And that is the confirmation of judge Brett Kavanaugh, and it will be likely because of the actions of an unlikely senator, Susan Collins of maine, who following the lead, as we pointed out, of Lindsey Graham decided that she is going to properly do her job as laid out in article ii of the constitution, advise and consent. Here is some of what Susan Collins said yesterday. Judge kavanaugh has received rave reviews for his 12year track record as a judge. We must always remember that it is when passions are most enflamed that fairness is most in jeopardy. I do not believe that these charges can fairly prevent judge kavanaugh from serving on the court. I will vote to confirm judge kavanaugh. Rachel that was a 44minute speech. And by the way, you mentioned Unlikely Hero for the conservatives in this very important and crucial moment. She laid out the case for Brett Kavanaugh, and as she did that, reminded conservatives of all the things they may not like about Brett Kavanaugh. And yet conservatives are rallying behind her because she truly gal vannized the vote galvanized the vote. It was shortly after she delivered it that joe manchin put out a tweet and a press release that he would also vote yes. Griff and this is, indeed, an extension of President Trumps style of politics of standing up to a mob and saying, no, lets bring in mercedes schlapp, White House Senior Communications adviser. Good morning, mercedes. I want to get your reaction to senator collins speech. Well, clearly for senate collins, this was a moment of courage for her where she carefully laid out and explained the case for why judge Brett Kavanaugh is most qualified candidate to be on the Supreme Court. She talked about the importance of the fact that, look, there is a lot of this emotioning that has surrounded emotion that has surrounded this case, but there was a lot of foul play by the democrats as well many terms of what they did in concealing the letter for is long. She talked about the fact that when you looked at the evidence presented, it was clear that the facts were on judge kavanaughs side. At the same time, she talked about what really mattered as well which is that of a man who has served our country for a very long time, who has a very good, solid judicial opinions, over 300 judicial opinions written and, obviously, has gone through a very lengthy process, interview process in the senate which made him clear and qualified to become the next Supreme Court justice. Griff yeah. So we are very proud of senator collins for speaking up in such a calm and prolific way, and it really shows that when you put the emotions aside and you put the fact that so many of these democrats used destructive tactics to destroy the reputation of this fine man, its a moment of truth, and it shows that President Trump, of course, made the right decision in picking judge kavanaugh. And President Trump stood by Brett Kavanaugh throughout this whole process. I dont know if any other republican president would have done so. Griff yeah. Rachel thats a great point. Pete hes taught republicans how to fight. This is a nasty, nasty process. How much does this win mean to President Trump and to this white house to come through all of this and at the end of the day get that unlikely vote from Susan Collins . You saw allies like Mitch Mcconnell and Chuck Grassley and Lindsey Graham boldly make the case. Talk about the meaning of this win for you guys. Well, its such a huge win for the president , but not only for the president , but for the nation, for the American People, for the fact that when President Trump was voted into office, he laid it very clearly out there of who the type of nominees that he was going to be looking for. He distributed that list wide. And so is because of the fact that it is for President Trump, as senator collins has said, hes the one that gets to choose based on the philosophy of these judges. Its been a win. But theres been several wins. Not only do we have two Supreme Court justices, you know, hopefully now with the vote later today, but youre talking about over 26 Circuit Court justices judges that have been confirmed. Those are huge successes when it comes to judicial system. It allows us to go back to where youre talking about strict constitutionalist and the fact that were able to rebalance the court in that way. Rachel has the president spoken to Brett Kavanaugh yet since yesterday . The president did speak with Brett Kavanaugh. I know its one of these moments, again, that im incredibly proud of working with this president who has stood by judge kavanaugh, has really made it a point to explain to American People why judge kavanaugh is the right person at the right moment for the court. Rachel and after he talked to him, did you get any indication from the president on how he and his family are doing . This has been a a grueling process. Well, i know judge kavanaugh personally, i know his wife. It has been a tough process. But one of the beauties of this family is the fact that, as i think his wife mentioned, you know, we need to pray for mercy and forgiveness. Its a moment in time where it is putting those battles behind. But