Here tonight, republicans on the House Intelligence Committee voted to release a classified memo they wrote that upwardly alleges the fbi improperly used surveillance. Christopher wray tonight says the removal of his second in command, Andrew Mccabe, was not political. Nevertheless, both of these new developments signal a sharp uptake in the political temperature here in washington. Continuing coverage tonight. Breaking right now, im told Top White House lawyers who specialize in National Security matters are now pouring over this republican memo after consultations with staff on the house intel panel. They are going through this memo carefully with two goals. It released the memo as early as wednesday so as not to step on the state of the Union Address tomorrow night. And then im hearing we will hear a new push from republicans on the health for a Second Special counsel to be named. Top people at the fbi like Andrew Mccabe and Rod Rosenstein in the Justice Department are implicated in this republican memo. G. O. P. Leaders do not think they can credibly investigate themselves. Mccabe is no longer in office but tonight hes technically on the fbi payroll because hes running through his left over Vacation Time to reach his full pension. He was removed just hours after his boss, Christopher Wray, quietly made a rare sunday visit to capitol hill to get a look at that memo. As the daily beast reports, mccabe is one of several officials named in the memo who engaged in what republicans are calling fisa abuse, to get a warrant to spy on former trump Foreign Policy advisor carter page in part with information from that trump dossier paid for by the dnc and the Hillary Clinton campaign. The president has been tweeting in recent months about the fact he does not believe mccabe should have been leading the probe of Hillary Clintons email server for so long before he finally recused himself. Today the white house tried to insist they had nothing to do with it. The House Intelligence Panel voted to release that memo on surveillance. Democrats claim g. O. P. I think he has done an admirable job serving the country and i think that this committee and others have done a tremendous disservice to mr. Mccabe. Its about democracy and the constitution. Rod rosenstein, number two at justice, and Christopher Wray were spotted leaving the white house after chief of staff john kelly this afternoon shortly before the houseboat, which now starts the clock on the president getting five days to decide whether to block releasing this memo on National Security grounds, or just let it be released. Meanwhile, the nonpartisan Justice DepartmentInspector GeneralMichael Horowitz is also expected to release an explosive report looking at the handling of the clinton email matter among other issues by mccabe and other officials. New york times reporting tonight that he was briefed on something in that ig report that sparked an effort to demote mccabe. Committee republicans will say no, this was all something we have discussed in the committee. You cant declassify this information, shannon, because it might disclose sources and methods nav potomac maybe even put intelligence assets at risk. Theres a big debate about this. Mike quigley, a democrat on the committee from chicago, he indicated that this is like someone who hasnt read the book, a teenager who was up at 11 00 at night, 1 00 in the morning, has had to cope rebels and is trying to finish the book report without winning stomach reading the book. You need that classified information. The republicans say thats not the case. Shannon why release it now . Because the question right now, some people said they wanted to get this out before the state of the Union Address. Trump comes to capitol hill to talk about this tomorrow. It seems like they will let this ride a little bit later in the week. There was a big debate on capitol hill about reauthorizing the fisa program, section 702, domestic surveillance. They did a temporary extension of this at the end of the year. They did it on a longerterm basis in middecember. Had they released this memo a couple of weeks ago, that very well could have tanked that roll call built because this program is so controversial. Republicans will say wait a minute, this has nothing to do with section 702. Some of the things which are alleged in this memo contribute to that narrative, that this was the problem with fisa overall. That could have ended the program and forced it to go dark right there. Unclear if its going to the same classification vetting the g. O. P. Is now doing with their memo. The former chief counsel for the Senate Select committee on intelligence and former Deputy Assistant attorney general, represents the members of the president s campaign in the mueller investigation, great at it with us tonight. Fbi directors and their teams are expected to serve long terms to ensure independence from the politicians they hold accountable. Firing comey, forcing out mccabe and reassigning others is a purge of independent Law Enforcement readers in an effort to place trump about the law. Your reaction . President trump should have fired james comey on day one. Just for his behavior in the Hillary Clinton socalled investigation. Who can help it if there are corrupt people they are trying to purge . Mccabe is too little too late. His wife paid over 700,000 from hillarys top democratic fundraisers to run for office. Any Law Enforcement officials should be sensitive to the fact that they should recuse themselves because of the appearance of a conflict of interest. And what did he do . He stated and he conducted. He was director stomach directing the socalled investigation of hillary and the exoneration. And then he started the investigation of the Trump Campaign with the russians. He did not even recuse himself conveniently until one week before the election. Shannon what you say to those who say the money to his wife did not come at the same time that he