the government goes after you it can be a nightmare. tonight we're going to show you several alarming stories in which government officials decide to take on private citizens. these people who didn't and still don't believe they were breaking any rules were suddenly in the fight of they lives. the full force of the government baring down on them. that's what makes it so scary. if it could happen to you, it could happen to anyone. we start in nevada where john roberts has the story of a family of ranchers who found their very way of life under attack. ♪ the western range lands, vast, scenic and a battleground for what became known as the sage brush rebellion, a fight that began decades ago between locals and the federal government over land use. >> the sanl brush rebellion got its name in the type of vegetation. ranchers are complaining that the bureau of land management doesn't identify with ranching approximate. >> wayne hague, sr. didn't plan to become the face of that bebell on, but that's what happened. >> when did your parents buy the pine creek ranch? >> june of 1978. >> he was just two when his parents sold their california ranch and bought pine creek ranch in central nevada. in other words he can't remember a time when his family hasn't had to fight the government they bought it to raise a family on the ranch and continue their livestock business. >> the ranch itself is more than 7,000 acres. it also included exclusive access to more than 7,000 acres of adjoining land, so called open range. wayne took a couple of days to show us around. >> the you really need that much property in. >> yes, in this country it takes 320 acre to raise one cow for one year. >> they couldn't afford to purchase the acres, so they paid for their smaller piece of property and at the same time bought the right to water and grazing on the larger spread. that's the way it's been done out here since the 1860s. this these rights have been passed down for more than 100 years and the reason that pine creek is economically valuable. the extra land is public property managed by the forest service and that's where they say their problems began. it's not like they weren't warned. >> my dad bought it knowing that there was a problem down there, but he had worked with the federal agencies in the previous ranch in california and got along with them. he thought, well, you know, i can work with these folks. >> why would the government do that? they said the feds were trying to strip them of their rights in order to take control of the land, partly for environmental reasons and the water, which in a desert state is like gold. in fact, many western ranchers feel the government would like to end their way of life completely. no sooner had the family settled in that the government offered to buy the ranch. he declined so the government filed a claim for water rights. wayne, sr. wasn't having it. if the government wanted a fight, a fight is what it would get. he contested that claim, starting a battle that would consume the rest of his life. in one, 105 day grazing season with ur your family was visited by government employees 70 days, received 40 certified letter ps that's more than one visit by the government in a sense for every day that you're out there grazing. >> that's right. >> one to have violations that the government had, out of the millions of miles of fence we have up on the mountain, one of the staples was missing out of one wire in the interfence. >> where was that fence post? >> it was up on top of the mountain. we sent a man to go fix it. >> how long did it take? >> took him a whole day. >> is it fair to say that pine creek rampl was in violation many times? >> probably to a strict t, yeah we fell in violation. there's no way to keep out of it. gou say were we in violations of the general terms and conditions of the permits we're operating under compared so other ranchers, absolutely not. >> in 1989 a fed up wayne, sr. published a book titled "storm over range lands." they claim that in response the government reacted by going after them even harder. and by the end of 1990 had suspended one of their essential grazing permits. >> we were observing the effects of cattle grazing to the resources. >> the forest service made this video in 1991 laying out their case. >> excessive grazing is causing one of the more undesirable species. >> they claim that the cattle were overgrazing and that the land needed a fear-year rest to recover. they instructed them to remove their cattle. the problem, wayne says, is that the government couldn't clearly identify the boundaries of the forbidden area. >> we were licensed to have cattle in the valley. but if cattle got up here in the mountains, they were going to be in trespass and there's in fence dividing the two. there's 22 miles of unfenced boundary just on this portion alone. the forest service couldn't tell us where the line was but if the cow got on the other side of the line, they were going to impound the line. >> that is what happened. the cows got on that side of the line. >> yes. >> so you were in trespass. >> yes, technically by the regulations we were in trespass. >> on july 27th, 1991, the forest service took action. >> the government was coming in to take our cows on the impoundment. made a big production out of it. they had ten federal agents fully armed. >> it didn't turn into a hollywood style gunfight. quite the opposite. for the