Welcome to fox news night, i am Shannon Bream in washington. We begin tonight with correspondent kristin fisher. She is following the latest on the partial Government Shutdown from the white house. Good evening. We are now 59 minutes away from this becoming the longest shutdown in the history of the United States. Both the house and senate have already adjourned, so that discouraging milestone is going to be met and it is happening at the very end of the same day that those 800,000 or so federal employees missed their first paycheck. Today, Congress Passed a shockingly bipartisan bill guaranteeing back pay for all federal employees, and President Trump says he will sign it but that is where the compromise ends. Nancy pelosi left for the weekend with these parting word words. We mentioned, a temper tantrum by the president. I am a mother of five, grandmother of nine. I know temper tantrums when i see one. President trump may not be backing down his demands for a while, but he did dial down the threats of declaring a National Emergency. Today, he pumped the brakes at a white house roundtable on border security. What we are not looking to do right now is call a National Emergency. What will happen, i will be sued, it will be brought to the ninth circuit, and may be even though the word is unambiguous, just like with the travel ban, it will go to the ninth circuit, and we will probably lose there, too peer to. Besides, he got pushed back from Congressional Republicans who didnt like the idea of capping a Disaster Relief fund meant to help california, puerto rico, and texas after wildfires and hurricanes. The senator said today, i will tell you i will oppose any programming of the Harvey Disaster funds. We make very sure to make sure that the victims of Hurricane Harvey are able to rebuild. But the Lieutenant Governor said last night after meeting with the president at the border that he was all for it. Im not concerned about that. He will take care of us, as will senator cruz, and we will get the money to build the wall. Today, senator Lindsey Graham repeated his plea, mr. President , declare a National Emergency now. Build a wall now. Speak at the big picture, senator grahams grand bargain is dead, the National Emergency declaration is on ice, and congress has left town. They are no closer to a compromise. Here we are now 57 minutes from this becoming the longest shutdown in history, and we have no idea how or when the government is going to be reopened. Donald trump wants a medieval border wall and is trying to force us to pay a 5 billion plus ransom note. There is no reason to have a middle he will respond to a 21st century problem. The president campaigned on building a medieval style border wall, and of course, the promise was that mexico would pay for i it. I never changed my mind about the utility of physical barriers, that has never been the issue from a peer to two years ago all we were hearing was we were going to build a wall and the inference was that it would be all too thousand miles of the border, but that is simply not feasible. To simply build a wall and walk away from it would be a medieval solution to what is a very complex and dynamic problem. Over the last few years, the president has evolved to situation greatly. He talked about technology, Human Resources, and physical barriers, and we are no longer talking about the idea of securing the border, all 2,000 miles with a 30foot high concrete wall. This has evolved, the president has listened to the experts and i have always supported physical barriers. They have great utility in a lot of places. A lot of locations on our border. Shannon you have a much better assessment than most of us. I want to mention that you are among those who have said to the federal government, withhold my pay for now while we figure this all out. You are in the same place as a federal employees who are on the receiving end of this decision. I wanted to know that but also read something because you have been doing a lot of debating about who thinks the wall is not going to work, this is quoting a Virginia Tech medieval professor, trump says it medieval walls work, they didnt. Calling a proposed wall medieval is very misleading because walls in the medieval time. Did not work at the way President Trump thinks they will appear to medieval walls had more to do with the reassuring those live inside them then dividing self from others. Its an interesting academic perspective, but then we were confronted with reality, right . They are meant to make people inside feel better, but it is like a trump said, we care about the people we love inside and that is why we have these. A physical barrier is a part of a multifaceted solution, i read about this in the wall street journal today, it is about 234 miles of physical barriers, its about 75 extra Immigration Judges on the border to enhance the capacity of enrolling people, about 750 more Border Patrol agents, more detention beds that we can house the families and, remember this is a crisis because there are four more families coming across, more women and children, than there ever have been before. That is why president obama himself said it is a humanitarian crisis on the border. We are talking about technology, more technology into ports of entry. This isnt some medieval solution, it is an actual realistic, solution. It is what democrats often talk about on the house floor. They say it is all these other things, we should have a mix, and i say, dont you realize that is actually our plan . Dont argue against an idea that doesnt exist. Like the sheriff said, originally there was talk about a grand 2,000mile border wall. It doesnt work in a lot of places. In texas we have multifaceted solutions, that is what this