the captain of this plane should not have been flying in the first place. >> oh my god! oh my god! the plane is on fire. >> a shocking new report shows the pilot had two prescription drugs in his system when a u.s. airways flight crashed at the airport in philadelphia in march. doctors told him he wasn't able to fly for 60 hours after taking that medicine but he got into the cockpit 45 hours after taking those pills. the report also says he and his copilot failed to properly prepare the plane for takeoff and ignored warning signs. >> the goam mandate for large -- the obamacare mandate for large companies kicking in. they must provide insurance if they have more than 100 workers. critics say employers will cut hours to stay under the requirement. those are your headlines. back to you guys. >> thank you very much ainsley. four minutes after the hour. now to a fox news alert. today the country is mourning the loss of a man known as a liberal lion. i'm talking about former new york governor mario cuomo. he is dead at the age of 82. patricia stark has a look back at his life and legacy. >> mario cuomo was a political giant in new york state, the first-generation american earned his law degree before working his way into politics. he was elected new york's 52n governor in 1982 and served three terms. his death coming hours after his son andrew was sworn in for his second term as governor. >> he couldn't be here physically today, my father. but my father is in this room. he's in the heart and mind of every person who is here. he's here and he's here. >> cuomo had been sick for months and passed away of heart failure at home with his family by his side. his daughter noted he passed 5:15 p.m. which were his lucky numbers added he waited until after andrew's swearing in. he launched himself into the national spotlight when he delivered the keynote speech at the 1984 democratic convention. >> we democrats must unite so that the entire nation can unite. >> there was later talk he would be a running mate for bill clinton but decided not to run. as governor he balanced budgets, reduced taxes and created jobs for new york. president obama released a statement praising cuomo for his public service and new jersey governor chris christie remembered a giant from across the political aisle. he was a strong leader who loved new york and his leader. he was a role model for future generations that anything was possible through hard work and education. mario cuomo leaves behind his wife of 60 years, five children and 14 grandchildren. >> mario cuomo, i remember he came by and talked about his children's book. he wrote a couple of really great children's books, came by the studio early on. and i also remember too that he was a guy that everyone was certain was running for president. it was just a matter of almost as inevitable it seems back then as hillary clinton is to run for president, it seems inevitable -- just a formality. there still is questions about why it didn't happen. court as we were talking about in this piece, bill clinton choosing him, wanted to put him in the supreme court. he said i want to stay and serve new yorkers. i don't want to be on the supreme court. i want to continue to do my part to serve new yorkers. he was certainly a new yorker through and through. >> we want to get to this fox news exclusive. catherine heritage did incredible reporting and has a story about a military veteran who served multiple tours in iraq. he was so fed up with what was going on in syria, he decided to get a plane ticket and fly over there and start fighting. he joined a group with the kurds. we're asking this morning if it is that easy to go fight in syria, is it that easy to go fight on the side of isis? >> he'll go through the process, what it was like to sign up how easy it was to go and get out. here he is with his voice disguised and his face obscured talking about what he went through. >> what is anybody doing about it? nothing. sitting around going what do we do instead of getting up and willing to change. i bought a ticket. it was that easy. it was like booking a flight to miami beach. there was a facebook page for it. it sparked my interest. they got back to me, told me to send them essentially a resume for vetting purposes. >> that simple, just to go on facebook plug in some information. they do a background check on him to make sure he's legit. he wants to go on the front lines to fight isis. he wants to be there face-to-face with these guys. >> catherine heritage said the military experience he had was a plus. but he goes on to tell her they basically were giving everybody a gun and saying good luck, buddy. as soon as he was met in the airport at iraq they drove him almost immediately to the front lines and he didn't have body armor. >> it is unbelievable the kurds still are not armed. he said it was incredible how poorly equipped they are. he says nobody there knew how to handle a gun so he was training other people to do it. he also was heartened by the fact that it was clear to him he was fighting for the good guys. why we haven't done more to back the kurds who have done nothing but respect us and show the heart of a lion in battle, i don't get it. we promised almost nine months ago. >> what is amazing how easy it was for him to join the good foot. imagine how easy it is for lone wolves to join the bad guys. >> we've already seen it. >> on a different debate let's talk about a domestic debate and that is disciplining your kids. this is a huge story when adrian peterson went up on charges put against him. now dads are worried. when they want to discipline their kids are they going to end up with discipline themselves? possibly jail time? >> this father in florida wanted to to discipline his 12-year-old