family, it was a big dose of reality. in all the forest service impounded and eventually sold over 100 cattle pep then they sent them a bill for the difference between the sale and the cost of con fie skags. >> that was the final straw. it was virtually impossible to run cows anymore because there's no guarantee they with can keep a cow on the side of the imaginary line. >> their cattle ranches business was effectively shut down. there was only one option left. they sued the government claiming their property had been is a fox news lert. recent reports indicated there could have been a signal coming from the indian ocean. hms echo is in the area to check that out. two other sounds were picked up in other areas. there is a news conference going on. they're doing preliminary introductions with a we're going to hear is captain, we're going owe to hear chief coordinator air chief angus marshal houston, retired. this has promising news, mr. houston warned people being careful moving forward they want to make sure all facts are on the table. saying the strevength of the signals have not been linked to flit 370. let's hear what he has to say about the latest update. >> on the missing malaysian airlines flight ms 370. the electric pulse signals detected by the chinese ship and acoustic noise being pursued by the australian defense vessel, ocean shield in the current location. i stated that the ocean shield would be delayed from going to approximate area where 101 detected signals continuing her own investigations. today, i can report some very encouraging information which has unfolded as of the last 24 hours the ping lobing indicator deployed from the australian defense vessel ocean shield detected signals consistent with those emitted by aircraft black boxes. two separate signal detections occurred within the northern part of the defined search area. the first detection held for approximately two hours and 20 minutes the ship then lost contact before conducting a turn and attempting to reacquire the signal the second detection on the return legaled held approximately 13 minutes. on this occasion two pinger returns were audible. significantly, this would be consistent with transmissions from both the flight data recorder and the cockpit voice recorder. clearly, this is a most-promising lead. probably in the search so far, it's the, probably the best information that we have had. again, i ask all of you to treat this information cautiously until such time we can provide a determination. we haven't found the aircraft yet i stress this. it's very important. ocean shield remains in the area and continues to try to regain contact with the towed pinger locator. to this point it's not been able to reacquire the signals. there are many steps yet before these detections can be positively verified being from missing flight mh 370. firstly we need to fix the position, then, ocean shield can lower the underwater vehicle blue pin 21 into the water and attempt to locate wreckage on the sea floor. another source of evidence such as wreckage would verify this lead. the area in which the signals have been received have a depth of approximately 4500 meters. this is also the limited capability of the underwater vehicle. it could take some days before the information is available to establish whether these detections can be confirmed as being from mh 370. in very deep oceanic water, nothing happens fast. of course, once we have a determination, ocean shield will stay in the current area until such time as it can verify or discount detections as being from mh 370. work continues by ocean shield to refine pinger detection location. we'll continue to follow a carefully-planned to is hes of investigation to verify or discount. a few words about today's search. up to nine military aircraft, three civil aircraft and 14 ships will assist in the search the search area is around 234,000 square kilo meters. good weather is expected throughout the day which shall in the afternoon. this is an oddity. i thank men and women assisting in the search effort including military personnel from around the world. respond here. yesterday's media conference i said i would come back to you on some relevant matters the chinese ship hisuin was on the southern extremity of the search area when it first detected a pulse signal. let me say a few words about the search area. i'm going to refer to a map av net following this conference. now, you might all recall the analysis by experts scene i referred to, i think, 3, or 4 days ago. this was analysis of the satellite signals and the aircraft simulation work. what that revealed was there were a series of acts which signifies where each exchange or handshake occurred between satellite and the aircraft. the sixth exchange is represented by the line here. a short time after sixth exchange, there was another exchange. with a slightly-different signal. this is a matter of, i think, about eight minutes after the sixth ping. and the experts consider this as significant. they think something happened at that stage. and we assessed about where aircraft would have run out of fuel. now, the search area is the underwater search area, which is reflected here, in other words the area where the aircraft might have entered the water is reflected by boxes here. do not worry about the other search areas because the aircraft have been looking for reccage on the surface and have been taking