is about. The politics of it have gotten really ugly. Shannon speaking of politics, i want to play something from one of the Top Democrats in the senate talking about the efficacy of these walls. Lets get your reaction. There isnt a single fence or wall that you build that cant be overcome with a tunnel or a ladder or some other approach. Lets be real about it. That is why we have insisted on the democratic side about being smart when it comes to border security. Shannon sheriff, you first. The senator needs to come down to my part of the world. Physical barriers do work, they have always worked. We have barriers in my county, they have great efficacy. Of course, we are always going to have any physical barrier backed up with technology and Human Resources, because the drug cartels have infinite resources. They are entrepreneurs, as we plug one hall they will try another, so they will always try to defeat whatever we place there, so they will always have to be backed up by technology and Human Resources. We will have to move Human Resources closer to the border. Its a flawed argument and i would invite the democrats to quit using the term medieval solution. I might have coined that phrase, but it is no longer applicable. What we have is congressman crenshaw, as he pointed out, a multifaceted approach to a very dynamic and challenging problem. That is what we are talking about today and that has great efficacy and it will work. Shannon in your piece you wrote today you talk about the fact that you dont just abandon things because there may be some possible ways to challenge them, but 400 people 400,000 people ce border, just because somebody can put forth a ton of resources to may be digging under it or use special equipment and really special training to try to get over a large wall the way this is, just because that is possible and because some good may be due it doesnt mean it is not an enormous mitigating factor for the vast majority of people. The solution isnt just have nothing so they can easily walk across. That is not a solution at all. I was the last saying it because it sounds crazy, and of course we would have to have something there to mitigate it, like the sheriff is saying. I wish democrats wouldnt just dismiss it in a kind of smug manner without any evidence, without any reasoning behind it. They dismiss this as an obviously stupid idea. Of course it is not a stupid idea. And medieval solutions, the point is that it has been around for a long time because these things do actually work and they are part of the solution. Not the only solution, but part of it. Shannon the white house had looked at 13. 9 billion in funding approved by congress as part of a Disaster Response bill for funding the wall. My understanding is you have had some conversations about that because there have been objections about that possibility. Of course, i am from houston and Harvey Relief funds are a big priority of mine. We couldnt possibly support money being taken away from tha that. If we do get to this point where he is declaring a National Emergency we would have to be very careful about that. I really want is a Congress Come to a solution here. I think there is plenty of for political negotiations, lets keep in mind the republicans have come down from President Trumps giant wall to a very reasonable amount, and docked 25 billion to 5 billion. Ron desantis formally suspended following the Fort Lauderdale shooting in 2017, and last years shooting that killed 17 at a high school. These incidents demonstrate sheriff israels repeated incompetence appeared in the family of the victims deserve accountability. In turn, Governor Desantis named the former sergeant as the new Broward County sheriff. It is interesting that this sheriff comes from the very same Police Department that was ran inside the high school while broward deputies took shelter outside, even though Broward County deputies knew where the shooter was. In fact, there is Surveillance Video that shows Broward County School Resource Deputy Scott Peterson taking shelter, despite seeing the shooter in the stairwell of the building. Sheriff israel later said that the deputys actions and sicken him but he refused to take any responsibility. His name is Rush Limbaugh, here is what he has to say. I have a sense that he is winning this thing big time and by winning a big time im talking about the American People. I think chuck and nancy and the democrats are beginning to look the way we see them to a lot of people. Shannon you take the pulse of the people, what do you make a brushs assessment . I think rush is largely wrong. Ive looked at the polls, and the data shows that half the American People blame the president for the shutdown, and about a third for 35 blame the democrats. It is true that the president s base remains firm, but i think the reason he has moved towards the National Emergency, the trip to mcallen, the National Address is because he realizes his strategy isnt working and as time goes on, it will work less and less as people see the impacts of the Government Shutdown. Shannon that is kind of in the vein of what Jennifer Rubin said in the Washington Post saying, Rush Limbaugh convinced him, meaning the president , that the public was with him, and no one would care that the government is closed. Not a single one of those propositions is true. Wait until they find out how unpopular taking money from actual victims of real emergencies is. And we talked to congressman crenshaw, he was reassured that that is not going to happen. But it has imploded. They are looking at a number of ideas, and i have also seen polls that show that 80 of the American People, including 71 of democrats, believe that there is a crisis or a serious problem