Ainsley yeah, steve, the violence coming just hours after the grand jury announced decision in the Breonna Taylor case. Brian thats where we had when the verdict came down the attorney general explained what the grand jury came up with. The unrest was almost right after the president s press conference. Night fell and you started seeing it. Now seeing pictures in louisville. Not the only place unrest. Chicago three separate places. In three separate places in new york city. And around new york city as you know two officers were shot. And we do happen to see situations in which uhauls have been dropping off with signs and in some cases weapons for people to protest. Steve, good morning to you. It was chaos on the streets of louisville last night. You can see things have calmed down significantly but for those two Police Officers. The good news is they are in stable condition. Police are also releasing some of that dramatic video last night around 8 30 when police say they were investigating gunfire about a half mile from city hall. Thats when those two officers were shot. We know that one suspect is in custody. Its unclear whether or not there is anyone else thats been arrested overnight. Again, the good news, those officers are in stable condition. The president officering a tweet offering prayers and support saying praying for the two Police Officers that were shot. The federal government stands behind you and is ready to help. Spoke to the governor and we are prepared to Work Together immediately upon request. We are also hearing from former Vice President joe biden also on twitter saying violence can never be the answer. Police, they have been setting up road blocks, things like that. On wednesday a grand jury chose not to indict officers for Breonna Taylors death back in march. One former officer was indicted on wanton endangerment for firing his gun into a nearby apartment. That indictment is not directly connected to Breonna Taylors death. We heard from kentuckys attorney general he hopes residents who are outraged will protest peacefully. I hope we respond in a manner that respects First Amendment rights keeping Breonna Taylors legacy in mind but also in a way that respects our louisville. Now, we are hearing also from the lawyer representing Breonna Taylors family who says they are outraged. As i mentioned the city of louisville not taking any chances. Look what they have put up here. Massive dump trucks pretty much guarding all of downtown. Preventing any cars coming out here. Nobody out here early this morning. We will see what the rest of the day brings. Who is out there exploiting the pain and fear and emotions of africanamericans on the street right now in louisville in order to incite riots and violence and destruction . This stuff was obviously planned. So we really need to know who is funding this stuff. We really need to know where the money is come from. And need to know who is behind this stuff. When i saw that video it was shocking to me how obviously coordinated it all was. I want to know who is out here exploiting peoples pain in this way . Brian what happened is over the course of months there was an investigation by a grand jury. The nature of the grand jury is secret. The deliberations are not made public. The attorney general looks at that and makes the announcement yesterday. The sergeant would be the one charged but not for the shooting death of Breonna Taylor. Says thats not justice. The attorney general says i understand the pain but you have to understand there is facts to this case that are different than being portrayed. Here he is yesterday. The decision before my office as a special prosecutor in this case was not to decide if the loss of ms. Taylors loss was a tragedy. The answer to that question is unequivocally yes. I understand that ms. Breonna taylors death has become a part of a National Story and conversation. But we must also remember the facts and the collection of evidence in this case are different than cases elsewhere in the country. If we simply act on emotion or outrage there is no justifiable. Mob justice is not justice. Justice sought by violence is not justice. It just becomes revenge. Brian she was shot six times. Rob, your reaction to the verdict, the attorney generals announcement, the grand jurys decision . I think first of all before i say anything you always have to say when im talking about Breonna Taylor that her death was a tragedy that should have never happened. I watched every second of that press conference yesterday. The thing that struck me the most is one of the first things that he said that was a result of the independent investigation was that officers actually did knock and announce themselves at the door. Steve thats right. , when i heard that it threw the entire narrative that had been pushed by some Mainstream Media outlets and a lot of entertainers, activists over the last six months. This no knock narrative had been pushed to the point that senator rand paul who is advocate for criminal Justice Reform actually introduced the justifiable for Breonna Taylor act which sought to ban no knock warrants. This is how pervasive that narrative had gotten in the Mainstream Media. When i saw that press conference and you saw that the facts came out in that narrative was sort of destroyed a little bit, and i think the question is, and this is a question that daniel cammeron brought up in the press conference, is that do we want a truth or do we want a truth that fits a narrative . And the unfortunate thing is that this narrative had been solidified so much over the past few months