Right before the testimony started there was a new layer of intrigue to it. And, of course, the democrats were trying to show that barr was in cahoots with, get this, the president of the United States to somehow block a report thats already been out. Ainsley new this morning, he is supposed to testify in front of the House Judiciary Committee. He says he will not do that he is not going to comply with that and not going to supply with the subpoena because these lawmakers want staffers to ask questions. He said i didnt agree to too that. Steve look, the democratsen the House Along Party lines voted yesterday and they changed the rules. They voted to add an extra hour at the end of the hearing which was going to be today so that house judiciary lawyers could question mr. Barr. Heres the questions that a lot of people are saying why would they need to have lawyers do it . On the House Judiciary Committee on the democratic side there are 24 members. 18 of them have law degrees. So why do they need a 19th person who is a lawyer on the staff to ask questions . It does not speak very highly of their skill as a litigator. Ainsley they are saying we dont have time for followup. We each only get five minutes. So many attorneys on that committee, then one attorney could ask a question if there is a follow up the other attorney can ask a question. There are 41 people on this committee. Republicans and democrats. Steve where is that going . Brian have to wonder if the democrats are saying man we overplayed our hand. Jerry nadler found his way to the a fike money and said this is why he thinks the attorney general is not showing up. Hes terrified of having to face a skilled attorney. But a fiveminute rule is not conducive to followup. It is very valuable as any lawyer will tell to you have somebody in this case a staff lawyer and follow up when he gives a nonresponsive answer. The most effective way of getting to the truth can i understand given how dishonest he has been since march 24th at the earliest. Since march 24th at the latest. Democrats were asking about the ending regarding his fourpage statement that he sent out where it was revealed, you know, hours before, the hearing started that Robert Mueller had sent a letter in march and said did he not like the attorney generals fourpage memo and how the public was interpreting it. And it didnt capture the context. And mr. Barr said yesterday that the letter was kind of submisnity, written by a staff member. Brian listen, bob, whats with the letter you . Could have called me. If you have a problem just call me. Which made him think his staff wrote it and many people think it was the lead staff wiseman who is a democrat that appeared on at Hillary Clintons being a loser party. William barr answered that question repeatedly. This one through senator blumenthal. You, in effect, exonerated or cleared the president. No, i didnt exonerate. I said that we did not believe that there was sufficient evidence to establish an obstruction offense which is the job of the Justice Department. And the job of the Justice Department is now over. That determines whether or not there is a crime. The report is now in the hands of the American People. Everyone can decide for themselves. There is an election in 18 months. Thats very democratic process. But we are out of it. We have to stop using the criminal justice process as a political weapon. Ainsley we did our job. He goes on to say that he read the full report that mueller gave him. He was surprised that mueller didnt make a decision on obstruction. So he and the deputy, Rod Rosenstein, they felt the doj had to make a decision otherwise it would be irresponsible and it would be unfair for the special counsel didnt have enough evidence, they said, and so the president was clear. Steve nonetheless, we just heard him say they were using the democrats are using the criminal justice process as a political weapon. We have got a little montage of some of their comments. You be the judge. But i think history will set you harshly. You not only put your own credibility into sanction giving sanction to the behavior to the language you used in that press conference you held. You lied. And now we know. Being the attorney general of the United States is a sacred trust. You have betrayed that trust. America deserves better. You should resign. You slandered this man from top to bottom. In your view have you nothing to hide. They will ask far better questions than the politicians did. Example. Senator harris, Kamala Harris from california, did you look at the underlying evidence . She was the second most important attorney general position in terms of numbers of prosecutions managed in the country. She couldnt possibly look in all the evidence and all the prosecutions. You have 44 fbi agents and 19 lawyers supervisorsed by bob mueller. You trust that when they come to a conclusion, they have eyeballed all the evidence. So then you dont have to examine the evidence yourself. It would have bee absurd for him to have. 1. 