with the border. There is another poll that shows 90 of people that think illegal immigration is a serious issue facing our country right now. Im not going to declare winners and losers because we still have federal workers who are not going to get paychecks today, and i dont think that is an appropriate way to classify it, but i think on the issue, the president is convincing people what president barack obama said in 2014, there is a humanitarian crisis going on at the border. Shannon in the meantime, doesnt look like the democrats are backing down at all. Why would they change . They have gotten a lot of mileage out of this type of moral blackmail, which is to constantly say that people are dying thanks to republicans, that this is a known issue, that this is somehow immoral to pursue this republican agenda, and always frame it in moral terms has always been a winning issue because republicans actually back down, they let that be the last word. And one, as much time as theyve had with President Trump, they still havent found their footing with him yet because this week i think he regained a lot of territory. He was able to frame this as a National Security crisis. Weve americans dying at the hands of the drugs that are coming across the border and fueling the Opioid Crisis that Congress People have up until now pretended they care about, but all of a sudden the democrats are running the opposite direction because they dont like trump. It is blindly political. I think the president is starting to expose that. In the days after President Trump fired james comey as fbi director, Law Enforcement officials became so concerned by the president s behavior that they began investigating whether or not he had been working with russia on behalf of american interests. It just goes to show that the dirty dossier fueled all of this witch hunt which continues on today. The first dozen years of college, i was with the media, and the first three letters of news spell new. There is nothing new here. We have known the top levels of the fbi were out to get the president. They disagreed with the outcome of the election and they were going to used the power of their investigation to go get him. It is very simple, it is still the investigation of a man in search of a crime. Shannon of course, there are many People Associated with the institution. The doj, the fbi say that is not the case, although it is still being investigated by the house. Im sure they will drop that investigation now because they are setting their sights on the president , but i want to read a little bit of rudy giuliani, his response in the story, he said the fact that it goes back a year and half and nothing came of it that showed a breach of National Security means they found nothing. Doug, is this much ado about nothing . I dont think we know. I would love for mr. Mueller to investigate what the fbi was doing at a time when they were in turmoil, we know that. I really think that there are so many questions raised by the time report that is not to rush to judgment, that is time to explore really what is happening. It is hard to believe that the president of the United States duly elected was an agent of russia or under their influence, but lets see why the fbi did what they did at a time when we all know they were in chaos. Speak out now is the time for the attorney general of the United States to make sure that there is an investigation done into this, because if the whole idea that confidence in te integrity of the fbis being undermined, that needs to be fleshed out. We need a real investigation into the fbi, how all of this happened and why they are beholden to political opposition that so far has yielded next to nothing by way of truth. This is unacceptable, and if you want to restore confidence in the fbi, investigated, make the results of public and reveal that you either found this, or there was nothing wrong. Democrats are making sure that their intentions to investigate President Trump now that they control powerful house committees, but in generating unexpected controversy tonight, chad is here to explain what is happening on the hill. It is not unusual for a new majority to switch up committees. Both parties understand that. They have different priorities, but now the democrats are in charge of the House Foreign Affairs committee, they are indeed ditching the old terrorism nonproliferation and trade subcommittee created after 9 11. New House Foreign Affairs Committee Chairman eliot engel, a democrat from new york, is replacing it with the panel on oversight and investigations. It is a little more complicated than that, given that the responsibilities of the current terrorism subcommittee will be farmed out by the democrats to other subcommittees with reasonable oversight. Ive taken five flights in the last 48 hours so i have talked to some tsa folks and a lot of people in the airport about how they are doing. They are worried but most of them say they will show up. I dont know why you would sue the Democratic Leadership, you need to sue the republicans, you need to bring an action in the court, which they have done, against the United States. The people, the air Traffic Controllers, tsa, many of these federal agencies, they have a right to be paid. It is something called the fair labor standards act, which applies to most of these workers, and even the government isnt allowed to violate that. Youve got to pay people at least the minimum wage. By a certain date. And if they dont, there is penalties and damages. These people are not the rich and famous, how can they afford to work without getting paid . Theyve got families to raise, theyve got diapers to buy, theyve got educations to pay for, and they are supposed to be focused .
