Within the 568 pages is a thorough examination of political bias and missteps by top fbi agents and officials at the doj Inspector General concludes there is no evidence s tainted their investigation. The language is very important here. Tonight we are examining the claims conference of coverage of the wideranging ig report on the kind of email investigation release lead today. We begin with chief intelligence correspondent catherine herridge. Shes been pouring over this. All right, so were hearing that there is no evidence of a political bias but what does that really mean . So i think the language really matters in this Inspector General report. If you look at the specific section in the executive summary, it says we did not find documentary or testimonial evidence, so we didnt find paper or witness testimony that there were any improper considerations including political bias. So if you read in between the lines here, shannon, and i know you are doing that with your legal mind, what you see is they never found paper or witnesses that spoke to it to make that connection but its not to say it didnt happen. Shannon okay, there was also a new text revealed from fbi agent peter strzok about stopping trump, stopping him from becoming president. My understanding that was previously redacted when house lawmakers were given some of this material. What we learned today is that they have been pouring through a friends review with the strzok and page cell phones and its been an ongoing process. Every time they did another cycle, new Text Messages would come to light. This particular text message which comes from august of 2016 only came to light last month. Thats how annuities. The Inspector General, based on what we learned today, makes kind of a pivot in his conclusions, saying we felt that before january of 2016 and the comey Public Statement about the clinton emails, we couldnt find evidence of political bias. But after that and based on this text, we think that in the later stages, there may been political bias. And that agent strzok was prioritizing the Russian Investigation and not prioritizing the clinton email investigation. Shannon seems like there is an openended question that the ig said much of these texts were about the russia investigation. Almost leading you to think theres going to be more of that conversation. Im glad you picked up. Net. I think he was communicating is that im not making judgments per se about all these investigations, just the clinton case. Wait for chapter two, whether there was political bias at play. Laura it may be a whole nother layer. Also the question about whether any kind of foreign entity was able to hack into Hillary Clintons emails. We did a lot of reporting here at fox news about the likelihood that there was some kind of compromise of the clinton email server or her classifying emails. Thats important because that would be a strong indicator that there shouldve been a criminal prosecution. In the ig report for the first time, we see documentary evidence that the fbi knew that some of Hillary Clintons emails were compromised either by foreign nations or foreign Intelligence Services. And this is a very important quote in the comes from 2017. When an fbi inspecting team did a review of how the clinton email case was handled. It states classified information was improperly stored and transmitted on clintons email server and classified information was compromised by unauthorized individuals to include foreign governments or Intelligence Services via cyber intrusion or other means. That is really in black and white now. We know that there was a breach or a compromise of the clinton emails, at least one, the secret level, high level of classification. What it doesnt say is that the server itself was compromised but in terms of criminal prosecution of that really doesnt matter. What matters is the classified information fell into the hands of a hostile adversary. Shannon Something Else we saw today, the draft that the comey exoneration lender went through and that one point there was a mentor that president obama was one of the people she had communicated with in an area that they thought may have been potentially compromised in a hostile area and talking about somebody with the foreign influence probing in. But they took president obamas name out of the record and said a senior or highlevel official. His name was scrubbed from the draft. I guess one of the lessons here is that its kind of a do is i say but not as i do. What we learned is that everyone at senior levels of the u. S. Government is counseled against using personal email especially for government business because of classification issues. But what you saw throughout the report is that even director comey was using a Gmail Account for his work at the fbi. Hillary clinton used it as secretary of state and president obama all used it does well with his highly secured blackberry. I think what matters for folks at home is that you have in some cases the crown jewels of the u. S. Intelligence community that are very vulnerable or exposed and in this case we now have evidence that some of them fell into the wrong hands. Our ongoing reporting were shown to be accurate and backed up by the Inspector Generals report because we took a lot of pushback on some of this reporting and im glad to see a lot of it was indicated. Inspector general concluded text between fbi agents implied one of them might be willing to take official action against then candidate donald trump yet key players are not over whether that means there bias impacted their investigation. This report did not find any evidence of political bias or improper considerations actually impacting the investigation under review. Chris wray, im sorry, youre wrong. There are consequences. Great to be here. Thank you. Shannon lets talk a little bit more about what weve learned today. I want to start with this comment from congressman trey gowdy earlier tonight on special report. Peter strzok, the fbi agent who was on Hillary Clintons investigation arguably the lead russia investigator, not only wanted to stop his campaign but once he won, got on the Mueller Probe because he wanted to impeach him. Thats a level of animus and bias that everyone should reject. Shannon and d, the overall conclusion of the Inspector General is that if there was political bias, they didnt see evidence it that factored into any decisions made on the investigation. Does that settle it for you . No, it really doesnt. Think about how carefully their wording this. I really dont like it when they say theres no evidence because that means there is no suggestion in the record that bias could have been a factor. While they are saying here and its very carefully done is that while the ig was evaluating was a series of judgment calls and they