In it, democrats make the case about impeachment saying the evidence is clear that President Trump used the power of his office to pressure ukraine into announcing investigations into his political rival, former Vice President joe biden and a debunked Conspiracy Theory that it was ukraine, not russia, that interfered in the 2016 election. These investigations were designed to benefit his 2020 president ial campaign. The democrats go on to say, the matters are not seriously contested. To the contrary, they make it plain that President Trump abused the power of his office for personal and political gain at the expense of National Security. Heres a sample of adam schiffs Closing Argument. Theres really no contesting the facts. Theres no contesting what all of these witnesses have said, which is the president conditioned two important official acts of his office, meeting in the oval office with the president of the ukraine, something that he sought and 400 million of taxpayer funded military assistance to help ukraine fight the russians. Chairman schiff he hopes that argument helps move the need well the American People making the case for impeachment. Trace . Trace the chairman is about to make his way into the room now. Meantime, as were waiting for the chairman to come in, what are we hearing from republicans, mike . Republicans are asking why is it that tonight when they vote on this report that its happening behind closed doors . Chairman schiff. Today we transmit the report of the work of three committees, the intelligence committee, the Oversight Committee as well as the Foreign Affairs committee into the president s misconduct with respect to ukraine. At the outset, i want to just thank the incredible members of all three committees as well as our amazing staff that did long hours of work through depositions, open hearings and compiling all of the evidence in to todays report. It was enormous task. I want to begin by acknowledging the great work of the great and late colleague of mine, elijah cummings. We continue to be inspired by his legacy and guided by thoughts of his integrity and the great moral clarity that he always showed in his work. I also want to thank my colleagues, chairman angle, chair woman maloney for their tremendous work as well. This report chronicles the scheme by the president of the United States to cooers an ally, ukraine, that is at war with an adversary, russia, into doing the president s political dirty work. It involves a scheme in which donald trump withheld official acts, a white house meeting, as well as hundreds of millions of dollars of needed military assistance in order to compel that power to deliver two investigations that he believed would assist his reelection campaign. And i want to underscore first of all just how important that white house meeting was to ukraine. Ukraine has a new reformer as its president , president zelensky. A meeting with the most important patron of ukraine, the president of the United States in the oval office carries enormous significance, both to the people of ukraine but as equally important to russia. That the United States has ukraines back in its conflict with a nation which invaded its territory. The military assistance is also absolutely essential. As president zelensky goes in to negotiations with Vladimir Putin, the fact that the United States is providing substantial military assistance approved on a bipartisan basis by congress is enormously important. The withholding of that aid for a period of time sends a disastrous message to friend and foe alike that the United States does not have the back of its ally. So these were things that you crane desperately wanted and needed. At the same time, there was something that President Trump wanted and believed that he needed and that was an investigation that would damage the rival that he feared apparently the most, joe biden, as well as an investigation into a debunked Conspiracy Theory that it was ukraine, not russia that interfered in our last election. That Conspiracy Theory, which is often summarized or characterized by the term crowd strike. That is a russian narrative. That is a Conspiracy Theory put out, promulgated by Vladimir Putin to deflect attention away from russias interference in our own elections and to try to drive a wedge between the United States and the nation of ukraine. So thats what the president wanted. These two sham investigations. One into joe biden, also debunked and discredited, that sham investigative theory but also into this idea that ukraine interfered in our election, not russia. And he was willing to sacrifice the National Security of the United States by withholding military aid and diplomatic recognition of the white house meeting in order to get what he wanted. That scheme, however, was discovered because among other things, a courageous person stepped forward and blew the whistle and because congress announced they would investigate the matter. Once we began our investigation and once it became clear that this would be public, the scheme would be public, only then did the president of the United States release the military aid. As for the white house meeting that the ukraine sought, that has still not happened to this day. Now, what does this mean for americans . Why should they care about what the president did vis a vis ukraine . Why should they care about ukraine . First of all, this is not about ukraine. This is about our democracy, this is our National Security and whether the American People have the right to expect that the president of the United States will act in their interests with their security at mind and