account of 30 days of oceanic drift. but, the satellite has given us this area here as the most-likely place where mh 370 entered water. now what is significant about this is that yesterday, or couple days ago, hisuin 01 had its encounter with the electronic pulse in this location here. ocean shield is currently working up in this location there. so, all of the search underwater is being enabled by that wonderful work that was done by the expert team in kuala lumpur. their work enabled us to come up with a underwater search area which is narrowly focused and with the acoustic events we're getting in the area, we are encouraged very close to where we need to be. so i just put that on the table because people have asked the question, and i think we need to explain it. what is the difference between this end of the box and that end of the box? aassumptions that relate to aircraft speed if the aircraft is traveling slower than normal, it would be this area here where the aircraft might have ended up. if the aircraft was traveling faster than perhaps normal, or, a bit faster than here, it would end up in this area, here. so, that is why we're searching in this area here. and the most promising lead at this stage is the event i described first up with ocean shield in this location here. this will be up on the net after this press conference. yesterday, i also stated ocean shield had a remotely operated vehicle on board. that is not the case. the capability in fact, which i've mentioned is a blip in 21 underwater vehicle with a side stand sonar capability for the accurate mapping of the sea bed. and of course, it can also have a camera attached to it. if the need arises. ocean shield is capable of carrying and operating a remote operated vehicle but does not have one in fact. options are being collected and considered. i'm now happy to take your questions. >> is the black box batteries where to die in the next day or so do you feel we'd be close enough to find the wreckage of the plane if it were to be there? >> i think the lead we've got at the moment justifies a very thorough prosecution, obviously. we're doing the first thing is trying to fix the position on the basis of the returns transmissions picked up early on on. hopefully we'll reacquire those but you're right the life of the batteries must be getting close to the end of life. it's about 31 days so we're already one day past the advertised shelf life. we hope that it keeps going for a little bit longer but then, we need to go down first of all where the underwater vehicle to map the floor. the subject matter expert ease that is available available to determine if there is something unusual on the sea floor like aircraft wreckage. in the event of finding something unusual the vehicle will come up to the surface, fitted with a camera, hopefully, we'd then be able to pick up imagery. now, i stress this is very deep water. 4500 meters, and the limitation on depth in terms of the vehicle is 4500 meters so we're right on the edge of capability. and we might be limited by the capability if, for example the aircraft ended up in deeper water. >> is it possible it's diven than, different black box that one belongs in the recorder now one belonging to the cockpit voice recorder? and other question what is the moment for affirming this path is now consistent? >> yes. yes. in terms of those events they're in the area of probability. that was worked out by the experts in kuala lumpur. we have to prosecute those contacts. we don't know at the moment. we don't have confirmation but one or another is significant enough for us to say yes. this is where the aircraft is we have to have further confirmation. we put it to you we cannot confirm until we've found wreckage. that is why the work that the work that it does is absolutely vital in the immediate future. and of course we need a group position on the ocean floor to be able to prosecute a quick and efficient search. if we're dealing with improv advised position we'll have to search amongst a larger area >> [ inaudible ] >> two events that search area is three, over 300 nautical miles long. one was, one extremity the other, at the other extremity. i would like likely they're the same event. but, in deep water funny things happen with acoustic signal was different temperatures, layering and so on. unlike, i might actually get commander leafy to speak about that in just a moment. in terms of time frame, i don't think you're here yesterday i referred to the fact just before the press conference we're starting to hear ocean shield had made a contact but we had no details at that stage. over the last 24 hours, and indeed for probably next 24 hours, ocean shield will continue runs back and forth i might add this is a very time-intensive operation because its towing a lot of cable and to turn it around, to come back again, takes three hours. to turn around. well, the detections as i understand it, first detections were around middle of the night. not last night, not before. there has been two contacts thus far. and they were early on in the process. and precise timing i haven't got for you. one is two hours and 20 minutes the other happened on the second run so... when you get the time for you, i'd suggest it's probably miles later, other question you had? >> i've answered it. >> in terms of lobing indicating the pinger in the area to locate was it within a couple miles? 