daughter so he decided to call 911 and made sure the cops watch so he wouldn't be charged with it. >> they get called with this routinely there. police department, i know you guys might be busy with other things but corporal punishment on my daughter. can you guys come over to the house? not a lot to work with. obviously didn't have the passion to knock it home. >> absolutely. i think what we're dealing with here is a system predicated on political, you know, advancement and favorrism and nepotism for a very long time and the most qualified candidates are often overlooked for judgeships begin to cronies, people with positions. >> i can see the passion in your eyes and how passionate you are this morning, so let me ask you this. the mayor watched as he got embarrassed as they turned their backs on the monitor at the funeral. he saw how he was treated at the hospital. what is your take on this mayor? >> i think he's lost control. i think his first year in office has been an unmitigated disaster. i think that he would serve new york city well by purging his entire advisory staff and bringing in a group of people who are professional and have had success in operating successfully city governments. >> you were not at the big tuesday meeting with all of the nypd associations sargts -- sergeants. can you tell me what progress was made? >> i wasn't privy to the conversations inside, but the buzz is that no resolve, no advancement, no potential for anything to come of it. this mayor has had over a month since the staten island grand jury decisions to support nypd and he failed to do so. >> summonses are down, arrests are down. that is a response because they don't feel the mayor's office has their backs. what's next? >> i fear it's going to get worse before it gets better. and i think that police law enforcement will continue to do their jobs and protect the people that they know have their backs, but i fear that the rhetoric will drive and the chasm that this mayor has caused and this rift will get worse before it gets better. but i'm hopeful that someday everything can get back to normal. >> unfortunately, it's your move mayor and we don't like this one. thanks so much for your service. coming up straight ahead, last june president obama promised to make student lincoln debt more manageable -- to make student loan debt more manageable for students. who will ultimately pay for this massive bill? >> i'm not sure that every person will go to college. i think there is a higher percentage now than previous times in u.s. history. perhaps not every high school student in the united states is destined to go to college. there are careers they can follow without going to college. i think something people ought to consider here is this is money that the federal government is along along -- loaning to students and going to colleges, students are giving it to colleges. the colleges are the ultimate beneficiaries. according to statistics, 55% of full-time college students in the 2011-2012 school year had federal student loans and the percentage was higher for those in four-year colleges. this is becoming a routine part of american life for college students. i think we need to question whether it makes sense for the federal government to subsidize american colleges and universities at putting debt on the shoulders of students who go to college because that's what we're doing. >> president obama signing an executive order trying to fix all of this. has it done anything? >> no. the fact is that $119 billion in increased student loan debt just in the last year alone according to the u.s. treasury. i think what we have to worry about down the road is the temptation of the government to do a bailout. according to the congressional research service, there are already 50 programs that are authorized where people can get their loans repaid or forgiven if they do things the government wants them to do. work in a certain profession, work in a certain government agency. i think there is going to be a political temptation down the road for congress to want to forgive even greater amounts of student debt which will transfer the burden of this to the average taxpayer, even taxpayers who didn't go to college. i think that is a risk down the road. i think we really have to stop and examine this. ought not there be something done on the part of colleges and universities to control their costs and expenses rather than charging students more than they can pay and their families can pay so students are taking on massive amounts of debt which potentially is a liability for the taxpayers of this country. >> the cost to attend the university of texas $26,000 a year. it goes on and on across the country. read terry's piece on cmsnews.com. >> that crash of the airasia plane, what we learned overnight from search crews in a live report. you know that song made famous from the movie "pitch perfect" ♪ >> how about one with a little extra kick? >> listen to this story. this is so bizarre. a driver hiding two bodies in the bed of his pickup truck accused of shooting two west virginia police officers. it started when the officers pulled over the driver of a stolen s.u.v. the driver of that truck also stopped on the side of the road and started firing shots at the cops. it turns out the man with the gun was the father of the guy driving that stolen s.u.v. the officers were wounded in that shootout and the gunman was hit in the leg. when the gunman's truck was searched, officers found a dead man and a dead woman in the bed of his truck. they were the owners of the stolen s.u.v. that the son was driving. both the father and the son are behind bars this morning. the flu claiming another young life this one in iowa. a thzee-year-old little girl