So i dont want to hear what he would have done because its much easier to retrospect tialy say what you would have done. I would have done things differently too. We didnt know that at the time. I want to hear moving forward whats going to be done. I can tell you a lot of people do look to President Trump. What are we going to do . How are we going to get that economy back . Because the Mental Health from having such a bad economy is detrimental. How are we going to keep our children in school make sure they get that development . Gore went to the Supreme Court for disasmghts look, i believe she is one of the greatest legal minds of our generation. She has the credentials to serve on the court. And if the members of the u. S. Senate want to attack her on her religion or for being a working mom and having seven schoolaged children. Then to me thats disgusting. We should stop politicizing these nominations to the high court. We should look at them on their merits. She should have an up or down vote and election day if all possible. Or is it the joe biden that weve seen in some of these appearances in recent months that had people scratching their heads . I think that that is what this night is about and at 90 minutes its a challenge to handle Chris Wallace for 90 minutes. Steve no kidding. Of course everybody is going to be watching to see if they go off the rails at some point and we know that donald trump is going to try to provoke joe biden, because weve even heard from the biden people they are trying to keep him calm. Listen. I think this is a great opportunity for the president to really just be himself. He doesnt have to hold back very much. He doesnt have to hold back at all really and hes very well prepared. Hes much better prepared now than he was four years ago just by the mere fact hes probably had a debate every day. I dont think any president has answered more questions than this president. Steve well there you go, and brett, i was talking to one of your fox news correspondents who used to live upstairs in my house and apparently, later today, hes going to be reporting that the hard ball negotiations are still happening , behind the scenes between the two campaigns. Yeah, so, theres a lot thats on the line here, and i dont think donald trump, youre right, is going to feel uncomfortable in the moment. He does face tough questions every day, and guiliani is right he has answered more questions than any president in recent history, and the question is can he be focused and pointed and thats what hes working on with guiliani and christy. We dont have a real look beyond the scenes at the biden preparations other than some reporting that its very detailed and a lot of back and forth but he has not taken a lot of tough questions from the media as you know. Ainsley lets talk about the Supreme Court. Amy Coney Barrett is going to meet with nine republican senators all men and then theres Democratic Senators six of them refusing to meet with her. How does this work and do you think she cares if the democrats wont meet with her . Im sure she cares. I think that this process is going to be a tough one. I think its fascinating that Kamala Harris is on the 7th Judiciary Committee and asked whether shes going to meet with her or not and essentially said i havent made the decision yet. Well, thats a big decision, and its a Supreme Court nominee and this process is moving forward. Ainsley brett let me interrupt you because we do have the sound bite and well get your reaction here it is. Im sure thats going to happen. Well see how everything works out. I havent made a plan one way or the other but im going to be, i am definitely going to be involved in the hearings and performing my role and responsibility on the Senate Judiciary committee. Do you have a message to judge barrett specifically . I have a message to the American People which is theres a lot on the line not only our fact that the democracy would dictate 36 days before the election when people are actually voting right now that the president , the new president , be in a position of being able to nominate who be the next lifetime appointment to the United States Supreme Court. Ainsley brett some are calling her to recuse herself from the hearing since she is the Vice President ial candidate. Yeah, i dont think thats going to happen but i also dont think that shes really made a decision. It sounds like she may meet with her, may not. Shes also asked a couple of specific questions that joe biden hasnt answered either. Are you for expanding the number of justices on the court . They wont answer that question. Are you for killing the filibuster in the senate . They wont answer that question. So, facing questions is part of the job, and itll be interesting to see if they get pressed by the media. Brian that was very differential of you they have not answered questions to anyone , shes given maybe a handful of interviews since she got the job as Vice President ial nominee but brett the word is that 87yearold senator dianne feinstein, among democrats the word is she might not be up to the challenge here. How real is that in buzz on the left and what would that mean . Well i think no one is up to the challenge on the left because they dont have any real amo to go against this nomination. They know that the