4 million. Brian i have seen the warehouse. Its unbelievable. So some of the questions were out of line. He wouldnt get questions like that lawyer to lawyer. Which is why i argue the attorney general should go and let those lawyers ask him questions and well learn more than we learned yesterday. Ainsley judge, are the American People smart enough to see whats happening here they are just not happy with barrs decision. They are going after him every way that they can. It was the opinion of the group of lima, most of the western hemisphere and now we know most of europe. But more importantly it was the view of the real Venezuelan Supreme Court which is now unfortunately in exile as well as the last democratic legitimate institute of Venezuela National assembly. Under the venezuelan constitution, when the presidency is vacated such as when a president stays past their legal term, at that point the president or the leader of the National Assembly becomes interim president to prepare the country for elections. Thats what happened back in january. That is why most of the civilized world, with a few exceptions juan guaido as the interim president of venezuela and that is why when he asks for the military to respect the legitimate government of caracas that is not a coup that a step to finally remove the obstacle to democratic elections and legitimate venezuelan government. Steve right. And eli, in your column, you talk about how so many people are getting this wrong. They are calling it a coup. It was not a coup. He was elected. Is he not trying to overthrow the government. Is he trying to restore the government. Correct. Thats the key point here. Because the last election from maduro was not legitimate. This is really this is a cherry on a cape of usurp station. Attacked including the National Assembly effectively stripped of all powers and replace it with another body. He has done all of these types of things. In the process invited predatory powers such as china, cuba and russia into venezuela which china and russia have taken a number of loans and put his country into severe debt which they now cannot repay. So, you know we are at a point standoff. Maduro is still in caracas still in power. But he has not been able to arrest and i think he has not yet given the order to arrest juan guaido and i think maybe the reason he hasnt given that order is because he knows that the highest levels of his regime there are Senior Leaders who have been meeting and negotiating with guaido for this particular democratic transition. Steve exit question. How much longer . You cant really predict these things, i think its a really tenuous moment at this point. Watch the meeting in lima, peru for what is known as the group of lima. So far we have seen very important and consistent solidarity from them. And hope from that will continue after their meeting today and tomorrow. Brian i heard from the administration they essentially said yesterday was a swing and a miss. Doesnt mean they are not going to connect today. We will see. He did get off the plane on russias behest and we dont know. Why maduro was about to be exiled they thought to cuba and something went wrong. The format would change and they would give the staff or staffers a half hour straight. One person with a followup it was very similar, i think with judge kavanaugh when the republicans elected to put somebody there to ask one question. They looked at that and the attorney general looked at it and said no, thats not what i volunteered for. And usually the democrats would come back and do a deal. Instead they said you better show up or you are scared. And he says im not showing up. So, they are going to give a couple days of negotiation and then they said they will go use Everything Possible to haul him in. Steve right. They may hold him in contempt of court. Michael goodwin writes on the pages of the new york post. They smeared him, called him a liar and said he should resign the same Senate Democrats on the Judiciary Committee who tried assassinate the judge kavanaugh pulled the same stunt with bill barr same result. They failed. Throwing mud while shooting blanks the. Ainsley they werent happy with the results of the investigation. Bill barr, yesterday, when he was testifying in front of the senate. He said they ever usin they aree Justice System as a political system. Watch. You, in effect, exonerated or cleared the president. No. I didnt exonerate. I said that we did not believe that there was sufficient evidence to establish an obstruction offense which is the job of the Justice Department. And the job of the Justice Department is now over. That determines whether or not there is a crime. The report is now in the hands of the American People, everyone can decide for themselves. There an election in 18 months. Thats very democratic process. But we are out of it. We have to stop using the criminal justice process as a political weapon. Brian really, if you look back 2001 when we couldnt decide an election and goes right up to the supreme court, every single thing we cant negotiate, building a wall, not building a wall. The president grabs other money, put it into the courts. Everything is going through the courts right now and putting way too much pressure andvillefying the attorney general lawyers just like him. Meanwhile, one of the lowest moments that i have seen in quite some time took place with senator mazday hirono used her time to slam the president , to disparage the attorney general, not only what they did but how they act and what they say grifter, liar, all included. This is the culmination of that. Listen. You think