died this week. started showing symptoms of this is the latest death in a string of 16 children dying because of the flu in the u.s. this season. iowa is surrounded by statqz with dangerously high flu rates. the c.d.c. calling this year's flu an epidemic. united airlines apologizing to a new jersey family after a mother claims they humiliated her special needs daughter. the three-year-old had cerebral palsy and she can't sit up on her own. she asked to sit in the lap of her mom or dad on flights to support her. on the way home from their family vacation a flight attendant demanded the child sit in her own seat. the family posted this tweet, when united finally did apologize more than five days later and they are thanking the airlines for their apology. how much do you think it would cost for a brand-new iphone 6? editor and chief of town hall magazine joins us now. good morning. thanks for being with us. first up, obamacare. >> absolutely. the congressional republican hands are probably going to be forced on this one by the supreme court. they have a big decision coming up in june on a case that may invalidate tax credits to many republican states. republicans in congress are going to have to have an alternative program to obamacare ready to go by june. >> how about immigration? john boehner may be doing something with d.h.s. in the spending bill set to expire. >> they passed the spending bill for the rest of the government in december but punted on department of homeland security. will republicans stand? will they force obama to retract his amnesty? we'll know by the end of february. >> how about extending tax breaks? >> tax extenders already expired for 2015, new year's day yesterday. the question is when will republicans go back and redo these tax extenders before the end of the year retro actively. the big question is whether or not obama is going to demand increases in revenue, any type of tax reform republicans do. >> the highway -- the highway trust fund is expected to go broke at the end of may and a way to change that, or to subsidize that at least is to do something with the gas tax. what's going to end up with this? front page is cuomo's death, highly revered figure in new york city. then you have everything going on with bill de blasio reigniting some tensions after we thought he was trying to mend some fences. but this morning it looks a whole lot worse for him. >> yeah. judge johnson decided to release two individuals who madurossistic threats against cops. one of these individuals actually posted a picture of somebody shooting into a cop car through a window and put it on one of his social media sites. this judge felt it was a good move to let these two out and that judge has been reappointed by this mayor. >> yeah. and so often according to a guest we had on earlier, qualified judges are given the back seat and not appointed because of cronyism. he says that's what's going on with this reappointment. we're talking about sergeant patrick cullen, the president of the new york state supreme court officers association and here is what he had to say. >> i think that what we're dealing with here is a system predicated on political you know advancement and favoritism and nepotism for a very long time and the most qualified candidates are often overlooked for judgeships, given to cronies, people of positions. >> you want to see what one of the threats sounded like and see if it sounds benign. just a knuckle head. i googled all of you meaning the cops. i find out where you live. i don't know about dead cops or your families. i will meet you in a bodega and get you. you will die. another put up something that said essentially the 73rd precinct will be hit next. and these two guys are allowed out. that judge let them out and now this is two days after the mayor had a major meeting with all the union heads saying he wanted to heal the rift in their relationship. this is how he does it. it's another dagger. >> yeah. it would have been a great olive branch that he could have extended. >> yeah. sergeant cool since laying the mayor's first term, first few months has been an unmitigated disaster for the mayor. we'll see if he can mend further fence. >> you're going to be happy about this because we know your heart is really in philadelphia still, clayton because right now between new york, the columbus ohio and philadelphia pennsylvania, to see who will host the dnc convention. new york was the front runner. but could the current state and the rift between the cops and the mayor's office push new york to the back burner and say we don't want the controversy. we don't want the nypd turning their backs on anybody and casting aspersion at our party. and therefore, give it to these other two cities. >> officials are now reconsidering their plan to do that thinking it will take the spotlight off the presidential nominee. >> bring it to philly. we've got great cheese steaks down there. totally welcoming. why not? sitting around going oh, what do we do? instead of getting up and want to go change it. i bought a ticket. it was that easy. it was like book ago flight to miami beach. there was a facebook page for it. shot a message expressed my interest. they got back to me, told me to send them essentially a resume. >> so the vetting process is pretty easy. just gets on facebook and sends a message and they say all right, come on. get a plane ticket. come over. somebody meets him at the airport in iraq and almost immediately takes him to the front lines and gives him a gun and says, all right. good luck. he said he didn't even have any body armor. so he took a bible and stuffed it into his clothing. >> he had some training other guys don't. a scottish guy picked him up. he's fighting with canadians. a