We begin with chief intelligence correspondent Catherine Herridge tracking all of them. One of the filings was for the district attorney, and the recommendation was for at least four years in prison and a fine of 500,000. The special counsel filing was interesting because it gave us an indication of the type of a russia information that he had been providing. I have one quote in my notebook, thats the acronym for the special Counsel Office and, the investigation that he obtained by virtue of his regular contact, the Company Executives during the Campaign Goes on to say that there was contact during the white house between the 17 and 18 time period. We dont know what the nature of the context were, whether they were inappropriate, or in the worstCase Scenario whether they were illegal. Also another key player, Paul Manafort filing there but so much of it, like the flynn filing we got days ago redacted. We have that there and, they predicted that sensitive Ongoing Investigation but what we can see in the section that is public is the allegation that violated his plea agreement with the special counsel which was over his contact with the white house and administration, two episodes in the spring of 2018. We dont know what the substance of the contacts was about but they said that was a violation. What has my attention at this point was the section that is under seal, thats not public and whether that relates to anything in the campaign. Or transition. One of the names coming up is tony podesta, obviously a key player here in d. C. So if we look at the venn diagram, tony podesta is a brother of john podesta who ran a ran Hillary Clintons campaign in 2016. Tony podesta obviously wasnt levying with the ukraine, and what i find interesting is that we are hearing again this is becoming very active just a couple of days before the sentencing memos. We look at timing with the data points to see if there is a method with the madness. There is shoe on both part know mike feet, so the republicans and democrats are under the microscope for the foreign lobbying. And thats a great pivot away from the trump russia collision and, this has all been about from day one the effort to impeach the president and of course that doesnt require trump russia collision. So we do know, that was the task of the special counsel and they do talk about the fact that individual number one who we all believed to be the president , they say that he was actually directing with respect to paying off a couple of women who said that they had Financial Affairs of the president. Law professor and attorney Jonathan Turley had this to say about those particular parts of the cohen filing. They are directly implicating the president of the United States. These are rarely criminal matters but they can be a crime. The issue is not how serious is this crime to prosecute, the issue is, the council has come as close as you could get to accusing the president of a conspiracy to commit a crime. We know often these election violations go nowhere, they are a slap on the wrist or a fine or you make it right. What do you think happens in this case . Before coming to the white house, i spent six years in new york is a federal prosecutor, and ive written a lot of sentencing memos and read a lot of sentencing memos. The sentencing memos today were deadly stuff. And its not a terribly good day for the president. October of 2016 on the two payoffs, and these are not Just Campaign finance violations, a prosecutor can look at those and say, that looks like money laundering. Well that looks like fraud. Those were according to the prosecutors, and those were not muellers prosecutors, these are the Southern District of new york, career prosecutor saying, this was active cooperation between Michael Cohen and the president to pay off these women and keep them from coming forward with their stories and interfering with their election. With all these filings on the table, this is the way the president called it tonight. It totally clears the president , and they call it a complete exoneration of the president , and they are very happy about it but alex, we wouldnt expect his legal team to see anything different. I wouldnt expect that and they wouldnt be doing their job if they said anything different. And and hes very significant. That does name the president , someone who uses the unindicted coconspirator term, and per doj policy, everyone agrees you cant indict a sitting president much less for this. Then you have the two mueller filings and manafort and cohens cases and i would argue that while the president was not exonerated, nothing that came out today really raises any additional issues in terms of legal liability on those cases for the president. What i do find remarkable was in the manafort proceeding, the fact that he lied about being in contact with senior officials in 2018. Because you mentioned that, i we have part of that from what happened today. They said that basically, and ask egos talking about the fact that manafort is accused of lying, and they say that document could serve as a warning shot to other witnesses not to lie or tell partial truths which includes a president who has already submitted his written statement to the team. There is no doubt, you shouldnt lie. You will get in trouble, but on that issue of why was any Administration Official talking to him when he was either indicted for a felony or pled guilty to a felony, thats pretty remarkable. But if i was the president or unhappy about any of this today, i would be focused on that regard. These two different memos, very different, the prosecutor basically said this guy didnt help us very much. We dont think you should make the sentence any more than you have to, but weve gotten all kinds of information. The defendant has committed to provide relevant and a truthful information in an effort to assist with the investigation. Quickly from all of you, what kind of cooperation do you think they have with cohen Going Forward . I dont think much. You can tell from this filing, they dont file a 5k letter or memo on behalf of cohen, because he didnt provide much cooperation or juicy information that they could use in building their narrative of collusion. Basically, they recommended that his sentence relying to congress which is what the special counsel jurisdiction wasnt ran concurrently with his sentence imposed by the Southern District of new york. So i think what we have here, i want to go back to the big picture for a minute because we have sort of an unprecedented appointment of the special counsel by deputy associate attorney general Rod Rosenstein based on no criminal predicate, no evidence of crime. Thats very much like watergate, unlike whitewater, and all of those involved, the evidence of the crime prior to the appointment, we didnt have that. We should have never had a special counsel appointed. They used this power to shake down every associate of the president so they could take down the president. You could also conclude from the fact that President Trump has been tweeting about this repeatedly in recent days on showing lots of frustration that there is concern, concern at his level and no doubt concerned that the staff level as well. That wasnt part of his mandate and no one is going after these russians. They are not coming to disneyland where they could be arrested, so that is moved. We know that a lot of these special counsel or independent councils, whatever whatever theyve been called over the years, they dont always stay on the original track. Thats exactly right. There is another aspect to it which is that all the possible crimes, those that have arisen as a result, after it began in terms of whether people cooperated or lied or whatever to the fbi. I think really most peoples conclusions looking at all this is that it just confirms how out of touch and decadent, frankly, our political and media establishments are. They spent all this time, thinking about russia were talking about russia, and thats a low unemployment and out of the workforce, very serious issues going on. Yet this obsession with russia continues. I think the frustration is, this is a total focus of everyone in official washington and its obviously frustrating when there are so many real problems to address. One thing they have to be thinking about this, the memo, this has to be something they think about, too. It talked about relevant and useful information concerning his contacts during the 201718 time period. Im guessing they go over in their minds with the conversations and their emails and texts about what those medications and contacts could have been. We dont have any more details than that, which you just read it, but you read that muller and his prosecutors are drawing connections and getting closer in some ways to President Trump and the people around him, and they got some help from cohen in that endeavo endeavor. Theres so much redacted and so much we dont know, there could be nothing touching on the president or anyone, especially his family members.