its okay for a president to offer pardons to people who dont testify against him, to therei threatene family of someone who does. Is that okay . When did he offer a pardon to someone i think you know what im talking about. Please. Please, mr. Attorney general, you know, give us some credit for knowing what the hell is going on around here with you. Not really to this ryan of questioning. Listen, you slandered this man. What i want to know is how do we get to this point . I do not think that. How do we get to the point . All i can say. Mr. Chairman i am done, thank you very much. You slandered this man from top to bottom. So, if you want more of, this you are not going to get it. Steve thats probably what he was talking about in that earlier sound bite where he was accusing the democrats of using the criminal Justice System as a political weapon. Ainsley he is saying im here to talk about the Mueller Report. Why are you asking me these questions . Steve so many wanted to know about that letter that was revealed in the hours before he was supposed to go up on capitol hill where Robert Mueller said hey, look, i think the public has the wrong impression of the findings from that fourpage, wasnt a summary, but a memo. And then he said, you know, he described, mr. Barr, the attorney general described the letter that mueller sent as a little snitty and he said it was probably sent by somebody on his staff. It was insinuated ultimately he said bob, why dont you pick up the phone and we can talk about this. Ultimately what came out of that he said to mr. Mueller, did i get anything wrong in my four pages . Mr. Mueller said no, you didnt. Brian he felt i feel as though there will be another chapter. The judge also feels mueller will be up there on capitol hill. Something else to add. I think two people got it right, senator ben sasse and senator klobuchar especially in the beginning both looked what the russians did and how to approach it and how to stop next time. She also wants to get paper ballots along with the senator from oklahoma so have you paper ballots on all our elections. We have to get paper ballots next time. If someone finds a way to electronically bring Voting Machines to their knees even though people say its impossible im not convinced of it. Have a bipartisan push. 80 senators agreed to it to get paper ballots. And senator klobuchar used her first three or four minutes to get the attorney general to go to bat on bipartisan legislation. In detail ben sasse did his homework. He found out what the russians did and asked the questions and found out how to stop it next time. That to me i understand you have to have politics overwhelmingly about the letters and summaries and it was not about what the russians did. Steve one of the other things that congress would like, the democrats in congress, they would like to see an unredacted version of the Mueller Report. And the department of justice has made it very clear that is not going to happen. Yesterday, the assistant attorney general steven boyd wrote a letter to congress and said allowing your committee to use the department of justice investigative files to rereinvestigate the same matter and secondguess decisions that have been made by the department would not only set a dangerous precedent but would also have immediate negative consequences. Keep in mind, a lot of that stuff is prohibited by law to be released. If you at this point in time released, congress, change the rules. Ainsley so much classified information that wouldnt be fair to release if you release the unredacted full version and thats why the democrats the democrats are subpoenaing that. The republicans want accountability. They will want to find out how this all happened. They want to get to the bottom of this investigation. I think Everyone Wants to make sure that russia does not try to change the results of our election. Brian the Inspector General report is coming out this month and john huber is supposed to do something. We dont know if he is ever going to produce anything. If he does, these things should have the socalled effect of investigating the investigators to find out how this started to make sure the next political candidate isnt political carnage of the Intelligence Community if, in fact, that indeed happened. I would say the redaction part is a nonstarter. Only 8 is redacted. Enough there for democrats to be unhappy about and republicans to be happy about. In the midst of that six minute slander attack what really was clear to me is that she didnt actually read the Mueller Report. And its likely that everything she knows about the Mueller Report she from recess tabs twitter. She talked about how the president fired james comey because he wouldnt shut down the investigation. Thats not what the Mueller Report said. The Mueller Report said that the reason why the president fired comey was because he wouldnt go out and tell the press what he had told the president namely at that time he was not under investigation. Barr tried to make that point but hirono wouldnt let him. She just kept on going and going. Brian heres the media reaction to what they witnessed over 12 hours. Attorney general barr continuing to distort and deflate the Mueller Report. I think the tatters. There was an ease with which barr lied. He was being deceptive and