lot of people see the islamic state taking over and they want to take action. something that's buried, we have yet to arm the kurds adequately. and the whole fight against isis is being buried. no one is doing almost anything around there maybe 300 here 200 people there. but for the most part, there is no strategy and the president is getting a pass on it. nobody is pushing him to solve the problem, which was the disintegration of iraq. >> is this helping to expose how easy it is to get a plane ticket to go over and start fighting and potentially join isis? >> right. the federal government says they're spending $147.9 billion for veterans for benefits. it doesn't feel like it to you? >> no, it doesn't. i think i'd like to be part of the solution rather than the problem. i think that one thing they should do with the vied rans administration is start closing down all the medical centers except for long-term care for the people who are wounded and things. leave hospitals open on the bases and allow the vets who qualify for the benefits to go to hospitals anywhere in the country and doctors. just put us right in there with medicare. >> yeah. meanwhile, you think a illegal immigrants are getting a better shake at this. >> from what i understand, you come into the country illegal you break into our country and you have medical problem, go to the hospital and they take care of you. a veteran who fought for the constitution doesn't get that full right. >> what we're starting to see even more are these military charities really stepping up, right? >> that was in the sheraton hotel. he and i would agree and sometimes disagree. he could lecture. he could be difficult. he could also be very friendly and affectionate and protective as he was with me at certain times. although sometimes he would call me up and remind me that i hadn't been elected governor and that he had been elected governor. so i was acting as his press officer at that time. sometimes speech writer and worked on a bunch of his speeches. so he would remind me that i should really speak to him before making any statements to the press. >> i want to hear about the speak writing phase because he's known for some great oratory phases. what was it like to put words on paper for him? >> he was a craftsman in terms of words. he read an awful lot. he was almost kind of a zen governor in some ways. he would do yoga. he would stand on his head. i remember during the sing sing uprising before he was elected governor, we were there just a few aides in the world trade center office and it was a very tense stand down. 17 folks at sing sing, correction officers, were being held hostage. so he stayed up for two nights as we all did, to get it done and get them removed safely. that kind of set him on the path nationally as well. >> what do you think the loss to mayor koch in the mayoral race played to him becoming governor? >> he lost to ed koch in a mayoral race when he was a lot more conservative. he became a lot more liberal in that gubernatorial race. when he would run for mayor, he would run on the neighborhood preservation party in new york, which had all kinds of stigmas in terms of intergroup relations. he became more of a liberal. he beat ed koch when everybody thought that ed koch would win. so it was a come from behind victory that no one expected. he stayed three terms and eventually beaten by governor pataki. >> i'm curious, his hesitation to go to the national stage. he had an opportunity that bill clinton was going to put him over for the supreme court. he wanted to stay in view of new yorkers. and he could have been a running mate for olympic. >> he's a mysterious figure that a lot of people were not able to figure out. contradictory in many respects. he might be remembered for the things that he didn't do. he had an opportunity to run twice for president. he didn't do it. he had an opportunity apparently to be in the united states supreme court as an appointee by bill clinton. he didn't do it. i think he wanted to be remembered as the son of an immigrant, as an american who made it against all the odds and wanted to be an inspiration to a lot of americans who had the same background. big government guy. didn't actually work out in new york state. taxes went too high. the accomplishments were not as strong as he would have wanted. but he tried really hard. in fact, he told the "new york times" that he wanted that to be his epitaph, that he tried. and he did try. i'll always be grateful that he was so nice to a young guy and gave him an opportunity to do a lot of things, from writing speeches to being a press secretary, to hanging out with him around the state going up and down from brooklyn to buffalo. incredible experience. >> and passing away minutes after his son, andrew cuomo, sworn in. >> that is incredible. >> peter johnson, jr., thank you so much. >> good to see you guys. let's get it over to ainsley earhart now who is standing by with a look at the other headline. >> thank you. chilling new threats on twitter targeting police officers in st. louis, missouri. 