i will tell you its going to be very hard to forget what some of these democrats have done from the beginning where they made it their priority to resist, to insure that this man would not make it to court. And the way they did it in trying to destroy his reputation is completely uncalled for. Grif give and, mercy, forgive the political reporter in me, but what do you think this means now looking to the midterms . You know, i think this really has revealed a lot on the democrat side. Its revealed a nastiness, as you mentioned before, that is, its very unfortunate. I mean, as weve as the president s been traveling around the country and just talking to people even around in this area, women are really upset about the fact that they have tried to destroy the reputation of judge kavanaugh, someone who is a father, you know, someone whos a husband, a son, someone who has dedicated his life to faith and public service. And yet theyve taken him, this one person, ask try to just destroy him by going back to high school drunkenness, a yearbook. I mean, it makes you question whether anyone would want to put themselves in a position to serve in the government. I mean, rachel, you know, your husband serves in congress. Politics is nasty, but its unfortunate that when were talking about the Supreme Court, i mean, we had never treated sotomayor or kagan in that way ever. Rachel right. We looked at their judicial opinion and, yes, we might not agree. But to go back and try to destroy Brett Kavanaugh and the longlasting effects it will have on him and his family, its just i find it to be this is not what we want in america. Rachel i think a lot of bright, legal minds are going to go, you know what . I might stay in the private sector instead of public service. Women are upset. I think the way the conversation has been laid out by the left is about dividing men and women. Im going to tell you something that i just saw this morning that got me upset, id love to get your reaction. Its not just men and the division between men and women, but in a Time Magazine oped they talked about dividing women from their children. They said women who support Brett Kavanaugh are choosing their sons over their daughters. Wow. Rachel what do you say to haha . Well, im the mother of five daughters so, rachel, i cant make that comparison. But i will tell you what i think has happened during these past two weeks and just being able to talk to my 15yearold and intoyearold 13yearold, yes, weve had conversations about the horrors of Sexual Assault. Weved had conversations about mistaking sure that you do the right thing, obviously, especially in these years that theyre in high school. You have a daughter in college. But at the same time, we have to talk about the other side of this which is about fairness and due process and the presumption of innocence, something that was completely lost in this process. And i tell you, my girls, they see it. They saw it very clearly when, you know, they watched the Opening Statement from Brett Kavanaugh. President trump did, in sharing thoughts with him basically made the argument as well. He was a man who did the right thing. I would have been proud for Brett Kavanaugh to have been my son. He did all the right things, went to right schools, stued very hard studied very hard, you know, was very successful in his career in public service. And yet the destructive tactics of the left, i think, has created a very damaging effect. But we will rise above that. He will serve on the court. As he said, hell be an independent and impartial judge. Hes incredibly respected in legal circles, and i tell you, this is a lesson for all of us that we should not allow such destructive personal politics, character assassination politics win at the end. Rachel three out of four undecided senators including democrat joe manchin say theyll vote yes on the judge. Griff what will this mean going into the midterms, and will the partisan battle over kavanaugh give republicans the edge in the senate . Reporter yeah, one of the main things to talk about is the concept in the senate of pairing votes or live pairs. We think we know how this vote is going to go down, its expected to be 50 yeas, 48 nays, one present, Lisa Murkowski, and one absent, steve danes from montana. You have two senators on opposite sides of an issue. Senator danes is not going to be here, hes going to attend his daughters wedding in montana. Senator murkowski is opposed, but she wanted to do a favor for her friend here. So what happens, and it doesnt happen very often, its kind of a gentlepersons agreement in the senate, but they will pair their votes. When they call senator murkowskis name on the roll, she will rise, she will note that senator daines had he been present would vote yes, and she notes that she is is no, but she will vote present. And so they pair off. And so she says, you know, it is a little confusing, but in the words of senator more cow city when murkowski, she said, quote, everything we do here is kind of confusing. Rachel so nice for him to be able the walk his daughter down. Thats an important moment in a familys life, so very nice. Griff