paying for the wall. I was a member of congress and the Government Shutdown over christmas for 27 days in 1995. It was a disaster. It was during the reign of newt gingrich. At any rate, was to pay the price, i think the president will. Nancy pelosi should make a deal in my view and Chuck Schumer should too. Put daca in there, ending u. S. Military assistance to yemen which is something on a bipartisan basis that the senate wants. Those would be at least two. Border security is something i strongly support. Not necessarily a physical wall. Chris thats the president s you cant put into an environmental areas along the coast of texas. Chris but you would pay for a wall . Hemorrhaging deficits. If we are headed for a recession, these billions of dollars to add up. With the trump tax bill and other things, theres just no relief in sight. So i would return if i could, some form of this wonderful plan that was supposed to balance the budget and cut spending. Chris all of this isnt going to happen in two weeks. Let me bring in our other two colleagues. Guy, how do think this will play out . Even though the possibility of a shutdown is serious. Obviously, we are here talking about it. If there is a shutdown, its always a partial settlement it will be even more partial in this case because the Republican Congress has passed for Appropriations Bills regular order than theyve done in more than two decades. Including defense. I think the urgency and the scare tactics in the fire around the shutdown wont be available to the democrats. Although i think they will get their licks in on the president if the wall is the sinking point. Who pays the price here . This is the last stand for the wall with republicans in control. If theres a shutdown over the wall, i think the president will be reported for his base for making that struggle. If it goes on a lot longer than that because there isnt a lot of support generally, then he will pay a price. Chris for all the talk about by republicans about democratic voter fraud, there seems to be another case in North Carolina where it was the republicans who were involved in voter fraud. Republican mark harris has a 905 vote lead over democrat dan mccready in a race for congress. Mccready had already conceded but now there are allegations of a gop operative mishandling hundreds of absentee ballots which may have been the difference. And the democrat mccready has now on conceded. God, what you make of this and explain whats going on here . It doesnt look good. If you read into the details, i would not be surprised if the end of seeing a new election in North Carolina. I think this shady characters fingerprints are all over this. Chris tell what he did. He was collecting ballots, absentee ballots. Chris it was a republican, not mark harris. Somebody working for him. Hes worked with both parties over the course of time. He has this amazing track record where his clients tend to outperform expectations by far when it come to absentee ballots. They collect these from voters, something happens to them and someof them appear in some disappear. And then boom, the outcomes tend to benefit his clients.