that people were not going to accept anything but an indictment of these officers. And they were primed for some of the protests and the violence that were seeing happening right now. Steve right. I agree with you completely about the new news about what was the deal with the no knock warrant. And he very effectively, rob, walked through the prosecutors case and what the grand jury was presented and clearly they agreed of with him where apparently the officers, the grand jury and prosecutors felt the officers were justified in using force because what they did was they went to that apartment. It was the wrong apartment. For who they were looking for. They went, they knocked on the door. Nobody came, so they breached the door. And Breonna Taylors boyfriend thought they were intruders and shot one of the Police Officers in the leg. And thats when the shooting started. And thats when she was killed. But, nonetheless, when he was laying that out, one phrase that he used yesterday, rob, was mob justice is not justice that got a lot of attention on tv yesterday. Watch this. I question the judgment of the Kentucky Attorney general saying, quote mob justice is not justice. He said it becomes revenge. The president having said that if joe biden wins the mob wins. Thats what he says. We know this is very politically loaded language. Your death is irrelevant to the law in the state of kentucky. This was a black lives dont matter ruling. Let me say this is a black woman. He does not speak for black folk. Is he skin folk but is he not kin folk. Because he is up there with a black face, he does not speak for all of us. This was not a tragedy. This was a murder. He should be ashamed of himself. Steve rob, i know you were in minneapolis after the george floyd verdict as well. So how do you square what you heard yesterday about the attorney general . Well, you know, its unfortunate but expected. And, you know, he alluded to this in his remarks. I think he had made a remark that said there is going to be entertainers and activists and celebrities that are going to tell us how to feel. None of them know the people of kentucky. I think he said Something Like that. Daniel cammeron being black and up there this is not somebody who was appointed as Kentucky Attorney general because of what happened. He was already there he is not there to speak for black people. Selfthere to speak for the people of the commonwealth of louisville, kentucky. Thats what he did. Its not surprising to me that he is the subject of attacks from a lot of people on the black left who want to tie him negatively to the president who want to call him, you know, the slurs that they use for black conservatives. And for me it is unfortunate because this isnt a republican or democrat thing. This is somebody who was on the side of facts and truth and very emotionally and very methodically laid all this out. I dont know how anybody could have watched that press conference and said daniel cammeron doesnt care about black people or black lives or doesnt care with Breonna Taylors family. Why was it important for you to write this . It was important for me to write that because there is a lot of racialized language that comes from both the black and white left when it comes to high profile africanamericans that are republicans either people like me that are commentators and influencers or people like daniel cammeron who are actually in power. Its really important to start calling that stuff out it. Does nothing to bring us together as a country it. Does nothing to bring different groups of africanamericans that may see this case differently together. And i think that it is very important to call it out for how destructive and divisive that kind of language really is. I somebody saying on one of the other Cable Networks that the Kentucky Attorney general was eating coon flakes. Thats not a good thing to say about anybody. And we have to Start Talking about how destructive that language is to people as a black conservative, i have been on the other end of that stuff as well. There is going to be a lot of people that hate me right now for basically just trying to be on the side of fact and reason when it comes to this tragedy and trying to figure out a way to bring americans together as a result of this. And so people with get the reforms that they are choosing but that they want. But like daniel cammeron said, you know, mob justice is not justice. It gets to a point where it becomes revenge. I think there are a lot of people with a lot of positions of power. So after they establish safety and effectiveness in adults, they tend to then move towards children and go from the older children working their way down to younger children with lower doses of the fact screen and thats how they establish the safety in children. I think we are at least two years before we will see something for children like the previous doctor said that they have to do rigorous testing in adults. It probably wont be done and even rushing it probably wont be done until april. And then we have to see how its effective once its released. Only tested in 18 to 65yearolds. Talking about giving to vaccine and people who need it the most. Really the people who need it the most is the elder live which it hasnt been tested. In we dont know if they are going to say we tested it now 18 to 65. Now what do we do for elderly and kids. Nine months to 12 months before we see any data coming out for children. I think we are a long time away. I think our Biggest Group that we need to be interested in is the teachers. If the teachers are refusing to