not for some elicit personal or political reason. So americans should care deeply about whether the president of the United States is betraying their trust in him, betraying that oath that he took to the constitution to protect our country and defend its institutions. So we should care about this. We must care about this. If we dont care about this, we can darn well be sured the president will be back at it doing this all over again. Because indeed, he already has. First, there was the invitation to russia to interfere in our last election. Hey, russia, if youre listening, hack hillarys emails. They tried to do exactly that. But then there was the use of this official power to compel another country, ukraine, to interfere in a 2020 election. And even after our investigation began, even after the impeachment inquiry began, there was President Donald Trump out on the white house lawn, once again making it abundantly clear that he wanted ukraine to investigate the bidens. And once more, he wanted other countries to interfere in our election as well and that china should also investigate the bidens. This is the result of a president that believes that hes beyond indictment, beyond impeachment, beyond any form of accountability and indeed above the law. That is a very dangerous thing for this country to have an unethical president , who believes theyre above the law. The question now is what does congress do about this . One of the other very important elements of our report today, which goes beyond the president s misconduct with ukraine, goes to the president s obstruction of the congress, of a coequal branch of government. And i want to underscore also the seriousness of this misconduct. Because the president informed every department for which we sought records, the state department, the office of management and budget, which has the records against the withholding of the aid, the defense department, his own white house personnel, to refuse to turn over a single document and answer to congressional subpoenas. The president obstructed witnesses to not appear. He used his office to try to intimidate witnesses. If the Congress Allows a president who is so fully and blankedly obstructs the work of congress into his own misconduct, then we are begging for more of the same. We are signalling to any future president that can engage in any corruption, malfeasance and negligence and theyre beyond accountability. To my gop colleagues, they need to consider that when we have a democratic president are they willing to say in answer to their oversight that a president may simply refuse. Because if they are and if we do, it will mean that the balance of power between our branches of government will be fundamentally altered and altered for the worse. It will mean that future corruption and incompetence will be far more likely than it is today. The facts are here are not sear justly contested. The evidence of the witnesses is very similar. After watching the hearings and the members of the two parties to the testimonys witnesses, if you thought there were two different hearings going on at the same time. This points out another danger that the Founding Fathers were all too aware of. That is the danger of excessive factionalism. A party is so wedded to their own party that theyre unable to do their constitutional duty. I firmly believe that if one party relinquishes its responsibility to the constitution and to their oath, it does not relieve us of our obligation to the same. And i hope that every member of the house and the senate, whether they go forward in the house or they dont, will keep in mind their duty as to the constitution. Not to the person of the president that ought to be our guiding principle. Finally, i think what is presented to us here, really so aptly summed up in what the president s own chief of staff had to say when he informed the country that yes, indeed, they had withheld military aid to get this political investigation. He told us to get over it. To get over it. That is what the president does. We should just get over it. This is essentially what he was saying. That we need to just get used to the idea of a corrupt president and get over it. So we will have to decide given that the evidence of this conduct is so clear and uncontested, are we prepared to just get over it . Are we prepared to say that we must expect from this president and those that follow that there will be a certain amount of corruption, the National Security of the country will be compromised, the oath of the office will mean that much less and in which the belief in the rule of law and the United States will be that much less. Is that what were simply to get over or get used to. I for one dont think we should get over this. I dont think we should get used to this. I dont think thats what the Founding Fathers had in mind. When they prescribed a remedy, this kind of conduct by a president of the United States putting his own personal political interests above the interests of the American People was exactly why they prescribed a remedy as extraordinary as the remedy of impeachment. And so we have a very difficult decision ahead of us to make. And i have every confidence that the Judiciary Committee in consultation with the entire caucus and our leadership will not only receive this report as well as the reports of others and make a proper determination about whether articles of impeachment are warranted. With that, im happy to respond to your questions. When did you obtain the cell phones records in this report and what did they tell you that you didnt learn otherwise . Well, i cant go into specifics of