100 miles? >> what i might do is ask the, one of the subject matter experts commander leafy to address your question he might add on some challenge as associated with work being done underwater. as you've heard most of the, all of the detections happening at the moment are acoustic. you can think of listening for sound, microphones. over the ping locator sitting aprochlly 3,000 meters below the ocean. unlike in air, where sound travels in a straight line, sounds through water is affected by temperature, pressure and that has affect of bending sometimes through 90 degrees wound waves. so it's possible and hard to predict, possible for sound to travel great disstances but the very difficult thing is the surface of the ocean. it's a markedly different environment for sound traveling through air and it's a specialized skill. in terms of the towed pinger locator we're expecting around 2,000 yard detection range. you can picture now moving not through water or five kilo meters per hour, there is a small piece of area being searched. ocean shield is on fifth leg of a search that has been expanding square around that initial detection point she will continue on that profile another 24 hours, if gaining another event on that pinger locator that will be the trigger at the moment to launch the underwater vehicle with accurate sonar and camera for mapping and looking at the ocean floor. but at the moment that is not the ploy the focus is on trying to reacquire the acoustic signals they had 24 hours ago. in terms of area, the, by the end of tomorrow when completing their runs they expect to have a three by three mile box searched so it's quite a small area searched very thoroughly. it's a very small area. that gives hopes a sense of challenges they're facing out there. keep in mind each of the runs that they conduct is around seven miles long. we have a turn at the end. it takes 7 or 8 hours to do each leg and turn. they need to steady on the new course and allowed tow pinger to settle down. it's a slow process we have the best in the world out there doing it, though. we're confident if there is a pinger out there we're confident we should find it we've got the best in the world engaging in this task. so thank you very much. >> inaudible ] >> well, i think we just have to be very, very careful. because we need to confirm it. in my view. with imagery of wreckage. i -- don't, you know, my view is, my personal view is probably not. but, as you just heard, strange things do happen in the ocean boy want more confirmation before we say "this is it". the point is coral yates well with the work done in kuala lumpur. and you know, this has been done without finding any wreckage thus far. and i think it's quite extraordinary. and what i'd like to see now is us find wreckage. because that will basically help solve the mystery. ask i would ask you to respect that because fundamentally with that wreckage, if we can't say it's definitely here we've got to go down and have a look and hopefully, we'll find it somewhere in the area that we've narrowed to. >> how optimistic are you? >> i'm more optimistic than i was a week ago. some of you saw me a week ago. i was really concerned because we haven't found any wreckage which is usually the finding of the downed aircraft has been enabled by wreckage. on the surface. just wait a minute. and essentially, this to my knowledge right in the middle of the ocean this is quite an extraordinary set of circumstances that we're now in a very well-defined search area which hopefully, will eventually yield the information we need to say mh p 70 might have entered the water just here. >> [ question inaudible ]. >> we're listening to mr. houston haying out information on the latest development in the search for malaysian airlines flight 370. he opened a stating two distinct pings were heard, the most audible. the most red kredible information thus far. he cautions they must be very careful with assessment and responsible in reporting adding further confirmation is very much needed. he went on to say, however this, corps yats well with information received from kuala lumpur and malaysia. information without the wreckage, he says we can't say it's definitely here they must be able to get a visual of the wreckage. he says he's more optimistic now than he was a week ago. this is quite an extraordinary set of circumstances here but they're still trying to refine and define their search. the wreckage, by the way, which is what they're actually trying to look for, they're hoping that the pinging information can built up a sound leading them to a visual identity. here is the problem, time is running out the life of the batteries are one day past advertised shelf life of 30 days. they're hoping it will last longer so they can use an underwater vehicle to possibly pick up imagery of what is below underwater in 4500 meters. that is a problem because that particular underwater vehicle can only travel to depths of 4.5 meters, #.8 miles, very difficult to determine if it's located. wrapping up the news conference we're seeing there, taking place in perth. he says pings are not significantly enough to confirm if the aircraft went down in the area and they'll continue the search as they have. looking for flight 370 and it's passengers back now to "enemies of the state" hosted by john scott. lois lerner was later asked about the house oversight committee, she claimed it was quote in the