go back to school and they have to offer a vaccine they are in that age group for the most part are they going to take it so they can come back to school and safely teach our children and yes i would give it to my children. Doctor, what are your patients asking you. There is concern it will be mandated for schools. My answer is its going to be very hard to mandate a vaccine for a pediatric population because that population has a very low rate of severe illness and death. So ethical its hard to mandate a vaccine for a population that is at minimal risk. Now, again, i think the people that have the bigger question are these teachers. Should teachers be vaccinated. So there is a lot of frustration, a number of people think that the Police Officer should have been charged. What is this charge that he faces within a done endangerment . Well, within a done endangerment is the kentucky phrase, the kentucky legal phrase for the reckless use of a dangerous instrument. So the dangerous instrument could be anything from a golf club to a Motor Vehicle to a handgun as in this case. This particular officer did not fire into the apartment. He fired wildly into another apartment. And for reckless use of a handgun, reckless firing at someone who had nothing to do with this he was indicted. The other two officers, the one of whom unloaded six rounds through the apartment door one of which killed ms. Taylor were not charged. Steve and the grand jury agreed with the prosecutors that the police could use they were justified in using force because after they did knock on the door, nobody came to the door and opened it so they broke it and once they did, her boyfriend was on the other side thought these were intruders and shot a Police Officer in the leg that is why they were justified in the use of force. Well, police can always use deadly force against some person or deadly force is used against them. This is a tragic, tragic confrontation. Steve it is. Of misunderstanding because the boyfriend who legally possessed his weapon and legally used the weapon had every reason to believe, because of the neighborhood in which they were located, that this was not the police, that it was someone or some group of people intending to harm them so his use of his weapon is lawful. The police thought were serving a warrant, somebody is firing at us, we have got to stay alive. We have to shoot back that is probably what goes into account. When the grand jury meets there is no judge or defense lawyer or defendant. Its the prosecutor and his witnesses and the grand jurors. And the prosecutor explains the law as he understands it and as he wants the grand jury to interpret it if he explains it fully the grand jury has a full menu in front of them of charges from which to choose they chose the lowest possible charge for the officer indicted and no charge for the officers who they found were legally defending themselves. Steve sure. Look, there is no great answer here. I understand the frustration of people in the streets in louisville. More tragedy last night when two Police Officers were shot. But the criminal Justice System was thought crafted to right every wrong. This is one of those wrongs that is not properly addressed by the criminal Justice System which is why the city of louisville paid ms. Taylors family 12 million to settle the civil lawsuit. Steve right. But there was anger on the street. There has been 100 days of protest. There has been there was a lot of miss information out there. We had heard it was a no knock warrant. As it turns out, they did knock on the door. We had heard the rumor that apparently the police went to the wrong house, searched the wrong address, but the louisville courier, the newspaper there, looked up the search warrants, and it was for her address, among other addresses. The police were not there by mistake. The police thought she had some sort of a connection to somebody they were investigating on a narcotics investigation. So, just a series of things that happened that brought us where we are. A lot of people are thinking was that the right decision that the grand jury made and ultimately you say. Well, the grand jury had all the evidence before it, steve, all the evidence that the prosecutors want you had it to have. The crowds in the street will probably, many of whom are legitimately demonstrating and many of whom are engaged in unlawful violence will not be satisfied until somebody is charged and convicted with murder. There apparently is not going to be any murder charge. The governor of kentucky has done a very unusual thing and i praise him for it. He has asked the attorney general to ask a judge to release all the information that was given to the grand jury so the public can decide for themselves if the grand jury did the right thing. The attorney general cant do this on his own. The prosecutors who presented the case to the grand jury cant do it on their own. Weigh what we now know based on the attorney general in kentucky said the police did knock and announce their presence. It was 40 minutes after midnight and the people who are on the inside of the apartment, ms. Taylor and her boyfriend, were asleep. So, you know, how effectively they announced they were the police is a different story. They did knock and announce. The problem is they come in the door. Its a very long, dark, dimly lit hallway and then they are fired upon. So the two police who come in the door fire back and they are the ones who ended up, one of them ended up firing a fatal shot. I think they struck ms. Taylor six times. The one who was charged was