There were big crowds out this morning but no violence despite a lot of drama and emotion. I have to go. An Emotional Press Conference featured family members of Rayshard Brooks to express their pain and anger. No one walking this green earth is fixing to be shot and killed like trash in the street. For falling asleep in a drive through. Brooks had fallen asleep in his car at a wendys, blocking other vehicles. Police were called at 10 30 p. M. I have my daughters there. He talks calmly with the police for more than 20 minutes until they intended to handcuff him after he failed the sobriety test. Brooks grabbed one of the officers tasers and had turned to fire before continuing to flee. The medical examiner report ruled brooks death a homicide, fighting he died as a result of two shots to the back. Its going to be a long time before this family heals. He left behind a wife and four children. His wife asked protesters to remain peaceful. Speak we want to keep his name positive. Thousands march to the state capital demanding new loss to regulate police conduct, including the coach of the atlanta hawks. I was born a black man i know onone day ill die a black man t i dont want to die because im a black man. Todays march fellows weekend approaches that include the torching of the wendys where the shooting happened. Burning down buildings will not get us change in this city, because of anything, it is going to erase the message. The police chief also resigned. This doesnt seem to be the political will on the part of Washington State governor jay inslee or seattle mayor jenny durkin to make any moves for the police to take this area back. President trump is clearly running out of patience. Listen. These are violent people that took it over. These are not people that are nice people. I saw on your network today, john, i saw what went on with the heating in the punching in the beating and all the other things going on in seattle and then you have a governor that doesnt do a damn thing about it and you have a mayor who doesnt know shes alive. Shes talking about a lovefest the summer. If they dont do the job ill do the job. You heard President Trump mention the mayor of seattle, she tweeted pretty much immediately after the comment saying our president will do anything to avoid listening to the voices of millions of americans asking for change. Have there been isolated incidents of violence . Yes there have. Street people forcibly removed. Was there an attempted robbery just outside the zone yesterday . Yes there was. Are those incidents isolated . Yes they are. Theres been thousands of interactions among thousands of people of the last 72 hours. We have witnessed much of it and the fact on the ground is that this is overwhelmingly peaceful. If the president or anybody else wants to watch those incidents of violence which are being tweeted and retweeted again and again, yes, you can get the impression that this is violent and chaotic. There is music. There is kids and all kinds of things going on but you say youre seeing Something Different at night. Whats happening and what are you seeing . With all due respect to the reporter there, i think the autonomous zone can be described as a sort of dr. Jekyll and mr. Hyde in that you see during the day yes its very peaceful. Families come down and people come there with their pets. Its peaceful if you can ignore all the boardedup businesses, all the graffiti calling for the murder of police, yes thats peaceful. Then at night you see the criminal elements come out. Unfortunately last night that was made very clear when one person on microphone and a loudspeaker was able to sick a mob of probably more than a hundred people to chase down this business that was several blocks away. They all descended on it. They pushed up against the fence and rushed in. It could have been extremely violent. Fortunately it wasnt, according to what i heard from the owner and staff. They had detained one of the comrades of this camp for alleged arson and theft. And because of that all his comrades came to help get him out. The police never came. Shannon okay. I want to read something from the daily beast. They say local businesses there are loving it, they are loving the zone. Their estimation is local businesses are chipping with free food and open bathrooms despite rumors that activists were holding them prisoner in their own beer hall and inside movie theaters. Whats been your experience with Business Owners within that zone . How are they doing . Sure, there are some businesses whose owners ar and management may be sympathetic to whats going on and have liked whats happening. There are others who dont. For example, there is a trader joes nearby who announced just a few days ago that they are closing indefinitely because of security and safety issues. When you take that and you also see all the businesses that are boarded up, that no cause can drive into this area, i dont see how the few anecdotes of positive experiences of some owners could be the representative voice particularly when there are now some dissident voices coming out to speak, and they are having to do it anonymously because of threats of retaliation. Shannon i thought it was very interesting that the police chief says we are asking people to come out to the edges of the borders of this area to make reports so we can know whats going on and try to help them. It doesnt sound like a very efficient way of doing it but she says basically we are trying to do the best that we can. If there are serious crimes will go in because thats what we do. We are the police and thats what we have to do. Here is someone who wanted to