35-year-old jason valentine now under arrest for posting phrases like this: kill a pig night and pick a side or die with them. police saying that many of these tweets mentioning ferguson where an unarmed teen-ager, michael brown, was shot and killed by a police officer. the flu claiming another young life. this time in iowa. a three-year-old little girl died this week. here is her picture. just three days after she started showing symptoms of the flu. this is the latest death in a string of 16 children dying because of the flu in the u.s. this season. iowa is surrounded by states with dangerously high flu rates, as you can see. the cdc now calling this year's flu an epidemic. a dad who wanted to discipline his 12-year-old daughter calls police to come out to supervise him thanking her. -- spanking her. he told the police that he didn't want to break the law. the undersheriff saying this in response. it's definitely not something that we advertise to do and is done only when a deputy has no other calls to handle. so what do you think? >> shortly after the cops were murdered execution style, i saw the tweets and was very confused because i thought this was unanimously an act of barbarism and i thought that given the fact that she was an undergraduate, a representative of the african-american studies department, that it was news worthy. and after actually send her a request for comment, she called for an infatah do in america. >> look at some of the threatening facebook post she wrote. i will really fight you right now, you racist system lickers need to stand down. where is your humanity? >> i'm unsure of any. i know that the community right now is so reeling from everything that happened. it certainly was a divisive time. i don't know what's going to happen, but she just told the boston globe that she stood by all of the comments on her twitter feed, including a call for an intafada in america including the death of innocent. >> you're getting all sorts of crude messages that are just horrible. one person even called your grandmother's house? i thought you did. i apologize. i didn't mean to leave you hanging there. ohio state looked good the second half. the ducks had the better uniforms and they're seven-point favorites. a fox news alert. >> four minutes after the hour. today the country is in mourning over the loss of the man kn liberal lion. we're talking about former new york governor mario cuomo has died at the age of 82. patricia stark has a look back at his life and legacy. >> reporter: mario cuomo was a political giant in new york state. the first generation american earned his law degree before working his way into politics. he was elected new york's 52nd governor in 1982 and served three terms. his death coming just hours after his son, andrew, was sworn in for his second term as governor. >> he couldn't be here physically today my father. but my father is in this room. he's in the heart and mind of every person who is here. he's here and he's here. >> cuomo had been sick for months and passed away of heart failure at home with his family by his side. his daughter noted he passed at 5:15 p.m., which were husband licky numbers. adding he waited until after andrew's swearing in. he launched himself into the spotlight when he delivered the keynote speech at the 1984 democratic national convention. >> democrats must unite. we democrats must unite so that the entire nation can unite. >> reporter: there was later talk that he would be a running mate for bill clinton but decided not to run. as governor, he balanced budgets, reduced taxes and created jobs for new york. president obama released a statement praising cuomo for his public service. new jersey republican governor chris christie remembered a giant from across the political aisle. he was a strong eloquent leader who loved new york and its people. as an italian american, he was also a role model for future generations that anything was possible through hard work and education. mario cuomo leaves behind his wife of 60 years five children and 14 grandchildren. >> it's quite a tale of two new york leaders this morning when you have the cover of all the local papers honoring mario cuomo and then you have just when you open up the paper and dig a little deeper inside, not so nice words for mayor de blasio right now. >> right. it's all about cuomo right now, but de blasio for all the wrong reasons has been on the cover of most new york papers and national papers because of the tension that he ignited in his battle with the nypd from how he took the assessment of the eric garner grand jury decision on down. tuesday there was a major summit with all the police unions. he's saying he wanted to heal the rift between the cops and the mayor's office. allowing this judge to get reappointed do that or a major set back? for me it looks like a major set back. >> we're talk being judge laura johnson, soft on cops who made threats against them. this is one of the threats from travis may against nypd police officers and their families during the arraignment. he said, i googled all of you, find out where you live. i don't know about dead cops or your families. i will meet you at a bodega and get you. you will die. >> yeah. he was also picked up for attacking a cop outside a brooklyn restaurant and was stunned with a taser. hours later he is now out, along with another guy who posted pictures with a gun outside a cop car. >> cops here are furious about this reappointment. and sergeant cullen is one and he was on the show, the president of the new york state supreme court officers and he had this to say. >> i think that what we're dealing with here is a system predicated on political, you know advancement and favoritism and nepotism for a very long time and the most qualified candidates are often overlooked for judgeships, given to cronies, people of positions. >> not just in new york city, america's largest city, but across the country we're dealing with tensions between communities and police officers. we heard earlier in some of ainsley's headlines in st. louis, a man was charged with threatening cops saying kill pigs tonight. a man in san francisco arrested for shooting at police officers. new york sets the tone for the rest of the country under a lot of circumstances. >> and it could also have political implications now for the dnc. party officials are talking about bringing it here, the big convention to new york in brooklyn. but now that may all change because of this tension between the police department and mayor del blass i don't. maybe want to move the dnc to a separate location. >> yeah. they haven't awarded it. it's like the olympics or the super bowl. it will be major revenue and you want the number one media market. philadelphia and columbus are finalists. it looks like according to one local newspaper that the inside word has the other two cities moving up because the last thing the democrats want, you could understand that, is the law enforcement community turning their backs on a liberal progressive detainee represented by mayor de blasio. 