outside, ainsley, in a parking lot in the rear area of the building and just started to fire wildly. So it was appropriate to charge him with wanton endangerment. The thing is he didnt hit anyone. Fortunately. But you couldnt charge him with murder because he didnt cause the murder. So i think they brought the charge against him that the law would justify. But i think as the attorney general said yesterday the problem with this case is that the criminal law is not designed or suited to answer every human tragedy. And this is a terrible tragedy. It really have someone says look somebody enters my house after midnight its dark. I dont know who it is. Might be in a dangerous neighborhood. Then i would do the same thing. So it is tragic. And the guy on the outside, the Police Officer that was indicted with three charges he was outside like you said sliding glass doors. There was a window. He shot through both of those. But the blinds were closed so he didnt have a line of sight. And those bullets went into a neighbors house with a pregnant woman, a man and a 5yearold child. So thats why the three charges. But it is tragic. What do you say to the people who were out there protesting though and they say there is no justification . Well, you know, its i understand that this is caught up in a political narrative. I think its a very unfortunate political narrative for the country because it targets the police. If we dont have good policing, we cant have prosperity. We cant have protection in any neighborhood. And what happened here is a terrible outcome. But you have a situation where the police had a lawful warrant. They were legally authorized to come into the apartment and for those who say that this apartment was not connected to the narcotics trafficking, they are just, you know, putting their head in the sand and not looking at the facts. That this was a Narcotics Trafficking Network in this neighborhood and this apartment was closely tied to it and, unfortunately, ms. Taylor was tied to the person who appears to have been running the network. So, the idea that it was you know, somehow wrong for the police to be at this apartment is belied by the fact that a court issued the warrant to allow them to enter. How they executed it, you know, is a different and tragic matter. But i dont think the facts there the idea this was unconnected location. Ainsley yeah. And we dont know what they said when they got into the apartment. Maybe when you have a search warrant you have to announce continuously as you are walking into someones house and apartment. Bloomberg, the Florida Attorney general ashley moody is now calling for an investigation and she joins us live right now from tampa, good morning to you. Good morning. Great to be with you. Steve great to have you as well. Explain the law where if you are a felon and you have a fine you cant vote. Well, again, lets be clear. Its fines but its also restitution. Moneys that are owed to victims of crime. Steve okay. And, you know, it is a bipartisan law, it applies to all equally. Steve okay. So, interest are a number of felons and i dont know where the number 16 million came up, but he now is offering to pay the fines, the restitution, et cetera. You think that could violate election law and so you have called for an investigation. You know, look, we have to have trust in our elections process. Its essential to a strong stable democracy. And so when you hear words like targeting certain voters investing and adding to a particular column, that doesnt matter what party it is that triggers florida law. Under florida law you cannot directly or indirectly give anything of value to persuade or entice a vote. And so as attorney general, and i believe any official charged with enforcing elections law, we have to be clear about what we are doing, which is why when i asked for further investigation i attached all the relevant law. Even opinions that describe if you target even particular voters that may be predisposed to vote a particular way, that may be illegal. And, you know, americans can judge for themselves. They need to know that those that are in charge of the elections investigations are on it. I am hopeful that the fbi also takes notice. I directed them also to consider federal law. Americans need to know that no stone will be left unturned and investigations will proceed so that they can trust in these elections. Steve i have heard some people suggest that Michael Bloomberg is just simply trying to buy votes down in florida. But there is no guarantee that these people would vote for any particular candidate. Nonetheless, have you had some critics who have said why is she doing that . Well, look, this is merely an investigation that i have directed. Again, when you look at the memo and what was alleged, when you hear words like we need to get this done, investing money to targeted particular group of voters that may be predisposed to vote a certain way, that raises concerns that you are directly influencing or even indirectly giving money to persuade votes to go a certain way. So, the investigation will proceed but what americans need to know and what is so very important because we want there to be trust in this election process, that is those that are charged with year seein with ovd investigating will be diligently investigating. This Breonna Taylor case we have been looking at this for months, the grand jury has. Did they come to a decision that you are comfortable with . You know, heres the issue with the grand jurys decision. There is a lot we just simply dont know. And so you know, those who are angry they