ordinary course of the application process. >> those are lies. and we can prove it's not true by looking at the data and looking at the process before 2010. >> in october of 2012, the irs sent engelbrecht yet another round of questions. the following month, barack obama swept to a second term. >> the net effect of the irs's par gtargeting of our organization was the limiting of houf how far we could reach and how many people we could engage. >> why do you think the irs behaved in the way it did in. >> because it could. >> on may 10th, 2013, in anticipation of an inspect general report critical of the irs, lois lerner admitted that her agency had indeed inappropriately targeted tea party groups for additional scrutiny. >> i'm glad to hear she spoke the truth. of course they have. what else is this? >> morning, everybody, please have a seat. >> three days later, president obama who insisted that he had first heard about the irs targeting by reading the papers spoke to the press. >> if in fact irs personnel engaged in the kind of practices that have been reported on and were intentionally targeting conservative groups, then's outrageous. >> and a day later are rick holder announced he ordered a department of justice probe. >> we're examining the fact to see if there were criminal violations. >> the defense generally from the irs has been we're not ma never lent, we're just incompetent. >> i sleep a lot better thinking that. >> in january 2014, the department of justice made it known that though its investigation has not been completed, there were no plans to file criminal charges over the irs scrutiny of conservative groups. president obama had this to say to fox's bill o'reilly during their super bowl sunday conversation. >> you're saying no construction in. >> no. >> none. >> there were some bone headed decisions. >> bone head decisions but no mass corruption? >> not even mass corruption. not even a smidgen of corruption. >> engelbrecht is not convinced. >> i was open season on political tar. the administration has taken the irs and used it as its own effect as a weapon. and that should send a chill through every american citizen whether or not you're conservative. >> but as engelbrecht found out, this was only the beginning. >> getting a letter from the irs can be pretty scary but not as scary as having government agents show up at your [ thunder crashes ] [ female announcer ] some people like to pretend a flood could never happen to them. and that their homeowners insurance protects them. [ thunder crashes ] it doesn't. stop pretending. only flood insurance covers floods. ♪ visit floodsmart.gov/pretend to learn your risk. in the case of katherine engelbrecht, it seems that the irs was trag its feet in granting her tax exempt status. but she seemed to be keeping the government agencies plenty business. katherine engelbrecht applied for tax exempt status in mid 2010. she endured more than three years of inaction from the irs. by late 2013, after becoming a poster child for alleged irs abuse, her groups were finally granted tax exempt status. but during that long wait the irs kept her occupied in other ways. >> aside from the tax exempt business -- >> right. >> -- you had more run-ins with the rivers. tell us about that. >> the irs showed up to audit our business. we'd never been audited before. here again you think maybe i just drew the short straw. we went through the audit. those audits of the businesss led to personal audits. >> in december of 2010 fbi agents made a surprise visit to the meeting place of her tea party group to ask engelbrecht a series of questions. >> it was a domestic terrorism unit and they wanted information op somebody that attended one of our meetings. >> do you think the fbi thought you were involved with terrorists? >> i don't know what they thought. >> did they ever offer you an explanation as to why they were asking all of these questions? >> no if and they either showed up or called you to check up half a dozen times in. >> right. >> that doesn't happen to most people. >> so they told me. >> then in february, 2012, the bureau of alcohol, tobacco and firearms shouds up unannounced at their manufacturing business in texas. as it happens, the engelbrechts are licensed to manufacture firearms. they say they never have. >> we don't make them. >> have you ever had this kind of inspection before from the atf in. >> no. >> what were they looking for? >> they were looking for a way to scare us. >> in july of 2012, yet another federal agency, the occupational safety and health administration showed up unannounced at their business to conduct a surprise inspection. after spending two full days scouring the business, osha found several infractions, for example, a fark lift operator wasn't using a seat belt. osha imposed some hefty fines. >> i think our tally for that little tour was $22,000, something like that. >> $22,000? >> so four federal agents are now looking at the engelbrechts, the irs, the atf, the fbi and osha. >> isn't it possible that this is all just a coincidence? >> wouldn't that be great in but you start stacking it up at and at some point, if it walks like a duck and quacks like a duck, probably a duck. >> we called up these agencies and asked for a response. the irs said they were legally prevented from discloeing any information. the fbi did not reply. the atf said they were within their right to make a warrantless inspection