chad, let me quickly get you to midterms. Full disclosure, chad is the brightest we have at fox news, and i frequently consult him when i am doing political reportings, but this is going to have an impact on the midterms. What is your take on it . Reporter it depends which side it energized. Theres a lot of people who think this may have supercharged the right because of how they feel he was illtreated by the democrats. It was interesting just minutes after joe manchin of West Virginia, his opponent, Patrick Morrissey the republican, put out a state. He called senator manchins decision craven and he was, quote, trying to save his career. You can imagine what Patrick Morrissey might have said had joe manchin decided to vote no. So he might not be in a win win, lose lose situation there no matter how he would vote. Manchin is ahead of Patrick Morrissey in West Virginia. But look at some other states, you know . You look at Heidi Heitkamp from north dakota, she is trailing kevin kramer, the statewide republican congressman there, and she decided to vote no. And its not just because youre going to vote for Brett Kavanaugh that the republicans suddenly call off the dogs on these democrats in tight races in republican states this fall. Griff thanks, chad. Yesterday certainly was, and i look forward to later this afternoon. Pete senator, you sat behind Susan Collins when she gave her speech, you were there with the gavel. Was there doubt in that moment . You know, when i was seated presiding over the vote, we really didnt know what several senators were going to do, so it became a very historic, heightened tensions. Most of the senators were sitting at their seat voting which is a rare occurrence. Usually were huddled around the vote counter. So i really took it all in. The galleries were full, the press was there. So it was a bit of a surprise, yes. Griff senator, there was a moment of that speech from senator collins when she said when passions are most enflamed, it is fairness that is most in jeopardy. Your reaction to that. Well, i was just incredibly honored to hear her speech, the learn so much there her to learn so much from her just in that moment. But when she talked about fairness and the presumption of innocence and the tenets of our democracy, her speech was so well researched, well delivered and so powerful that i think when it comes right down to it, the fairness aspect of what weve seen moving forward is why i think Brett Kavanaugh will be confirmed later this afternoon. Rachel we just had your colleague senator on, senator hyde smith, and she said that there was an intention to stand behind her as sort of a sisterhood of conservative women. Really nice to see that happening in such an important moment, because it has been a difficult week. And i wanted to ask you about another colleague of yours, senator cory booker, who was caught on tape saying to activists, get up in their faces, and was called out by another senators wife, rand pauls wife, saying, come on, this is not the right way, you know, to do this. Were already in heightened times. There has been violation against Member Violence against members of congress. Do you feel safe, and what do you think about what cory booker said in this environment . Well, quite honestly, the last several weeks have been very eyeopening to me. Ive been on capitol hill for several years now, and ive never felt that the safety aspects of us traveling to do our job back and forth to capitol or meet with our constituents was as ten youous as it was tenuous as it was this last week. I certainly made extra precauses for myself to make sure that i was not alone and had people around me to help me if i found myself i was yelled at in the halls and all that. I mean, i dont want to give up anybodys right to yell at me or tell me what they think, because thats the way america was founded. But weve got to have we cannot incite people to get up in faces, to become so aggressive that their frustrations that may lead them to do something that maybe they didnt intend to do in the beginning, and then it gets physical. And then somebodys going to get hurt. Somebody is going to get hurt. Pete youre right. Senator, youre from West Virginia. Your fellow senator is joe manchin. He says he will vote for Brett Kavanaugh. You have endorsed his opponent republican. Whats this going to mean for that race and constituents back home . Well, i think it will put a different spin on the race. I think that i have endorsed Patrick Morrissey because i want somebody who plays on the same team with me, that would vote for tax reform and other things. I am good friends with senator manchin, and no matter what happens, i think our friendship will stay intact. But i think its a close race, its going to be a close race. As we know, the president is very beloved in our state. Hes been there twice, i expect him to come back. And so i think itll go right down to wire. Pete it certainly will. Just like the vote. Now i get it. Griff Mitch Mcconnell blasts america garland Merrick Garland number one, that was a president ial election year. Joe biden, as a democratic senator, said you cant do this in