were not going to secondguess peoples discretionary judgment because their metric was, was the decision made a rational, not whether they agreed with federal whether it was the only decision that couldve been made under the circumstances. If thats where youre coming from and youre also saying at the same time there is pervasive evidence that they had bias, they cant rule out the fact that bias may have played in and may have been decisive. What they are actually saying is we dont have evidence here from which we can conclude for certainty that bias was what the driving factor was here. But they cant discount it. For them to continue to say there is no evidence that bias played a role here is just preposterous. Thats not what the report says. Shannon well, it feels a little bit like the david james comey, then fbi director, came out and outlined this entire case what happened with Hillary Clinton and then at the end said but theres nothing prosecutable here. Were going to decline to move forward with any recommendation along that line. Something i learned for the first time today here is that there were five different fbi employees they found text and messages that they were concerned about. Weve heard about peter strzok and lisa page but there were other people we dont have a name yet four. Do you think we will get those . I think eventually will get a lot more information than we have not, particularly in the congressional hearings. And i think where we will end up getting a lot of information, shannon, is when we get the other half of the story. I mean, if you think about what happened here. The fbi and this is evident from the Text Messages of strzok and page, they considered the clinton email investigation and the trump russia investigation as a single continuum to the point that when crews dropped out of the race and it was clear trump was going to be the nominee, the first thing these to say is, and reacting to trump being the nominee, man, weve got to get this Hillary Clinton email investigation done. Ratchets up the pressure to and made your exam, which is what they called it. And the minds of the agents, this was one series of investigations together that impacted the election. And the reason this is important is you can look at all the different decisions that got waited by Inspector General horowitz and look at them in the isolation of the clinton email case and say yeah, you know, that looks reasonable. Maybe thats reasonable. Might not have done what i wouldve done but okay. But what you dont get is comparing how they handled the email investigation to how they handled the trumprussia investigation. So if you look for example at a decision that they make to give a guy immunity even though they had ironclad evidence that he had lied to the fbi and was involved in the destruction of evidence, they make a case for why it was reasonable to give the guy immunity. If you looked at that in the abstract, you, you would say okay, well, maybe not what i wouldve done but reasonable. You dont get to compare that to the five guys that mueller has investigated where the lies that were told were not near the core of what he was investigating, and yet having them over the barrel, he prosecuted every single one of them for false statements and got them to cooperate in that fashion. Peter strzoks attorney, he figures prominently in this report, he said the ig conclude there is no evidence that the political views of special agents strzok and others impacted the handling of the clinton email investigation. That is repeated there with general size throughout the 568 pages here but you are saying common sense tells you otherwise . I dont know how he could possibly know that lessie can crawl inside your mind and actually examine their mental process. I want to complement the Inspector General for what i think is generally a very thorough work. Its something weve been looking forward to. Hes brought forth information that those of us on the Intel Committee have been beating our heads against the wall trying to get from the fbi. We are glad hes done it. Some of this is very important. Im just going to agree to disagree on this. He can presume whether it impacted the outcome of their work when it seems extraordinary unlikely. This is from someone who defended director comey for many, many years. It shows the obvious lack of leadership. How is it that the very senior people around the fbi, and we now know they are essentially political hacks. Liberal political hacks. It isnt just a coincidence. The Inspector General calling his insubordination and pointing out the fact that he was investigating Hillary Clinton, doing the same thing. The number of leaks in the Media Contacts that senior fbi officials had no business talking to the media. Accepting gifts from the media representatives. What you make of that initial assessment by the ig that there was some kind of connection but it wasnt enough to taint this. I think it raises the question of why was he interacting the way he was and why was he sharing information with john podesta . The ig report points out that he actually tipped off john podesta who was Hillary Clintons Campaign Chairman about the release schedule of the Hillary Clinton emails in 2016. At the same time that is your point of outcome he is trying to get a job for his 25yearold son. It just looks bad. This is the kind of small fish behavior people dont like. You say didnt really break any laws. Thats not the point. This is the department of justice. We expect impartiality and we dont expect them to be sharing information they shouldnt be sharing while the same time getting favors for family members and thats clearly what hes trying to do. Shannon someone else mentioned quite a few times in this report that a lot of folks may not have expected to figure so prominently is former Virginia Governor terry mcauliffe. Obviously very, very close to the clintons, key political player with them. And the party more broadly. There is talk and hear of his connection, his tax connection intonations to Andrew Mccabes wife. Weve been over the territory before. But theres quite a lot of admonishment here that there were sizable donations that the recusal to happen but maybe it wasnt fully respected by mccabe once this was in full play. Thats exactly right. Enter mccabe was told to recuse himself and not be involved in the Clinton Foundation investigation, and he was anyway. Look, this is the way the clintons of operated for more than 40 years in politics. And that is that they have a network of relationships and friends. It makes it very difficult as far as a Legal Standard is concerned of proving a quid pror some kind of collusion because oftentimes its a third party involved in the transaction. In this particular case, Hillary Clinton is under investigation by