dates in which we obtained certain evidence or if indeed we obtained communications from one or multiple parties. But certainly the phone records show that there was considerable coordination among the parties including white house, coordination in the Smear Campaign against ambassador yovavanovich, coordination in the execution of the policy and this was indeed a continuum that began even prior to the recall of the ambassador. Your question gets to an important point, which there is more investigative work to be done. One of the issues that were looking into is did this scheme begin earlier than we first understood. Was this scheme in fact put in place to try to pressure the last president of the ukraine into conducting the same investigations. And was that plan put into turmoil and chaos when this new reformer, zelensky, surged in the polling and ultimately won that presidency. That is something that we continue to investigate. That is something that these phone records also shed light on. Even as we believe that we cannot wait because the president s efforts to secure intervention in the next election persist, we continue our investigation and we will. Sure sounds like you support impeaching the president. Do you support impeaching and the senate removing him from office . Im going to reserve any kind of a public judgment on that until i have a chance to consult with my colleagues, with our leadership and i think this really needs to be a decision that we all make as a body. So im going to continue to reserve judgment, but as you can tell, i am gravely concerned that if we merely accept this that we invite not only further corruption of our elections by this president , but we also invite it of the next president. So im keenly aware of the significance of the precedent we set in whatever direction we move. Im also very strongly guided by the fact that one of the seminole moments in this scheme took place the day after bob mueller testified, the day after donald trump fought that the last investigation was over, he began the next significant step in a new course of misconduct. Given that you said more investigating is to be done, you think theres a stronger case or would it be strongfer you had more time to do the extra investigation . You know, i would say a couple things. First of all, as i mentioned, we continue to investigate whether the scheme began earlier than expected, whether it also involved the last president of ukraine. But look, we have provided overwhelming evidence in this report of a scheme to pressure the current president of the ukraine, to conduct these political investigations. Leadership it move others if were able to show that this was not the first time, this was the second time . I think what we have produced in remarkable short order is so overwhelming that it ought to be presented to the Judiciary Committee now without any further delay. If we do uncover additional evidence and we learn more every day, we will feel free to file supplemental reports to the Judiciary Committee. Theres grave risk to the country with waiting until we have every last fact when we know enough about his misconduct to make a responsible judgment about whether we think that is compatible with the office of the presidency. Do the phone records test out on anything you heard from the witnesses or anything that the president said . No, they dont. At least that i can identify at this moment. I think the phone records are remarkably consistent with the coordination of a lot of this scheme. Now, we obviously dont have complete phone records. Some of them are deeply suggested who the parties were talking to in the white house or the office of management and budget. But because of the president s effort to step wall the investigation, including not turn over their own phone records and including to witnesses like sondland that asked for them, we dont have all of the answers. We do know this without any doubt. That is the president of the United States solicited foreign interference in our election and used the power of his office, the power to convene a meeting in the oval office, the power to provide or withhold hundreds of millions of aid to an ally at war to get his political dirty work done. The only question is how much more, how more extensive was the scheme, how many others may have been involved. What was the full knowledge and participation of other parties. While we intend to get answers to the questions and let the American People know the full facts, we dont intend to delay when the integrity of the next election is at risk. Mr. Chairman, your report mentions call records involving ranking members nunes. Did you speak to him about it and do you think he should recuse himself on the vote . Do you plan to prevent this report in person . The rules adopted by the judiciary provides that our staff, counsel, will present the report to the committee. Thats what we expect will take place. In terms of the ranking member, it wont surprise you im going to reserve comment. It is i think deeply concerning that at a time when the president of the United States was using the power of his office to dig up dirt on a political rival, that there may be evidence that there were members of Congress Complicit in that activity. Now, theres a lot more to learn about that and i dont want to state that that is an unequivocal fact. The allegations are deeply concerning. Our focus is on the president s conduct first and foremost. It may be the role of others to evaluate the conduct of congress. Thanks very much. Trace there you have it. Thats the intelligence chair chief adam schiff giving his News