election years. Democrats forget9 that. Number two, as i recall this covering thenpresident obama, the republicans allowed two Supreme Court justices to go through in Midterm Election years and, by the way, they went by bigger margins than this rachel and with no threats of Sexual Assaults and games played all of that. And heres another thing, Mitch Mcconnell said something very important in the middle of this process p he said were going to plow through this. Democrats lied, they said hes talking about plowing over this woman whos accusing judge kavanaugh about Sexual Assault. No, he was talking about plowing through the process, obviously. He wasnt and it was taken out of context. Is and he was saying, you know, theyre coming after me, but were going to get this done. And the other point id make about that when i was talking about what happened in the obama years and Merrick Garland, what about harry reid did . He was the one who changed this and opened the tour for President Trump to get this through with just 51 votes instead of 60 votes, number one. And i found this got lost are, but Chuck Schumers lost if you guys take back the majority in november, will you bring it back to 60 votes . He said were going to look at that. Youre going the look at the that now . First of all, its not going to happen, but second of all, democrats started that, and its backfired. Pete griff made a good point, it almost feels like Mitch Mcconnell learned Republican Party is the party of trump whereas paul ryan never really got that memo. Right . So is in the senate youve seep that change where hes embraced the president s agenda youre always taking on the swamp and all that, and is youve been right on some of these issues. But what i would point out is Mitch Mcconnell hasnt just plowed through with two Supreme Court picks and helped the president reshape the court which is a big, big deal, obviously, but think about the tax cuts. Think about this economy. Thats lost in what happened yesterday. We got another jobs report yesterday that shows the economy is rocking right now. Pete yep. Rachel and by the way griff im happy to eat crow anytime. Im just teasing. Rachel going to your point about Mitch Mcconnell, the sort of grease in that wheel might be senator mcconnells wife who works for donald trump. Usually theres a woman behind im glad you mentioned her, because remember with all these protests you were talking about, remember that video a few months ago when this was really starting to heat up rachel i love that mess. She was a mama bear, and she fought back. She wasnt scared, she pushed the security out of the way, stay away from my husband. Rachel we need more of her pete hows this affect the midterms . Theres polling data, look at the fox poll a couple days back that was suggesting that in a place like north dakota it looks like heitkamp is a goner. She finally said, look, im likely to lose, im going to stick with democrats on this. But i think democrats are going to be decomplainted coming out of this. They put everything into this. Now that theyve lost theyre saying, well, if hes on, lets impeach him. Griff true. Come on. Griff democrats are likely, still to their favor, take the house back. And we were seeing jerry nadler who is the Ranking Member of the House Democrat Judiciary Committee, well, were going to have to investigate judge kavanaugh now because what theyre doing, theyre saying and they used this word, its not mine hes not going to be a legitimate Supreme Court rachel youve been hearing that all over the press. Griff exactly. They said that about trump in january 2017, and what happened with the womens march and madonna and lets are blow up the white house and all that crazy rhetoric, now you see the womens march turning on Susan Collins whos with the democrats at least half the time on some of these big issues. I dont want to repeat some of the stuff theyre saying about how shes an apolo interest for rape and all of this nonsense. To answer your question about heading into the midterms, none of us know where the energy is really going to be but, boy, when democrats are turning on their own, that not good. Rachel there could be a lesson in wisconsin. When the left acted like this after scott walker passed act 10, when he had to run again, they voted for him in greater numbers, and i think it was a lot of independents and democrats who were very frustrated with the process and the way he was treated coming back and saying were going to vote against the way Susan Collins made another important point, she said democrats overflay played their hands overplayed their hands. As Supreme Court justice this afternoon thanks in part to this passionate speech from senator Susan Collins touting his career and character. Rachel joining us now with reaction is someone who has known him for nearly 38 years, julie duval. Welcome. Good morning. Good morning to you. Rachel what do you make of everything thats happening . You know him well. The process is almost to an end. How is he doing, how is the family doing . Well, i think everybodys going to be a lot happier when the end of the day happens today. Pete no doubt. Rachel