remain anonymous but someone who lived in the area or nearby. This is what the anonymous person identified as brandon tells the daily caller. For the first time in my life on capitol hill, i hear gunshots every single night. Ive heard people screaming every school night outside. They are not protest screams. Ive heard protest streams. Also heard screams of terror out there and i dont know whats happening out there. Shannon he mentions gunshots. Andy, what are you seeing, what are you hearing with respect to people who are bearing arms. Are they doing so legally . What do you know about the claims hes making . You see a lot of people openly carrying weapons. Handguns, rifles, batons or even knives. Theres quite a lot of open drug use as well. Night its completely different than during the day. You see vagrants come there, some are dealing with mental and health crises. There was an ambulance that was called yesterday. The fact that police are not going in should tell you quite a lot. One of my sources told me last week if anybody needs help, you actually have to leave the physical zone and return to the u. S. , lets say, to get help. This is now a oneweek experiment in anarchy and chaos and those who live there have to fend for themselves. We havent heard from nypd just yet but some of the unions representing them saying this is a blatant attack on police. Something we are learning just within the last 30 minutes. We are learning that three different officers were at this shake shack just within about an hour. We are told that they are expected to be all right. I want to start with this, the New York Times, this is how they characterize the law in georgia. Officers may use deadly force of the reason he believabl belia felony suspect possesses a deadly weapon, imminent threat or probable cause to believe the person has committed a crime that involves serious physical harm or the threat of such harm. Daniel, i want to start with you. If you had a chance to look at it and as a former officer, would you make of this case . This case isnt as clearcut as the floyd case where we saw clear probable cause and the video claims the homicide occurred. Walter scott case. Running away without engaging in a confrontation. Unfortunately there was physical assault on the officers beforehand and the suspect grabbed the officers teaser and ran away with it and then engaged the taser against the officer. I have the benefit of 20 20 hindsight where i can watch the videos. Up and engage in the foot chase, not injured, not out of the fight. Know all the facts and the circumstances with 20 20 hindsight and im hoping i never wouldve i wouldnt have taken that shot. When youre met with force, the officer has the right under their conduct in our use of force laws, he can use one level forth above and potentially an officer could be disabled by a taser. Then he is going to fire. They can easily access the gun and then they are killed with their own firearm. Knowing this what i know now with the hindsight of 2020, i hope i wouldnt have done that but its not what i would do that counts. We dont know the officers medical condition. If he has in a fib or pacemaker or other device, cardiac a rhythmic event could cause him death or great bodily injury. We have to look at that at that time. Its a tragic event for the family, for the victim, for the officer and community. Its a tragic loss of the time when tensions are high and certainly not something we needed Going Forward when we are trying to figure out how we place our communities in an effective way that the community can accept and the police are able to perform. Shannon robert, youve got to think officers are so nervous about everything they are doing right now. There are a lot of fears. They know they are being recorded. They are trying to be careful because no one wants to kill somebody, suspect, unnecessarily when theres not a threat of deadly harm immediately to them or others. How do you walk through this case . There are calls for murder charges. I think i think based on what weve seen so far theres good to be more that comes. I think would be hard to get a conviction on that particular charge. I dont think you get to the point of murder but i think you get to reckless conduct. The attorney for the family presented today additional shots fired. One hit a passenger vehicle in line at wendys. Nearly struck somebody. There was a family in the car and that bullet could have struck that family. There was no immediate risk of death for those officers. You had somebody who is passed out drunk and frankly i think we are talking about this discussion about defunding the police, this is what people are talking about. When somebody is passed out in their car and drive through, you send an ambulance. You take that person to the hospital. You get them an iv and then you get them into alcohol treatment to find out whats going on. So that when we put police in in the situation where you send them into a confrontation like this with nothing but a gun, taser, a billy club and pepper spray, the there are no positive outcomes. This is what people are talking about when they say we need to reevaluate how we do Law Enforcement in the country. Shannon what about that assessment of having alternate means where people show up when it appears when officers come it looks like that trickle what they were assessing, they thought he mightve been operating the vehicle under the influence. How do you balance that . Shannon, whats unfortunate is that most people passing judgment on the police were never in their lives in a shoot, dont shoot situation. They never had to make a splitsecond decision like i