numbers are against them, so, what can they do . They can delay for a few hours, maybe a day or so but for the most part this is in the cards if something dramatic doesnt happen in that hearing. Brian its safe to say both will not open up and say i promise not to attack you personally because i think its going to be a lot of that, from the president perspective, is there a line he should not cross look i think the American People want to hear substance, i think this is, its interesting if you look at sort of the way that we prepared my dad for these debates, he worked really hard, we had disciplined practice sessions and then he always took the day off right before the debate, and i have been watching joe biden. Hes taking that to new heights. He seems to have taken every day off until this debate comes up, so, he seems to be in a position where hes hoping to be very relaxed, but in all seriousness, the American People want to know what hes going to do for the country. Hes managed to avoid having to answer questions he wont tell us if hes going to stack the Supreme Court, he wont give people a list of his Supreme Court nominees. Weve watched President Trump particularly in terms of these nominations fundamentally change the face of the federal bench and thats going to last for generations, of course with just it Amy Coney Barrett hopefully to be justice Amy Coney Barrett so those kind of things where we have a track record and the Biden Campaign has basically kept joe biden in hiding. Hes not going to be able to hide tonight. Brian on the word record lets fast forward four more years the Vice President has somebody he doesnt know too well john edwards in the senate when your dad was Vice President here they are squaring off, watch. Frankly, you have a record in the senate thats not very distinguished one of the worst attendance records in the United States senate. Im in the senate to most when they are in session, and the first time i ever met you was when you walked on the stage tonight. Brian wow, so, gotta show up, so it was direct but it wasnt yelling, it wasnt personal. Factual. Yeah, factual and you know its fascinating brian because as i said we did spend a lot of time working on the debate prep going through binders putting together answers, how do you get your answer into a 90 second clip, and both in 2000 and in 2004, the lines that people remember were lines that my dad came up with on his own, sitting there at the table, and so i think that comes with sort of being relaxed, knowing the topic , and being able to listen to your opponent and respond to what the opponent is saying. Brian congresswoman i think this is really preparation what im about to say. You can look at joe bidens record and he could say my whole career ive been a moderate but what does that have to do with now . And you could say what you said in the debate was when it comes to energy, get rid of fossil fuels, get rid of fracking. Two months later get rid of fracking. Now, he says im not getting rid of fracking. People in pennsylvania and ohio are going to be listening for that. The president has got to prepare to hit him with no you didnt, yes i did. Youre better off knowing exactly what he said and when. Right thats exactly right. The other point i think he raised is an important one is the Vice President ial debate which will happen next week is going to be hugely important this year, they are always important but this year in particular since youve had both joe biden and Kamala Harris say that its going to be a harris biden administration. The American People are going to want to hear Kamala Harris explain to them why she wants to takeaway everybodys private health insurance, why she believes in a green new deal. Why in fact is her voting record in the senate the farthest left of any member of the United States senate. She also has been hiding and shes going to have to give everybody some answers and i think thats going to be particularly important this year as well. Amy barrett is going to be an excellent justice if shes confirmed auto it was thinking this morning about in high school i went through a phase where i liked this band called rush and they had an album called grace under pressure, and thats amy barrett. She is poised and shes also as a teacher and a scholar incredibly rigourous and focused and i think we saw that last time around when she was being confirmed by the Senate Judiciary committee. I think we saw that in the clip that you just showed, that in the face of attacks that were in my view inappropriate and unfortunate, she was very clear and direct in assuring americans and assuring the senators that she understands the role of a judge and she understands the task of a judge is to answer legal questions, and not religious questions. So i have a great deal of confidence in her ability to really contribute to the Supreme Court. Ainsley tell us more about her personally and then well get into the critics because i know your wife nicole they clerk ed together. Your wife was clerking for Clarence Thomas and she was clerking for scalia. What was her reputation . Yeah, her reputation as a law clerk that year, we met more than 22 years ago i believe, she was widely reputed be one of the smartest law clerks in the building my friend professor noah feldman up at