no doubt about that. Pete what was inside that crucible and, again, its mostly him and his family, but supporters of his like yourself have been attacked and maligned also, and whats it like to have been standing in that metaphorical standing line . Its easy to stick by somebody who you know is innocent and is a great person, and theres a big group of us that went to senate the other day, went to visit various offices and hundreds of letters were written in sport of brett in support of brett, people that have known him personally, and we delivered them to different senators offices. It was a success is, i hope. Griff julie, we you have been here, thank you for coming on. I know everybodys really tired, those who have been supporting him, but have you had a chance to speak with judge kavanaugh or to his wife about senator collins giving that speech and talking about fairness revailing . Prevailing . I have not spoken with him about it. Ive spoken with people that have spoken with him, and we are so grateful to senator flake, senator manchin and senator collins. She was an inspiration. It was an amazing speech, and people cant stop talking about it. Rachel you said that this whole process, especially the culmination yesterday with senator collins, you said it was the vindication of good over evil. But has this process caused you to lose faith in our government in some ways . For a little while, it did. But i think were going to come back, and i think its going to be fine. Pete yeah. Go ahead. Griff i was just going to say following up on that a little bit, do you believe this will keep qualified, good people to think twice about being nominated and stepping forward . I was very worried about that because hes got the best character, and if he can be taken down, anybody can be taken down. Who in the world would want to go through that . But im hoping ive got my fingers crossed that good people will want to run for public office. Pete the former friend of dr. Ford says she felt pressured by democrats and folks on the left to change her story, you know, while the pressure was mounting. Would that surprise you . I cant speak to that. I just can say kudos to leland for sticking to truth and telling her truth. That, that shows volumes for her character as well. Griff well, and, julie, let me just while were approaching this historic vote, why dont you have the last word this telling america who Brett Kavanaugh is. He is one of the most kind, decent human beings. He has been since high school to present day, and the women that have supported him have known him from high school through now. Theyre his neighbors, they go to church with him, they worked with him at the white house, and we all say the same thing. He is absolutely incapable of doing what he was accused of doing, and it was a smear campaign, and he needs to get his good name back. He deserves it, and i cant wait to celebrate with him, i hope. Today we have come to conclusion of a confirmation process that has become so disfunctional, it looks more like a carrick a cature caricature of a gutterlevel Political Campaign than a solemn occasion. Griff and here to react to that speech is fox news legal analyst and author of the russia hoax, gregg jarrett. Gregg, you called in the finest speech youve ever heard . Yeah. And, i mean, ive been covering capitol hill and speeches on the floor of the senate and the house for, you know, the better part of four decades. With uncommon eloquence and sound reasoning, i thought that was the best speech on the floor of the senate that ive seen. And it was important that she began by condemning the outrageous behavior, the character assassination and the smears of special Interest Groups, activist protesters as well as some democrats which she made it abundantly clear backfired on them insofar as her vote is concerned. Rachel heres some of that. Lets play that so people know what youre talking about. The president nominated Brett Kavanaugh on july 9th. Within moments of that announcement, special Interest Groups raced to be the first to oppose him. A number of senators joined the race to announce their opposition, but they were beaten to punch by one of our colleagues who actually announced opposition before the nominees identity was even known. Pete so preemptive resistance. Yeah, i mean, there was a great line among many great lines in her lengthy speech. But she said something very important, that fundamental fairness and presumption of innocence is relevant to advise and consent duty of the United States senate. And she set what i think is sort of a new standard for judging accusations more likely than not which lawyers, as you know, call preponderance of the evidence in civil cases. There has to be some established standard, and she said the standard was not met. And, by the way, thats the lowest possible standard. Griff wise words. Will they be heeded . You know, its hard to know. I do think that there ought to be a couple of investigations. The Senate Ethics committee needs to look into Dianne Feinsteins conduct in concealing vital information. And as you know, i wrote a column saying that there is significant