Conference. What you didnt see is on the right side of adam schiff, we saw walking in the room, he had a Bulletin Board with the points that he was trying to lay out. You can see it right there. The camera was focused on schiff but he was going point by point trying to make his case. This is what it is. The democrats case for impeaching the president. Adam schiff spoke for the better part of 20 minutes there. Kind of giving a Closing Argument like he did in the public hearings in the House Committee and took a few questions. I want to bring in brett bear, the abe core of special report. Anything jump out that he just said here . A couple things. Youre seeing the outlines of what chairman schiff and democrats in the majority believe are the articles of impeachment. That is bribery, abuse of power, contempt of congress and obstruction of justice. Those four generally. And it will be up to the Judiciary Committee to put it together. The thing that jumped out is this explanation about why democrats have to move fast, move now. Because chairman schiff said that they believe the president could do it again. Saying reach out to other foreign entities to somehow affect the 2020 election. So they feel theyre compelled to act now as opposed to wait for these key people to testify like Mick Mulvaney and secretary pompeo and rudy guliani. That would have to wind its way through the courts. Schiff is saying thats why we have to move now. Its interesting. He mentioned mulvaney again. We saw in the hearing that they played the comments of the press conference with the white house chief of staff said what he said. Theres a chance the democrats are betting that when they get to the senate, that they could compel mulvaney to testify. They only need four republicans to come over to change the rules on that. It would be up to Justice Roberts who would preside in the senate trial. I think that they might say that theyre trying to do it that way rather than go through the courts. Trace on your point, its fascinating. He said at some point in time, we need more investigative work to be done on this. He said i dont have all the answers. Then he said the evidence is overwhelming and sounds like they could use more answers, more evidence but at the same time, they appear to want it fasttracked. Fasttracked. Their reasoning is that somehow they have to compel lawmakers to vote the president out of office before he does it again in their words. I think its just an interesting argument to make. Republicans are pushing back that they say this whole thing is a hoax, its made up, follows the russia track that the democrats have trying to get him out of office and this is an Election Year and the voters should decide 2020 whether they want President Trump in or out. Its going to be fascinating to see how this Judiciary Committee unfolds. Were going to start with the behindthescenes of professors arguing whether its impeachable or not. Its 3 to 1. Democrats leaning professors and one gop professor as the president mentioned today. But you will then have a vote eventually. When that vote happens, trace, its still up in the air. Trace sounds like youre talking about the hearing tomorrow. You have these four legal scholars. Three are on the record saying two saying the president should be impeached or has obstructed justice. One of them hasnt said. Look, im not going to weighin on this but clearly that jurist is a liberal and then you have Jonathan Turley who has said publicly that the democrats dont have a case here. So it seems like this is a 3 to 1 thing as you into this tomorrow and the result is obvious. And republicans are already arguing the process is not fair. The white house made a choice. Theyre not going to take part in it because they believe taking part in it will somehow give it credence. That is a choice, a strategy that theyre making. May be the right legal strategy but does prevent the other side from coming forward in this particular hearing. The question really comes down to numbers. Numbers in the house for the democrats on the moderate side. Remember, two of them already voted against the inquiry to begin with. Do you lose more in the 31 democrats that won in trump districts in 2016. And then the other numbers, if it goes to the senate, how do you move 20 republicans to impeach and remove this president . Trace thats my last question, bret. You look at this report and it seems like they threw everything out there. He talked about the president asking china to investigate, you know, joe biden and what he is saying and what adam schiff seems to be saying, were laying it all out there. Well let the Judiciary Committee pick and choose what they think they can sell to their colleagues. I think theres some truth to the reporting that theyre considering, democrats are, opening up to other avenues. Not being just focused on ukraine and as they outline the articles of impeachment. If that happens, it gets messier. Its not a Bumper Sticker for the American Public to understand. As i mentioned in the beginning, they may be calculating if they get to the senate, they only need four republicans to come over to compel some testimony. The evidence in here, half of it is allegations. The other half is foot notes to hearing testimony that is primarily hearsay. So you know, as a former prosecutor, i know that if criminal rules of procedure are violated, the case cannot go forward. This case should not be going forward. Listen to what he said. When its fair, it will be fair in the senate, i would love to have mike pompeo, id love to have mick, rick perry and many other people testify. But i dont want them to testify when