harvard has said as much repeatedly but ive really had the privilege my wife and i have of being friends with amy and Jessie Barrett for a long time neighbors and colleagues with faculty of the notre dame law school. Shes a beloved teacher, she always wins the teacher award so none of the rest of us always have a chance to win it. Ainsley shes the godmother to one of your daughters right . She is a godmother to my middle daughter and our children are friends theyve kind of grown up together. Just the other day when the barrettes got back from the rose garden ceremony i looked out the window and my youngest son and her young boys were having some kind of a jedi war in the backyard and it was a nice picture. Ainsley thats cute were showing the pictures of your kids playing together and real quickly she has seven children and thats just amazing and shes adopted two children. What do you know about that . I know the family very well like i said weve been neighbors the whole time. Our siblings kind of our children kind of match up pretty well as friends so ive been able to watch her kids grow up and i just admire how that family works together as a team, both amy and jessie and all of the kids frankly. They all pitch into make this collective team effort work well and it does. Its very impressive. All over south bend, it isnt a very big town, everybody who knows the barrettes kind of admires them and wonders how they do it, but they do it very well, and you know, theyre involved not just with their own family but with Jessie Barretts coached my kids soccer teams and amy barretts been the classroom mom for some of my kids kindergarten classes, so theyre engaged in the community and theyre very generous with their time. Yeah, theres a balance of issues first you have the Covid Concerns of healthcare, and then you have the responses of the economy, this businesses are boarded up because they literally cant survive and on the flip side this balance of justice as well as law and order in the cities, and so thats going to be a big issue and now ill tell you this. The way that both candidates have been campaigning have been different. Donald trump has focused on the normal retail politics, going out knocking on doors its estimated by the Campaign Number s that they knockon 1 million doors a month, whereas joe biden theyre not knocking on any doors they want to do Virtual Events they dont want to get out and do rallies or anything like that. They say they can do that because the numbers are in their favor but the trump internal polls saying that this knocking on the doors is working for them when they get on this debate stage, both this is the first time both of them will meet, but this will be the first time both of them are going to be challenged on the way that they have decided to campaign and whether their message is working with the voters. Ainsley what do you want to hear from both of these candidates when they talk about the topic of race and violence . Well ainsley, you guys know not only have i been reporting on it, but actually, providing an analysis on it. You have to balance getting things done when it comes to criminal Justice Reform and policing reform, while not allowing the cities in america to burn down, and that is going to be important to articulate. How do you say that i want equal justice under the law, for all citizens in america, also saying you feel like cops are being demonized and the attack on cops cant be right but also the violence in American Cities by these anarchists you got to go after them, and so both candidates have to be able to articulate a message, they talk to all three buckets, and thats going to be a problem because Chris Wallaces probably going to press them on that and the American People they are going to be listening for sure. Brian lawrence tell me if this is a place the president should go. Joe biden got in the race he said after charlottesville. I saw the president s tone he was embracing, he thought, racism, and thats why he got in the president s never felt as though that was properly defined. Do you think the president should go there and try to correct the record because he knows joe bidens going to want to go there. I think the president should focus on his agenda. He released a platinum plan in atlanta last week where he talked about where he wanted to take black america and that goes into investment making sure the economy is better for school choice. That platinum plan he should know it and deliver that to the people. The people, you know, look. I can go back with both candidates and talk about stuff that they have said about black america or things theyve done in joe biden with the crime bill , and bring some criticism. I think people want a forward message what could benefit them and if they can do that then that be great for them. Steve thats where the idea for the happy cookbook came from i was just very overwhelmed actually with emotion, just hear ing your story. Steve and thats the whole idea behind the foods that make you happy. It just reminds you of something happy. Its like last time i told you the story about my wifes lasagne. She made it on our first date and at the end i said you know, youre going to think im crazy but some day were going to be married and she said you know what you need to leave.