2016 is a long way away. things could be healed. but you don't want to take a risk because there is a huge runup time in preparation for hotels and just planning purposes. so they could be getting themselves in trouble here. >> let's go down to florida where a father has sparked a debate over corporal punishment. he wants to punish his daughter, his 12-year-old, mind you, for getting into an argument with her sister and he wants to spank her, but he feels like he needs to call 911 to get a cop over there so this police officer can watch and make sure he's not committing a crime because he's so scared he's going to have child abuse or assault charges against him. what's even more wild about this is that the law enforcement community says this has happened dozens of times. >> this is okay down there. noel steven writes this the undersheriff, he says it's definitely not something we advertise to do and even though law enforcement has been willing to help out in the situation, watching a patient discipline their child is something that's done only when a deputy has no other calls to handle. so call us if you want to spank or otherwise hit your kid and we'll come and watch that. >> it's pretty pathetic that it's gotten to this. i want to hear your responses. you've answered. here is michelle ho says it's no one else's business what a parent does unless it's actual abuse. but that's the point. you don't want to be accused of it, especially if your kid wants to call 911 and report their parents. >> what's actual abuse differs by state. there are 19 states that still allow corporal punishment in schools. florida is one of them. even in wood shops in florida, they actually create paddles in the wood shops. 16 inches long and have a certain size that they use for corporal punishment. teachers are allowed to hit their kids in school, even if they're late for school. >> right. we made bowls in our school and i brought my bowl home. no one would eat out of it. >> another says, if you need to call the police to supervise you spanking your child, you don't have any business spanking that child. >> dawn writes, what is really sad about this story is that the parents are parenting -- that are parenting are afraid of doing their job. >> exactly. unbelievable that it's gotten to this. but the sheriffs must be saying, you got to be kidding me. out of all the things i got to do, i got to show up and watch the johnsons discipline their children. incredible. >> and the sheriff is saying that it's not something they do unless there is nothing else going on. what about just patrolling the streets? you want them out doing that -- >> we've been having a national discussion about corporal punishment after adrian peterson was using a switch and whipping his kid. >> because his dad did that to him. that's the way he was brought up. >> does that make it okay? how can you protect yourself and your loved ones? let's ask dr. lisa, who specializes in pediatric medicine. nice to see you. >> thank you. >> so three days she starts showing symptoms. how early should parents be taking their kids to the e.r. if they see something wrong? >> with children, they can have some of the bigger complications from the flu. younger than five years of age certainly the younger than two years of age that they could see complications. high fever. >> what's high? >> over 103. you can see with the flu. but the problem is with children, you can have that even with a common cold. so if you're not sure, my feeling is take them to the doctor and you can take them soon. especially for those who are less than two years of age and those who also have some chronic medical conditions. that could be asthma diabetes, any chronic lung heart neurologic problems. they'll be at higher risk for those complications. >> you know it can sometimes be difficult to diagnose what's going on. do you have find it difficult to diagnose these kids when they have the flu symptoms? are you able to differentiate from the flu and common cold? >> sometimes you walk in the room, you look and you can tell immediately that they have the flu. with others, it could be a little bit more complicated. there is a rapid test for flu. it's not perfect, but it might give you some sense. again, with those who have maybe more of a risk of complications, you would want to start antiviral medication perhaps with them. it's a case by case basis. for those with more complications, like with chronic illnesses, get that started soon, within the first 48 hours. >> cdc calling this epidemic. we saw that map. it's troubling. why is this happening. >> we see the flu every year between october and may and peaks in february. now we're seeing the beginning of this peak a little earlier. once it gets started it starts to take effect and now we're not having a perfect match for that flu vaccine. but it still has some protection against other strains of flu. >> let's talk about the vaccine. is the vaccine that we all were told to get this flu season not effective at all? >> no. we're still telling you to get it. the reason being is because there are other strains of the flu that are out there. it can protect against those. and it may also provide some weak defense against the strain that we're seeing now, this h 3 n 2. it could still give weak protection, but some protection and could shorten the duration of the symptoms, perhaps making for a more mild course. >> if this flu shot is not entirely preventive of this one causing these problems what are some other things we can do to try to stop the flu in our house? >> thanks. 