deceitful. An attorney general who presented himself in a way thats not really refutable anymore. Is he fully obviously corrupted. Brian so that was their opinion. The viewers really got a good analysis there. I will tell you what. I think bill barr knows more about the law, the department of justice and the job of attorney general than any of the democrats up there grand standing and trying to trip him up and certainly any of the media out there trying to make controversy where there is absolutely none to be had. We are talking about a letter here. A letter that was released that was accurate. Muellers letter actually said that barr or not summary but conclusions are accurate. Then he released the report two or three weeks later. Brian real quick senator harris comes out and says why is the attorney general Rod Rosenstein allowed to evaluate this . He is conflicted . Where did that come from . He was the god for the last two years and now all of a sudden he has a horse in this race . And not only was he the god but he was cleared by career doj officials to be the acting attorney general over this investigation. So then when he gets back down to Deputy Attorney general on this particular investigation. He is supposed to get recleared by ethics . That makes absolutely no sense whatsoever. And the fact that the press is linizing Kamala Harris questioning shows exactly where theyre putting their chips in this debate. Brian underlying documents she wants him to read thats why you had special counsel. Millions of documents collected and you want the brand new attorney general to read 3 million documents before he releases the report . They didnt want to wait two weeks what about two more years . The job of mueller was to collect evidence, review the evidence and come to factual conclusions. Did they really want barr to ignore those factual conclusions and come to his own . We know the sources coming out tell us there may have been an incident inside fighting not necessarily a case of illness but, you know, when we went 45 miles north of here and talked to some of the residents they are very frustrated with this caravan and migrant situation. We are trying to find out more guys on the situation inside this shelter. And the situation with the Health Concern across all of these migrants in the latest caravan. Guys . Tom, what do you make of the fact that, you know, over the last number of months the president has been asking mexico to do more and now griff is outside of a Detention Center in southern mexico tapachula where they have a lot of people there and they are trying to keep them there and trying to figure out what to do with them before they continue their trek north. Well, i agree with the president. Mexico needs to do more and they are not doing enough. Look, the criminal cartels moving these people to the border and managing their crossing the border. I said many times the cartels push a group of families to one sector to move drugs and bad people to another sector. 1 3 of the women are being sexually molested. According to doctors without borders. Criminal cartels are operating without impunity in mexico. Its against the law in mexico to smuggle people. Its against the law in mexico to traffic women and children. I said ice needs to get down there send a couple hundred agents down there and work with the units and try to dismantle these criminal organizations. Follow the money. Will congress approve that . No. Look, i dont have any faith in congress. Congress failed this president from day one. Talking about the president obstructing justice, who is obstructing more than congress . They have obstructed as president from day one they have obstructed him. But, look, just forget about congress. There are certain things we can do operationally. There is three quick things they can do right now that theyre not doing. I have said it before on this show. If ice needs to do a national operation. Look to those family units. 90 of them lose their case. They have been ordered removed by a judge. Seek them out, detain them and remove them. It will work. I did it three and a half years ago under democratic administration. I got a lot of push back and i did it guess what, almost immediately the border numbers went down because they saw families on planes going home. Right now Central America is seeing all these people leaving and no one is coming home. 90 lose their cases get an order from a judge we need to execute those orders and show there is a cons sequence. We need to surge Immigration Judges to the border. Forget about 800,000 backlog. Let it sit there send all the judges to the border. Deal with the people coming across right now. Have quick hearings. Put them on planes and send them home. Again, 90 lose. Brian keep the 800,000 pun intended on ice and worry about the next ones, todays . Yeah. Call it lasting first stop. All immigration. Third deal with the temporary facilities and hold everybody. We did it during the cuban migration. We did it during nic rag grawn migration and haiti migration. Build temporary facilities and hold everybody. Only hold families for 20 days hold them for 2 20 days have. Toe dine. Get released within an hour. Half of them dont file cases of immigration and the ones that do show up, they get ordered removed 90 of the time. There is no consequence.