evidence that the lawyers for professor ford were not acting in her best interests, but in the interests of democrats. And those lawyers who are democratic operatives and activists were recommended by dianne feinstein, and it appears they never communicated to their client that she could have avoided the spectacle by having a private, confidential interview with female fbi agents or the staff rachel thats outrageous. That oohs a breach of ethics. Pete got that leave it there. More fox friends on the other side. Griff Health Administration celebrating a huge political victory. It should begin between 3 30 and 4 00 p. M. Eastern time were now hearing and should last 1520 minutes thats a live look at the senate floor as senators continue to speak within that 30 hour window. The outcome is expected to be 50 48 with senator Lisa Montgomery the only republican voting no by voting president and she will pair her vote with the absence of senator steve dan es, attending the wedding of his daughter in montana. Pete there arent many moments where youre watching your television, and politics is usually fairly predictable. Yesterday wasnt. Everyone is watching Susan Collins on the floor, whats she going to say which way ill will she come down and ultimately she gave a very powerful speech. Well play some clips off but the vote came out and it was, it was 5149 yesterday and is predicted today to be 50481. All you need is 50 to get Brett Kavanaugh confirmed. Rachel recall jeff flake actually said well unless something really big happens, i got a little bit nervous but i understand that the Vice President is present and just in case, theres a vote there as well. Griff hes a tie breaker. Pete youve taked a lot about these speech from Susan Collins. Conservatives get frustrated shes always waffling but at a moment like this sometimes you need the clarity of someone who tries to call balls and strikes and she called out the left for what they did to this nominee. Griff and senator collins we got the heads up she was going to tell us how she goes at 3 00 but really what she was letting everybody know is she was going to make an important speech so for our viewers that may have been busy yesterday afternoon, i want you to just hear a little bit of Susan Collins what she had to say. Take a listen. Judge kavanaugh has received rave reviews for his 12year track record as the judge. We must always remember that it is when passions are most en flamed that fairness is most in jeopardy. I do not believe that these charges can fairly prevent judge kavanaugh from serving on the court. I will vote to confirm judge kavanaugh. Griff pete is making fun of me because ive got a crush on Susan Collins today but it could have been pointing out the significance of what she just said we must always remember that when fashions are most en flamed that fairness is the most in jeopardy that is the moment of that speech, and strong words but i believe its going to be something by which we judge future nominees who may come under attack like kavanaugh did. Rachel and shes one of the most liberal senators on the republican side and yet, shes the hero of the moment. Really saving this nomination and in a lot of ways we know Lindsay Graham gave a speech, the one that pete wants to put on a perpetual loop. Pete yeah, as a testament of how to fight. Rachel youre right. But this moment was so important , because she does have a reputation of being somebody who is willing to look at both sides, being bipartisan so she was the right messenger to clinch this moment. Pete if were making fun of you being in love with Susan Collins youre making fun of me with being in love with Mitch Mcconnell this morning. You have to give the Senate Majority his due, he navigated a system this is his second Supreme Court nominee, he has learned how to work with the Republican Party led by donald trump. Rachel thats right. Pete a lot of the folks, Chuck Grassley, Mitch Mcconnell, Lindsay Graham, they deserve the credit for being there at the tough moments and ramming this thing through for a highly qualified judge being smeared. Rachel when donald trump was being elected i remember telling my husband listen the most important thing donald trump will do is reach republicans how to fight and its been almost two years, were seeing they know how to fight and also realize they are stronger united. This was a moment that you night ed the Republican Party no one gave into the namecalling of youre a sexist and this and that. They withstood some of the worst insults by very organized and paid for protesters, on their way to the vote and they stood strong and stood together. Griff and we are the advisor of the white house here a little bit earlier whose saying that President Trump has actually talked to judge kavanaugh. Here is what mercedes had to say the president did speak with Brett Kavanaugh. I know its one of these moments again that im incredibly proud of working with this president who has stood by judge kavanaugh , has really made it a point to explain to the American People why judge kavanaugh is the right person at the right moment for the court. Pete this right moment