23 minutes after the hour. as the city of new york continues to mourn the loss of nypd officers ramos and liu who were brutally executed, many are wondering what will happen to their families. our next guest says his organization is stepping up in a big way with a goal of raising $800,000 to pay off the mortgages of the families' homes. frank siller is the chairman of the steven filler tunnel to towers foundation. he lost his brother steven on 9-11. good morning and thanks for being with us. >> thank you. >> we just got an update. you're over $600,000. >> yes. last friday we made the announcement with former mayor rudy guiliani, which he donated $20,000. we have to pay these mortgages off because it's just one less thing for these families to worry about. >> yeah. and you're doing this in memory of your brother, who when he hears what's going on on 9-11, he grabs his gear, runs through the battery tunnel to the world trade center and perishes while he's involved in the rescue effort. tell us about him. >> he was an outrageous young man. a father of five. youngest of seven. but steven just went to work that day and ran into what ended up being giving his life. these two police officers going to work said good-bye to their families, sitting in a car and a senseless assassination took them away. those families will be changed forever. believe me, i know. after the services and everything settles down and everyone else gets back in their lives, these two families have to deal with this tragedy and this loss every single day. so i think it's so important that america comes together, that we make sure we tell them that we're behind them and that one thing that we could do is alleviate the pressure of them having to make their mortgage payments. we build houses for the most catastrophically injured service members around the country and we know what that's like to hand them a mortgage free house. they don't have to worry about making that payment ever. so we want to give that to these to families 'cause they deserve it. as rudy guiliani said they've earned it. we owe it to them. >> what are you hearing from the families? a baby just vanishing from her crib in the middle of of the night? >> her parents' pleas heard around the country. >> please, bring her home. our two other boys are waiting for her. please, just drop her off anywhere. we don't care. just somewhere safe where she can "homeland," please. >> questions emerge around her parents' possible involvement. however, over time, the case grew cold. now megyn kelly uncovered a new twist. she was there in the beginning and is there now. >> and joining us now live on the phone is megyn kelly. good morning. thanks for being with us. >> good morning. happy new year. >> so tell us about these new interviews that are surfacing. >> back when the investigation was underway, unbeknownst to the general public, the private investigator who had been hired by a private benefactor whose only interest was finding the little girl and this person basically contracted with a former c.i.a. agent. this is one of the top interrogators of the c.i.a. for a quarter century. this guy interrogated terrorists, double agents, you name it. they call him a human lie detector. she sent him to missouri to interview the parents. within days of little lisa's disappearance. and they interviewed them for hours, eight hours. two c.i.a. agents. and this went on and on and on to try to figure out whether these parents were telling the truth. it's all on camera. the kelly file has obtained the case exclusively. we've been through them tooth and nail. we've highlighted the most compelling parts and we have an interview with the main interrogator, phil houston where he walks you through his assessment of whether these parents really did something to their child or whether they are telling the truth, that this was an abduction in the middlity movement by a stranger and this child may still be alive. >> we have part of that interrogation. let's take a listen to just a clip of that right now. >> i think the first question that i need to ask you this morning, okay, is what involvement did you have in the disappearance of lisa? >> none. the only thing i did wrong was drink that night and possibly not be alert, not hear. i'm sorry. is it; in that answer, what did you hear? >> we didn't see those depptive indicators. she answered correctly. we're not giving her credit for answering it directly. what we're giving her credit for is not exhibiting the deceptive indicators. >> found it compelling that there are some photos of ha baby lisa might look like today. we'll put it up on the screen. remarkable. tell us what we're looking at. this is what police would be looking for today, right? >> the center for missing and exploited children does this. lisa would be four now. she would have turned four in october. and you'll see the whole thing tonight at 9 with bill houston where he walks you through whether he thinks each parent was a truth teller. we do the mother and the father. on each of the answers. and the thing i find fascinating about phil is not only will he tell you about these parents, but you'll learn a thing or two about how to tell if somebody is lying to you. not only did he talk about the body language that they will exhibit when concerned and