have been other officers have during the course of our career. I think whats important for people to understand is that especially in this case, this was a tragic shooting. No Police Officer wakes up and wants to kill anyone during the course of their duty. But heres a situation where the police were very, very calm, very professional when they approached the vehicle. Up to the point where what happened, the suspect resisted. Not only did he resist, he fought and fought and fought. They are rolling around on the ground and then he grabbed a weapon and believe me a pen could be a weapon. He runs away and turns and fires of the Police Officer. The Police Officer had to make a splitsecond decision based on what my colleague said a few minutes ago on whether the officer felt his life was in imminent danger. So i believe that as we move forward and ive mentioned this a few times, i believe that lawmakers and others should go through Police Tactical training courses where they are put in situations to shoot and dont shoot. They will have a better understanding of what Police Officers face as they are running into these situations. This was escalated not by the police. He was escalated by the suspect and all he had to do was comply and we hear that all the time. Just comply with the police. Shannon yeah. Its heartbreaking to watch the lead up to this and see the very civilized conversation and the respect they have for each other and for her to end this way. We do know the new mexico civil guard was on hand for that protest. In Chicago Police are investigating vandalism of two historic statues, a 100yearold statue of George Washington that was covered in graffiti including slave owner and burn down the white house. Chicago University Professor of africanamerican studies lionel kimball says its better to have a conversation about what washington means instead of destroying history. Christopher columbus monument on chicagos west side also appears to have been vandalized. In delaware, statue of Caesar Rodney was taken down that we dont know if its a permanent move or simply to protect the statue. Rodney signed the declaration of independence, served as delawares president during the american revolution, and was a slave owner. But in philadelphia, statue of abolitionist Matthias Baldwin who argued for the rights of africanamericans in 1837 was also vandalized, though its now been cleaned up. Shannon. You know and i know that coverage wouldve been enormous, and the outrage on the left and perhaps elsewhere wouldve been extraordinary. There is no doubt that this thing has been treated with kid gloves by the media. There hasnt been that much coverage, and a lot of the coverage has been remarkably favorable. I cant believe that the majority of americans agree with that view of it but there it is. Shannon we also are seeing the Mainstream Media covering gettogethers. Tweets from nbc. One shows a massive gathering in new york this weekend. Rally for black trans lives draws packed crowds. If you saw the video this weekend or any of the stills its a significant crowd. Then they talk about the president s plans to return to rallies this saturday and says for the First Time Since most of the country were shuttered by the Coronavirus Health experts are questioning that decision. What do you make of it, brit . Well, its obviously a completely different standard used by nbc to apply to those two crowds. One of them hasnt happened yet and the other did happen and was massive. It was an amazingly big crowd they are all packed in together like sardines. Outside there are less vulnerable than your inside because the virus disperses in the air to some extent. Perhaps to a considerable extent. But still the point is pretty clear. Nbc news was applying a double standard in its reaction to those two crowds. One of them yet to come. Then he would be immune to criticism in the same way that all these protesters have been immune to criticism even from some significant number of health experts. The piece in the Philadelphia Inquirer that led to a resignation in both those cases they were jobs that were lost. Shannon this raises the question about history and historical figures and weve covered four days a number of monuments that have been defaced, statues that have come down, people saying its time for the confederate statues and leaders may be renaming basis. Theres a lot of attention on one statue. Zachary evans at the National Review quoted as saying outrage over vandalism of philadelphia abolitionist statues. He said they decided to take it down. He was blm before there was a slogan. The irony of vandalizing a monument to those who died to end slavery is lost on those he says morons who dont know their history. This statute, a man who started schooling for africanamerican children, fought against slavery. Hes one of many caught up in this whole thing. I think it goes to this question, shannon. That is, is it slavery and discrimination and racism that these protests are really about . Or are they black lives matter leaders have a different agenda . The behavior of some of them at these rallies, some of the participants in these protests and riots suggests to me that it goes deeper than that, that it is a kind of antiamericanism because all kinds of people are swept up in their urge to deface monuments and tear them down and so forth, many of whom have nothing to do with slavery. George washington memorials have been defaced. So it just goes to that very question that we are dealing here with people more deeply american and not simply antipolice or antidiscrimination. They are against this country in much deeper ways in my view.