are not going to september truth. When you look at the facts that there were issues put out early on it was a no knock warrant. We found out there was a knock and announcement. We also find out that a suspect fired several shots entered. They are exonerated. There is a lot of misinformation being put out and there is a lot that we just dont know. Even the and i applaud the attorney general daniel cammeron for his thoroughness, his commitment to find the truth. And he is absolutely right. Mob justice simply is not justice its just revenge. Brian as a tulsa prisoner you look at this and Something Like this could happen in your jurisdiction tomorrow. And as you look at what happened here people want to say the police were wrong. Others want to say they were right. Is this racerelated . I dont see that its race related whatsoever. And im really glad to see the Louisville Police department take swift action because you can see how our cities across the nation have very liberal policies, are definitely being destroyed and looting, rioting, burning death and destruction. So, but when it comes back to a race issue, no. I dont see that this is a race issue. Her name was on the search warrant. I actually took the time to read the search warrant last night in the affidavit. Her name was on the search warrant. Her address was on the search warrant. And race has absolutely nothing to do with it. It was all around a drug crime. Brian dr. Porcher with this verdict and i will let you weigh in on it. There was protest riots in milwaukee buffalo milwaukee and saint paul and three separate locations in new york for a total of over 2,000 people. We know what happened with the two Police Officers being shot in louisville. Is the reaction around the country is, that something that cant help but be factored in when the grand jury sits down to decide a case . Well, i think this is problematic. One of the things im speaking to where is joe biden in the wake of this anarchy that is plaguing the cities in the united states. This is a time when joe biden needs to posture and state that he is diametric opposition to the right shu riotous behavior. Martin luther king was focused on constitutionally protected protest. When we go back to Police Officers being shot and anarchy plaguing that community we need to focus on the rule of law. Providing authority. Therefore thats what we need to focus on this. And not to mention its financed. The question is who is financing it and these folks are outsiders of the municipality they are in. What are they doing there . They are carrying out a mission. And its certainly not about Breonna Taylor. It wasnt about george floyd. You know, they embed themselves in peaceful protests and frankly they have another agenda. We know what that agenda is. And we think about portland and they were crying about moving federal agents out and once that happened, did the rioting stop . No. It continued. And then the calls for resignation of all the Police Chiefs from across this country . Does it matter the race of the police chief . No it does not. There is another agenda and it is certainly to undermine our government as we know it. Brian weigh in real quick, diana, if people want to have racial justice, we get it. We also wants to support troops. But if organization to support troops is not getting the money to the troops it, doesnt and you stop giving money to it, it doesnt mean you are suddenly against the troops. Now to those two Police Officers that were shot last night, the good news you are in stable condition and one suspect is in custody. The police were actually streaming part of their operation on facebook last night. They captured dramatic video. While they were out there that the officers believe to have been shot. We heard from police chief last night who fears for his officers safety. As they were deploying to investigate what was going on, shots rang out and two officers were shot. Mark last night we heard from President Trump on twitter who said he was praying for the officers and the federal government stands behind kentucky and ready to help. He spoke to the governor and that we are prepared to Work Together immediately upon request. We are also hearing from northbound also on twitter that says violence is never and can never be the answer. Those who engage in it must be held accountable. On wednesday a grand jury chose not to indict any officers of Breonna Taylors death. One was charged with firing gun near apartment but the indictment is not necessarily connect today taylors death. Kentuckys attorney general says the hopes the people that are upset about this will protest peacefully. Mob justice is not justice. Mark compared to what we saw earlier this year, louisville seemed to be prepared for protests. They are blocking any cars from getting downtown. They dont want people to bring vehicles wherever theres crowds. The streets right now relatively calm and the businesses boarded up. I cant imagine anybody coming to work in downtown louisville today and we are expecting to get an update on police not only on officers but the suspect that was arrested for shooting them last night. Well, you know, i respect our criminal Justice System but i still think that it needs deep reform. I i think when it comes the nuance its dead today in politics and public life as well. I can see from the officers perspective that they were enforcing the search warrant but i have problematic concerns when it comes to search warrants. The target of the search warrant was mr. Glever. They had a noknock warrant. I read it. Apparently to the attorney general