and osha said their was just a routine random inspection. did you ever ask any of these agents or agencies why the sudden interest in you and your lives? >> no. it was just following orders. >> where did the orders come from? >> there's the question. >> in addition to all of this attention from government agencies, engelbrecht was soon piquing the interest of high placed names in washington. some democrats complained that electoral watchdog groups were really engaged in voter suppression, particularly of minorities. >> what true to vote zeros in on student, african americans, people who would normally vote democrat. >> just days before the election, robert bower, a man who had been demanded investigations into republican groups for years, issued a memorandum claiming that true to vote was part of a republican disenfranchisement program engaged in possibly illegal intimidation tactics. >> what did you think when you saw that memo? >> i thought that puts anytime the west wing. >> here you have the former white house counsel to president obama, the former general counsel to his reelection campaign accusing you of some pretty horrendous things. how did that feel? >> i know who we are, i know what we do, i know what we're about. they're lies. >> you've been quoted as saying they picked the wrong chick. what do you mean by that? >> if this is an attempt to silence me, you've got another thing coming. i know exactly what i'm here to do and i mean to do it. i'm not the only one. i'm speaking for thousands, maybe tens of thousands, maybe more citizens who have had these types of experiences. we will not be silenced. >> katherine engelbrecht has been dealing with the government for four years now. but when we come back we'll rejoin wayne hage whose family has been battling the government through six separate administrations. how did his story end, or has it? i dunno, i just ah woke up today and i said i need something sportier. annnd done. ok maxwell, just need to ah contact your insurance company with the vin number. oh, i just did it. with my geico app. vin # is up to the loaded. ok well then jerry here will take you through all of the features then. why don't weeeeeeeeeeee go out to the car. ok, i'll just be outside... ok, yeah. his dad is my boss. yeah. vin scanning to add a car. just a tap away on the geico app. . >> when we last left the hage family saga, wayne hage, sr. who had been clashing with the government had died. so it turned out wayne jr.'s birthright wasn't just the ranch but the struggle to keep it. john roberts tells us the amazing story of the degree to which he went to save the ranch. in 2006 it was wayne hage, jr.'s turn to fight the battle that had taken up a quarter century of his father's life. in fact he soon had a new case to deal with because wayne, sr. in his final years had gradually built up a new herd of cattle but still didn't have a grazing permit. this time however when the government threatened to impound more of the hage's life stock, there was a new sheriff in time literally. >> i was informed by my deputies they were going to do a cattle seizure. >> he's been sheriff since 2003. >> they didn't have a court order and they were doing it on a signature of a bureaucrat. and i told them, i said, if you get your s.w.a.t. team we'll be face og are s.w.a.t. on the property of mr. hage to prevent you from doing any unlawful seizure. >> why did he want to put himself between the federal government and the hage family? >> because it wu illegal. it was wrong. >> the feds gave up on the idea of seizing more cattle. but in filed a civil trespass suit against wayne, jr. with this case pending along with the one his father filed against the government years before, the legal bills were addeding up wayne, jr. couldn't afford to pay the lawyers and keep the ranch afloat. >> you decided to go to law school to support yourself. >> i figured it was cheaper for me to learn the law. i had to quit ranching, lock myself in the office and devote myself to full-time litigation. >> 13 trial week, 100-plus depositions, 50 cases of file boxes, 47,000 pages of documents and 137 trial exhibits. do do you feel like your life has become a courtroom drama. >> certain times it does feel like it, yes. >> the court of federal claims established to hear monetary claims against the u.s. government ruled on the case first brought by wayne hage, sr. almost 17 years later. the family prevailed. the judge awarded the hage estate more than $4 million, plus another 10 million in interest and attorney's fees. the trespass case already a year into late gags would take almost five more to sort out. on may 24th, 2013, the hages won another victory. the chief judge of the district court in nevada filed this ruling ordering the government to renew their permits. he also found that the government pressured hage business associates not to do business with them and that officials conspired to deprive the hages of their vested water rights. >> the judge said some of the things that were done by them shocked the conscious of the court. >> he said that several times, that it shocked the con. science of the court. >> the court found instances where they were wandering on to land. the cost of the damage, $165.88. it was long awaited vindication. even though the hages won back thath rights, they still haven't had their permits renewed. >> do you have any reason to believe they'll back off?