at this time you step back to the 30,00r conservatives is what weve been hoping and praying for for a generation which is a majority of jurists on the senate who have fidelity to the constitution who leave in its original construction and who protect things like the Second Amendment and free speech and unborn babies. A lot of people care about why they voted for this president. Its been delivered and will be delivered this afternoon. You got to take that victory lap and look at the folks that got you there and a lot of the senators deserve this. Griff this is tough news for democrats to some because now they are looking at this going oh, man, weve got a fight and were not winning at the moment. Griff i point this out, because i think that its significant that the house, the member of the house judiciary all committee, gerald nadler, here is a quote from him. He says that the senate having failed to do its proper constitutionally mandated job, we are going to have to do something to provide a check and balance to protect the rule of law and protect the legitimaticy of one of our most important institutions if the democrats actually do win in the house, and get the majority there, you can see nadler getting out in front saying were going to investigate Supreme Court judge Brett Kavanaugh. Rachel and he will become the chairman of the Judiciary Committee in the house if the democrats take over the house and so this is a man who clearly has not read the constitution probably should do that between now and election day, because that is not how our constitution works. It is the senate who has advice and consent and i tell you that looking forward to november, the democrats were already pretty much as energized as youre going to get. I think that the democrats did not anticipate that there would be whats now being called a kavanaugh affect that there are so many republicans, so many independents and even lean democrats that are very troubled by what they saw. Pete well the resistance has to continue somewhere because its almost all they had. They didnt accept the legitimaticy of the president s election and now they dont want to accept Brett Kavanaugh so thats going to be litigated in the midterms. We all talk a lot about politics but the process has to matter and if were always asking for a doover then theres no validation in what actually happened in fact Jonathan Turley made that point very well in the program earlier. Sure you could have a trial for the dead if you wanted or the confirmed but it is a dreadful idea. The framers created this process to have some finality. Now the democrats may not like the outcome of the vote but 50 50 senators are expected to be satisfied with this record and to confirm this nominee. If were going to start to do do overs every time the majority changes then we will never have a stable court. Pete thats it. Rachel or a stable country or a stable government. Pete thats right. Its a fantastic point so if youre frustrated go to the poll s in november of 2018. If youre motivated go to the polls in 2018. Theyve already started converg ing. You can see behind me theres a fairly large group. They pitched up just a few moments ago chanting kavanaugh must go. They plan to be here for the next few hours. One of the organizers tell me. Ive spent the last 24 hours, guys talking to protesters of all stripes here on capitol hill i want you to take a listen to what two of them had to say yesterday this is interesting. His credibility is spot on. I believe hes a man of god i believe hes appointed and chosen by god. The sexual allegations and his dishonesty during his testimony made me even more opposed and outraged. I do not see how we can let someone like him on the Supreme Court. Reporter so today, were anticipating protesters organiz ed by the womens march by stop kavanaugh by believe survivors and believe women but also a fairly robust presence as was yesterday from women for kavanaugh. Joining us now is Fox News Contributor jonal goldberg. So a lot of our viewers will know you were at one point a never trumper. Youve since said hey i want to call balls and strikes but this week there seemed to be a lot of folks who with not bad with the president having to at least acknowledge that look hes achieved a lot of the goals conservatives have had for decades. Well certainly on this look one of the things that i think is often misunderstood about President Trumps list is that was imposed on him by a lot of Republican Voters who were still skeptical of donald trump and they said look, the thing we care about most, other than Hillary Clinton losing, is the Supreme Court and getting judges into the judiciary that are our kind of judges and so it was a brilliant move to basically say hey look, i know you dont completely trust me. Here is this list, theyre all great. They come from the federal society and that probably won the election for him because it brought around the last sort of skeptical people and that was a brilliant move. Thats the list hes been working on and it points to the fact that conservatives have cared about reclaiming the Supreme Court for 50 years now. It is a central idea