the fbi. Hillary clinton has no connection with andrew mckay but one of Hillary Clintons close political allies, the governor of virginia, is sendins of dollars to the campaign of anger mccabes wife. Its tangled, indirect, hard to prove but it still leaves the same kind of stench and thats really the problem. Its about the rule of law. Its about impartial justice. And i think as this ig report shows, that is certainly not what we gotten these clinton investigations. Excluded there were findings that the fbi agents were supportive of Hillary Clinton and antidonald trump, then a candidate. Here is what the senates top Democrat Chuck schumer had to say today. Director comeys mishandling of the publicity around the clinton email campaign will prove to the benefit of then candidate trump coming not the other way around. It was trump who benefited from all these mistakes. So it hardly reflects deep state or bias against. Shannon that sort of sums up all the press releases i got from every democrat on the hill today. It didnt help hillary. It hurt her. And help donald trump. There was no bias. The g. O. P. Is trying to link this to somehow discredit the meal investigation. Theres no proof of the deep state. And that james comey went public with a Hillary Clinton email investigation but stayed silent on the russia investigation. On and on and on. They say that it actually was very bad for Hillary Clinton in the end. Dont think thats the case, particularly when you look at the investigation and every single turn whether it was the interview with her, the interview with her colleagues, and the special concessions they were granted. The fact that they didnt subpoena the devices. They simply asked for them. I could go on and on and on. Each one of those cases the benefit was to Hillary Clinton. In one case in which they argue that it hurt Hillary Clinton, it was the comey announcements of leader that they were reopening the investigation. He had to do that because he had told a Congressional Committee earlier that they there were no emails out there and there was no longer the case. He was forced to do that not out of political calculation but because he faced the very real possibility of being accused of lying to congress. So its laughable to me that they take one incident in a long chain of events and say this one incident proves that there was no bias. You simply cant look at this in any systematic way and come to any other conclusion that Hillary Clinton got favorable treatment, extensive favorable treatment in this investigation. Push their rationale aside to a certain degree. I find it interesting that Robert Mueller to a certain degree and you read this and you read about the spirit of the comey fbi. Comeys assumptions were all based on the fact that Hillary Clinton was going to win the president ial election. Shannon thats clear in the report that they all agree thats what they thought. Thats what was going to happen. They didnt act like Law Enforcement people. They acted like people who are caught in this political swirl and as we see playing games and sending emails. The first and most important thing i take away from this is james comey is ruined. This is the full ruination of james comey. We see now why he wanted to get his book out. Reason why he did the aggressor publicity tour. This is horrible for him. And heres Robert Mueller, not a spring chicken, who basically in a sense had to come out of retirement to save this i dont want to make it sound too strong. Trump Foundation Went to actual, 0 too expensive. Clinton foundation, 93 went to expenses, travel, overhead salaries and the only 6 went to the actual charitable programmatic spending of the charity. The foundation currently has 1. 7 million remaining in which the new York Attorney general has been holding hostage for political gain. Its unconscionable, particularly because the foundation previously announced its intention to dissolve more than a year and half ago. The prior new York Attorney general who was forced to resign from office in disgrace needed his stated mission to use this matter to not only advances on Political Goals but also for his own political fundraising. They say they wanted this man of that and they havent been able to. I want to first go back and correct a few things charlie said they were plainly false. The Clinton Foundation come as Kellyanne Conway said, does very good work and actually spent about 80 to 90 of their money on charitable work. They are more like the red cross that spends directly on putting people in the ground, less like the Gates Foundation to give donations. So thats a talking boy thats freak only been used and widely debunked. But going back to the Trump Foundation, they dont just spend money on charitable giving. Pat bonnies campaign, not a charity. Donald trump and this came out today in a lawsuit, donald trump is a handwritten note directing that 100,000 from the foundation go to fix a problem for maralago. Shannon i have to say i saw that and i have some questions about that because the document that i saw, he said 100,000 to fisher house. Which people know is a military related charity. So the fact that its being characterized as something that had to do with quitting up a mess involving maralago is confusing at best. Based on that handwritten document. Sure, and this was one that was reported back during the campaign. This was a settlement they worked out where maralago had an issue with a flag and what they agreed on was were going to give some money to charity. If trump had done that with his own money or with corporate money, totally fine. You might be a good charity. Thats not the issue. The issue is using the Trump Foundation to pay off corporate or personal debts. Shannon let me bring charlie back in. The trump folks are saying this was his money, most of it that funneled through. The president is also claiming they paid out more than they actually have on hand. So, you know, i guess well have to wait and see with the loss of go straight he put his own personal money in and paid more than that lets talk more broadly here. Whats the actual agenda of the new York Attorney Generals Office. They want to destroy this president come highly politicized. Schneiderman didnt even want to do this. Schneiderman want to do everything he possibly could against this president. He even refused, saying there wasnt enough evidence. This Russian Investigation is imploding. Where the top professionals looking into this alleged brush occlusion the last 18 months and only thing they found his weight, know weve been there once colluding. They need to find everything they possibly can to create distractions integrate these proxies against the president and they would love nothing more than to try to have power of discovery against on jr. , eric, and ivanka.
