Shannon are you confident with the investigations we know of, the us attorneys looking into the origin, one in the direction of the attorney general and inspector general, are you confident as those investigations play out, two of the three we get may give us answers, or raise questions about what happened . I am confident in our investigation we have done. We have sent eight criminal referrals to the department of justice and will likely have more. I am impressed with the new attorney general. I dont know the us attorney in connecticut but everyone says he will do a good job but i cant answer that question until we talk about our concerns but once you track down basically the information we have put together it would be impossible for people not to be prosecuted. It will raise the stakes and if he doesnt show up i think it will be interesting to see what chairman nadler does because it is a question of intent and whether mcgann is held in contempt of Congress Though that tool has less heat than it used to. The position of the office of Legal Counsel is without precedent in so far as the Harriet Myers decision, District Courts decision in the bush years over a similar issue and they said clearly there is no absolute immunity here for advisors such as mcgann given the privilege that is extensively exerted extends before and after his service and his testimony is Public Record in the Mueller Report. There are serious legal questions it will be interesting to see if chairman nadler takes this one over. Shannon the legal opinion does point out there were requests like this made by barack obama, bill clinton, there were people that were able to exert this privilege and not be forced to testify. They said it is a bipartisan issue, there is precedent. Harriet myers never went on to appeal so its a district opinion. It may not hold the same sway is other such decisions. They feel they are on Firm Legal Footing and is not just about this president. They want to protect the precedent for future president s. The harry myers decision was a District Court decision in the District Court cut a deal and information was provided to congress so the outcome properly exercising its oversight and legislative prerogatives but there is a very real scenario here where this is litigated in the courts and we may have precedent made as a result of this impasse. Shannon there has been so much latebreaking stuff im trying to find a copy of this letter the chairman nadler sent out a short time ago but what he said in that letter was the president has already thrown you under the bus, tweeted about not believing what you had to say about things, they werent exactly accurate, and a lot of this is already in the Mueller Report. It is already out there, you cant say executive privilege and not show up. Don mcgann will he do what he thinks is the right thing to do. He talked to congress when authorized to about matters he was authorized to talk about and now, executive privilege and don mcgann if hes a good former official will abide by that and he has made clear as his client tends to abide by that request so that will happen going forward. The question is whether Congress Tries to hold him in civil contempt or contempt of congress and sends the sergeantatarms, these they have not done it yet and even if they go to court and it takes months or years to resolve. At the end of the day it they will come to a resolution, this will play out in weeks and months, not the next couple days. The federal court, the judge today ruled against the president trying to stop the release of 10 years worth of financial records. He says it is overly broad, goes back to things before i was president. The judge said they can move forward, the president says they are going to appeal it. Where does this go . It will go to the Supreme Court. This is at the heart of the administrations attempt to get around Constitutional Authority and strikes the separation of powers.