that unites everybody who isnt, people like the Washington Post have gone full tribal and crazy antitrump but anybody who still considers themselves a conservative even Susan Collins cares about this and thats why i think in a lot of ways it was bigger than trump it was bigger than the presidency and thats what brought everybody sort of together. Also, the absolutely repugnant and witch hunt type tactics that the left used in this case was just so horrific that you had to make a choice. Pete yeah, and rachel has also made the point a couple times this morning i think its an important one. This president has also taught conservatives how to fight and how to win and in many other cases there was a lot of hand ringing over the particulars of certain poll sicks at all takes and not a lot of results and that is Mitch Mcconnell and paul ryan whose retiring. I dont know about that one, sorry. Look, i think Mitch Mcconnell i think deserves enormous amount of credit for doing this. He blocked merit garland when barack obama was still president hes an institutional insider and the kind of guy who swims across a potential with a knife in his mouth and hes been that way for a very very long time and one of the moments in the last 10 days one of the moments that put this in jeopardy was when donald trump did what he did at that mississippi rally, because at that time, the three people who mattered most for this project were Susan Collins, jeff flake and Lisa Murkowski and that made them go wobbly, and so i understand the argument about how he fights and i think it was very good that he stood by Brett Kavanaugh but im not sure that this was an example of trumpian fighting tactics winning the day. It had much more to do with inside the ring fighting tactics of Mitch Mcconnell getting this done. Pete stepping back even though from this youve got the Supreme Court, youve got tax cuts, youve got deregulation, rebuilding of the military, a conservative grab bag of accomplishments, will never trumpers or some of those acknowledge this and maybe be willing to vote for him in 2020 . Could we see that kind of result i certainly think look, there are a lot of people who have come around to sort of being sort of protrump or at least certainly im happy to acknowledge i like a lot of those things. I think those things are great. I do think though, that if youre talking about voters, attitudes about the president are pretty locked in. If you go by the standard Political Science model Donald Trumps Approval Rating should be in the low 60s given where the economy is, but lots of voters have basically decided they dont care about that. Pete hes also got the media though and the institutions. Thats absolutely true, but i agree but my point is people who say that its just the economy is stupid, thats never been true or put it this way its been true every single time and every election except all the ones where it wasnt. Pete [laughter] good point. So i think the problem is that trump is such a large personality it becomes difficult to sort of just use the standard scorecard for him, and so the kavanaugh thing has certainly brought a lot of republicans back into the fold and itll help with the senate races. I dont know that itll help with a lot of the house races the house needs to hold on to because those are in more purpl ish districts but look its very hard to predict. I dont know how you could listen to that 43 minute speech and draw that conclusion and also Susan Collins turns her back on women who have been traumatized by Sexual Assault. Elections have consequences to start turning the ship back toward the rule of law, decency, truth and the preservation of democracy. November 6 has to be a lot more than a blue wave vote to rape ap ologist. Ive been called that the too. My sister and my mother both suffered from much worse Sexual Assault than that and im anything but a rape apologist, so to hear that kind of rhetoric and inflammatory language is just ridiculous and has no place in politics but thats why things are getting so partisan and crazy. Rachel i dont think its working. It doesnt work. Rachel we saw the war on women way back when Hillary Clinton was running i just dont think its working but i think frankly donald trump has something to do with that. He just said he actually sent out a tweet. Dont let these protesters get under your skin to the senators. Stand strong they are all paid for, dont give in. Pete and theyre chasing them through the halls. And that is not, i dont think thats very Good Behavior if you will. Well perhaps well find out in the midterms. I think were going to find out in the midterms and if its not a blue wave i guess youll know your answer and if people show up it may have energized republicans more than anybody the behavior of the democrats during this whole confirmation the very poor behavior of the democrats during this confirmation time. I started my activism decades ago it was on that issue and this is now the 21st century. American women have different options, we are more in control of our lives, we have agencies, this argument continues to place us in the position as infants and as powerless.