this is a total fix. The president is insisting if this does go to the senate, he wants a full and fair trial and also at the same time warning democrats that if they push it that far, if they do send it to the senate, it could backfire on them because the next time theres a democrat president and a republican controlled congress, may work out badly for the democratic president. President trumps conditions release of the vital military assistance. Now hes saying the only reason he released that aid is because he got caught. Im a big believer in simplification. I said from the beginning the core of this case, trace is the president allegedly withheld money from ukraine unless they would have a press Conference Announcing something. So the question a jurist will answer, did ukraine get the money . Yes. Did they have to do the press conference. No. But to your question, they had to come up with a new narrative. The only reason it was released is because it was closed. But theres a columbo point in there, during the hearing one of the witnesses said the president was on the phone in august, tell him its going to be good news with respect to the money. That deflates the motion that the only reason he released it is because of the win in congress. Trace what if this thing, they can push it further and get Mick Mulvaney to testify, john bolton to testify. Yes, sir. That is fact. Trace so tell me about your story. Have you fought, have you told the military and said look, im sick, my children are sick. My husband feels better when he leaves the base. What have you told them . I exhausted all avenues as far as fort hood is concerned. I reached to the highest levels of the chain of command. I advocated for other military families as well as my own to accomplish safer habitable homes to no avail. Trace shannon, youre also a military wife and parent. I think its important to know that, you know, we spend so much time thanking our military members for their service. How about some medical care . How about some housing . Proper housing. What is the holdup here. What is the solution . Right. We started hearing about this issue through our network about a year ago. So we decided to take a closer look what was happening in families homes. We did a survey. In a week, we had 17,000 families respond sharing stories about vermin, lead, mold. Its not a oneoff scenario. This is something that families need to feel that they can trust the military again. This is something that were hoping a tenants bill of rights come forward so we have something to fall back on and work on together. Trace and while shannon was talking, we look at the housing that military families are putting up, in particular the housing youve had. What do you tell your kids, maureen . What do you tell them when theyre sick all the time and you dont have the ability or power to move them someplace safe . It is the most hopeless, helpless feeling i had in my life to look my children in their eyes and tell them theres nothing that i can do beyond what i have done to ensure their health and their safety at this point. That is a moment of weakness that ive never thought id have to ever experience in my life. It makes a mom as a parent, you feel defeated and depleted. Trace as any american. The military does so much for us. Shannon, did the senators seem amenable at the hearing . They did. Everybody is angry about this. This is a bipartisan issue. Nobody wants to hear about military families struggling in their own homes. We look to the holidays. We have families that have been displaced more than 100 days. Imagine not knowing when youre going to be in your house, if you can set up a christmas tree. So this is something, its not just a military problem. Its something that we should all be angry about, something that we should be active and engaged on. Military families sacrifice so much. They shouldnt have to be worried about safety. Its not much to expect to have a safe place to raise your family. So were really hopeful that we get a quick resolution so families dont have to worry about this. I wanted to touch on what senator blumenthal said. Its unacceptable but theres many families facing it. But speaking up, putting their stories out there. A lot of spouses like myself were afraid to speak for a very long time. So in getting our story out there and the recognition that the senators hear us and they care, that is moving mountains. The committee will meet at 6 00 to vote this report out. Tomorrow we have the first hearing, formal hearing before the house Judiciary Committee. The question is what do they do . Do they go to a markup session where they go through what has presented to them. Fox has told to look at four potential articles based on the report here, obstruction of justice, abuse of power, contempt of congress and bribery. Only after the markup session will be complete you can see potentially and i underscore that, maybe then will they put articles of impeachment on the house floor where the actual house would vote. Im going to run you through very important parliamentary math. This is what it would take to impeach. Theres 431 members of the house. It would take 216 yays. Theres 233 democrats right now. So if ive done the math right here, that means that you could lose 17 democrats or 17 democrats who represent the 31 districts carried by President Trump would have to vote for impeachment. Thats some algebra there. But its very important. That underscores why this Impeachment Vote again, you dont just vote on one article. They might put on two, three, four. That was the case with president clinton. The house approved two in 1974.