he says that they did not exercise that. Mr. Walker says that he never heard them announce themselves. Now, that would give you some pause as well because he shot those officers and he was cleared of all those charges because im assuming that the attorney general im sorry, the local da thought that was true. So, again, theres a little blame on both sides of this and i think overall no one is happy because at the end of the day it showed you some errors in our criminal Justice System. The innocent person is Breonna Taylor. She did not have a criminal background and she was ems technician. Mr. Walker was innocent as well. Kentucky has stand your ground laws. How do you enforce your warrant like that, it was a searching warrant and not arrest warrant in a state that has stand your ground laws . There are certain protections for citizens and he pulled his firearm not knowing who was coming through the door, so as civil libertarian, as the days come, im interested in seeing whats in the grand jury report, when they could protect those grand jurors. Steve its certainly frustrating but mistakes were made and the grand jury made everything ultimately before the grand jury came out, the city of louisville gave her families 2 million but admission that something definitely went wrong. Yesterday before the attorney general presented to america the information that the grand jury was presenting with, there was apparently a uhaul, did you see this that was unloading things . They were handing great big signs saying abolish police, they had the 3 arrow logo associated with antifa and shields and one woman heard saying we have shields handed out by somebody who appeared to be an organizer, they had masks and goggles and Water Bottles which they use when the police do deploy anticrowd control measures. It looks like theres some sort of coordination that went into what we saw later in the day. Yeah, how long have we been talking about this, guys. Ive talked about the coordination. The question is who is going to stop this because they are righteous folks that are out there protesting and then you have agitators that come in from out of town, many are wealthy, come from rich neighborhoods and they come down and seem to stir the pot in the communities and they are well prepared and well funded but seems like no one wants to go in there and shut it down. If they have a video, they can know who purchased the uhaul. They have facial Recognition Technology and use them to get real criminals off the street. Ainsley so the ag was weighing in on some of what the celebrities and influencers were saying not in support of how the ruling went down. Listen to what the attorney general said. Okay. Theyll be celebrities, influencers and activists who have never lived in kentucky who try to tell us how to feel, suggesting they understand the facts of this case and that they know our community and Common Wealth better than we do. But they dont. Lets not give into attempts to influence our thinking or capture our emotions. At the end to have day, it is up to us. We live here together. Ainsley i want you to weigh in on that and i also want you to make some suggestions. Im not a Police Officer, i respect them, but what could have been done differently, you know, they are searching in the middle of the night, they are entering an apartment where this man thinks that someone is breaking in, a lot of our viewers would have done the same thing, they would have fired shots . I mean, first of all, to the attorney generals word its important for all of us who have platform as we pursue justice its not our job to gaslight, on the flip side, if it wasnt for people with platforms the story of Breonna Taylor would be dead. And you bring an interesting point. Im a legal gun owner and you come through my door and i dont know who you are, that could be a problem. Thats the training ive received from the military and former Police Officers, and so as civil libertarian theres a lot of problematic things with this case. What is my solution . Maybe they should have came through the early morning, maybe they should have came through the day, maybe they should have announced themselves louder, this was not a violent search warrant. This was a warrant to gather evidence, evidence that i may know was not found in the house. There were no drugs and the gun that was there was a legal gun, was purchased by a legal gun owner. Again, a lot of us that are Second Amendment advocates have a lot of problems with this case. Yes, we support Law Enforcement, we we believe that what happened last night to those two cops were wrong was wrong. When you are looking up this case, im not saying go charge them because im not a lawyer and understand that he didnt have enough evidence according to him to present to the grand jury to get a true bill, but at the end of the day, a lot of us that support the Second Amendment are saying, do we still have rights as well because if we dont know who is coming through the door, weve been taught through our training to fire off a round. Senator i havent released a timeline yet but the earliest anyone has ever been had a hearing from the time a nomination to hearing was 10 days with Justice John Paul stevens and i think justice berger. We are looking at a timetable like that and we will give a chance for democrats to challenge the nominee and not abuse the nominee. We will let the American People look at the nominee. Highlyqualified woman who will impress the country. We will try to make it a circumstance where you can learn about her, learn about the law, learn about the senate.