was investigating hillary, that they didnt overlap . It doesnt matter. They took place. She was running for office, he was helping her campaign. I was there at the Justice Department, i know what its like to say i cant do this because it might not look right. If thats what he was supposed to do. Now we see with all these texts that he was just involved with peter strzok and lisa page, setting out insurance plans deciding what to do. Shannon you are referencing a tweet that talked about a meeting in andys office and a lot of people think that andy was Andrew Mccabe. We have this memo now. At the democrats say its full of misleading information. They are offering their own memo to separate fact from fiction. Heres what the top democrat, adam schiff, on the House Intelligence Committee had to say today. We had boats today to politicize the intelligence process, to prohibit the fbi and the department of justice from expressing their concerns to our committee and to the house and to selectively released to the public only the majorities distorted memo without the full facts. A very sad day i think in the history of this committee. Shannon both sides are adamant about where they stand. Where is the truth in all of this do you think . Shannon i want to ask you before we let you go because you had some advice for the president. He said you didnt think it was especially smart for him to agree to sit down with special counsel. Noting that everybody has pretty much got in trouble so far, it has not been about the underlying conduct, which may have been legal in these cases. Its the lying about it. Axioms wrote this. He says one source who knows trump as well as anyone told me he believes the president would be incapable of avoiding perjuring himself. Trump doesnt deal in reality, the source that, he creates his own reality and he actually believes it. You know the fact is that if you get anything wrong if you are sitting there in a conversation with a federal investigator, you could get yourself in a lot of trouble. Theres any crime at the basis of this investigation. Thats the frightening thing to me. Theyre supposed to only be a special counsel appointed if theres criminal activity, and Rod Rosenstein directed bob mueller to look at any links of coordination between the russian government and the Trump Campaign. There is no criminal conduct stated in his directive to bob mueller. That is scary in and of itself. The second thing is you dont have to have lied. Scooter libby didnt lie. He said what he thought was the truth, another witness said what she thought was the truth and the special counsel in that matter, in which Scooter Libby was indicted, indicted Scooter Libby without one other minutia of evidence. Two years later that first witness recanted because she found other evidence. Its frightening, because you dont have to lie. If a prosecutor thinks you can be indicted just because you disagreed with another witness. Shannon its a very delicate dance. The president stands by his previous comments, but in terms of the situation today, as i just said, weve seen reports just as all as you have, we dont have any specific comments and i would refer you to the fbi for any specifics. Let me ask you this, do you think this comes up in a speech at all or do you think he does not touch the situation . To a certain degree he might be obliged to stick up for his own Justice Department because now we come to the point where the attacks are so constant on the Justice Department. These are the president s appointees. We know he doesnt like Jeff Sessions. He doesnt like the way Jeff Sessions has done his job. Shannon he didnt like the recusal. It stuck with him. I dont know how much longer Jeff Sessions really can stay on as attorney general given the way in which republicans in congress and the president basically say the Justice Department is a mess, the fbi is a mess, everything is a garbage fire disaster. The president could go a long way towards getting past this part of it by saying Christopher Wray, our team at the Justice Department, our team at the fbi, great people, doing a a great b independent and strong. If you were to say that that would probably help them a great deal. I dont know if you will. Shannon this is what hes up against. They want to know that we are going to come forward with an infrastructure package. They want to know that we are going to work on immigration. Jobs and the economy, the wonderful tax cuts and jobs act that we just passed last month is providing wonderful opportunity across the united states. Those of the things that the American People are really interested in and they want us to work on. Shannon what kind of message do you think he should have to run a . What kind of words are concepts or themes would you like to see from him . Again, going back to those main points that i just mentioned. It will be important to communicate that to the American People. The president , i know, will speak from the heart. Hes very good at that. And when he does it and stick to those topics that the American People want to hear about, they are caught up in his speech and in his language. I hope its a message of optimism, keeping america safe, keeping a strong, and of course making us all proud to be americans. Thats what i hope to hear from the president and thats what i truly expect. If you dont like something, you filibuster it. And you dont ever see results. Its time to have those discussions and i do think that we can do better for the American People. But in a bill today, this very important paincapable unborn Child Protection act, it had 51 votes, the majority in the senate agreed that this was a good piece of policy legislation, and it couldnt move forward because we didnt have the 60 votes necessary. If sweeping, very broad sanctions covering whole sectors of the economy and enforcing them with military force where necessary. We are not doing that and the result is the sanctions dont work.