full of anxiety about possibly lying to you, but the way in which he asks the questions -- if you hear that question, he sounds mild mannered. it's just a nice little opener. but he asks everything by design. and in a certain way to illicit a certain response. so you almost learn how to ask somebody something and how to monitor for truth telling. by the end, you will view this case in a way you never did before. and mark furman will come on and give you pause about it all. he finished the interview with an interview with the parent and tells us the status of their lives today almost three years after their little daughter disappeared in the middle of the night. >> you were there in the finishing. you watched the thing unfold. we heard about it going cold. and now you have these new revelations and new insight. what does your gut tell you? >> you know, when i was covering this case, i would speak with bill -- bill stanton is the private investigator who was brought in. he went out there with an open mind. actually he went out there thinking the parents did it because statistically the parents do it. it's very rare for a child to get kidnapped out of his or her bed in the middle of the night. it's usually the parents. 99% of the time. and he you wily became convinced that the parents did not do it. and i talked to him and he convinced me too. then i would talk to furman who devoted a lifetime and he convinces me the other way. so i honestly can say i don't know the answer. but i'll tell you this, i think there is a better than fighting chance that that child was taken out of her crib as she slept at 11 months old and there is some eyewitness testimony to support it, by more than one person in the neighborhood. and the cops zeroed in on this family, which is -- that's what they do. there is nothing wrong with the cops doing that because like i say, usually the way it is. but there is a question about whether some of the other main leads for the case has been investigated. if there is a chance this little girl is out there with somebody who has no right to her, who god forbid isn't looking out for her, then the country should be aware of that and we should put this little girl's face on the camera and people should be aware. just be aware, because it happens. just recently they found a child after ten years who the parents thought she was gone and they found her and she was returned. so it happens. that's all i'm saying. you'll see the full investigation tonight. >> your how long long investigation tonight airs at 9:00 o'clock eastern. we do thank you for coming on the program. have a good morning. >> take care. >> have a great 2015. she had a heck of a 2014. meanwhile, let's go over to ainsley for her final update. >> thank you so much. good morning. chilling new threats on twitter targeting police officers in st. louis, missouri. 35-year-old jason valentine is now under arrest for posting phrases like this: kill a pig night and pick a side or die with them. police say that many of the tweets mentioning ferguson where an unarmed teen-ager, michael brown, was shot and killed by a police officer. two weeks after the president announced the release of a u.s. spy serving jail time in cuba, the family of that spy says that they still have not heard from him. his family says they heard from him every day during his 20 years in prison. but they say there has not been any communication since the white house's big announcement. do you have a facebook page? >> sure. you remember the super bowl commercial that depicted the green police where swat teams were kicking down people's doors because they failed to compost? this is one more tiny step in that direction. the fine is only $1 per can if more than 10% of your trash becomes either recyclables or food waste. it's okay to put your food waste in a public trash can. so all of a sudden those will become very valuable in seattle. you can put that banana peel in the public trash can but if it's too much of your trash can, then you're in trouble. then you pay a giant fine of a dollar. >> people might be -- >> it might be worth a dollar. >> exactly. here is another one. more rooms for hens in the hen house out in california. they need to stretch their legs. >> it's okay for you as a human being to live in cramped conditions, but chickens and hens, they said this is a new law set up by california which is going to make a happier and healthier chicken. again, no word for people. this is expected to drive up the cost of eggs from 10 to 40%. you may say, i don't live in california. anybody who wants to sell eggs in california has to comply with this new law. it will affect chicken growers all across the country. >> back here in new york state right now, this is something that's a big problem internationally. but you can't throw your computers away in the trash anymore or old cell phones. you'll get in trouble for this. >> yeah. i scoffed at the total fine of one dollar. this one is $100 per item. so this is actually could add up quick and i understand obviously, anything with a circuit in it. they could be recycled and ought to. but i don't know if we necessarily need to have the state coming down and arresting you if you have the audacity to toss out an ipod that doesn't work. >> there are heavy metals in the devices which could be toxic. i think that's the problem here. a lot of people don't know where to go for these centers that are able to pick these things up. there is a lot of -- maybe they need to educate people about them first. jim, great to see you. happy new year to you. >> thanks for having me. next up, the harlem globetrotters are here and they're touring the country and honoring our military heros too. can they teach brian and anna a few new tricks?
